who's drunk? plus americans spending billions and billions of dollars on high-class cuisine, not for ourselves but for our pets. so does fluff really care if fluff's food is from a celebrity chef or are our pets just would having down our wallets? let's get to it. now, shepard smith reporting. >> first from the fox news desk governor scott walker is rolling out his plan to replace president obama's health care law. his first big policy push. and it comes as he takes another drop in the polls. there's a new cnn orc survey that shows scott walker at 8% nationally, 8. that's zero eight percent tied with marco rubio. they trail donald trump and they trail jeb bush and they trail dr. ben carson. like most republicans are he's calling for repealing the affordable care act which they've talked about since there

was an affordable care act. but he says he's going further than his rivals by laying out how to replace it. >> as we think about obamacare, you think about candidates talking about obamacare and what they're going to do to repeal it and how to replace it. one, we're one of the few candidates who have actually laid a plan out, not just for how to repeal it but also for what to do in its place. >> governor walker's proposal calls for giving people tax credits to help them buy private insurance. to pay for it, he said he'll reform how the federal government helps people access health insurance, unquote. the math is fuzzy. then there's the challenge of repealing the law in first place. that would take -- now, listen -- 60 votes in the united states senate. they can't get. meantime, the florida senator marco rubio is also seeing his numbers drop. an average of fox news polls shows his decline since the spring. he's now at his lowest level of support yet. in a fox news survey, 4%.

more than a month since he's visited new hampshire, first primary state. scott walker's trip to iowa this week is his first in a month. now some republicans in those states are openly questioning the absence on the stral. analysts say the slow start has cost senator rubio key endorsements. his campaign team dismissies an and projects a surge in the comes months. peter doocy following the front-runner donald trump and ed henry covering the democrats for us. let's carl with carl cameron live in washington. >> shep, the first caucus is just six months away. a lot of candidates are busily pumping out a variety of policies these days for the purposes of getting official positions sort of on the board before labor day when the campaign always had sort of the traditional acceleration. they want to show substance more than the front-runner, particularly front-runner donald trump who she say is pretty thin. yesterday he outlined a hardline

proposal that would be very hard to pass through congress as well. and if it could pass, it could be harder to implement. today was scott walker's turn and the issue is health care. he's promising a variety of very popular gop alternatives. it includes all kinds of reforms, tax credits for private health insurance, block granting medicaid to the states to give states more say on things. allowing people to shop for insurance across state lines and more. walker was leading the polls in iowa before trump got into the race. here's how he put it today earlier. >> i may not be the flashiest of the folk, i may not have the pizzazz that people on the east and the west coast, but i hope you see here in minnesota and across america, i think like you think. i'm willing to stand up against anyone including members of my own party. i'm willing to stand up against anyone to get the job done. we're not intimidated. >> louisiana governor bobby jindal isn't intimidated by walker's plan either.

he trashed it today saying while walker would tie medicare to age instead of income he's essentially creating a cradle-to-grave process and it's unacceptable. every time a gop candidate offers a plan it will get slammed by democrats but the 16 rivals and their supporters. >> its a no-mandate healthcare plan. how to fund it seems mystical and almost supernatural. >> well, it replaces and appeals obama care with a host of gop proposals. marco rubio was at the iowa state fair today. the first time it's rained since wednesday. and we had a candidate going up there talking about his healthcare plan. he had to cut it short because of the rain. watch. >> we have to repeal and replace a health care law. we have to repeal it and we have to replace it with something that gives every american the opportunity to acquire the health care insurance that they want. >> rubio put his goals and priorities into a "wall street

journal" op-ed. despite majorities in the house and senate is they've tried more than 50 times in the last few years to repeal the affordable care act and fail pd. they're hoping a republican in the white house may change that. it could not change the numbers but could give them more leverage. >> trump nation now. donald trump says he's ready to drop a billion dollars on his presidential campaign if that's what it takes to win the white house. the current republican front-runner claims he's wort more than 10 billion. some critics say that might be an exaggeration. forbes list it as 4 billion. but who knows? either way he says he's really rich so he won't need donations from lobbyists and won't owe anybody any favors. peter doocy in washington, how much of trump's campaign money trump? >> almost all of it. 1.9 million taken in so far, the total spent 1.4 million through the most recent fec filing.

