44 democrats, two indiaen indep who lean republican. currently there are three simple policies that need to be changed. defunding of pln until this selling of baby body parts is completed. kate's law needs to pass. sanctuary cities need to lose federal funding. they are opposed by many democrats. >> i support the sanctuary. we have this terrible case and our hearts and prayers go out to the family. but in terms of the question, which was the bill about mandatory minimums, if we had passed a comprehensive immigration reform, which is the

answer to many of the questions that you may ask on this subject, then we'd be in a better place. >> hard to believe despite mrs. pelosi's opinion, the house did pass legislation that would defund sanctuary cities last week. now it's up to the senate. the question tonight, will republicans in the senate do the right thing and stand up for justice? if they don't, i believe the american people will turn against the gop. the senate and the house will soon embark on vacation until september 8th. so quick action would be good. senate majority leader mcconnell's office tells "the factor" the senate will vote next week on legislation to defund planned parenthood. that's an important vote in light of the horrific videos the country has seen the last month or so. 62% of americans in a rasmussen poll say they disapprove of cities and municipalities defying the feds on immigration law. talking points believes an overwhelming majority of americans support kate's law as

well. that's fox news do a poll on kate's law. we should have the results next week. summing up, if the republican party does the right thing, americans will take notice even if the president and the democratic party sabotage the legislation, which is likely. but if the gopers do not stand up, don't do anything on these three vital issues, the party may lose all credibility. and that's a memo. now from the top story tonight, reaction. joining us from washington charles krauthammer. so three bills. do you think the republicans are going to get behind all three? >> the fallacy in your argument is that all the republicans in the senate could stand up unanimously, let's say on planned parenthood or on kate's law. and they don't succeed because you need 60 votes, not the 50. >> i understand that. >> but that's a big impediment. >> it's not about that, though. you're missing the point. you usually don't. the point is that people in this

country, the voters in this country, have to see with their own eyes vividly, all the b.s. has to fly out the window. who's standing up for them and who isn't? we just heard nancy pelosi flat out say that she's not going to support kate's law, which would protect people like kate steinle from being murdered. this woman has the gall to try to excuse her unbelievable incompetence by pointing to some phantom comprehensive law that's never going to get passed instead of embracing something that could matter right away. that's what i want the people to see, charles. >> wells i'm with you on that. nobody's against that. the idea is you want to bring the bill up, that will happen next week on the planned parenthood defunding. you will have a debate. the democrats are going to be on the defensive. everybody is going to see how morally bankrupt their position is, how much they are in the pocket of planned parenthood.

[ overlapping speakers ] >> now we need the other two to be brought up. the house already passed the sanctuary city defunding thing. and that's good. but look, you and i agree that we want the american people to see who is looking out for them and who isn't. and therefore, once that's established, yeah, they can sabotage the laws. and obama could veto the laws. but once that's established, you're going to see a change in this country right now. because it's still 50-50. about 50-50. and it shouldn't be. because the democrats are on the

wrong side of history here, charles. they're in the wrong side. >> i do agree on issues where you know the democrats are going to stop you, or you know that even if you pass it obama will issue a veto. you want it out there. you want the debate. you want people to be exposed. >> that's right. >> and over time, i assure you the planned parenthood, the videos that have been shown up to now and that will be shown, the ones still to come, are going to have a profound effect. it will be a long-term effect, but it will be a profound effect. i think not quite but almost as profound as the advent of ultrasound, which had an effect on public opinion. it took years. but it sunk in. >> we'll see. it all has to do with the next election and who's going to be sitting. and by the way, i believe kate's law will pass because i think the democratic senator from california, diane feinstein, will back that law. and when she backs that law, then you're going to have a bunch of democrats come over.

because this is so stark, so irresponsible, not to back that law, to allow a man who was convicted of seven felonies in this country to come back six times. and you're going to vote against that? that's outrageous. >> i commend you for bringing it up for essentially venting it. >> thank you. >> but let me just say one thing. the sanctuary cities thing would have a far more widespread effect -- kate's law is a good law but it's rarely narrowly focused. >> i understand that. but it's the symbolism of it. >> there are symbolism and there are also dead people. >> that's right. >> i'd like to see -- >> i promised the steinle family i would get this as far as i can take it and i'm going to damn well do it. now i got to switch over to the. a week from tomorrow, fox news first debate. everybody's eyes are on donald trump because he can do one of two things. he can blow it up and continue to really really attack his

