i'm julie banderas in for shepard smith. the shooting in the last movie theater attack was once a political activist who lashed out at taxes and porn, according to a jung who knew the killer. we'll talk to him live in just a moment. first, new details boat gunman's hoyt. years ago he was accused of plotting to burn down the office of an attorney representing theaters that showed pornographic films. according to newspaper in columbus georgia, other warning signes stretch bam the shooter's ex-wife told the court her then-husband was so unstage she took away his guns. police sale he opened fire in a movie theater in lafayette louisiana two people killed, nine wounded before the gunman killed himself. witnesses described a scene of chaos. they say they were 20 minutes

into the comedy film "train wreck" when they heard the first pops. as soon as they realized they were under fire, survivors say they hit the floor, one victim jump speed in the line of fire to take a bullet for her friend. another person managed to pull a fire alarm to alert everybody else and that is when survivors took off running. >> running out telling everybody to run for their life, and-just seem like a little practice and then i see a bigger group coming out screaming the same thing mitchell reaction was -- then we saw a lady with president on her way. >> the gunman was headed to his car but the police were there and he went back into the theaters' shot himself dead. according to investigators the gunman what a drifter living in a nearby motel. cops found all sorts of wigs and disguises inside his motel room, but so far nothing at all to

indicate why he would go to a theater to take out innocent lives. will carr is live in lafayette louisiana. what more do we more about the victims at this hour? >> reporter: well, authorities are continuing to try to furring out what brought houser here in the first place. we are learning more about the victims, including 343-year-old jillian johnson. she says her best friend was her husband. she was a local musician. she owned a local retail shop. and according to her web site, she was the best with to an -- obsessed with tina turner and john steinbeck. she died at the hospital. her family released a statement saying they're hearts are shattered. police say that houser shot and killed 21-year-old mayci breaux, she was trying to take in a funny movie. the star of the movie amy schumer, tweeting, my heart is broken all my thoughts and prayers are with everyone in louisiana. that was he can code bibi governor bobby jindal. nine others were injured. three are in stable condition.

one remains in critical, and authorities say they're going to continue to go deliberately slow and methodically, going inch by inch on the inside of the theater with their investigation. they sals say the gun here is hard to trace. >> will karr, thank you very much. job bobby peters says he knew the suspect. the judge is also the form are mayor of columbus, georgia, and joins us now on the phone. thank you so much for talking to us. you were the former mayor of columbus georgia, and you say you actually noticed this guy in the past and you knew him for a long time. maybe you can tell us a little more about him. >> well, he is part of this community for many years and he come from a political family. his dad was an elected official here in columbus as a tax commissioner, very beloved man electioned many times. mr. houser -- knew him as rusty

houser in columbus. he ran for office himself. he did come to council meetings all the time, he did question government. didn't seem to trust government, and i think he wanted to project the image he was kind of the watchdog of government locally here and questioned many things about government. unfortunate situation, but he was never rude, never made any threats, simply came and talk about issues at public forums and on the radio and seemed to be want to be involved with the government part of the government, at the same time constantly questioning the government. >> i want to ask you if you could please stand by because we want to go to a news conference right now cared from phoenix city -- alabama sheriff. >> were was returned to him through the phoenix city police department. from that point we didn't have any involvement other than some complaints where he was actually

the complainant. up until 2014, and in 2014, our office served an unlawful detainer on him on an eviction process. at that point that was at the address of 1101 32nd street, and at that point he left the residence that he went back and actually did some damage, some vandalism to that address and a report was made by the owner at that time about the damage. there was no warrant signed again by the victim, and so he was not arrested in that charge. he was just listed also the offender. at that point we don't show any address that he lived here from that point on. everything from, from what we see, is when he started kind of moving around and staying from

one place to another. that is really all the involvement that our office has with mr. houser. there are some other involvement in columbus, there's some other things that he did in columbus. i understand that he was active politically over there in the columbus area. i understand that he actually ran for public office a time or two in columbus. up in of that occurred -- none of that occurred here in phoenix city. i'll open it up for questions. understand please, that this is an early investigation and there's some information that may or may not be able to be released. >> domestic violent arrest in 2005 -- [inaudible] >> it wasn't an arrest. let's make sure we're clear. only a report made with the

police department. he was never arrested for that domestic violence. so make sure we understand it was a report, and the report detailed what occurred, but he was never arrested. >> why wasn't there a prosecution? -- [inaudible] >> we're looking at it. the laws today are certainly different than what they were in '05, and it looks like in '05 there was never any followup by the victim to sign a warrant. >> sheriff -- [inaudible] >> we did not. the columbus police -- phoenix city police department did. [inaudible] >> yes sir. >> what was the damage in 2014 to the property? >> there was several damages. he -- according to the report, there was concrete poured down the plumbing pipes.

