>> that's it for tonight. thanks for watching "the factor." i am bill o'reilly. always remember the spin stops here. we are definitely looking out for you. breaking tonight, the first gop presidential debate is less than a week away. some candidates are fighting to secure a spot on the big stage. welcome. one of the biggest obstacles to candidate success is the fact that the potential field swelled to 17 different faces. fox news will host the top ten contenders thursday in cleveland. the real clear politics average gives us a good snapshot of the field. this is not the guide fox news will use to determine who makes the final cut. as we get closer to the debate some of the candidates are making headlines already. >> over time the trump phenomenon will either succeed

or fail based on his proposals. >> you call it a phenomenon. >> the fact you are asking me about it you're not asking about scott walker or other well qualified candidates. it is a phenomenon. >> what section of america do you represent? >> the poll had me with 16 or 17 and datas had me at 25%. the next person was 12%. that's a big difference. we represent a big section. >> not the immigrant population presumably. >> excuse me? >> not many of the immigrant population. >> i did well. in fact the hispanics, a poll came out two days ago. where i'm number one with the hispanics. i know you are surprised. i'm number one with hispanics. i said if i get the nomination i will win with the hispanics. >> they want to hear who you are for not against. i said donald trump could speak for himself. he's using the talking points of the democrats. those talking points haven't

worked well in the last four years. >> television works. give some other candidates time from 8:00 in the morning to 8:00 at night all day long every day for three weeks i'm guessing other candidates might rise as well. for example, while some people are hearing about one candidate all the time few know i have offered a tax code. >> this is the most feckless foreign policy in american history. he's so naive. he would trust the iranians and he would take the israelis and basically march them to the door of the oven. >> don't talk to me about being anti-gun as governor and raise something to me that was -- listen. that was 20 years ago. if you want to debate me, come in the top ten, run for president and come to fox in cleveland on august 6. i'm happy to debate you. >> pollster frank lundst it's going to be so much fun. ready? >> i'm ready. in fact i expect new drinking

games to be created out of the debate on august 6. there are two key points i want to raise. number one, because we are six months away from the fistrst vote in iowa and new hampshire it will be more about personality than policy. voters are sizing up the candidates to decide whether or not they like them empathize with them whether or not there is a connection. that's more important now than where they stand on the specific issues. second it shall and this is specifically for donald trump. it's the old simon and garfunkle song "the boxer." a man hears what he wants to hear and disregards the rest. that's what's happening with donald trump. if you like him, you love what he's saying. if you don't, you hate what he's saying. each person hear what is he says differently depending where they stand in the political aisle. >> he's topping every single recent poll. we don't know which version will

show up. he says he'll be respectful but he's bombastic. who stands to gain by engaging him? who stands to lose by engaging him directly? >> i'm not convinced that anyone stands on engaging him. i had the chance to do it. i understand what it is to feel the wrath of donald trump. he's credible. he's tough. i'm surprised he's not prepping for the debate because no matter how much you know you never know enough of the details. that's the guy he is. >> do you think he's managing expectations? this guy is smart. he has been successful on a number of things. love or hate him, i don't know. i mentioned it to somebody else. gosh can't believe he says i'll just show up. i am who i am. do you think he's doing a lot of debate prep? >> actually no i don't. it may be. he's not asking you to vote for him based on his knowledge of specific policy. he's asking you to vote for him

and he says it again and again because of the art of the deal. because of leadership. because of the determination. he's asking people to vote for him because of a passion, rather than a policy. early on in this election process that's a smart strategy. >> i wondered how it would work once we got to the debates. having interviewed him, he'll continue to what he's best at. he says i'm the only one who can create jobs. i'm a successful businessman. i can turn things around. when you say how would you do it as president? how would you work with capitol hill. he returns to i want to make america great. i wonder how long he can go on the big concepts people seem enamored of versus a deep dyeive on policy at some point. >> depends how the media treats him. the candidates are right to be angry. there is a lot of focus on donald trump who is between 20 and 25%.

he's getting over 50% of the coverage. he's crowding out other candidates' messages. equally important, the way the media treats him -- sometimes with with respect. more often with scorn. he's becoming the iteration of anger the public has toward the main stream media and frustration with america's elite. every time trump speaks against he goes up another two points. the press is creating a surge for donald trump. >> although he's at the top of the polls he's also at the top of the polls for a person you would never vote for according to gop primary. who do you think will be a good debater who will have a chance to shine on stage? >> first person is marco rubio. he has the best positive message of any of the candidates. it's very emotional, very personal. i know from the work i have done that people reacted positively. the second person i will be

