an american. why was he here? why wasn't he deported? and what happens now. >> hello and welcome to "justice," i'm judge jeanine pirro, thank you for joining us. it was the highest watched debate of all time, we have a stellar lineup to break it all down. but first, some of those gop candidates are back on the campaign trail and speaking out at the annual redstate gathering. take a look at some of the highlights. >> if you're looking at somebody who is running for president of the united states you need to wonder will they really do what they say they're going to do? well, let me tell you this. if i can do it in a state with 750,000 more republicans in a

democratic legislature, i am battle-tested for washington, d.c., everybody, and i'm ready to bring the fight there. >> i tell people it's going to be a show me, don't tell me election. i mean, we have had six and a half years of a pretty good talker. a young inexperienced united states senator that has gotten america in the ditch now. >> now, i know you're not supposed to say this but i'm going to say it anyway. folks who want to come to america should come legally. should learn english, should adopt our values and roll up their sleeves and get to work when they get here. >> i will go into the oval office regularly once a week for example on a weekly radio address and i will say to you fellow citizens, please take out your smartphones. i would like to ask you a couple of questions, question number one do you think it's important that we know where your money is being spent? press one for yes, two for no.

>> america doesn't owe me anything. but i have a debt to america i will never repay. you see this is not just the country i was born in. this is the country that literally changed the history of my family. >> if somebody wants to argue about my conservative credentials, you put my record against the headwinds i fought against the clinton machine. i'm here to tell you today i fought it, and beat it. most importantly i lived to tell about it. >> they're not even having the debate. maybe 2017, we'll schedule the democratic primary debate. actually they did plan to have a debate earlier. problem was the invitation was e-mailed to hillary clinton. >> people are struggling today. we can't tell them how bad it is over and over again. we have to give them a sense that if you let us come in and work as a team and solve problems that your spirits could be lifted up because your life will get better. >> last year alone, six of the top ten most wealthy counties in

america, you know where they are? in and around washington, d.c., for the rest of the country, we understand people create jobs not the government. we need to help people in towns and villages all across this country. >> the first republican primary debate of the 2016 presidential race. certainly it has had a lot of fireworks. and it also has some candidates who really stood out. among the pack, many say marco rubio was one of those candidates. take a look. >> if i'm our nominee how is hillary clinton going to lecture me about living paycheck to paycheck. i was raised paycheck to paycheck. how is she going to lecture me about student loans? i owed over $100,000 just four years ago. if i'm our nominee we will be the party of the future. >> with me now, democratic strategist fowler and lisa booth. all right, good evening to both of you.

marco rubio, lisa, i'll start with you first, what is your take? >> well, i think marco rubio had an excellent debate, you know he came into the debate prepared. he hit all the right notes from the economy to immigration, as well. so he definitely came prepared. one of the highlights you just showed, and one of the attributes, he talked about income inequality, and it is something that resonates with voters. >> i think marco rubio had a pretty good one-liners. i think the headlines have been trump, trump, trump and more trump, judge. >> well, you know what? it is about attention, no question about that. another big moment was when john kasich talked about same-sex marriage. take a look at this, guys. >> if you had a son or daughter who was gay or lesbian, how would you explain to them your

opposition to same-sex marriage? >> well, look, i'm an old fashioned person here, and i happen to believe in traditional marriage, but i also have said the court has ruled -- megyn, the court has ruled. and i said we'll accept it. and guess what? i just went to a wedding of a friend of mine who happens to be gay. because somebody doesn't think the way i do doesn't mean i can't care about them or can't love them. so if one of my daughters happened to be that, of course i would love them and accept them. >> all right, lisa, that works really well in a general election. not so well in a primary election. primary nomination. >> well, you know, potentially that could get him into trouble. but look, he did state he is for traditional marriage. so i don't necessarily know if it's a bad thing to say look, even as somebody who does believe in traditional marriage you can still love other people even if you don't agree with them. richard, what is your take on