there was a lot of damage to the gas pipes coming into the home. so there was a significant amount of damage. to the home. >> do you know of any history of mental illness? >> i can tell you that we believe that he was being seen in '08 and '09 for mental illness here, and we have no idea about that mental illness record. the medical record, as you know, are sealed and we don't know what he was being treated for. >> so than didn't play any roll in denying -- >> no. the denial of his concealed permit was simply the domestic violence report from '05 bat year prior to him applying for the permit, and the arson arrest that he had in early '90.

>> you said he lived off and on at that address -- living here -- [inaudible] -- own that home? >> the best we can tell the home was bought by the housers probably around, i'm thinking, 2011. it still is in their name it was foreclosed on, and the oregon who bought it at a foreclosure who is had him evicted. then at the point he got evicted he went back and did the damage. >> any booby traps? that's how they classified it. >> certainly i think the gas issue was what they were talking about with the bob booby -- booby traps. that was dangerous. case was dismissed at grand jury. any other questions? >> does that mean it was leaking out there was actually gas in the house? >> you know, my understanding is that he had done something to the gas line coming into the fireplace. there was a gas fireplace and he had tampered with that, so that it -- if you were to turn it on, it would have been blowing gas fire out. so it was certainly maybe being considered a booby trap like you said. any other questions? >> yes. people are wondering why was the -- [inaudible question] -- individual was not either in jail or in-getting help. can you explain how he continued to get out? >> well, when you say an extensive rap sheet he has

never been arrested in phoenix city alabama. or russell county. the things he got arrested for are -- were in columbus, and that case was dismissed. i just think that often times victims, for whatever reason, don't want to follow through with prosecution. if it's misdemeanorses, there are certain restrictions on police making that case. certainly whoever investigated it didn't find it enough to do -- follow through with a warrant. i can't speak to that as far as that goes, and the mental health side there's cuts being made all over about mental health, and that's what is so scary for us in law enforcement and should be scary for the community, is the states and the

cuts that are being made as far as mental health around the state, is allowing a lot of these people that should not be walking around, to be out in the community, and that is a scary scenario that we're dealing with every day and it's a financial decision that people way above my grade are making to close mental health facilities. >> were there any warrants for his arrest out as of yesterday? were there any warrants? >> to my knowledge, no sir. i'm not aware of any outstanding warrant for him period. >> never been in your jail. right? >> never been in the russell county jail at all. >> any idea why in lafayette? >> i don't. i'm sure that that is something that may come out later in the investigation with those -- with the pd there but we have no

idea at this point. >> has your department -- [inaudible] -- family wife, daughter? >> we have not. i understand that there have been reached -- they have been reached out to and have been spoke to, but not by us. >> are they still in this area? >> i don't think so. >> really, sheriff as far as russell county, he was not on your radar as somebody who was a. violent or, b., mentally ill. >> no, sir. he actually did most of his activism for nontaxes and things like that, in columbus. and he was born -- i say born -- he was raised in columbus. his family is from columbus. he did however live over here and did apply for a pistol permit here and was denied, but his main time that he spent in this area was really in

columbus georgia. >> did he have a carry permit? >> not to my knowledge. any other questions? >> who filed the domestic violence -- >> his wife. >> anything that in his report that would have prohibited him from buying a gun legally beyond the mental health issue? >> at this point i didn't see anything in his record that really would have stop him -- well i shouldn't say that. i do see that in '8 and '9 oeh was treat for mental illness. that should have stopped him from buying a weapon. >> why was he denied the pistol permit? >> because of his arrest for arson and report of domestic violence against him from '05. anything else?

