that is going to be termed out. >> exactly, so probably in her inner circle, somebody stripped off the top secret from the documents and sent it on her way. so that is a problem because judge napolitano says that is two felonies. it's altering a top secret document and it's placing top secret documents in unsafe places. >> that's right. worse off than that, is the fact it should have been classified top secret,/si, special intelligence and anyone who is not practicing under the procedures in order to keep our national security and keep americans safe would have faced punishment and at the very least would have had their account suspended. >> if you are going to play the card of i didn't know or it was mislabeled, no, you did know.

you did know what you could do and someone in there went with some white-out and changed it -- just in case we get found out, it didn't say top secret here. and by the way what we keep hearing, when i saw it it wasn't top secret. wow, we're already getting the cover story, perhaps. there's no worry in the hillary clinton camp. jennifer palmaery says you might hear some nus over the next few days about hillary clinton's emails. this kind of nonsense comes with the territory when you run for president. we know that. hillary knows that, and we expect it to continue from now until election day. the problem is this is no longer coming from one of the 16 candidates or from trey gowdy. they are standing back and watching the fbi taking over. >> she condition say it's a republican witch-hunt anymore when it's happening under the

justice department under president obama who is a democrat. look, she thought she was bigger than the law is what some people are saying. he said the elites don't trust her and the low information voters don't like her. we have been following the clinton scandals and they have been numerous here on fox news channels for years. the networks, abc, nbc and cbs are covering the story. it's a criminal investigation, potential felony. people could go to jail. they are covering it, in such a light way, we're talking about jail in some cases. they are describing it's a headache, a distraction, it's been a rough summer for her. could they make it any easier for her? you be the judge. >> this has been a tough summer for hirk, while she remains the frontrunner, this is a much

tougher. >> none of those republicans served as secretary of state or handled the kind of sensitive material that clinton did. >> good news for her, a new poll shows she still has a commanding lead over sanders in iowa. >> fantastic. what a shock. she's beating a socialist in iowa who leads her now by 8 points in new hampshire if you believe some of the recent polls. the hillary clinton camp says they are outliers, we're not worried about it. the only time i've heard the press turned on hirk -- hillary clinton when she assumed -- when they assumed that barack obama was a better candidate. that's when hillary clinton felt she could not get a fair shot. perhaps she's right. now there's a protection around her. this is the media bubble wrap but i don't think it's going to work. >> for her? >> for her. >> it's not working because for that reason. the clintons come with a lot of

baggage. ed kline is going to be joining us to talk about that in the next hour. meantime, bernie sanders is on fire. this may have had something to do with the fact that hillary clinton turned her email server over to the fbi to show that she was cooperating because in the meantime she's hemorrhaging voters in new hampshire. meanwhile, donald trump and ben carson are leading the pack in iowa. >> wow. >> ben is doing so well after the debate. >> he sure it. i believe he's 9% with kraryl fiorina there. sending the message we're anti establishment. they are not former politicians. they don't have a scrap of that in their history. donald trump says i don't have to be a man with a history of politics here. i would put the greatest minds around me because i know some of the smartest people. >> you take some of these great

minds that we had, nobody can beat us. we don't use them. we use a guy who gives $50,000 to someone and they become the head of this. i know the best negotiators in new york. i know the good ones, the bad ones. i use the ones that nobody knows that are good. i would put people in charge of these massive economic -- >> listen. that's what people like. governor perry was leading at this point in the last election cycle, i get it. but donald trump according to the last poll has 22% of the vote and ben carson with 14. walker is down to 7. this is after the debate. >> carson just bumped walker in that poll. >> the thing about the debate was, we've been talking about it for months on this program, it would be great to see as many candidates altogether answering the same kind of questions and see how they handles things. a week ago tonight america got a good look at the men or women who could be the next president

lives terrified by this. the video shows the chaotic after math as people tried to get out of that building. there are three victims at this point. they are expected to recover. no word yet on what caused that collapse. >> overnight, a series of deadly explosions rock a toxic chemical warehouse in china. watch. and that looks like something out of a movie. the two powerful blasts happening within seconds of each other, packing the equivalent of up to 21 tons of tnt. at least 44 people are dead this morning, including 12 firefighters, hundreds more injured. the moments on that explosion caught on surveillance, a man standing near a set of glass doors is knocked down by that impact. we hope he's okay. we just don't know yet. the exact cause of that blast is under investigation. it's believed it may have come from some sort of incoming shipments to that chemical

plant. wow. then some incredible video coming out of taiwan. take a look at the winds from a deadly typhoon actually lifting. this is a 747 jetliner and you can see how those winds just kind of lift it off the ground. the wheels sort of move back and forth and that powerful storm eventually just causing that storm to come off the tarmac there. by the way, a boeing 747 weighs 350,000 pounds when it's empty. that tells you how powerful these typhoon winds can be. and well wishes pouring in this morning for former president jimmy carter after it's revealed that he is battling cancer. carter says the disease was found during liver surgery and has spread to other parts of his body. it's not clear yet where that cancer originated. the 90-year-old says he will under go treatment at an atlanta hospital and release administer information as soon as next week. president obama spoke with carter last night to wish him a speedy recovery and we're wishing that to him as well this morning. those are your headlines.

environmental mishaps. after all, remember the b.p. oil spill? oh, yeah. epa fined them $5.5 billion for the deep water horizon disaster but what if the epa causes its own disaster let's say by releasing millions of gallons of goldmine waste in a river. who is going to police them? it has happened out in colorado. and judge andrew napolitano joins us. the epa condition get in trouble, the company that didn't it -- that did it can't get in trouble. >> it's a classic case of the government violating its own law, the government's own contractors doing what the government has punished others severely. those companies forked up billions and billions for the clean-up. who is going to do it here? the epa hires a contractor. the contractor goes into a

goldmine. the contractor breaches a wall of the mine and this heavy metal is destroying hundreds of millions, probably billions of dollars worth of property. >> there's lead and ars nick and all sorts of bad stuff going down the river. >> the epa end dem any fies the contractor. plain english, if you sue the contractor, the government bears the burden of the lawsuit. >> otherwise, the contractor wouldn't have taken the job. >> correct. because no contractor could possibly afford to repair damage like this. the question is can you sue the epa's contractor? you have to show what's called gross negligence. not an honest accident or mistake, where they accidentally broke down a wall, but some standard of behavior, utterly heedless of the consequences. >> man oh, man. >> the federal government will end up paying for this. the taxpayer will end up paying for this. >> the federal government is us. >> the land will never be returned to its pristine state
