bush scott walker and all the rest? plus it's like earth was taking a selfie. and the moon decided to photo bomb it. new pictures of our planet from a million miles away. let's get to it. >> good afternoon, from the fox news desk. the malaysian prime minister confirms what we have known for a week now, part of that missing malaysian airlines jet washed ashore on remote island in the indian ocean. it was always the only conclusion. since there is but one missing boeing 777 in all the world. still, the news does not solve one of aviation's biggest mysteries. the wing part does not tell us why the jet went down whether it was a malfunction or something criminal. it does not explain why the jet's transresponder went dark during the flight from kuala lumpur to beijing. and we still do not know about

the 239 passengers and crew and whether they knew what was happening as they plunged to their deaths at sea. comprehensive coverage ahead beginning with leah gabriel from our newsroom. leah there is still so much we don't know. >> reporter: you are right. we have one ig piece of a very big puzzle that will lead to some answers and a whole lot more questions. malaysia's prime minister said this discovery means the flight ended in the indian ocean and had a message for the families. >> it is my hope that this confirmation however tragic and painful, will at least bring certainty to the families and loved ones of the 239 people on board mh370. they have our deepest sympathy and prayers. >> clearly, he believe this is gives families closure, that their loved ones did not make it to dry land. schieppe in an intact airplane.

how exactly he would know or anyone would know that that flaperon didn't fall to have airplane somehow -- that's anyone's question. it's worth pointing out a suit case was also found a day before the flaperon on the same island. a french examiner says that will be examined by french police. as for the flaperon french experts began examining on wednesday. they are using high powered micro scopes to find forensics on it. >> the mystery has deepened. let's bring in an aviation attorney who represents families of those on board malaysian airlines flight 370. he has been involved from the beginning and knows everything from the inside out on all of this. they found this flaperon. it's made of carbon products -- >> composites. >> composites which float very easily. >> right. >> it seas has sealed

compartments in it. if anything is going to float, it's go to float. >> right. >> you use this flaperon to either during takeoff, create lift or during landing to create drag. i'm guessing was this deployed? k we look at it and say is it more likely it was deployed or not deployed. >> the likelihood from what we know right now is that the flaperon was not deployed. how do we know that the front ends the rounter ends not the back side -- >> let us put it on the screen please. >> the front side of it has no significant deformation, which means it was protected whenever the plane ultimately came to rest. what you do not know is how the flaperon came off, what caused it to separate from the airplane. it cough separated on impact. it could have separated as a result of an overload meaning that the plane was at high rate of speed coming down so that its structural capacity was exceeded

by the forces exerted on the wing and it comes off. those are the basic essentials. now, when they go and look at this wing they are going to be looking at the signature of the ragged edge at the back what does that tell them under a microscope. that they are going to be looking at the inside of the wing where it attached to the portion adjacent to it and look for striations f. there is a lot of striations it suggests fluttering and wiggling and waggling which is a signature of a fatigue fracture. or if it simply breaks off, it's going to tell you it was overload. when they get the answers to that you will have answers to probably what happened in the last few seconds of the flight. but it doesn't go back further than that. >> but that point is important because we are left with this question did somebody try to take that plane down as slowly as possible, as easy as possible as not to cause break up to the degree that's

possible? or did the plane run out of fuel with nobody in charge and just crash into the ocean? the signs would be different under those two scenarios. >> correct. the signature of failure will get you closer to an answer to your very good question why did it come off? was somebody trying to save the plane by a -- >> or the people in it. like maybe we can get on life rafts and float and maybe they will find us. >> sure. all true. all true. somebody trying to bring it into a smooth landing on the surface or was that opportunity taken away because the nose of the plane was heading straight down in a bullet-like cash with therash with the surface of the waters. >> we know at about quarter past 10:00 in morning about 11 or 12 minutes before they said good night, somebody changed the course this flight. we don't know who did it. we don't know why they did it. no clue right? >> somebody did more than that. you had three course changes after the plane took off from