opponents, or he can surprise everybody and come in as a statesman and frame the things that he believes in in a much more issue-oriented way. what do you think he's going to do? >> i'd like to see him play the statesman. >> do you think he will? >> i don't know. i mean, with this guy -- look, is it in his interests? right now he hasn't risen in the polls like a rocket because of statesmanship. so i suspect he'll stay on the transport that he's now used to get up in the polls, to be leading even in florida the poll today. and i don't think statesmanship is exactly it. so i expect he will be out there attacking. but the real question is, will anybody want to take him on? and this is a real dilemma in a big field. because if you're the one who takes him on, you could be the one who ends up damaged. let me remind you, in '04, in

the democratic primary, dick gephardt and howard dean were way ahead in iowa. and they took -- you remember this. each of them took out ads savaging each other. they ended up losing and sneaking in were john kerry and john edwards. and that's the problem if you take on trump. you might succeed in bringing him down a notch or two. but you may not be the one who benefits. so is there any interest that you would have as a candidate going after him? i don't know what the answer is. but i think only the candidates who i think are doing very badly are the ones who would risk it because it would be a hail mary. >> i think cruz might take him on. we will see. >> cruz won't take him on. not at all. cruz is riding in trump's wake. >> he's lost a lot of support to trump. and he's got to get that back. but anyway, i think it's a most fun debate we've had in decades. and we will obviously all be

some persons' priorities when they are concerned more about a symbol that had represented the negatives many years ago compared to today, thousands and thousands of babies, obviously, that we've seen in the news over and over with planned parenthood being butchered and having their baby parts sold, that people in some parts are paying a whole lot more attention to the flag controversy than their about what planned parenthood their barbaric practices are. >> okay. now why did you zero in on black babies? >> oh, because the confederate flag, obviously, has been such a focal point for much of society right now, that that was an easy comparison. again, this outrage over the flag and then especially in south carolina that was taken care of. they took down the flag. but where is more of the outcry about what is actually going on with innocent human life and how can civilized society even accept what's going on?

these communities, including our president, who would say, god bless you, planned parenthood. i'm there fighting with you. people deceived to make it sound like, oh, my goodness, an innocent human life is disposable. >> i just wanted to know if you think planned parenthood has a motivation to target minority women to come in and get their babies aborted. is there a reason they're in the poor neighborhoods? any reason? >> planned parenthood is a bogus business. they're in it to make money. they are in it to profit. and they have profit. and that's why our tax dollars should not go to planned parenthood. they're not needed. and they're not -- it's certainly not ethical for our tax dollars to go there. >> i hope you're right, governor. i don't think tax money should be going to this organization, either. and we appreciate your coming on tonight. >> thank you. they need to be shut down. >> another governor, bobby jindal, wants to hold mayors of sanctuary cities criminally accountable for their actions. but how?

unresolved problems tonight confronting sanctuary cities and the people who run them. governor of louisiana and presidential contend are bobby jindal wants congress to come down hard on maryors and others supporters of sanctuary cities. what are you asking them to do. >> let's recognize these mayors, these city officials, they are partners in crime. they should be held criminally liable as accomplices for the crimes committed by these folks that are here illegally thanks

to these sanctuary cities. so the first change, make them criminally liable. they are partners in crime. >> that would be unbelievable, though. president obama would veto that. but i don't know if he'd get that to pass even on the republican side. >> but we should. when you think about it, right now under federal law if you're an accessory after the fact, if you help someone, harbor somebody, that's what these folks are doing. but there's a second change. there's a second change. let's also make these folks civilly liable. let's give the families of these victims an opportunity to go to court. the sanctuary city officials, mayors, city officials as well as other federal and state officials that aren't going after these sanctuary cities. >> they have a right to sue now if they want to. they can sue municipalities and cities if they feel that they were derelict in protecting -- >> right now local officials have got immunity. their office, this is considered -- >> some of them, yes. you want to strip all immunity and civil lawsuits going against them. >> not only them but those that don't prosecute them under the

first change. bill, let's stop being politically correct. they're partners in crime. >> theoretically i agree. krauthammer gave me a hard time at the top and you saw this. he says well you know you're not going to get the democrats to do that. never get the democrats to do this. but a person like nancy pelosi in her own city this woman was killed, kate steinle, and still won't support keeping the aggravated felon, illegal aliens off the streets. still won't do it. so you know what you're up against, governor. you're up against an entrenched ideology that will never ever take punitive action against anything associated with illegal immigration. >> i've spent a lot of time in iowa, new hampshire, outside of d.c. this what is i hear from votes. they're frustrated not just with the democrats but the republicans. they're looking at the republican leadership. >> what i said. >> when are you going to stand up to us. i think your point to charles krauthammer is exactly right. republicans if they won't push through kate's law, to me every republican should be lining up going after the partners in crime.