the rest of the money has come from donations which trumps a team has said they don't need but they want to give supporters a way to help out. all $92,000 has been donated with four in ten donors pitching in less than $200. there's going to be a rare in-person fund-raiser next week in massachusetts for trump. as many as 700 tickets sold, $100 to get in. the billionaire businessman says he will match whatever donations his campaign ends up tallying. so far trump has a long ways to go to reach that billion dollars he says he would spend to win, only shelling out a little more than 0.001 of that amount. >> what will they pay him in a few months to drop out? how much money to the rest of the republicans have? >> trump, he's number one, but in terms of campaign cash, he's toward the bottom. mr. trump is maintaining a strong lead and has been dominating news coverage even though the only gop campaign accounts with less money than

him belong to santorum, pataki, jindal and fiorina. the top tier republican fund-raisers have pulled in far more than trump's, cruise 13.3 million. rubio 12.9 million. the bush campaign has 11.4 million. we have no indication that trump plans to change the strategy that has him sitting at number one, but we do know that if his numbers start to slip, he says the checkbook's coming out. >> standing by, peter doocy, thank you. the top two democratic candidates are taking their campaigns to vegas where the afl-cio is holding its convention. ed henry is along for the ride. hillary clinton about to speak any minute now, and we're expecting her to talk about the e-mail investigation, i would guess. >> well, that's right, shep. she wants to talk about the economy and other issues at a town hall meeting that will start a couple minutes behind me. but some of her staffers were saying she may come back and take questions from the media after this event here in las

vegas. what would be interesting about that, as you know, over the weekend she was very tough in saying that this e-mail investigation is all about partisanship. it's about republican attacks. it's not a legitimate investigation, but our own judge andrew napolitano said earlier today it is going to be hard for her to make that case when you have professionals at the fbi leading this probe. listen. >> i feel that she's in serious trouble and she doesn't recognize it. i can tell you this. the team of fbi investigators and federal prosecutors that are pursuing her are the highest and best from the justice department. >> now, interesting, there was a minister here giving an invocation a moment ago to warm up the crowd. he said give secretary clinton the strength and stamina in the face of opposition. she has a lot of opposition right now, shep. >> could we please see her with bernie sanders? could you arrange that? i know they're in the same town. >> we're trying to make that happen. after this town hall, secretary clinton will head to the luxor.

michael jordan is in court over his image. his airness taking the stand today. in a suit over a grocery store that used his name and his number, 23, not lindsey graham style, but just his number, without permission. michael jordan telling the jurors he values his image, quote, very preciously. here's the back story, if you haven't heard it. the grocery store was called dominic's. it was once part of safeway, but it no longer exists. this happened back in 2009. this store took out this ad that's on our big wall in "sports illustrated" congratulating michael jordan on his induction into the nba hall of fame. yoeting, michael jordan, you are a cut above. it also included a $2 coupon for steak. michael jordan sued, michael jordan won. and now the question for jurors is how much should safeway pony up? one economist testified that michael jordan's image is worth

at least $10 million. lawyers for safeway say the amount shouldn't be anywhere near that. the economist also pointed out michael jordan still makes more in endorsement deals than any current nba player. so once again, more than lebron. we're outside the federal courthouse in chicago for us this afternoon where all this is going down. what else did m.j. have to say there, mike? >> well, you know, shep, the back bone of his testimony is that he's suing to protect his likeness, his image, his brand. as you mentioned, he values it very much. he spoke about getting an $80 million deal with a headphone company and turning it down because he did not like what that company projected. michael jordan was testifying, he also said that if dominic's had asked him if he would have participated in this ad, he would have turned down that particular deal. a couple of anecdotes from the day. while on the witness stand testifying, michael jordan had to put on his glasses. he asked everyone in the courtroom to look away joking

