steinle murdered in san francisco by a criminal alien who had been deported five times. as you may know, we have called for new legislation called kate's law which would mandate any convicted aggravated felon who comes back to the u.s.a. after being deported, would receive at least five years in a federal penitentiary, no wiggle room. today on capitol hill, the senate judiciary committee held hearings on criminal alien violence. >> my son's name was joshua wilkerson on november 16th 2010 he was beaten, strangled, tortured, until he died. he was tied up, throne in a field and set on fire. his killer, morales was brought here illegally by his illegal parents when he was 10 years old so he fit the dream kid description. >> due to basic incompetence and disjointed laws, the u.s. has suffered a

self-inflicted wound in the murder of our daughter by the hand of a person that should have never been on the streets of this country. >> and that is the heart of this matter. harshly punishing illegal alien felons. return here after being deported. who could oppose that? well maybe dick durbin, senator from illinois. >> so, the suggestion that we make a mandatory minimum five year sentence for people who have been deported and come back across the border with, let's say with no other criminal -- no criminal history and no other history from the government's point of view, that seems to me to be an invitation for a lot of prosecutions. >> simply disgraceful durbin knows kate's law calls for the incarceration of felons, not chamber maids. he knows that. but attempts to distort kate's law by misdefining it. why? because durbin and others

like him do not care if convicted felons violate our immigration laws and kill people. that man does not care. but there was some outrage in the senate hearing today. >> there is a reason the american people are upset. if president obama had the courage of his convictions he would come and look in the eyes of these men and women who have lost their sons their daughters, their mothers, their sisters their brothers and the administration would stop releasing murderers and rapists. >> now there comes a time when the american people must demand congress and the president do the right thing. kate's law is the right thing. and that's the memo. now for the top story tonight, reaction, joining us from washington tonight kate's father judge and brother brad. what did you think of the hearing overall?

>> >> i liked what i you heard on some sides and some not. that's just the beginning of this particular legislation. we had meetings early before we met with the committee and on senators on both sides of the aisle. and i have a sneaking suspicion that there is something going to happen. there has to be some definitions between what's a felon and what -- you know, what you need to do to get to be a felon. >> and we had senator grassley, the chair on yesterday, and he said aggravated felon. i think that's the way to go here. but did you hear anyone say anything to you among the senators that upset you mr. steinle? >> not in this particular session, no. i didn't hear anything that upset me. >> you heard dick durbin basically misdefine kate's law. he did it on purpose. he knows what it is.

he did it to object secure the real issue hoping that, you know, kate's law will not be passed. that bothers me. and as the father of kate herself, i think it -- i would like to get your opinion on mr. durbin. >> well, you will have to excuse me, bill, we left the chamber after we had testified. >> oh, okay. did you didn't hear him. >> did i not hear him. >> well, you heard him here. brad i will throw it over to you, there is an element in this country who is not sympathetic to the murder of your sister. i mean, they say they are but they won't take any steps to prevent another kate from being murdered. how do you see those people? >> well, the clip i just saw from the senator that spoke i think it's very plain and clear to see that a kate's law that deals with felons that have committed crimes,

anything from rape to murder committed any type of assault if they are felons we should definitely make sure that they are either detained or sent out of the country so nothing like this happens again. there is no question about it, it's black and white. there is no reason these people should be on the street. >> that's right. and then the man who killed your sister was a drug dealer. he sold hard drugs. and that is under the banner of aggravated felon as well. and should be because these drug gangs are causing havoc all over the country. mr. steinle, i can't imagine how painful this whole thing is, you know. i know there are families who don't want to go through this. you have taken upon yourself and kate's mother as well, you can tell us, you know, emotionally, how this has

affected you? >> well, it's indescribable. there is no words. i felt sorry for the many people that have come up to me and you would see them struggle for a word to say. there just are no words until you have experienced it. but our faith has kept us strong and we believe we have a kate on our shoulder. and we think other things are in play here. we haven't gotten our arms around them yet. i think this is just the beginning and not the end. >> so do i i agree. >> if we can get this kate's law passed and i testified to that today if we save one son, one daughter, one mother one father, one sister one brother then kate's death is not all in vain. >> yes and i agree. that's what we are all working toward. we're going to come down very hard on people who don't get on the right side of this issue. because, again, there is no excuse. we are aggravated felons who are deported and come back.

inspired terrorist. our job john, you and me and fox news, to get the truth. what's the latest tonight? >> well, it could be that it's really a little bit of both or it's all of the above, bill, us what what we have learned in the last few days about mohammed abdulazeez that he does indeed appeared to have suffered from depression, bipolar disorder. despondent and thought his life was rapidly spiraling downward might end up in jail at the end of this month because of a dui charge going back to april the 20th. at the same time, some of the new developments today intelligent sources tell me in recent weeks he has done some internet searches on the topic of martyrdom. he had also watched at least one video from anwar al-awlaki. the radical american born muslim cleric who was advocating attacks on americans, including the military before he was taken out by a drone back in 2011. and in some of his writings, described as rambling during depressive states. he also at least once

