you say there is a time it could end. >> the laws of political gravity don't apply to donald trump. however, where his campaign will be tested is when it comes to the iowa caucus and natural primary. the iowa caucus takes a lot of campaign infrastructure and organization. that's when voters really have to be put to the test as well. there is really no consequence at this point of registering in the polls. we have seen him continue his support. supporters -- >> increasing his support. on the heels of some very controversial comments he's increasing in iowa and doing well in new hampshire. hang in there for a second. david, trump gets hammered in the media and his poll numbers rise. he says things people say he shouldn't say and his poll numbers go higher. congress has a 10% approval rating. it's not rocket science to say i'm not one of them so i have

things up republicans when they start to think about electability, given the choices they have, whether it's ted cruz or jeb bush or ben carson, carly fiorina and 15 other candidates, they will pick somebody and it doesn't have to be him. >> can you touch on that for a second? look at the clear politics average. he's, what, four points above the next closest competitor? yet trump is toast. don voyage. that's it. he's finished. he's the energizer bunny. >> he's been able to say controversial things about every constituency possible. veterans, women, evangelicals, you name it. because there's been no consequence for him that's what fuels him and what fuels his supporters. they like that he's able to say these things without being driven out of the party. if these other candidates were talking the same way, using the same language and words they would be trifen out of politics for sure. what's important here though is

over the next several weeks keep an eye on other candidates. carly fiorina on the debate stage last week talked about how the political class failed you. she's tapping into the anxiety. john kasich mentioned that the republican electorate is frustrated with its own party. these are voters who are serious about the process. even if trump isn't. if they perceive him not to be they will choose another candidate. >> quick question before i move on. he invoked ronald reagan with sean hannity. we'll see that later tonight. not a bad idea. not a bad strategy. >> invoking reagan can't hurt. at a time when so many voters don't even remember when he was president and so many were too young to understand his presidency, number one i don't think it helps a republican to make a big deal out of reagan. as iconic and important of a president as he was. >> i think he was comparing ronald reagan who was not

necessarily always a republican. he went to the dark side for a while and came back. >> he was an fdr democrat. by 1964 he was supporting barry goldwater. more conservative than trump realizes. >> interesting name. back to you, kaitlyn. today we heard rick perry asked his staff that for the time being we are not going to pay you as a campaign. super pacs have to start paying you and they are okay with it. let me talk about trump. he's 9/11 going to have that problem. >> and what's interesting about trump being in the field and taking up a lot of oxygen from candidates, it's having an impact down the ballot. rick perry wu first to attack trump. thought he would get a lot of attention that way. he did. it wasn't translating in the polls. now the super pac is coming to take over. it's important because a lot of candidates will rely on super pacs to take them farther than they would have made it traditionally. remember, rick santorum and newt

gingrich had super pac money. they were able to last longer than originally thought. we'll see that magnified this cycle. >> david, donald trump, is he going to get sick of spending his own -- i'm not sure he spent that much money. without having to reach into his pocket. will he get tired of spending his own money? >> it fends on how committed he is to winning the nomination. the thing about wealthy people who earned a living is they don't waste money. if he's committed to this and not raising money and doing it on his own he has the deepest pockets out there and he can do it. there is something important to understand about trump. he has fame, name recognition. he has an ability. he has at least the opportunity to attract the kind of support other candidates can't if he uses it. >> i'm not sure. i'm not sure you will hear a husband saying, honey, i'm going to write donald trump a $500 check for the campaign.

janine tereli. are new york and baltimore next? frankly every time there is a race issue, are we going to repeat these issues? these activists coming in and creating violence and disrupting the community? >> well, i don't think it is violence per se. there is a situation in ferguson where there are a lot of problems. black lives matter is a legitimate political group that will be a major player in democratic politics. if they are going to keep the obama -- >> on the plus side or negative? they 'tis rupted bernie sanders, stopped him in his tracks. he had to leave the stage because they disrupted that. >> eric, look -- >> one more issue. martin o'malley had to come out and apologize for saying all lives matter. >> bernie sanders's rally was upset and protested, but he appointed some individuals regarding the issue of race.