looking for is chris christie. you showed a segment there. he has the best sound bites. most likely to start yelling at somebody of anybody. not only will he be entertaining but tough. the third person i look for is governor scott walker, current governor wisconsin, a blue state. he has a strong record and has a gentle way of communicating. those are the three people i will be watching. >> let's talk about ben carson. a brilliant doctor. he has a lot of grassroots support. people adore him. he's got such a laid back way of talking, even when he's his most passionate about an idea or policy he has depth. do you think it will work for him in the debate? >> he has significant depth. the thing i find interesting is if you have christie and trump on one end and carson is the opposite. the level of civility and decency republican primary voters should appreciate. i would advise him to speak up

speak out. your normal way of backing up and being civil, there are ten other people -- nine other people on stage. you're got to be heard. >> you may get run over with this group. let me ask you about ted cruz. he was a champion debater. i have heard him argue at the supreme court. he's very convincing. >> the key to this debate is not the overall presentation. it's the one or two sound bites. it's the seven seconds that matters most. i'm convinced ted cruz will have one of those we'll see again and again. there is no presidential candidate better than cruz at delivering something powerful in a short amount of time. >> we'll see how it plays out. afterward you will give post debate analysis with a focus group for "the kelly file." we'll look forward to it. >> i will make three or four republicans happy and three or four angry. it's what i do.

two years later mrs. clinton returned some documents to the state department and deleted the rest. the agency is releasing her e-mails to the public and we are finding dozens of what appear to be classified documents, raising new concerns. chief intelligence correspondent catherine haridge in washington. >> if you search through the more than 1300 documents using a code for classified information there are 37. this after the intelligence community watch dog concluded there are potentially hundreds of classified documents on clinton's personal server like this one between an aide and then secretary of state clinton. briefing her in advance of a call with abbas who believed toyota be the palestinian leader and all of the details are wiped. classified details on her personal server and the backup copy on a thumb drive held by her lawyer may be a violation of 18 u.s. code 1924 governing the unlawful removal and storage of classified information.

glandular issue but is basically healthy and she's fine to be president. i don't know if that will pass long term. that's what she's offering. on the other hand, they made more than $140 million american dollars from 2007 to today. you put it together with their haul from 2000 when they left the white house we are talking about a quarter billion tlardollars. do you know what they did to get it? they gave speeches wrote books, were famous, influential. she was powerful. she was a senator. she was the secretary of state. he was flying around on 747s and having a big time. but all they had to do was be themselves and people gave them money. she said the money didn't affect the way she did her job, won't affect the way she did it as president. but a quarter billion for just being famous? >> you and keep it up we'll have to put southern subtitles on there for the people.

here. first, trace? >> over the past two years the center for medical progress has taken under cover videos of the educational vid eovideos. the naf sued to keep the videos from being released arguing they could lead to death threats saying quote, the broader public interest can be served by preventing defendants from harassing, intimidating and inciting violence against naf, its employees and members. today they were banned from releasing videos on the heels of a california superior court issuing a temporary restraining order preventing cmp from releasing under cover videos of a company that buys fetal tissue for research. pro life advocates say the legal action is an attempt to hide the horrible truth. so far cmp released three different videos showing senior level employees of planned parenthood casually talking about selling fetal tissue and

graphically explaining techniques used to remove the valuable parts of aborted babies. the video shows the vice president and medical director of planned parenthood of the rocky mountains talking about maximizing profits while avoiding legal consequences. selling fetal tissue for profit is against the law. they claim to have nine more under cover videos but it is unclear if any will be released. amid the controversy hillary clinton acknowledged she found the planned parenthood videos disturbing saying while they have done good work for women, this raises questions about the whole process, though she didn't expound on what process. last night she posted on twitter, quote, proud to stand with planned parenthood and access to quality, affordable health care for women, men and young people. there is a push to cut off planned parenthood's federal

funding. >> thank you so much. on that joining us now, south carolina congressman who joined the effort to defund planned parenthood. the stakes are high here. congressman, thanks for joining us. >> yes, ma'am. thank you for having me. >> you have done something you don't often do which is sign your namen a letter with members of congress basically standing up and saying this is my position. i'm not going to move from it. in this case you are saying you're not going to vote for a funding measure that includes continued funding for planned parenthood. you know that you're going to be on a collision course with possibly being responsible for being accused of shutting down the government if you maintain this position. why are you tagking it? >> i don't believe in infanticide. there are things that define us as a decent people as people of good conscience. when you watch these videos as bar barrick and depraved as they are, when you are discussing the selling of body parts while eating a salad, like you are

talking about a stock tip. and the latest video where you are right on the precipice of discussing homicide if you look at the quote, folks who come in after delivery but still want a procedure, what does that mean? if that's not partial birth abortion what does it mean? the people i work for do not want to fund that. people can disagree about a woman's right to choose and roe versus wade but this is barbaric bedepraved and if the president wants to insist on a fwoth shutdown so he can fund something and i didn't think planned parenthood was necessary after obamacare. i thought it provided health care and access to everyone. why do we need planned parenthood to prop up the abortion industry? i'm not going to fund it. >> are there democrats, people with concerns about the video that will join republican