this one you'll find hard to believe. teens who smoke e-cigarettes are likely to smoke conventional cigarettes later in their lives. we needed a study for this. there's a new government-funded study that suts just that. they interviewed teens in the los angeles area. here's what they found. in the beginning nearly one out of every ten kids said they used e-cigarettes but never tried conventional cigarettes. half a year later three in ten said they tried cigarettes or cigars. the study pointed out hookah and cigars were more popular than cigarettes in both groups. one doctor called the study the strongest evidence to date that e-cigarettes might pose a health hazard by encouraging adolescents to start smoking conventional tobacco products. this is just in los angeles. uncertain whether they'd get the same results nationwide. it is not uncertain. e-cigarettes have nicotine in them. they don't have tobacco, they have nicotine. that's the part you get addicted

of the region's main industries. flames in the central part of washington state consuming an area the size of montgomery, alabama, and forcing tourists to flee the resort town of schelan. it burned down a warehouse with apples inside threatening the jobs of some 800 workers. washington state is the nation's largest apple producer. one employee says he's worried about where he's going to get his next paycheck. >> are we going to have a job, you know? i mean, obviously buildings and stuff are replaceable, but jobs, you know, probably have to go look for a different job maybe. >> crews say flames have already destroyed some 50 homes and businesses. forced about 1500 people to evacuate. julia has details on where the other fire dangers are out west. we knew this would be a bad fire season. >> a hundred wildfires are burning across these seven

state. montana, officials say there's so many fires burning in the northern rockies that they just have to leave some of them alone because they don't have enough resources. here you can see a cloud of smoke rising in the distance. >> man, it looks like clouds. that's incredible. >> isn't that crazy? and in idaho, better news there. a massive wildfire on the burr of oregon. they have it 70% contained. it was roughly the size of los angeles. here you can see up in northern idaho, unfortunately, officials there say that some 42 homes have been destroyed. >> you know, it's an incredible thing battling that. but these things right here, they're very donkey kong. our flames are very donkey kong. if we used actually donkey kong flames we'd probably have to pay some michael jordanesque fine. so these are knockoffs. >> knockoff donkey kong flames. >> this is serious outside of our donkey kong flames

fighting because government fire. that's rare. >> yeah, shep, which gives you an idea how incredibly thin on resources these firefighters are. they'll undergo classroom training tomorrow, field training for the rest of the week, then we're told they'll be on the front lines fighting fires by sunday. i mean, talk about a quick turn around. it's unclear exactly where they'll be positioned but washington state and idaho, as you showed, appear to have the most need. back in the '90s using military members to fight fires is fairly common, but this is the first time they've been used since 2006. priz ininmates and firefighters from kand dar also involved. all told, 30,000 firefighters and support crews battling wildfires in ten states. >> how does the future look on this, trace? >> it's bad because we're just at the start of the traditional fire fighting season. as a rule, we don't get rain out

this one with the handheld anti-tank rocket. so there's our slide show for the day. another leading senate democrat breaking ranks with the white house on the iran nuclear deal. >> i have looked into my own self and my devotion to principle may once again lead me to an unpopular course. but if iran is to acquire a nuclear bomb, it will not have my name on it. >> well, the new jersey senator bob menendez also said today that he would vote to override any veto from president obama. senator menendez is a senior member of the foreign relations committee, he's also the former chairman. he joins new york senator chuck schumer who has also said he'll vote against it. the senate and house are expected to vote next month. important to give you context here because even mitch mcconnell, the republican leader, has said there is a, quote, great likelihood of success for president obama in his showdown with congressional republicans on the iran deal. again, that from the senate majority leader, the republican

leader mitch mcconnell acknowledging just yesterday. well, iran could soon get its hands on the top of the line missile system, one that can apparently track down and shoot down aircraft and intercept air strikes anywhere near its borders. and the missiles come from russia. a pentagon spokesman tells fox news that defense officials are concerned about this possible sale. according to the report, the reuters news agency, they are planning to sign a contract next week for several russian-made missile systems. actually, the number is four. a russian arms producer says moscow is selling iran one of the most advanced air defense systems in all the world. and it is. world powers reached a nuclear deal weeks ago offering iran relief from international sanctions as long as the secretive regime scales back its nuclear program. the deal also lifts a united nations weapons embargo on iran after several years but not right now. still, the russian president vladimir putin lifted his country's own ban on selling