kuala lumpur. you had the first one, which was basically a u-turn. >> u-turn. >> and then you had a right turn and then you had a left turn separated by significant periods of time when the airplane was moving in a straight path. that suggests -- suggests that somebody was doing something to the airplane. was it nefarious? was it the pilot? had the airplane also been compromised in some fashion, the controllability, we don't know that. but after that, you now have the plane headed down to the indian ocean, and then lost. in fact that's the last thing you know. what you do find out, however, is if you take the gyres and work backwards from reunion through the gyres to the place where they started to look in the south indian ocean off the coast of australia, you begin to get a picture that somewhere between the last change of course of the airplane and when it is presumed to have hit the

water, it may have been in control at some point and lost control thereafter. but the mystery of what happened to this plane has not really been solved by this little piece. nor the answers to the questions that you are going to get from the examination. >> you know what i hope -- i hope -- well to me, the idiot who doesn't know anything about this stuff, i'm thinking if they deployed that flap that wouldn't be found unless they deployed it so somebody tried to set it downtown down. since we found this thing, that means it was deployed that means that somebody was doing something at the time, which tells us a lot. but apparently that's not the case. >> that situation may bear out. >> but from the looks of this piece, it looked as if it was tucked. >> if it was tucked then you might have had a straight-in landing almost like the sullyberg on the hudson river.

who knows? >> we have got to find that plane. >> you need the plane, the black box, and wise questions being asked and the wise questions being answered. >> mark muller appreciate it. >> pleasure helping you. >> we are ending this discussion early because there is breaking news on fox news channel and disturbing reports coming right this minute from nashville, tennessee of a shooter near a movie theater in nashville. according to a reporting from fox 17 in nashville, wztv. it reports s.w.a.t. teams are on the scene at the car mike theater. details are sketchy because this has just happened. or senior correspondent mike leventhal gathering information. >> reporter: police sporchded to a call of a gunman outside a movie theater in nashville. the call came in at 1:13 p.m. local time. three paramedic units are on the way to the scene in a suburb of antioch. witnesses say they saw one

person covered by blood. a nearby hockey rink was locked down. this card at the car mike hick re8 theaters on bell road a. s.w.a.t. team has been dispatched to the scene. no word on the number of injuries or if there are any injuries comment for this one report from a local television station. we are trying to gather information at this time. >> we have gotten a tweet from police in nashville. where is the mic? we have just gotten information from police in tennessee. what was the tweet? >> the suspect is dead. >> this is from city of nashville, police. >> yeah met row nashville p.d. suspect dead. >> from metro pd. >> here's what we can tell you, during the part where rick leventhal was speaking. we got word this was an active shooter situation and that the s.w.a.t. team had arrived at this movie theater. this is the picture of it.

this is a google picture of course not a picture that comes from recently. we can tell you that the authorities have informed us while rick was speaking that was an active shooter situation. then seconds later police confirmed the shooter is dead. did the police shoot him or her? did he or she commit suicide? about these matters we don't have information. but rick leventhal is with us again. do we know whether this person had made his or her way into the building? >> that's not clear. what i can tell you is according to a local assignment editor at a local television station in nashville, the suspect is down after tear gas and multiple shots fired. apparently some of those shots fired by the metro police who did respond -- the police department did respond to this active shooter situation at that movie theater in the suburb of antioch. over 40 police units were dispatched to the scene. s.w.a.t. team on scene as well. again, we are now hearing that the shooter has been neutralized

after gunshots were fired, apparently in this movie theater. >> so rick what you are saying is there was tear gas and gunshots inside the theater? >> well it's unclear if the tear gas and multiple shots were inside or outside. they had a report of a person with a gun inside of the movie theaters. what isn't clear is where this apparent shootout took place. >> reading from the nashville tennesseean, now, the newspaper based there in nashville, metro police tweeted that the suspect involved in the active shooting situation at the antioch theater is dead. continuing to quote, the dispatcher said the shooting was reported at 1:13 p.m. that's central time at the theater at 901 bell road which is the car mike hick reeight theater according to the address records there. then at about 1:50 p.m. police scanner traffic indicated it was an active shooter situation. about 2:00 central time police

scanner traffic indicated the suspect may have left a backpack inside the theater. that has to be checked by police. extra police patrols have been assigned to the bellevue eight movie theater. gerald ford who works at the ice center nearby said the business was on lock down and no one was allowed to leave in or out. he said there were about 25 people there at the time. quoting now, we are waiting on instructions from police we have not been contacted yet, he said quoting again, we had a parent come in and they were just kind of told us there was a bunch of cops posted outside. enquote. a s.w.a.t. team was on scene, according to scanner traffic. again, all of that from the nashville tennesseean newspaper. tom daily says he heard the shots and works nearby. tom are you with us? name' here. >> what happened? >> we were trying to promote our market we had police officers come in and tell us to lock the doors and close everything. after that we heard numerous

