the information there was from five agencies related to the deadly attack in benghazi and there is a report that hillary's private attorney david kindle has copies on a thumb drive prompting letters to the fbi and state department asking why a lawyer without clearance has them and what they are doing make sure the information is secure. a state department spokesperson said it is being held in a safe place. kindle is the same attorney to defend david petraeus. the fbi raided his office over the incident but no raid on hillary clinton or the lawyer for this thumb drive.

you can ark argue this is the same crime. >> i am torn on it because in the petraeus case there is no argument they were classified. she is arguing they were not classified at the time. the inspector general said that is not true. he said they had information that was classified all along. the question i have is were they stamped classified or marked classified or is this something she should have known was classified or not. i am assuming as the secretary of state she should know the contents that were classified. >> maybe there was a guy named spanky. >> the idea you can give this drive to your lawyer with classified information and your lawyer is a safe protection of the documents i have a problem with. the executive order that

provides classification president obama issued the latest order specifically says what you can and can't do. it says most of the documents couldn't leave a government facility. we have them in her house and now at her lawyer's office supposedly in a safe which doesn't qualify as a skip. >> i am not buying she didn't know what was classified and what wasn't. we had another judge here, judge napolitano and we went through the e-mails and he said she had to know. >> she is saying she is the nation's top diplomat. you talk about the skip and it is specific ways of securing documents at home and there is no wiggle room. catherine heritage has been doing great reporting on this.

this is what general petraeus was accused of. it looks like as you look through the guidelines she has done the same thing. they have the right to secure the thumb drive and the server. i don't see as you comb through the elements this is unequal treatment between the two cases. >> the question is is there a safety brief because did this cause or lead to the death of the four americans? if that is the case it could be criminal. she is secretary of state, this is such a high honor this is like her going on her g-mail account and sending out classified information. and judge napolitano said in one e-mail she is talking about the specifics of the embassy over in benghazi and chris stevens being in the embassy. if it terrorist read the e-mails they know where he is. >> you think about it at the

time, stacey, what was going on with general petraeus? he sent the e-mails to a biographer it turned out he was having an affair with. and i think there are questions on why he was pushed out of the administration. general petraeus was in charge of the cia and a cia knew immediately it was a terror attack in benghazi and put out a memo saying it was terrorism. and her state department tried to tell a different story. >> the e-mails made public were from the national security agency. the defense intelligence agency and the national geospatial agency. how cannot -- how can that not

growing nervous about a heavy weight joining the 2016 field. democratic sources are telling fox news vice president joe biden chief of staff was spotted having breakfast with a major done aid. but the clinton party is saying there is no change on the focus of joe biden. but maybe there should be. when it comes to the opinion of the former colleagues biden holds a 9-point lead in favorability and hillary clinton is ahead 12-points in the non-favorable comment. okay.;. it is a little more than a conspiracy theory. we know joe biden is mourning the loss of his son so some say he would not jump in. but there is a lot of buzz. she is vulnerable.

helpful because iran would come back to the table and the world could get a better deal. they denied the remarks. so the remark about not letting canadians and americans in baits on sunday. do you say they were boasting? that is the claim. or do you think it is real? >> there is no love lost between iran and the united states and canada or any other civilized country. i don't know what is in the agreement. i don't happen if the agreement required them to open up for inspections. if is not part of the agreement i have no doubt they intend to keep us away. i said a month ago or so when we started talking about this i said i don't trust iran i will never trust them and i don't think they will ever live up to the agreement.

i don't expect them to eagerly allow western inspectors to come in. only those with diplomatic relationsism >> they said they will be the ones collecting the soil samples and air samples and hand them over rather than the inspectors. >> we can absolutely trust them to give us clean soil samples. i think you bring up a point of not knowing what is in the deal but what is in the specific bullet points. just two weeks ago, the supreme leader came out saying we don't have to honor any of this after we sign it. but the secretary of state testified on capitol hill we could trust them. if you watch the hearings and i encourage everyone to go back and watch them, not just kerry

most notable in baltimore maryland. leaving experts to worry mounting tension between law enforcement and communities are taking a toll. peter duecy is live. >> reporter: police officers are concerned about conscious quiz quiz -- consequences of mistakes and criminals are operating without much concern and murder rates in big cities are through the roof. chicago has had 240 homicides in 2015 and that is 20% more than this time last year. new orleans has seen a 33% jump in murders and st. louis a 36% spike. here in washington, d.c. where the homicide rate is up 20% the police chief is looking for help from other crime plagued cities. >> we are all seeing the same

reason to not. >> we know you used to be a cop and we know they are fearing doing their job because of high profile cases that make them guilty before proven guilty. >> when you have your commander and chief and all of your city officials not backing the law enforcement of their city what are they going to do? how are they going to do their job? that is the point i was making. i am not talking about bad shootings. the one we saw -- shot the man running away i don't see justifiable force in that. but when you highlight all of them and you find out it was a

justifiable shooting that builds a bad image. >> it is happening in cities where there are no incidents. in los angeles violent offenses are up 20% and property crime is up 10%. we have noticed it in new york. the decline in the quality of life. normally you blame them on the economy saying people are becoming more desperate but the economy is on the upswing so you cannot dothat right now. this is like a general sense of lawlessness. >> a lot of these cities are, as stacey mentioned, are led by democratic officials. ferguson was a democratic governor and representative. baltimore, democratic leadership for decades. i want to point to something important. the murder stats they are tinkering with them. the chicago tribune did a number of pieces on this.

they are reclassifying how they are doing the murder rate. if 87 people get shot in one weekend chicago counts it as incident so emanuel can stand up saying i brought the crime rate down. >> you are telling cops they are the problem. you are telling crooks if you do something wrong you will not get caught. break down of family and education is the problem as well. pressure is mounting on the minnesota dentist who killed a beloved lion in zimbabwe. and now the zimbabwe government is seeking the extradition of walter palmer. palmer issued a statement saying he relied on the guides to insure the hunt was legal. the feds have not been able to reach him so far despite

account and if twitter goes after them they close the account. or in this case they are concerned. a lot of people are under the mistaken impression if they are anonymous they have freed of speech and that is not true. there is case law saying tweets and post-ings have first amendment protection so the courts require people who want to go after someone post-ingpost-ing anonymous anonymously because there is less credibility it. it is not like the washington post said this. >> what about the cocaine think? >> it is defamation. if you start saying they are a thief or drug user that is defamatory. but the courts cause you to go beyond that and so you have a case. the proof you have a defamation