missile systems to iran back in april shortly after the framework for the nuclear agreement. we're joined by the former director for middle east affairs. he's managing director of the washington institute which describes itself as a nonpartisan think tank. good to see you again. >> good to see you, shep. >> this should surprise no one in the know. vladimir putin needs money. he lifted this ban and told the whole world he was doing it and he would sell them an air defense system is right in line with what was predicted. >> that's right, shep. i mean, this is a sale which is very concerning for the united states and for regional countries like israel because it really does upgrade iran's defensive capabilities. it's a very capable system that russia is selling to iran. at the same time, this is something which isn't prohibited by the u.s. sanctions. not prohibited under the new nuclear agreement. it was expected that russia would move ahead with this, what is actually 2007 contract now that this deal is done. clearly, they feel that now the

deal's done, there's no need to hold back on this type of assistance to iran. >> without the nuclear deal couldn't vladimir putin do exactly this? >> you're right, shep. i think what we see is russia and, frankly china, too, in the wake of the nuclear deal are determined to now sort of expand their strategic ties with iran. you know, this is the sort of thing that president obama said would happen without the deal but i think it's going to happen with the keel anyway. what you can say is that this is the sort of thing which was probably bound to happen sooner or later anyway with or without the deal. it cuts both ways. >> so this deal, is it still mostly about nuclear weapons and being able to monitor what they're doing? what is at the heart of this? >> well, it's morphed over time, shep. the negotiations began as being sort of about trying to induce a strategic shift by iran because

upstairs above jewel why, in case you're keeping up with geography. this is quite an advancement. >> yes, yes. this is part of the first class to include women. and they haven't been identified by the army yet, so we don't know exactly who they are, but we know they're in their 20s and they both graduated from west point. the pentagon calls the ranger program the army's premier combat leadership course teaching them how to overcome fatigue, hunger and stress to lead soldiers during small unit combat operations. in order to do this, they started back in april with 381 men and 19 women. they had to train with minimal food and sleep, and they learned how to operate in the woods, mountains and the swamp lands. now, only about -- so about 4,000 students attempt the ranger school each year and only about 40% of those actually graduate. 36% fail within the first four days. >> wow. >> but eight out of the nine women passed that initial test that happens in the first four

days. a physical test, swimming, navigation, six chinups, 49 push-ups, 59 sit-ups, a five-mile run in under 40 minutes and a 12-mile march carrying 35 pounds through the hills in under three hours. >> in one day. >> in one day. >> just in case you're keeping up there, it all has to be done in one day. >> three big phases. the eight women who pass the initial first part -- right, all of them ended up failing the second part of the first phase, but they got a redo. 57% don't finish the whole first phase. three women passed it and one of those got stuck in the mountain phase. we don't know her status. she could feasibly graduate later. two made it out. but those two aren't able to apply to the 75th ranger that is a special ops force that they're still not letting women try out

. co-pilot is headed to jail for six months for boozing it up with the crew. breathalyzer shows he was nearly seven times the legal limit. yes, seven times the legal limit for drinking. the baltic air co-pilot admitted in court that the group had downed a couple of bottles of whiskey and some beer. happened earlier this month at an airport in norway. two flight attendants also heading to the hoosegow for a few week. the other pilot's blood alcohol level was reportedly only double the limit. he is set to stand trial next month. baltic air with boozing comes along for the ride. get ready for bigger crowds and longer lines at the airport during a labor day holiday, which should be fantastic. that's the word from the industry group that projects 14.2 million u.s. passengers will fly over a seven-day period around that holiday. that's up 3% from last year when 14.2 million flew.

friday is the busiest day of them all. more flights and cheaper fares are driving the increase. the same group predicts that in may that this will be the busiest summer ever for air travel and sure enough. adam shapiro is with us here. why are so many people flying? >> it's cheap fares. it's crowded and not a pleasant experience fighting the lines. but cheaper fares. i was online looking at american, delta. they're offering deals, just as an example, miami to new york round trip 195 bucks. things are getting competitive. they've got overcapacity with the sits but they're trying to get people to sit on those planes. 14.2 million just over the labor day holiday. 222 million for the entire summer. that's a record number of us who are flying. take a look at the crowds you'll see at the airports because this will not change any time soon. the airlines are able to drop some of their fares because fuel prices have come down, 34% for them. shep, they're posting some