all right. >> thank you sir. >> thank you y'all so much. >> sheriff -- >> it is he hottest day ever and you got me in this zoot suit up here. >> you just heard sheriff taylor of the phoenix city, alabama police department. speaking of the mental health issues of john russel houser. those issues he suffered from in the past, in fact was treat for. he is said that a report of domestic violence was actually reported to the police department in 2005, but in fact houser was never arrested so he has no arrest records no other sort of red flags and there was never a prosecution or any pending arrests. so the question now is what drove him what was the motive? we were just speaking with judge bobby peters. want to bring him back. the former mayor of columbus, georgia, where houser resided and he often went to your city council meetings. as mayor. he was very vocal. you say that he came across as an intelligent well-spoken man who like to basically cross-fire

with elected officials. did he seem unstable? really. he usually had his facts. he would come to council on different issues and then really not a confrontation per se, but he would dig in, but i met with him individually at times in the mayor's office and he was more calmer, he wasn't in a public meeting. all the council meetings were televised and he wanted to be an elected official help ran for office. i don't know if he was really that antigovernment or just wanted to use that as a forum to run for office, but totally different situation in the '80s and '90s with him and what you're hearing today. >> it's interesting because you knew him personally, and he is being called a drifter. living in a nearby mow temp was married, divorced, has kids. did he seem like a family man to you? did he seem like a drifter as some are referring to him as? >> not back then. after that, after 2007, '03 '4,

i think he had some personal problems person issues and turmoil in his personal life but was a very public person. i think he wanted to be considered the watchdog of the government and he didn't trust the government, at least that's the image he projected here locally in the '079s and early 2000. >> he found his link in page. we were able to get this screen grab off of one of our booker's commuters. it describes him -- he comes across as a businessman who set his sites on several projects as an entrepreneur. he had a business sense about him. but he was a conservative and he felt very strongly about theaters specifically pornographic theaters. what did he try to get across to elected officials? what was he so angry about back then? >> well, some of his concerns is whiff the school district. his wife was a school teacher so

he had a lot of concerns with the operations of the school system itself, and he would also couple to council, which is separate body of elects officials and talk about the budget or anything that is dealing with -- could be garbage trucks, public safety, whatever the issue was. it's more rubber on the road here locally. >> did i gist hear you say -- did you say he was a school teacher. >> no, ma'am. his main concern was what i have can he school district because his wife was a teacher. >> old were his kids. >> i don't have any idea. >> so at this point there was no thought in your mind that his being vocal and argumentative with some elected officials would ever raise any red flags to in fact contact authorities. no divorces involved with him. >> that's right. no -- everything was cordial. he method his case. he did dig in. he would not listen to a lot

of -- sometimes let the facts get in his way. would dig into this position but never -- he wanted to be an elected official himself and he did run for office, and he didn't complete that, but all the turmoil you hear about was much later on, in columbus, he wanted to be a night club opener. had different ideas. wanted to be part of the community, and evidently there were things going on personal live that stop that. >> judge bobby peters, thank you. >> very asked case. thank you. >> extremely. hillary clinton's private e-mail account did contain classified information, according to the feds and now the case is in the hands of the justice department. we have details and the response from secretary clinton straight ahead.

classified at the time. but she says investigators don't know whether secretary clinton herself sent or received them. a state department spokesman says this, he does not agree all the e-mails were classified at the time. is your head spinning yet? ed henry is traveling with the clinton campaign in manhattan. ed, it's hard get to all the pieces here. clinton is pushing back against all of this. >> reporter: that's right. let me take a stab at it. beyond the four that the intelligence community's inspector general determined, four femas they believe had classified information in hillary clinton's private server, her personal e-mail account, is that inspector general and a second one an independent umpire at the state department, is alleging that there may be hundreds of e-mails with classified information in hillary clinton's private server. she tried to push back on all of that also while ago. she was trying to focus on the economy, but had to deal with this. listen.

>> we all have a responsibility to get this right. i have released 55,000 pages of e-mails. i have said repeatedly i will answer questions before the house committee. we are all accountable to the american people to get the facts right. >> reporter: but you noticed she never in that statement directly addressed whether or not there's classified information in that private server of hers. remember at her original news conference at the united nations in new york in march she vehemently defined any classified information in, now you have two independent umpires saying there is. >> what are we hearing from republicans? >> reporter: speaker john boehner, trey gowdy he republican chairman of the select committee on benghazi are saying this is very troubling and what they want is a look at that private server. trey gowdy putting out a