he has been pushing economic in equality. he was not addressing black lives. as a result of the protest, he definitely has tone an about face and addressed the issue of racial inequality in thisry. >> last night sheriff clark was on the show and said this is nothing more than a return to the scene of the crime where the big lie hands up don't shoot started. >> sure. that was a big lie. it was disputed by the at the present time of justice investigation and the forensic evidence. black lives don't matter is a disruptive group. one of the demands is to arrest darren wilson it shall. >> black lives matter. >> excuse me. black lives matter. they are ignoring the root causes of the problems in black communities. poor quality schools, high unemployment. individuals who are seeking income elsewhere because they can't get a job. low job creation. these are issues affecting these

communities. when you have this environment of course there will be more crime. we have 13% of black americans and they are creating almost half of the homicide rates in the country. >> go ahead. >> eric, it's disingenuous for my colleague to mention ferguson and not mention the situation in the university of cincinnati, the situation in north charleston, carolina, the freddie gray case. she can point to ferguson and argue that case. what about the shootings where the prosecutor has charged police officer. black lives matter and there are cases where police used excessive force. >> can i ask you this? >> please. >> is the phrase white lives matter offensive to you? >> it's not offensive to me. but it te flekts the issue. there are african-americans that are dying, being shot in the streets on a higher level, higher percentage level than whites. what this group is doing is

telling every democratic candidate you have to address the issue. my colleague has not made any reference to cincinnati that happened last week or the north charleston shooting in which an african-american man was shot eight times in the back. how about a comment about that s? >> we see on the democratic side hillary clinton wants to talk about everything except this. bernie sanders, his rally got stopped in its tracks by black lives matter. are the democrats going to be hurt by the black lives matter movement? >> to address leo's point what about the black on black high crime rate, murder rate in chicago and elsewhere in urban communities? to answer your question, eric, listen. this will harm the democratic party, the election. because listen these individuals are disruptors, not looking at the problems. the root problems happening in these communities which are really a result of failed progressive policies. they had their own agenda. again, what they are looking at,

legally. what he's saying is important. donald trump is against illegal immigration. he wants to increase legal immigration. that's where the debate should be. >> monica, your thoughts on who has it that can take it up. i don't know why we are talking about if donald trump falters, but who else has a good immigration policy and who has a bad one? >> because the imfwramigration crisis is out of control and i want to blame both sides. we have had members of both parties let this get out of control, let the border be wide open for different reasons. republicans want the cheap labor. democrats want to build a permanent voting majority. there should be a moratorium on all immigration -- legal and illegal -- until we can get a handle on the situation. number two, you asked about specifics. i agree with ruben and donald trump. first in terms of enforcing the border which is the key is to build the wall. it's the only way to stop the incoming flow and get a grip on the problem. you have people like ted cruz

who put out a very substantial approach here. he's had numerous proposals over the years. last year he proposed legislation to stop obama's illegal amnesty. the house put up mirrored proposals tonight. the senate democrats killed it. he's out there talking about border security. he's talking about what ruben talked about in terms of legal immigration -- hold on. highly skilled visas. >> i want to get to all sides. the real issue will be front and center on the campaign, who has the policy that works with the 12 or 15, however million many illegals here now. jeb bush says they would love to bring them over. there should be a pass to amnesty for all illegals here currently, right? >> i don't say that. i have never said that. here's my point of view. i am the grandson of an imgrant that came here 30 years ago legally. i don't support amnesty. i support what john kasich

"the o'reilly factor," the number one cable news show for 15 years and counting. >> thanks for staying with us. in the "is it legal" segment tonight two controversial cases beginning with the rape and murder of 64-year-old marilyn pharis in her own home in santa maria, california, allegedly by an illegal immigrant. victor ramirez had at least six prior arrests and was on probation at the time of the attack. in may of 2014 i.c.e. asked the santa barbara sheriff's department to hold ramirez, but the sheriff apparently let him go. the police chief in nearby santa maria is slamming the sanctuary policies that let ramirez go. >> i think it starts in washington, d.c. with the administration that we see and their policies. i think you can draw a direct line to sacramento with the policies of i'm going to say this governor and the
