everywhere she goes. >> bret baier, you must love it. new e-mail problems for hillary clinton. this time it could involve criminal investigations. and ear more political peril. a new statement from inspectors general this afternoon. this is "special report." >> good evening. welcome to washington. i'm bret baier. among the many ongoing scandals and near scandals surrounding hillary clinton's bid for the presidency her use of private e-mail accounts may now be the most potentially damaging. independent inspectors from different agencies are asking the justice department to determine if the former secretary of state illegally transmitted classified

information through her personal server. chief white house correspondent ed henry has tonight's top story from new york. >> maybe the heat is getting to everybody. >> reporter: as hillary clinton delivered what her aides build as a major economic speech she scrambled to not let it be overshadowed by a new firestorm about classified information on her private e-mail server. >> i have released 55,000 pages of e-mails. i have said repeatedly that i will answer questions before the house committee. we are all accountable to the american people to get the facts right. and i will do my part. >> reporter: she did not do her part to directly answer whether she sent classified information while serving as secretary of state. as the inspector general for the intelligence community revealed to congress there are at least four e-mails with classified information on that server despite this sharp denial in

march. >> there is no classified material. >> reporter: sources familiar with the investigation told fox that first inspector general plus a second one at the state department have determined clinton's private account contains hundreds of potentially classified e-mails, either sent or received by clinton. a state department memo obtained by fox revealing the matter is so serious, the inspector general has asked as more clinton e-mails are released to the public they should first be reviewed quote in a top secret classification environment. republicans pounced. speaker john boehner declaring quote her poor judgment has undermined our national security and it is time for her to finally do the right thing. the right thing according to boehner and trey gowdy of the house select committee on benghazi is for clinton to turn the e-mail server over to an independent arbiter. clinton refused. her aides jumped on the fact that the "new york times" reported that the inspector generals referred it to the attorney general for a criminal investigation. they dialled it back saying the

referral involved possible classified information. clinton's aides saying saying there is a criminal inquiry into hillary clinton's use of e-mail is fault. secretary of state john kerry told nbc he knows nothing about the details. >> inspectors general operate completely independently. that's why they were put there. >> ed henry reporting from new york saying kerry made an important point. the inspector general operates independent of the administration and the congress so they're not republican critics of clinton, they're nonpartisan umpires. that is an important point, ed. >> reporter: it is. it's going to be harder for the clinton cam make to attack. these are not republican partisan critics. nonpartisan umpires. the other point you mentioned at the top this new statement from the intelligence community inspector general. late this afternoon. what it said is they found the point i made about four e-mails that had classified information. they say they found that out of a limited sample of only 40 clinton e-mails.

she turned over more than 30,000 to the state department. if they found four out of 40 there could be a whole lot more bret. >> much more on this with the panel. ed thank you. republican presidential candidates were predictably outraged at the latest e-mail news. but they were able to set aside their anger long enough to talk about the situation as you can imagine. senior political correspondent mike emanuel has that part of the story tonight. >> reporter: republican candidates were quick to pounce on hillary clinton's latest negative headlines about her e-mail as secretary of state. >> well the inspector general referrals are stunning. and they demand immediate action. it also underscores the department of justice should have investigated this months ago when it broke. >> reporter: cruz says he hopes the credibility of the internal watchdogs will force the justice department to act. >> on its face it appeared that secretary clinton violated federal law. and yet by all appearances this department of justice is such a partisan arm of the dnc that no

investigation was opened. >> reporter: meanwhile, democratic sources say clinton campaign chairman john podesta has been telling allies privately that ohio governor john kasich is the candidate clinton team fierce most in a general election matchup. >> they obviously are concerned about the record. when you balance a federal budget reform the pentagon support strong defense, what i did and my team did when i became governor of ohio i think it's a formidable record. it's not just talk. it's actually results. >> reporter: while there's been plenty of jockeying for position among the 16 republican candidates carly fiorina has kept her focus on clinton. >> go ahead and admit it. you would just love to see me debate hillary clinton. >> reporter: and fiorina says she's the one to hold clinton accountable about her record. >> this has got to be a fight. and we'd better bring everything we have for that fight. we can't count on the media to ask her the tough questions about why she lied about benghazi why she's covering up for benghazi. >> reporter: some good news for