statement saying, quote the only way to resolve these important factual questions is for her to turn over her server to the property authorities for independent forensic evaluation. that from republican trey gowdy. the clinton camp has obviously shown no signs of giving in on that and they're fighting back because they say accurately that the original "new york times" report last night said that these independent umpires revved it to the justice department for a criminal investigation. now the "times" has aisled that back saying they revved it to the justice department but did not make a determine whether it is criminal. bottom line, outside of the legal issue politicallying this are new problems for human being human being and new questions. >> what will it do to her campaign? ed henry, thank you very much. >> let's bring in chris wallace now, and chris i mean, you just heard -- we're talking about this internal government review found that former secretary of state hillary clinton did send at least four e-mails from her personal account containing

classified information. she says she never did such. what too we make of this? >> well, it certainly at least raises questions as to whether she misstated the facts when she held that famous u.n. news conference back last march. look, hillary clinton has hit a rut in the polls. we saw a quinnipiac poll that showed she is now trailing three republican candidates, walker, rubio, and bush, in three key swing states. her favorability numbers are down, he honesty and trustworthy -- how do they feel whether she is honest and trust worthy those deklained. this only adds to that. i want to emphasize, these are not administration appointees. these are inspectors general. they independent umpires the people outside the system who are supposed to operate notly outside the bureaucracy and act

as an honest broker, and you have the eninspectors general for the state department and intelligence community both raisings questions. they were troubled about the presence of classified information on hillary clinton's private e-mail and whether it's a criminal investigation or a civil investigation, they have referred it to the justice department, which says that it has received that referral. it just raises the question, which i guess we have had since last march why on earth did hillary clinton have a private e-mail server in the first place? why went she on the government web site like every other government official. >> on thursday the it was concluded her emems contain information that should have been considered secret. as former secretary of state you have to know what is confidential and what is not and to use classified information and send it or receive it through a personal e-mail it could potentially turn into a criminal

investigation, it could not? if it does, in a criminal vegas is launched into a presidential candidate, that is not good. >> no. words like classified information, private e-mails criminal investigation any kind of investigation justice department, those are awful bad words if you're a presidential candidate. we have to wait and see. one of the questions that we're trying to sort out here is, was that classified information at the time or was it a decision made -- it wasn't classified at the time but the decision has been made afterwards it should have been classified. that may be a technicality that helps her in terms of an investigation but raises the question. this is sensitive information that either chev was or should have been classifieds at the time and that hillary clinton was either sending or receiving again, all of it raising the question why all of this wasn't being done on government servers, government web sites and in which case up in of this would ever have happened. so to

it launched last night from cape canaveral in florida. west of there man says workers were trying to dig a well in his backyard when he ground opened up and swallowed their truck. officials there say the sinkhole is some 30 feet deep. fortunately they say nobody got hurt. take a look at this. cars and trucks stopping and swerving on the interstate so a group of ducks could cross the road. happened this week outside minneapolis. was as close call about none of the cars crashed and the ducks made it across. the emergency state patrol is telling folks don't risk a crash by stopping for animals.

of different opinions out there. let's bring in tony, a republican strategyis and texas news contributor here in studio with he. first of all quite a difference. we haven't seen a gap like this in two years why the drop in favorablity? >> you have republicans on dropping from their own party from 88 to 68. the republican party is musk more vulcanized. our fangs moore prisoned. they stick to their guns and have been dissatisfied with washington and president obama they've been dissatisfied with their own leadership, not standing up in their opinion to president obama we had a large mid-term election victory and many republicans feel that's not bore a lot of fruit. the implication is this. we talked about donald trump getting the nontraditional support. look wholes is in the top five, dr. ben carson, an outsider, carly fiorina. there are republicans who really desperately want change, not only in terms of the white house

and at the democratic leadership but their open parties. >> let's talking about the favorite including jeb bush jeb, scott walker, and senator marco rubio bush fares the best in virginia but looking at colorado and iowa voters they appear to be more skeptical of him. in fact he just actually raised $500,000 in christie include's becomeyard but the skepticism remains. >> people don't believe he is a bona fide conservative and you have the whole idea that the run party establishment does not know how to win elects. that's where you'll see the support in the more middle american states. jeb bush has a lot of support on the eastern seaboard you. brought up chris chris christie's backyard. his backyard is the new york, new jersey, metropolitan area, where you have a lot of the establishment donor base which

is putting their money behind jeb bush, but everybody in the field, talk about marco rubio her is third no one is going to lack resources. >> what do you think bush, whacker, rudeow, or is donald trump going to give. the a run for his money? he did surge in polls after coming out so strong against immigration. when you talk about conservative republican they'd want someone who is going to stand ground on immigration. >> there's no doubt that jeb bush has the top hoff the field and everyone who is going to get close to him will be the anti-jeb bush, think scott walker and marco rubio are closest. rubio has the second highest favorability across every -- among republican primary oddens. donald trump has inspired the imagination. that's why you see his poll numbers doing as well as they have. but there's a lot of people just don't want another politician and that where you get the trump and ben carson support. >> what about john kashich? did he announce to late. >> to laid to get into the