gunshots close to 20 maybe 30 gunshots. the rest is history. the cops are telling us they may have tagged the guy that was involved in the shooting. >> where do you work? we work at sprint where we cut your bill in half. >> that's an interesting advertisement in the middle of a shooting at a movie theater. >> i'm just so used to saying it. >> like i was saying there were numerous cops from undercover to s.w.a.t. and they were all, you know toting blocks and ars and all types heavy machinery. we were wondering what was going on. five minutes later just random gunshots going on bang bang bang bang bang. we are kind of struck like deer caught in the headlineslights, like what is going on. >> could you describe this guy? >> i cannot describe the guy. i did not see him. we are right next door to the movie theater. >> the movie looks like it is a

stand alone building. are you in that same building -- >> the same plaza. they cut off our whole plaza. >> okay. so you could hear the gunfire, and it sounded like a suspects and police both firing? >> yes, sir, that's what he did sound like. like i said after those 25 or 30 shots went off, there were no more shots. so i figured that was the ends of that. i guess they are trying to clean up the area and make sure everybody is going back inside their buildings. honestly there is not a business right now that does not have a customer looking out spectating right now. >> we are getting reports of -- from local television stations of tear gas being fired. did you see any of that? >> i definitely smelled the tear gas because it kinds of traveled over to where our building is. like i said we are kind of right next door to them. so the tear gas definitely came over and we were getting the aftermath of that tear gas. >> we have our first pictures up on the scene as viewers will see now. these are clearly from a smart phone because they shot it

theater. the s.w.a.t. team responded. the s.w.a.t. team engaged this gunman some minutes later. there was gunfire and the gunman is deceased just inside the movie theater. so we believe the imminent threat has been ended. however, the gunman had two backpack-type bags with him. one on him. another that was left. we want to make sure that there is no danger with those pack backs. so officers are working now from hazardous devices to clear those backpacks. that's all i can give you at the moment. we'll have more later. that's the quick summary of an active situation that's still going on with the clearing of these backpacks. >> could you repeat the projector room part. >> the projector room part was mad max in this movie theater. >> there you go. that's a stunning development and another in a series over the

last few minutes. nashville, tennessee, a suburb antioch, police respond and according to the spokesperson who was just there, a police officer, a metro nashville police goes into the projector room leaves that room and as i remember what he said a gunman inside the theater fires upon him. he returns fire. shortly thereafter he encountered s.w.a.t. team. a s.w.a.t. team shoots at him, the gunman is now dead inside this movie theater where mat max was showing. what we don't know is motive. what we do know according to authorities that there were two backpacks involved here. one on him and a separate one. and they are trying to find out the details with those two things. these are live pictures now coming to us from wtvf television our network news affiliate, and i believe the sister station to our fox station. but i'm not 100% on. that we have been speaking with brittany from the sprint store, next door. now that we have a different view you can kind of see what we

are talking about. brittany was having a moment at 9:00 central time this morning, right brittany? >> yes, 9:00 a.m. >> somebody tried to get in the back door like a service entrance. >> it runs behind the sprint store as well as the theater. the thing beeped like the door was opened. then it shut. when it shut it locked. when he had open the door we had pulled it to. he sat outside in the grass with his backpack for a good hour maybe longer he sat right here by our back door. and i think now his backpacks are still in the theater. >> you are sure this is the same guy? if so how? >> simply because we watch a lot around here. when we came to work this morning he was signature outside behind us and the theater. he had two backpacks and he sat there for a while. and once i think we went out this back door he was gone and

how many people were inside the theater? did you see anybody running out of the theater? >> tone police. only the police officers is the only one i see coming out and shooting. and we was covered. >> i hear they used tear gas in this operation, there were multiple shots fired. would you come here sir? he doesn't want to be on tv but somebody who works nearby says he was locked down while he saw the s.w.a.t. team running around. to recap, about 1:15 police say an active shooter came into the hickory hollows cinemas. apparently he had some kind of action with him and hacked his way in is what i'm hearing. the only person injured in this shooting is somebody who has an action injury. however, we are hearing that the suspect was shot and is now dead. >> let's go back to brittany who works next door. brittany did you ever see an ax of any kind? >> i didn't. actually just now the police officers told us that you know,