the campaign. former texas governor rick perry, one of two felony indictments against perry was tossed out by a texas appeals court. perry's legal team has argued his veto of $7.5 million for the travis county d.a.'s office was explicitly part of his power as governor. at this point, perry will still have to face an abuse of power charge. bret? >> mike there was this very unusual kind of outburst on the senate floor. a lot of anger back and forth. tell us about that. >> >> reporter: that's right. senator ted cruz accused fellow republican majority leader mitch mcconnell of lying, claiming mcconnell had told cruise there had been no deal to vote on the operation of the export import bank. mcconnell set up a procedural vote today to reauthorize the import export bank which had its charter end at the end of june. then they blasted the majority leader. >> i cannot believe he would tell a flat out lie. and i voted based on those assurances that he made to each and every one of us. what we just saw today was an

hello, will. >> reporter: good evening, bret what was supposed to be a fun thursday night quickly turned hour riff nick a matter of seconds as an innocent group was gunned down in the theater behind me as they were watching a movie. authorities say this man, john russell houser bought a ticket to the new comedy "train wreck" at the grand theater 16 in lafayette, sat through the previews then about 20 minutes into the movie stood up pulled out a semiautomatic handgun and shot two people sitting in front of him. he then fired randomly the a the audience reloading at least once. >> how does the happiest place in the world produce somebody so full of hate and evil to just stand up in a movie theater and start shooting people? what provokes somebody to do that? >> reporter: witnesses say at first they thought the shots were part of the movie. >> then we saw a lady with blood all over her leg. i just grabbed my child and i mean we just all ran. >> reporter: police say houser ultimately shot and killed 33-year-old jillian johnson, a local business owner. her family said their hearts are shattered.

21-year-old maciboro from franklin louisiana also died at the scene. nine others were wounded. one remains in critical condition. authorities believe houser tried to blend in with the crowd rushing out of the theater but saw police officers and went back inside. >> we know he had at least one additional magazine which he dropped in the lobby. he reinserted reloaded and returned back into the theater, at which point we think he fired one additional round, and that was into himself. >> reporter: local and federal investigators are now digging into houser's past. they say the 59-year-old was a drifter, important in phoenix city alabama living in a motel 6 in lafayette for the past month. inside his room investigators found wigs and glasses, items they believe were meant for disguises after the shooting. they're also investigating his blogging habits. fox news has discovered documents that show houser's wife finaledled for a protective order in 2008 alleging acts of family violence which involved

his wife removing all guns from their house. >> i do see that in '8 and '9 he was treated for mental i8 illness. so that should have stopped him from buying a weapon. >> reporter: within the past couple of minutes, governor bobby jindal just took a tour of the crime scene. at the same time authorities are taking the time to honor two teachers both of whom were shot one who still managed to pull the alarm. authorities are saying that absolutely saved lives. bret. >> will in lafayette louisiana. thank you. up next president obama in his ancestral homeland of kenya. first fox affiliates around the country. fox 2 in detroit with fiat chrysler's recall about 1.5 million cars and trucks in the u.s. after two hackers took control of a jeep cherokee suv over the internet. the company says it's discovered the vulnerability and is updating software to fix it. fox 32 in chicago where a cook county judge has ruled that a law reducing multibillion dollar

reports from nairobi tonight. >> reporter: swahili for welcome, president obama made history, becoming the first sitting american president to visit kenya. and while it was not his first trip to the homeland of his father it was a first as the leader of the free world. but certainly not free of responsibility. the trip comes as a specter of terrorism continues to spread throughout east africa. from somalia and kenya into uganda with groups like al shabab threatening the regional security collective. president obama told the bbc the u.s. is doing all it can to help its allies fight back. >> the counterterrorism cooperation between the united states and kenya and uganda and other countries in east africa is very strong and part of the subject of the visit is to continue to strengthen those ties to make them more effective. >> reporter: kenya is desperate for help. al shabab has simply ravaged the country with zefgt attacks in 2013 when more than 60 were