efforts? >> well i don't know. i would think all people of good conscience would be sickened by what they have watched. will there be folks out there who are able to rationalize it? i'm sure there will be. i suspect that there will be a funding mechanism this fall and no government shutdown. i don't want one and neither do the 18 people who signed the letter. you have to stand for something as a people. what defines us as a people? i am speaking to a death penalty conference tomorrow. there is more sobriety in discussing the heinous acts of death row inmates than there was in the discussion of selling baby body parts. so if that opportunity define us as a people then perhaps i'm in the wrong line of work and i may be in the wrong republic. the america i believe in the people i represent do not expect me to fund the barbarism and

depravity i have seen. >> if it gets to the president, he's going to veto it. >> yeah. you know what? the president loves to talk about bipartisanship working together so long as you do everything he wants you to do. that's his definition of bipartisanship. i am not going to continue to fund an entity that does the things i have seen on these videos. so attorney general lynch can investigate it. the bureau of investigations can look at possible criminal violations. i'm not going to give taxpayer money to an entity that discusses the best way to sell body parts and whether or not you can perform procedures after a delivery and then sell those parts in interstate commerce. i'm not going to fund it. will my colleagues do it?

we'll see this fol.all. i'm not going to. >> you are chairing the benghazi committee investigating what happened. tooung the new round of hillary clinton e-mails, some heavily redacted will have an impact or be of help to your committee? >> probably not. we are in a constant battle with the state department over the production of documents. you know the self-described most transparent administration since the earth cooled loves to obstruct withdraw and redact. we'll find out what happened with or without their help. we are marching on toward the october interview with the secretary but we have 40 other interviews planned for fall. it would go better if the state department showed a little bit of interest in cooperating investigating. put politics aside and help us find out what happened to the four brave fellow americans, but

couple and shooting their daughter. >> the 18-year-old admitted i used a rifle to shoot three people who stopped to help him avenue ran out of gas. the 62-year-old and his 50-year-old wife and their 24-year-old daughter pulled over to offer assistance the rbi says he pulled out a rifle and demanded money. when the family said they didn't have any, he told them to walk away then he opened fire killing the father and mother and wounding the daughter who was able to run for help. when asked why he shot the family, he said he got tired of waiting around and the daughter laughed at him. the obama administration deems him a legal, permanent resident. he was arrested for felony burglary but at the time immigration and customs enforcement said their hands are

came here illegally, given a special juvenile visa immigration visa in 2013. so he was sort of grandfathered in that is why he was here. he hadn't committed a crime at that point. so what is wrong? with how this proceeded? >> well the first thing i want to point out is that white house and open border activists argue they don't want to tear families aparts even after they've committed crimes. here we are with an american family whose family has been rip add part permanently as a result of bad illegal immigration policies. when it comes to this guy this, is a result of the united states of america not enforcing entering the country illegally as a crime. the authorities in this case say they couldn't deport him because he only had a burglary charge instead of a conviction and a path from the obama administration. the fact is that entering the

country illegally is a deportable offense. >> you know the last couple years the administration has given prosecutors and immigration prosecutorial discretion. and it's stead sh you don't have to deport certain people we're telling you not to waste your time. you don't have a right to -- ice agents sued the administration over policies but that is where we stand. is this what we end up with? >> well what we have right now is 2 million people under this administration deported. 30,000 people every day just sitting in detention centsers. you're right to point out shannon, this man did not have a criminal record. i think all of us would agree none of us has a crystal ball and is clairvoyant.

it's terrible when a tragedy like this happens but this man, again was not here illegally. that special juvenile status are given to children who are abused or neglected from foreign countries. this isn't just a free pass. he fit the criteria for this visa. >> my source says that dhs is giving these out, they use the word quote, widely. these special immigration visas. >> this is a problem. they're giving them out without looking into back grounds of who the people are. and sure maybe he didn't have a violent criminal record but he had a criminal record because he was in the country illegally. let's not forget the obama administration is giving out these juvenile visas to people

they haven't vetted but releasing tens of thousands of violent criminals with convictions onto the streets of america. to say we don't have a crystal ball and don't know what is going to happen. why are we allowing people who have broken laws when moving into the united states to stay here at all? >> we do know there is evidence to support that there have been people who have chitted significant crimes that have been released back onto the streets. >> there is no question we have an immigration problem. that is why many people have been pushing for immigration reform, including securing our borders aerial drones rudy giuliani mentioned in columbia that has been successful. are we supposed to deport every person arrested and this person