at the sprint store next door. brittany hang on. our producers need to talk to you. i want to get back to the matter at hand. the number of incidents at movie theaters. it was disturbing from the beginning and more disturbing by the day. but to think what went down today, it sounds as if what we have is a couple of different events the knock at the back door this attempt to get in at the sprint store, a guy waits around outside. finally there is a showing of mad max at the theater. the police are called. i skipped the part about whether he had fired or something, but for some reason the police were called. according to the police themselves a cop goes into the projector room comes out and encounter at some point this gunman inside the theater. the gunman fires at the cop and the cop returns fire. shortly thereafter s.w.a.t. team encounters this gunman. s.w.a.t. team fires at him and as the police put it they took him down. along the way there was one

injury somebody with an ax injury. because apparently according to the theaters this man had an ax and got into the back door of that theater with that ax. that's what led to all of this? who was he? well brittany next door describes him as a guy in his maybe young 30s with sandy brown hair a backpack one of which was green. he had another one. authorities say he had one of those backpacks on him and he left another elsewhere. one would think according to the authorities they are working to see if there is anything in those backpacks that might cause injury to others. an incredible scene there. do we have local coverage to listen in to? >> our two local stations are still working on this. rick leventhal, you can't put this to a pattern. it's mighty early for that but what a scene. >> it's an unusual scene, an unusual set of circumstances but this person's goal was to kill people. he certainly had opportunities to do that. we know he had a gun in addition to that hatchet or ax that police describe. and apparently he did wound at

least one person with that ax when he went inside the movie theater. but we know he was armed with gun because when police responded, he fired at the officer and the officer returned fire. and then of course the s.w.a.t. team arrived and they killed the guy. but he had a gun. there were people inside that movie theater presumably watching mad max and other films. there is eight theaters there. he has a gun, a hatchet, he wounds one person and apparently was waiting for the cops to arrive. so you have to wonder if this was a suicide by cop situation or whether he really did intend to harm or kill large numbers of people because he certainly apparently had opportunities to do that and chose not to. >> from soeshltsed press now, police say the suspect in that shooting was armed with a hatchet and a gun, one gun, before being shot by an officer. we now know a s.w.a.t. officer. the spokesperson there was a man named dan aaron from metro nashville police. and he said that one person suffered that hatchet wound and he didn't really have any other

details. he said an officer came into the theater and was fired upon by the suspect. >> right. >> it sounds very much like this guy was waiting for police to get there, just like you say, rick. >> yeah. and now what we have to do is wait and find out whether he was posting things on social media, whether he has a history of mental illness, whether he had a vendetta against police, whether he had a desire to die. and right now, the police are trying to determine what are in those two backpacks that he left behind. and they will likely send in some sort of robot to check out the packages and prod them. it will be armed with a camera so they can see what they are looking at. then if they can determine it's not going to blow up i guess they would send in the bomb squad to try to get a closer look at the ims the. this is going to be a long drawn out scene before they safely determine what this gunman left behind. >> more details coming in. remember the spokesperson don aaron said the first officer

from metro nashville police had gone into the projector room. and when he came out, the suspect fired at him. then according to new reports and everything we are piling together here this police officer for metro nashville fired at the suspect, did not make contact with the suspect, and backed off. because you have got to figure at that point he knew there. well moments later, s.w.a.t. team came into this theater. and s.w.a.t. team encountered this suspect, and s.w.a.t. team took down this suspect. reading it from the "associated press," aaron says an officer came into the theater, was fired upon by the suspect. the officer shot back then backed off. and after that a s.w.a.t. team came in and there was another exchange of gunfire. the suspect was then found dead. motive? we have no idea. details of this person? we don't know. but we know this was the car mike hick tree eight theater in antioch, which is a nashville suburb. we know there is one person

for those familiar that's where this happened in antioch. and this afternoon, around 10:00, a showing of mad max at a theater, a guy who had apparently been hanging around this area since 9:00 in the morning went in with two backpack backpacks, a hatchet and a gun. and when a police officer arrived, showed up into the projector room there. when he left that projector room he encountered this gunman. the gunman fired at him and he returned fire as the police tell the story. moments later the gunman encountered the s.w.a.t. team. the s.w.a.t. team shoots and kills him. we have gotten word from the vendor built level one trauma cent they have received no patients nor do they expect any. we don't believe the person injured by the hatch elt or the ax had a life threatening injury.