killed at a kenyan mall in june 2014 when 50 more were murdered by the group. in april 2015 when more than 140 more were killed at a university. but the terror war isn't simply being waged on the african subcontinent. turkish airplanes bombed isis for the first time. the turks were reportedly close to completing a deal to allow coalition and u.s. forces to use their airports to launch attacks. >> this is something turkey made for its own national defense. the opening negotiations are subject to a different negotiations and process. >> i don't want to speak that there was some lightning bolt of revelation here. we have been talking about deeper cooperation with turkey for some time. >> reporter: military analysts say if completed, the deal would complete a significant advantage for coalition force in the fight against isis. >> this is about 60 miles northwest of syria, so it's not much time to get into the actual operating zone. so it's from a military

instead, he bought himself a 18-month u.s. jail sentence and then a one-way ticket back to china. the fbi says corporate espionage cases have doubled in the past few years, and china is almost always the culprit. the bureau says it isn't just chinese companies looking to steal secrets but their government as well. they released this video as part of a campaign to warn u.s. companies that in this unstable world, china's intelligence services are stepping up their game. >> they're going to clean our clocks anyway. so we can't just sit back build higher walls, bigger locks, and wait until we get all of our secrets stolen. >> reporter: in the past few days the obama administration reportedly decided not to publicly name and shame china for hacking a highly classified government database that contained security clearance information for tens of millions of federal employees. a government source says the indictment of five chinese military hackers last may for

industrial espionage angered beijing but didn't deter them. their multi-pronged test of u.s. resolve includes china's new man-made islands in the south china sea. the u.s. navy says their planes are routinely harassed by the chinese when flying in international air space near the islands. on one, china has completed a runway capable of landing heavy bombers. while the u.s. military has been outspoken about the rise of china and its continued aggressiveness today the state department wouldn't comment on the latest fbi warnings or china's moves against the united states. a source very familiar with the white house's thinking on china says that there are few levers we have to keep them in check short of declaring war. either the economic or military kind. bret? >> leeland, thank you. another negative day on wall street today. dow lost 163. the s&p 500 was down 22 1/2. the nasdaq fell 58. for the week the dow plunged

after that accident. at issue is whether price hikes violated laws against unfair and deceptive practices following the derailment that killed eight and injured more than 200, shutting down the tracks for several days. some creative pushback tonight against president obama's efforts to potentially control the makeup of your neighborhood. it involves a gutsy local politician who is taking the fight literally to hillary clinton's front door. senior correspondent rick leventhal has the story tonight from chappaquid new york. >> reporter: he went knocking on hillary clinton's front gate friday with no luck. the frontrunner for the 2016 democratic presidential nomination was home but did not appear. >> she said she's on the phone. i said i can wait. so she said she will call me later. >> reporter: he used the clinton's resident as a backdrop for a press conference accusing the obama administration of trying to yoururbanize suburbia.

hundreds of potentially classified e-mails. one investigator for the intelligence community revealed to congress there are at least four e-mails specifically with classified information in them. i'm going to read this. it's a little bit long. before i get to the panel. this is the i.g.'s statement. the inspector general's statement just this afternoon. "the ic intelligence community ig found four e-mails contain classified intelligence community derived information in a limited sample of 40 e-mails of the 30,000 e-mails provided by former secretary of state hillary clinton. the four e-mails which have not been released through the state foia process, did not contain classification markings and/or dissemination. these e-mails were not retroactively classified by the state department. rather these e-mails contained classified information when they were transmitted. they should never have been

transmitted via an unclassified personal system. the intelligence community i.g. made a referral detailing the potential compromise of classified information to security officials within the executive branch. the main purpose of the referral was to notify security officials that classified information may exist on at least one private server and thumb drive that are not in the government's possession. an important distinction is that the i.c. intelligence community's i.g. did not make a criminal referral. it was a security referral made for counter intelligence purposes. okay. with all of that let's bring in our panel. jason riley, columnist with the "wall street journal." ron fornier of the national journal and syndicated columnist charles krauthammer. the pushback today was on the "new york times" saying it was a criminal referral. you see the definitive statement there. it wasn't a criminal referral. but it was a referral that could be criminal if the justice department launches an investigation. >> i could correct you. it wasn't the "new york times" that said it was a criminal referral. it was the doj that said it was