turkey in the battle against the terrorist army. that air base is in southern turkey. not far from the syrian border, and that is where we have seen heavy fighting against the militants in up toes like kobani. a senior u.s. difference official saying the pentagon has used the base for drone mission before and other operations to support the battle against isis. this all comes as turkey beefs up security along the syria border a firefight killed five isis militants and one turkish soldier. hours later turkish officials say they launched airstrikes against three isis targets in syria. lea gabrielle has more. you spoke with an american pilot involved in the air war against isis. >> i spoke with a b-1 bomber wing commander who flew coalition airstrikes against isis in the battle for kobani. co ban enough is the town just across the border from turkey

and syria that isis took 0 control of. turkey kid not get involved in the fight and coalition strikes supported kurdish fors who won kobani back. we have seen isis take large amounts of territory in iraq and syria, i asked the wing commander how he responds when people say we are losing against isis. here's what he said. >> i would take issue with this. i think what we're really trying to do is keep the adversary from gaining they're objective and i think we're doing that. there's not an islamic state that exists in any kind of legitimate way in iraq and syria regardless of the tactical victories. >> is that true? we have seen the islamic state take over towns seen them implement their law. >> it's been on a very small scale, and so far has been temporary, as we have been able to drive them out of areas once they have been stabbed. >> he also toll me the air campaign is working exactly as it's supposed to be and that

doesn't mean going in and crush ago i sis from the air. >> i think that it is going to be a long fight. this is something that is going to take -- i think this is a campaign that we measure in years, and so i think it's going well. i think that the true measure of how we're doing is what it would look like if we hadn't engaged. i think in that case we would see the islamic state controlling much larger amounts of territory in iraq and syria and gaining in their legitimacy as an actual state. >> in fact he told me that that military is one part of a much bigger strategy, and he said that the best the military can do is to buy time while we wait for political solutions to emerge there. >> that is sad and that is scary because it puts or troops in harm's way to buy time. let me talk about defense secretary ash carter. he was in iraq today. >> that's part of that developing polite come solutions that the defense department has been saying, the solution is

political. sargeant carter flew to iraq from jordan and met with the leaders of the -- the kurdish leaders and visited with u.s. coalition troops. the u.s. military has been working closely with peshmerga forces. and he praised them, calling them the quote model of what we are trying to achieve. now he was referring to the strategy of enabling capable local forces to take the lead on the ground. he said that success from u.s. forces alone would not lead to a permanent solution. that ultimately it has to be a solution from people who live in that region. >> all right, thank you very much. air force one has just landed in kenya in its first of its kind trip by saying -- a sitting u.s. president and they have ramped up security in a big way. at ally bank no branches equals great rates. it's a fact. kind of like shopping hungry equals overshopping.

president obama arrived in kenya's capital city this afternoon, making him the very first sitting u.s. president to visit the african nation. officials in kenya beefed up the court. the terror group al-shabaab has haunched a series of recent attacks. investigators say they have links to al qaeda. in april militants stormed a christian university, killing nearly 150 people, most of them students. the group also claimed responsibility for the deadly attack on the westgate mall in my robe bee two years ago. >> president obama met with some of his relatives during the trip. among them his stepgood morning sarah obama who the president called grannie in his memoir. kevin cork is live from nairobi. how is the trip going? >> reporter: so far so good, and you're right the president

obviously brings not just a presidential responsibility but a little personal aside as well. his father was born here help has relatives here, and his presence here, the first for a sitting u.s. president is enormous news, not just for the country of kenya but for the entire region. he lanked not terribly long ago. it's nightfall here and when he got here we could hear people cheering on the streets here in nairobi. the president also having an opportunity to meet with family members. again, just a very brief but very important one as he won't be able to go to the home town of his father. i should also point out that as you mentioned -- i think it's important -- this is a major opportunity to talk about security in the region. let's be honest about the fact that relations between the u.s. and kenya have been strained for a little bit of time now because there is a feeling at least among some in the united states, that the kenyan government has been heavy handed with political opposition. that said, it's important to have a strategic cooperation as