that? >> well, i think john kasich was sort of a standout from the debate, he was from a battleground state from ohio, they have to win there, he is a reasonable guy. out of everybody on the guy he is the most able to govern. so i think he had a stellar performance last night and that line was just one of them. >> guys, who needs to make a big splash between now and the next debate to either get out from those who didn't make the top ten to get into it or to get higher within the top ten. lisa? >> well, i think it would be carly fiorina. look, she definitely was the highlight of the night. not only did she own the 5:00 hour -- >> but could she make a big splash in the next debate? >> she absolutely could, she wants to be in the top ten of the debate and was not able to do that. she needs to be able to take this moment and take it into fundraising, turn it into her

being able to build the campaign structure she needs to be able to go the distance. >> richard, it seems like maybe given the kudos that she has gotten from everybody across the board. if there is a question as lisa said about her campaign structu structure or organization, how come they were not able to pivot on that? >> i think she was the stellar knockout, at the end of the day she shows she is not only viable, but donors should go to her because she is a possible contender here. so google sort of said she was trending after that debate, that shows that donors are going to be rushing to carly especially after the performance. the shining stars, i think the person who has to do the most improvement is jeb bush. if he were to go in as the sort of, i am the party choice he has to do a lot of work.

he was off the last couple of days. >> who will make the biggest splash, give me a name. >> i really do think it's carly fiorina. >> lisa, lisa, she has made a splash. let's talk about the ten, then, within the ten who needs to make a bigger splash to move up within the ten? >> you know, maybe rand paul is in a lot of trouble, to be honest. i think he had a poor debate performance. look, he is sort of hanging there towards the bottom of the ten. so he needs to stay viable and in the debate and be on the stage in september. so -- >> what do you say, richard? >> well, here is the thing, rand was going into this to appeal to his base, that is exactly what he did. christie, what you saw is rand doubling down in his position. that is key, you want to turn out record numbers. libertarians are not being

polled here, lisa, you know that. >> well, they are -- if he wants -- >> who register and will become part of the system because they want to see rand paul be the nominee. so i think he had a great performance, who had a horrible performance was jeb bush. >> all right, being able -- >> what do you want to hear from the candidates in the next debate that you didn't hear about in this debate? >> i would like -- to see them go after hillary clinton more. i would like to see them go after hillary clinton more. the problem is they think that hillary clinton continues to get a free pass from the media. and mind you, there is a criminal probe from the fbi into her e-mail server so we're not hearing about that in the e-mail. so what i would like to see is the republican candidates put that in the forefront, go after hillary clinton, knock her on her record. she is a horrible secretary of state. and go after hillary clinton. >> bad idea. here is the thing, i think if republicans want to win this presidential race they have to talk about two things.

one is how we deal with veterans coming home from iraq and afghanistan, and two, the economy. lay the focus on the economy and how the vets do after they come back home from being in war the past ten years. we didn't talk about that in this debate and i hope we do it in the next one. >> sorry, running out of time, thank you so much. >> thank you, judge. >> all right, and one of the most heated exchanges of the night was chris christie and rand paul over those nsa phone records. take a look. >> that is a completely ridiculous answer, i want to collect more records from terrorists and less from other people, how are you supposed to know this? i tell you this, senator, had y of -- when you sit in a subcommittee, you can just blow hot air about this. what you need to do is make sure

it works the way it's supposed to work. >> here is the problem, governor, you fundamentally misunderstand the bill of rights. every time you did a case you got a warrant from a judge. i am talking about searches without warrants, indiscriminately, i don't trust president obama with our records. i know you gave him a big hug and if you want to give him a big hug again go right ahead. >> wow, all right, with me is adam goodman. look, you're a pro at this stuff. you worked for presidents, senators, congress, all kinds of candidates prepping them for these kinds of campaigns. with respect to what we just saw between christie and rand paul, are people into the entertainment at this point or were people really listening for substance there. did it help or hurt them? >> i think actually it helped a lot of people. first of all, judge, this made for great television. this is one of the most

spectacularly interesting public debates this country has ever seen. and i think actually fox news has now established a new standard that i think all the others will have to follow or they will look somewhat peaked in their approach to find out what is really going on. and what is going on in this particular race right now is you have three different campaigns. first is trump or no trump. and certainly donald drew a lot of viewers to the debate. the second is, he has nine republican governors who are running for president. and there is a real fight for who is going to be number one and the third is, is there an outsider? and i just listened to your previous cast, carly fiorina brought it. and no question -- >> in terms of rand paul and chris christie, you can't just -- you don't need a search