mentioned anwar al-awlaki. bill just as a side bar we are learning about at the reserve center which is where those four marines killed and petty officer second class randal smith was mortally wounded the fbi has found a gun which did not belong to police or the shooter. they believe that may have been one of the personal weapons of one of the service members inside who took it out and started shooting back during the fire fight with abdulazeez. this raises a dilemma because you are not supposed to have a weapon on military property but then, at the same time, bill, that seemed to be the only effective form of defense that they had inside from the reserve center. >> that's going to change and changed in some states already. what about this guy's overseas travel? he spent some time in jordan. he was in qatar. he got around over there. what do we know about that? >> he did get around. first of all to your point about being taken care of. certainly it's being taken care of on the state level. governors have the authority to tell the adjunct generals of the national guard that their troops can carry

weapons, but the u.s. military the federal military a different story. okay, now to your question he about his travels. we should point out that we also learned today that his uncle of his u.s.a. citizen has been in custody in jordan since the day after these attacks. is he being questioned by jordanian authorities as well as the fbi which has an fbi office attached to the u.s. embassy in imman. clearly the fact that the guy has not been allowed to go home is an indication that jordanian authorities appear to be fully cooperating with the u.s. authorities. they are questioning him about what abdulazeez was doing when he was there in jordan for seven months during 2014 ostensibly sent there by the family to live with the grandfather because he was coming to bad influences here in the united states by hanging around with his quote non-muslim friends. >> we ought to point out that his father, abdulazeez's father was on a terror watch list. he was taken off that but this whole family has a history of being connected to the jihad in one form or

another. now, the guns. >> or at least suspect ised of being. >> all right. the guns. "wall street journal" reporting that arms list.com may have been the source of the shooter's guns. what do we know about that? >> it's sort of an exchange place, if you will, almost like a craig's list for weapons. initially the fbi thought that some of the guns might have been bought illegally bill, they appear to be walking that back, though they haven't done it publicly and may tomorrow at a press conference it appears at the moment that all of those guns may have been purchased legally. we certainly know from talking with friends of abdulazeez that he shot quite often at the public range not far from downtown chattanooga. >> so tomorrow the fbi is going to have a press conference about what they know about this guy and the guns and the arms list and all of this. we will, of course, cover that john, thanks very much. we appreciate it directly ahead. planned parenthood may be in big trouble. allegations they are selling body parts of aborted babies. then later the white house fox news channelly lowers the american flag to mourn the five murdered servicemen

planned parenthood saying it's donations. that's how they are trying to spin it it's more than spin. there is a federal law against selling body parts. >> right. >> okay. so how much trouble do you think they are in? >> well now we have the second -- a second top planned parenthood executive caught on tape cavalierly discussing the sale of fetal body parts and tissue. i would think that where there is smoke bill, there is fire. this has been a bad outfit since its inception and now you have seven state governments as well as three congressional committees investigating into whether or not weather they are, in fact, in violation of federal law. >> what do you say kirsten? >> well, i think these are very alarming videos, but i also think that calling it a sale is probably overstating what's going on. but i think what they are doing is still improper. certainly unethical certainly immoral. and they are haggling over how much they are going to -- they would say get reimbursed for this.

>> all right so let me stop you there. you just used the word reimbursed but you say it's not a sale. >> well, right. so what planned parenthood would say is that we, you know, we are basically, you know, it costs us a certain amount of money to do this, so we are looking to get reimbursed for that. >> then they should have a set menu, should they not? >> exactly that's what i would say. you wouldn't be haggling. >> they don't want to low ball so you don't do that if you have -- look, if they are actually making a legal donation then they say this is what it costs us to make that donation and here's the reimbursement we must get. they don't sit in a restaurant going ho ho ho you make the first offer. i think we all know, we all know people with eyes and ears who could think clearly that planned parenthood and this is the second time as ms. monica pointed out they have done, this are selling the body parts of babies, which is against the

federal, the national organ transplantation act of 1984, and, if convicted these women, and i would assume the president of planned parenthood could get 10 years in prison. so under the obama administration, i don't think they are going to it prosecute planned parenthood right? >> there are a couple things that the republicans in congress can do right now. they can move to defund planned parenthood. as you point out they get a lot of taxpayer money. they can also in the senate pass the unborn child protection act which has been hanging out there since the kermit gosnell scandal first broke. there are things they can do legislatively to put the screws to planned parenthood. what you saw there was dr. gatter get the highest price for a kidney because i need a lamb bore guinea lamborghini. >> while we feel it is

immoral and off the charts sinful to body parts from aborted baby. the baby has to be developed enough to have body parts to do. this other people don't see these fetuses babies, as human beings? >> you don't have to be pro-life to realize that this is the evil. this a anihilism of the left of the whole and abortion industry in particular, bill, what you are seeing here is that the democratic party platform is any abortion at any time for any reason. this is the logical extension of that. >> pretty gruesome situation. >> how can we become so ignored termination of life is okay? >> i would say that actually most people do see this as a life. if you look at the most recent marist poll. most americans believe after the first trimester they don't think there should be abortions. they do see these as lives. any person who has a baby who is 10 to 20 weeks, which