morning. what we don't yet know is what was he doing? rick leventhal, do we have anything on these backpacks or what they are doing? >> they need to determine if there were explosives inside. he could have been carrying extra ammo. we have no ideas what's in them. we don't know where they are at in their investigation of those backpacks. but ever since that shooting in a aurora movie theater three years ago there have been a lot of discussions about beefing up security at movie theaters. by one estimation it would cost $250,000 to $1 million a year for each theater to install significant security because of the fact you have to put in metal detectors. hire and train people to operate the metal detectors. you need security guards. it would be a daunting task for many of these smaller movie theaters. but at this point, most theaters don't have any kind of real

security beyond a guy taking your ticket when you walk through the door. and there is a lot of discussion about whether or not that needs to change. the theater owners association -- >> neither does the mall. neither does the mcdonald's. neither does the kmili's. neither goss the gym where you work out. neither does the bathroom where you go. do we want security every place we walk the rest of our lives. >> i don't know how much you time you spent in israel. >> enough time the know i don't want that. >> well unfortunately, the way of life in israel is they have metal detectors at the mall entrance. security guards at nearly every restaurant including mcdonald's. those are armed security guards that work the doors there. the fact is we don't have them here and we have seen unfortunately a number of these kinds of shootings inside movie theaters and other places of business. so what we have now is a guy who apparent went into this movie theater with a hatch skpet a handgun. apparently wounded one person with hatchet. waited for police to arrive. shot at that police officer. the officer returned fires,

retreats, the s.w.a.t. team moves in and kills the guy. we don't know why he did it. we don't know whether his intention was to kill others. he had an opportunity but he didn't do it. >> the time for the discussion of whether we need that is certainly not right now and i'm not the one to have it. but i can tell you this israel has 8 million people. new york city has more than that. you want to put security at every place every american goes every moment for the rest of your life -- how to bankrupt the country. that's one way to do that. what we know is that now the local abc station is reporting a couple of people were injured. but we are told nobody was shot. in fact, trace gallagher in the mix now. trace, from everything we are hearing, this gunman did not go off firing any shots. we have zero reports of him firing shots before police got there. we have neighbors at the sprint store saying at 9:00 knock, knock, trying to get in the back door. 10:00, still out there in the back door. by 1:00 it sounds like he worked

his way into the back of the theater using this hatchet. eventually the cop arrived. and it was going on 15 or 20 minutes. it wasn't -- at least from the reports we have right now it wasn't until the first police officer arrived there was any shooting as far as we know trace. >> yeah no shots fired. here's the key thing, you and rick were talking about the back packs. we don't know exact me what was inside. but you want to talk about fascinating common denominators. going back two weeks to the shooting in lafayette, louisiana, and that gunman also brought in a backpack. there were no explosives inside. we open the know what's in these backpacks here. in the aurora shooting james holmes they copied hit car and fine backpacks inside there. both james holmes and the shooter in lafayette were both trying to get away. they had getaway plans. there were costumes.

hotel rooms, the guy who shot up the movie theater. the holmes had an elaborate plan to get away. the thing here the police whether look at what exactly was inside those backpacks, was he planning to go inside with more explosives more guns or was this another plan for another theater shooter to have some kind of plan to get away once he did with a he apparently was planning to do inside. >> don in lafayette, it sounds like the guy was doing shooting before the police showed. here from the reporting we have so far he waited for the police to come, and the only confirmed reporting that he ever shot at were police. >> this one appears to be different because it appears to be some random guy from the sprint people telling you this guy was out in the parking lot several hours, random guy wandering around and wandering into the movie theater. the other two movie theater shootings seemed plan.