warrant for that. i mean, the fisa court you got a warrant for. but what rand paul is talking about, the collection for the meta data, you wouldn't get a warrant to search for that. but that is just me because i'm a lawyer. you have prepped people for this. how do you prep candidates for a ten-person debate as opposed to a two-person debate, what do you say to them? >> get prepared for just about anything that comes at you. judge if you saw that debate, you need to have a warmup in debates where the first couple of questions you get them comfortable, get their legs under them and they're ready to go after it. this is when the candidates came out on stage, the first question came out of left stage, and that set the tone. number two, be sure you are ready for the unexpected. deliver the message, what happened in this debate those ten candidates are trying to

introduce themselves. some all over again, to the american public. the next debate will be different. the next debate is there will be a higher level of expectation that the engagement is going to be more specific, more directed and probably at the day, more talent. >> what do you tell them or what are they thinking as on the stage? on the one hand they have to show they're smart and likeable. what is the one thing you want them to come across with? >> that they're real and genuine. if there is nothing else that people are looking for today it's that. which is one of the reasons that hillary clinton is having such a devil of a time trying to get her sea legs rather underneath her. because people want those who look them straight in the eye and tell them where they're coming from. that was the appeal of donald trump coming into this race, there may have been maybe too much eyeballing going on.

>> people want to know you're real, honest and truthful. but you know what i think is interesting. you know the 11th commandment that ronald reagan always talked about, you don't really hit someone else who is within the tent. already, i think they're just getting geared up. will we see more of that in the debate? >> judge, i like to say -- this is really more about donald trump than anybody. you are referring to of course, ronald reagan, speaking no ill of anyone. i think donald trump's assessment is speak ill of everyone. you know who the winner is in all of this? the american people, they're really getting a good look at what leadership sounds like and looks like and feeling like. >> and you know to a certain extent we have to thank the fact that so many people were driven to this debate. and they kind of bring us a

welcome back to "justice." a big blow for the obama administration this week as senator charles schumer came out against the iran deal. with me now to talk about that as well as some hillary clinton news this week is liberal talk show host. all right, good evening, cocoa -- >> hello, judge. >> how are you? >> i'm good, how are you? >> good, the obama administration, the iran nuclear deal, the top democrats, most recently chuck schumer came out against the deal. why do you think that? >> i don't think that this is a defeat for the deal, chuck schumer maybe he actually believes it is bad and

dangerous. but i also think he is pressured by a lot of jews and people in israel. i think it is a tremendous deal and tremendous opportunity and makes israel safer. >> okay, now, you're an american jew, and you believe that it makes this whole situation calmer, safer, why? >> i do. because we have a chance. we have a chance to not only inspect iran and iran's nuclear facilities, we also have a chance to inspect the rest of the country. we have a chance to engage iran. iran is a young educated country. and iran's young educated people would love to engage with the west but they can't because the hardliners are keeping them down. >> so iran wants to do a back and forth with us because they can't? maybe it's because of the

ayatollah, maybe this iran nuclear deal doesn't help the people of iran. if they want to work and communicate with us, they can. >> if it opens iran to the rest of our world -- >> that's not our job, is it? >> of course it's our job, what else will we do? look, our choices are bombing or war or continuing on this feckless path we have been on for years or we do a deal with iran and make peace. and this is our chance. >> all right, coco, if we don't do the deal with them, they're going to kill us anyway. >> i don't think they're going to kill us. i think we're going to get bo e bogged down in a long war -- >> let me ask you this, four hostages, american hostages in iran, they're not included in the deal. there are no requirements. yet they're getting $150 billion

of our taxpayers' money. they chant death to america. and the president says oh, that is just the hardliners. whether or not, the ayatollah khomeini is -- >> the deal, the point of the deal is to stop them from continuing to enrich uranium and getting into plutonium -- >> they can keep it now, it's impervious to attack, we can't even look at them until at least 24 day's notice. >> no, that is not right. >> tell me where i'm wrong. >> first of all they disclosed that site to us now. and we get to inspect it. we get 24 hours, seven days a