factor followup segment tonight as we reported last night, a radical group called black lives matter has threatened to shut down republican convention in cleveland next year and is generally causing trouble all over the country. the group partially funded by george soro is, jay z and beyonce'. last night a reporter tried to cover a black lives matter conference at cleveland state university. >> i just want to say this is a people of african descent. if you are not please go to the outside of the circle. immediately. >> i'm a reporter. >> that's right. that's why we don't want a reporter.

thanks for staying with us. i'm bill o'reilly in the impact segment tonight controversy surrounding the iran nuke deal as you know. a new video featuring celebrities supports it. >> the agreement currently on the table is the best way to ensure iran doesn't build a [ mute ] bomb. >> and it gives the international community unprecedented access to verify that iran is keeping up its end of the bargain. >> and the alternative to that is war. >> look, we all love our children. and the iranians love their children. and [ mute ] -- >> we've got a deal on the table that keeps us all safe. >> now, i wonder what those celebrities would think about secretary of state john kerry's testimony yesterday on a side deal with the u.n. concerning high tech weapons that now will be delivered to iran. >> secretary rice said that she has seen this deal with the iaea, and that it will be shared

with congress. so if she's seen it, have you seen it? >> i don't believe that susan rice, national security adviser, has seen it. i think that she's -- >> she says she did six days ago that she had seen it and reviewed it and that congress will get to see anytime a classified section. my question is, have you seen it? >> no, i haven't seen it. i've been briefed on it. >> are you going to read it? >> we don't have access to the actual agreement. >> but secretary rice has access to it but you don't have access to it. >> i don't know about that. >> joining us now from austin, texas, karl rove. so this thing is pretty scary with iran now. what we're talking about is i guess ballistic missiles and other components to build high tech weaponry that because iran signed this nuke deal are going to be able to get. that's what we're talking about. but they made the deal with the u.n. and kerry doesn't know about it. >> well, no, there are two different things.

we know that the arms ban is going to go away within i believe it's five years. we know the restraint on their development of their icbm program goes away again within a certain number of years. what we don't know about are the side agreements between the international atomic energy agency and iran about inspections and other issues involving their existing infrastructure for the nuclear program. for example, one member of congress said that his understanding is that it allows the iranians to take their own samples of soil samples around suspected nuclear facilitiefaci. like letting barry bonds draw his own blood sample and submit it to prove he's not using steroids. it doesn't work. >> the fact the secretary of state who negotiated this whole thing doesn't know what the u.n. is doing on the side. >> jaw dropping. jaw dropping. >> will this become now a big campaign issue going forward for the presidency? >> yeah, i believe it will.

first firof all we're at the beginning of the debate. so far the administration is not making a particularly strong case for it. if you don't do this it's going to be war. this video, the global zero action corps video, look, they're a bunch of dufusses on that. let's take their argument. their argument is, if we don't do this deal we'll all be dead. several times they say we're going to die if we don't do this deal. so let's do the deal that expires in ten years so that iran can get a bomb and an icbm to deliver it in ten years. so i mean, this is an idiotic -- i love being reassured by a bunch of hollywood actors reading from a script that this is the best deal that we could possibly get. they haven't read it. they don't know what's in it. you take one look at this deal and it does not meet the constraints and demands that the president himself laid out for any kind of a deal. >> but you believe that this is going to be a center piece in

the presidential campaign upcoming? >> i think it's going to be two things. i think it's going to be a significant issue for some period of time in the next several months as it gets considered and voted upon and acted upon by the president. >> right. >> i think it will then be baked into the cake, if you will, in a broader issue of american foreign policy being feckless and week. the iranians made it clear. yesterday they went out and said look, this i not going to affect us at all. we're going to continue to support our proxy -- terrorist proxy allies, continue to dominate the region. so forget it, we're not changing. >> so baked into the cake in a bigger foreign policy debate with hillary clinton. be interesting. mr. rove, thank you. miller on deck. tom brady sacked by the nfl and he and the new england patriots are furious. are furious. miller is next.