a criminal referral. >> exactly. "new york times" took it back. >> now what the "new york times" did a little sloppy reporting overnight. they originally made it look like hillary clinton was the target of the investigation. of course we don't know what the target is because there's not an investigation yet. but fact of the matter is the clinton campaign wants to season that. but the fact of the matter is as you just read she said there was no classified material in her e-mail and there was classified material in her e-mail. now we may have an investigation. and god knows where it will lead. because the big matter here as we've known is that she secreted and deleted our e-mails and for reasons that we still don't know why. >> that's bottom line. >> that's why this is a story today. because she took our e-mails rogue. that's the bottom line. that's why this is a story. not because of the "new york times," not because of the mean old republicans, not because of gentlemen, like me who have covered her for a long time and have a good deal of respect for her but keep pounding on her over this. all she's got to do is give the

server to achldthe i.g. and return some foreign money back that the foundation got and this could be done. she could run a clean campaign. >> every time she opens her mouth on this issue she loses credibility. she's lied about being subpoenaed. about how many devices she's used as secretary of state. she's lied about the nature of the sensitivity of the e-mails that she sent. it is hurting her and the credibility department and in the likability department. and i think that is the real long-term issue here. thatc poll that came out earlier this week that found her down to three leading candidates in the republican party in some swing states that wasn't the worst part. if you're team clinton, the worst part of those findings was that more than 50% of the people don't find her credible. an even higher percentage don't find her likable. and this scandal will continue to hurt those numbers. >> yeah. i just do want to read what the campaign said charles. nick merrill's statement saying this. "it is now more clear than ever

that the "new york times" report claiming there is a criminal inquiry sought in hillary clinton's use of e-mail is false. it has now been discredited by both the justice department and the ranking member of the house oversight committee. this incident shows the danger of relying on reckless inaccurate leaks from partisan sources." so that is a common theme to go after that process part. but the facts here on the statement are pretty clear. >> if the times were running for president, that would be a relevant defense. >> good point. >> it has nothing at all to do with the substance of the charge. it's what anybody would do who doesn't have a defense is to say look at the shiny object over here the times made a mistake. it is entirely irrelevant whether the referral was criminal or not. as ron said that will be determined by the doj, although i think it will snow in hell before the doj's going to go

after her. that they go after david petraeus for a lot less but not her for obvious reasons. it's an extremely politicized department of justice. but look, she told awnn untruth when she said that the e-mails from blumenthal were unsolicited. we saw in her own e-mails keep it coming. we know she was telling an untruth when she said she turned everything over related to her work. we now have the e-mails that came from another source from blumenthal. and here the relevant point is that intelligence community i.g. andrea williams said the e-mails she sent were classified at the time she sent them and they remain classified. so what she said in the press conference was obviously untrue. and that is the only issue at question here. >> i do want to play the state department sound bite where they were pressed on it today. but you're right. e-mails containing classified information when they were

generated, meaning that in some pile here ron, there are classified e-mails or portions of them. now, who goes through there and decides which e-mails are going to state and which e-mails are not? are they cleared for the classified information that they are seeing through those e-mails. >> as you know there's some responsibility that's borne naturally by the person who's guesting and receiving the e-mails even if they're not marked classified. there's some responsibility in knowing that they should be. on the media issue, i agree with you. look in our institution you talk about trust, the media institution, we're even below politician and we've earned it. it makes it easier for candidates like hillary clinton, and a few weeks ago marco rubio seizing on mistakes or exaggerations or holes in the story. marco rubio's case was also a "new york times" story deflecting from the real issue. again the real issue here is that she did wrong and it's obvious that she did wrong and she won't own up to it. >> i do want to play this sound bite from the state department today asking about the

classified part of it. >> you don't believe anything that she sent at the time was classified? because again the intelligence community believes that e-mails she sent were classified at the time she sent them and are still classified today. >> again, that's a question really for her and her people to answer answer. we don't believe that. upgrading them again. to our knowledge none of them needed to be classified at the time. >> to our knowledge. >> how about the ones that have been deleted? >> right. are the inspectors general part of the vast right wing conspiracy? it's hard to argue that they are. another problem that hillary has here is that she's seen as a vulnerable candidate by other democrats. there are other people more serious challengers than a bernie sanders, a joe biden or a john kerry, who could still get into this race. that is also a concern of clinton. >> does this lead to an independent prosecutor another