week, it's the rest of the country which we don't get to inspect short of notice. but we will have constant monitoring of that site. we have never seen the monitoring of a country's nuclear investigations like we have in this deal. that is what makes it a best chance to make peace. >> awwhat about the fact that ts guy, suleimon, he violated it already. i wouldn't give them a dime. did hillary clinton have a good week this week? >> she had a good week. >> why? >> because any week that donald trump wins the republican debate is a great week for hillary clinton. >> to be indicted -- >> nobody is talking about her

live from america's news quarters, northern california residents are heading home tonight as evacuation orders are lifted. cooler weather helping firefighters gain ground on a wildfire that has been burning since july 29th. officials say the so-called rocky fire is now 62% contained, the inferno burning acres in three counties. 3,000 firefighters are fighting the blaze. taiwan residents cleaning up from a typhoon leaving six people dead at least 100 injured. traffic lights and power lines are down right now.

at one point more than 3 million homes were without power. all domestic flights were cancelled as well as the number of international flights. the typhoon moved through quickly and now is pounding southeastern china. i'm jackie ibanez. now back to "justice" with judge jeanine. >> 2016 will be a fight between conservatism and a democrat party that is undermining the very character of this nation. we need a nominee that will throw every punch. not pull punches, and someone who cannot stumble before he even gets into the ring. >> one of the biggest story lines coming out of the 5:00 p.m. happy hour debate, carly fiorina. and one of the panelists here to break it down for me, will one

of them falter in the top ten? >> she gave the strongest performance of any candidate on any stage that day. she owned that 5:00 debate, and i think everybody is rooting for her. >> okay, now, matt, you were in the audience that night. so can you tell us things that we may not have seen on television -- let's talk about this. when the audience goes crazy, whether it's positive or negative, how do you think that impacts the candidates? do they even hear it? does it affect their confidence? >> yeah, absolutely. i mean, you know, proba most noise of the night, i think we all recognize that republicans don't like rosie o'donnell. you could hear the candidates, making sure everything was going well. it was an interesting dynamic to be in the hall and watch it. >> you know when you say that, when i was debating and running for office i mean, you try to

make eye contact with you know, your campaign manager. it's almost like can you tell me how i'm doing? so you saw that same kind of thing in a presidential debate, huh? >> yeah, absolutely. and then the family members, it was a combination of them trying to put a smile on, look confident, but you know part of them were just ready to run to the rest room, upset to their stomach. it's quite an interesting personal dynamic to watch. >> okay, i'm sure it is. what can we expect from these candidates between now and the next debate? >> i think what you can expect from these candidates is that a sharper focus on how they're going to take on the obama agenda, really, this whole campaign, judge, is about a third obama term and all of these obama policies. hillary clinton has already told us she is going to rubber stamp and go further to the left. these republican candidates will only distinguish themselves to say how hard they're going to fight and what they stand for.

that is the next stage we'll go to. >> all right, you were there, matt, during the breaks when we couldn't see what was going on. the cameras were kind of off or we couldn't see it. what were the candidates like with each other? were they interacting, uncomfortable? >> in the beginning a lot of them were tight and a little nervous at the first break. it just seemed that way. they were more to themselves, but as the event went on there was a lot of laughter, a lot of kidding around, actually walked away on the stage to talk to folks. trump and governor bush talked and you know governor bush gave marco rubio a big hug. you could seen see three quarters of the way, trump moved to bush, and was starting to have warm feelings about this guy. so hopefully this will have a tonic effect on this race. >> what about the chris christie/rand paul, that was just shy of an out and out

dukeout on the stage. they were a ways from each other on the stage, right? >> yeah, they were like basically on opposite sides of the stage. each one had a strategy, the further out you were on the stage the worst you were doing in the polls. and i think they both came out saying i got to get into a fight with somebody, they did with each other. both of them were on the bubble. do they make that next main stage debate. >> all right, matt, thank you so much for being with us. >> thank you, judge. >> all right, illegal immigration, it was a big topic of the debate and has been throughout this campaign. and now another chase where an illegal criminal alien is charged in the brutal rape and death of an american. this time in santa maria, california. with me now, the sheriff from that office. thank you so much for joining me, sheriff. >> of course, judge, thank you.