james holmes entered the door and shot up the movie theater. the other shooter in lafayette was in the back of the theater and when the movie started 20 minutes in he started from the back of the theater shooting down. we have three different scenarios. the only common denominator is the backpacks being brought to the scene and why. you talk about security. maybe movie theaters need to look at backpacks being brought in and out of theaters. >> maybe they do. maybe every place we go. maybe they ought to search us every place we now. for now let's just report on what happened. on may 15th this screened out of competition on the 68th cannes film festival. this movie has been out, seems to me like six weeks. it is not a place where you expect to have a lot of people. if your thought is i'm going to shoot up a movie theater full of people. why do you go to the sprint store at 9:00 and b wait for the

gas or pepper spray, you know you might have been accidentally wrong about. but the national spokesperson brian haus there says three people were exposed to pepper spray. you know it would burn your eyes but it is not going to hurt you bad he loochl one of those who was exposed to the pepper spray also hurt superficially as he put it by what he believed to be the hatchet. but we can't be for sure. but the cops tell us it was the hatch elt that allowed the man entrance into the back locked door of the theater. you talk about searching bags all you want, if you can break a locked door where there is no one to do the searching you have a whole different is it set of situations. the man had a gun but there are no indications he fired at anyone except police. no indication. in fact he fired at the one police officer who had just left the projector room. according to the authorities, that police officer returned fire didn't hit anything, and backed off. then a member of the s.w.a.t. team which came in separately from this other police officer,

encounters him, shoots him, and he's dead. people that work at the sprint store next door tell us she believed just from looking at the guy at the back door at 9:00 in the morning may have been in his early 30s, had what she described as sandy brown hair. one of backpacks was an army green color as she put it of the. she didn't get the color of the other one. authorities tell us one of the backpacks was on the suspect and the other backpack was left on the scene there inside the theater. but we have not heard one person in any way that this gunman ever fired at anybody. is it possible -- we have every reason to believe that this began at the back door of the sprint store at 9:00. it was four hours later before the rest of this happened. we know from the sprint store employee that the guy seemed to be just sort of hanging around in the back at least an hour. whether he stayed there the entire time or not, he came back. and he didn't go in there shooting everything up, unless

we've been misinformed thus far. he want in there and waited for police. when a police officer arrived it was then and only then that shots were fired. and it was then shortly after that a s.w.a.t. team member took him out and killed him. might there be information about what was he was doing there in the first place in the backpack? sure, might be. have they figured out who he is? probably. but they haven't come forward. although we have every reason to believe because they have been so forthcoming with information in the early going they will do so when they have information coming up. no reason to believe there is any danger to people in the area or beyond at this moment. they are wondering about these backpacks, certainly, but the trauma center at vanderbilt logical medical center tells us they have not received anybody nor do they expect to receive anybody. the local fire department spokesperson telts us three people were treated for pepper spray, one superficial wound to the shoulder. he didn't treat the suspect because the suspect is dead

six minutes before 3:00 in nashville where the details of today's shooting of a suspect at a movie theater are coming together. and as the details come together what this does not sound like is a movie theater shooting. because a man with a backpack or two of them actually shows up at a sprint store at the back door at 9:00 in the morning. according to the employees, an hour later he's still there, that's 10:00 a.m. 1:00 there's a movie going on mad max at the movie theater

which is in the same parking lot next door. fbi's nashville field office confirms its responded there. it also confirms it has responded to the scene. atf on scene. a law enforcement force say investigators are running down possible motives for the attack. the investigation is fluid. here's what we know he didn't shoot anybody or pull out a hatchet at the print store in the morning. by 1:00 in the afternoon he's inside the movie theater. the initial report according to news channel 5, a reporter on scene there is saying that the report is he pulled out a hatchet and then he pulled out a gun. no reports that he did any firing. then police arrived. and when police arrived. a police officer goes in according to the authorities, goes in to the projection room leaves the projection room encountered the suspect, the suspect fires at the officer. from all we know that's the first time that anyone did any firing. the suspect fired at a police officer.

at the reporting of the police go the police fired back but the officer was there at the moment by himself or herself and backed off. swat team encountered the guy, swat team fired at him and killed him. nothing to indicate that he fired at anybody in the theater. reports are people had come running out of the theater because the man who was in the theater showed up with a hatchet and a gun. the firing didn't happen until the police got there. was this guy wanting to take on police? was this about police? was he going wherever he could to take on police? was he some sort of crazy guy who happened to have a hatch and a gun? what was his motive? authorities are working to take out those backpacks to make sure that they don't have anything in them that could hurt anybody. they're working on a robot to get in there and do that.