>> all right, the police chief in santa maria says that his department arrested this guy six times in the past 15 months. and the way i figure it, he has violated parole twice already. what is this guy doing out at all? >> right, if he was an american citizen, right, he would be in jail. and yet he is an illegal from mexico. and this is happening all too often we're hearing about and who was the victim? an american citizen. this was a 64-year-old woman sleeping in her house. this guy with another criminal breaks into her house, rapes her, and kills her with a hammer. this is outrageous. these stories are replicated in other states as in my state. and another story, almost the same. an illegal who did a home invasion, raped her and kidnapped her for a week. and he is released by ice only

to go and murder a store clerk in my state. and ice says oh, there is a glitch in my system. >> here is one of the problems i have. if you were arrested six times within 16 months and then you violate more than twice, you lock their butt up. what is the district attorney and the police doing? you know what? i get the ice thing and the disaster and will go through it in a minute, about how lax the requirements are. what about our system? it doesn't say you have to go to jail for something an american goes to jail for, does it? >> they share responsibility. you as a judge, in this case, santa maria, the judge released him to this victor martinez to go to rehab. this is outrageous. >> yet we're paying for that rehab. >> i know, there should be no rehab. there should be no you're released and we'll monitor you.

if you're a criminal illegal. bottom line, take these people, not only identify them, ship them out of the united states never to return again. never allowed back in our country. >> of course not. in and out, l now, let me ask you about homeland security. the new issue says that policies for apprehension. they say that priority one is a threat to public safety. well, apparently this guy didn't fit into priority one. priority two is the second highest priority for those aliens convicted of three or more misdemeanor offenses. this guy is convicted of four the way i figure it. >> exactly. >> so even under the ice defi guidelines that jay johnson delivered, which i think are shameless -- >> the owner law when it comes to immigration, last year alone,

you for joining us. you have a new book out, american wife. >> so american wife is really the story of my life and chronicles the time of chris' service but has e-mails from chris and the life from my perspective. and then it takes you through the murder and trials and tribulations after. but people will think it's doom and gloom. but it's not. >> your story is not about doom and gloom. and your story made everyone feel great about being an american. we looked up to you as this woman who went through hell, literally. and then when he came home you went through hell again. but good, i'm glad there is a little humor in your life, you look great. >> thank you. >> but you continue to fight for chris and the foundation and the american military. >> right, the american military and our first responders in this country, i believe we really need to take care of them. and that is something that chris taught me. and especially the first

responders, i think they're overlooked a lot. and they make the media for any little thing that people can pick apart. but we don't focus on is the sacrifice they make. the divorce rate is exceptionally high for these people. that is sad, they start out trying to fight evil in the world and then they are torn apart. >> what about what you read, you hear and read the news every day. you hear about the isis fighters, you know, driving their weapons. the iraqi fighters dropping their weapons. isis now is driving our tanks. and then you hear that you know, american soldiers if they had their way would just go over there and clean it up. >> what was frustrating for you and as you can remember with chris in terms of the government and the rules of engagement? >> well, i think there is certainly room for rules of engagement, right? we want our soldiers to have

high standards and do the right thing. at the same time you don't send somebody into a fight and then tie their hands behind their back when they're fighting the types of fighting they're doing. the terrorists are putting women and children at risk. they're fighting in a way that you can't fight pristinely and always above the fray. it just doesn't work that way. >> that is not what war is. what would you do? what would chris do? it has been years and years, he went four tours, right? >> right, right. >> all right, would you continue to do that -- >> i think every military person says take the gloves off. if i was going to throw you in a boxing ring and tie your hands is that right? no, absolutely right, take the gloves off and let them do their business. if these people could be talked to and reasoned with. if they wanted a solution or resolution, fine, but they don't. they want to terrorize, so there is really nothing you can do but to eradicate it.

>> i want before the segment is over, tell us about norman, who is he? >> norman is my fabulous friend, my golden retriever? >> he is sitting here -- >> he is the best dog ever. >> i got him from southeastern guide dogs, they have a paws for patriot. one of the friends i talked to says it is a game changer. >> for you, too? >> how? >> 100%, i know that american wife and american sniper, they help people not feel so alone because they realize their experience is shared. and you know, i can feel my heart rate going up just talking about it because it's hard to explain. it makes me feel a little bit embarrassed or weak in some ways but at the same time i'm not alone. and when i was with chris, everything reminds me of chris. everything i do i'm thinking about chris. and in some ways i take the focus off this anxiety and in
