and do you have a gripe with the tsa? no. did the post office lose your package? well, now you can complain about it using yelp, the restaurant review site. the government promises to listen. how is this going to go? let's get to it. now, live on fox news channel shepard smith reporting. and good afternoon from washington. first today common core. what's your take on how we teach and test our children today? some of the republicans who want to be president are tackling that very issue. several gop contenders speaking at a forum in new hampshire. governor chris christie expected to take the stage any minute now. he's likely to face some of the questions that his rivals took earlier. common core is a set of standards for schools aimed at making sure all kids in all states learn the same basics of math, language, et cetera. common core had support from governors and local officials from 48 states both democrat and republican. but some republicans who once

supported common core have now backtracked after critics claimed it gave the feds too much control over local schools. anybody who has spent any time online, either digitally or in car pool, knows lots of parents have lots to say about common core. states are not required to get federal approval for what local schools teach. each state can select its own standards and its own lessons to teach students, but common core remains. now, the issue's become yet another potential landmine, one that has republican candidates stepping very carefully. we have live team fox coverage of politics today. ed henry covering the democrats in nevada. first to john roberts live in lond londonderry, new hampshire. >> a divisive issue on the campaign trail particularly among republicans and a hot button issue. only two of the republican candidates, jeb bush and john kasich actually support xon core. when asked this morning jeb bush

joked common core, what's that? bobby jindal reminded them that he's in federal court fighting common core. the reauthorizations of george b. bush's no child left behind act. the republicans in congress are trying to change parameters to give more control to the individual states. jeb bush is a strong defender of that program. >> no child left behind created the need for accountability. it was state driven and that's the way it should be, and there should be real controls over the federal government's incursion into this, but if you don't measure, you don't care. >> jeb bush told the crowd today that any reform to no child left behind should include school choice for any student who is eligible for it. >> john, a lot of conservatives say they want the federal government out of the education business completely. >> and some aren't quite so kind about it. there are a lot of candidates, a number here on the republican side who actually want to eliminate the department of education. those would include rick perry, ted cruz, mike huckabee.

others want the federal government to get out of the way of local school boards and that the president should help facilitate, not dictate. >> i think that the president needs to share best practices. presidents need to be out. they need to be out of the white house, and they need to have limited time on the golf course, and they need to be out there in the legislatures making the talks about best practices at work to help our kids be successful. >> kasich says that some schools in his state are irreparably broken and the only way to fix the system is to create more school choice, that way increase competition so that schools are fighting for students as opposed to just letting them cruise through school. >> john roberts with republicans in new hampshire. on the other side for hillary clinton, the last 24 hours have been a real mess. first, that disastrous e-mail news conference. now another poll shows bernie sanders gaining ground on her. the senator had already been closing in on her in our fox

news poll. now it's more pronounced. he's cut her lead in half. our poll also shows vice president biden with his biggest number yet, 14%, and he's not even running. he's not ruled it out. ed henry following the candidates in las vegas. ed, "the washington post," the fix today says server palooza and falling poll numbers have led to a full-on democratic freakout. there's pushback on the word "freakout" now but clearly times aren't good. >> might be a little hyperbole but he's a solid reporter and he's reporting on what's happening which is democrats are getting increasingly nervous. why? you talked about the news conference here in las vegas. i pressed hillary clinton repeatedly about her e-mail server, about her arrangement, the fbi investigation. she repeatedly insisted this was a routine matter even though there were no other cabinet secretaries we were aware of who had their own e-mail servers.

when i pressed her on the fact that the fbi now believes that somebody wiped her server of all the data and may be able to restore it and find what was deleted, she's tried to blow the whole thing off. >> did you wipe the service? >> like with a cloth or something? no. i know you want point and i can just repeat what i said. in order to be as cooperative as possible, we have turned over the server. they can do whatever they want to with the server to figure out what's there, what's not. >> now, her joke about -- other an attempt at a joke of wiping a computer server would be like using a towel to wipe a window with windex or something like that, the kind of joke that may have fallen flat just like the one over the weekend in iowa. she said she loves snapchat because the messages disappear. this is part of that freakout. >> if her detractors are trying to add to this pile of things

which they say points to you can't be trusted, you obfuscate, you avoid, well, it's working. her own side would suggest she's letting it work. >> she is. that these are self-inflicted wounds. now on the positive side for hillary clinton, even the polls in like the fox poll that show that bernie sanders has been gaining ground, she's still in the lead. she's still the front-runner, but obviously not in as solid a position as she was in the beginning of this race as we edge closer and closer to iowa, new hampshire, the first debates on the democratic side. and just a few moments ago here in las vegas, martin o'malley, another democratic candidate, weighed in. listen. >> i think it's a huge distraction from what we should be talking about as a party. we need to start having debates in the democratic party, and we need to have an exchange of ideas about the things that we can do. >> and so look, this is why we keep hearing that freakout you mentioned, why we're hearing could al gore, could joe biden,

could secretary of state john kerry or even elizabeth warren get in. there's democratic names being want bandied about. >> ed henry in vegas. thanks. carly fiorina has blasted the transportation security administration in a yelp review. this after the government struck a deal with the website to officially recognize the ratings of federal agency. how does this work? >> yes, shep, the feds say they'll official start tracking the operatings to improve what they call customer satisfaction, so you can rate the government just like you would a restaurant. as for the tsa, right now it has 2 out of 5 stars. and fiorina thinks it should have even fewer. she gave the agency a one-star review just yesterday. she wrote the tsa spent 160 million of your taxpayer dollars on body scanners that have 96% failure rate. unfortunately, these stories of

inept federal bureaucracies have become far too common. yelp made that a not recommend he view and doesn't factor into the agency's rating. the u.s. postal service seems to be faring a little better. the office at its headquarters in d.c. has 2 1/2 stars. one woman gave it 3 and said the security check-in process changes literally weekly, but other than that, my visits are pleasant down at hq. then the irs also has 2 1/2 stars. one guy even gave it a 5-star review, but a little bit of a backhanded one at that. he wrote, the irs is my charity of choice. it gets five stars because i don't want to get audited. so people have actually been reviewing government agencies on yelp for years but no the feds say they're going to officially start tracking them. >> jared from subway today, the guilty plea. the word was this was all about child porn, which was bad enough. but as it turns out, there's

child porn from the charity's former director. now prosecutors say jared fogle will go to prison for anywhere between 5 and 12 years. he was in court today in indianapolis. investigators say for years he set up business trips to coincide with his plans to have sex with kids. they say it went on until a couple of months ago. among his trips, at least one visit to new york to have sex with two 16-year-old girls. they say he even offered to pay one of those girls if she could find him a different underage girl, quote, the younger girl the better. >> let's call this what it is. this is about using wealth, status and secrecy to illegally export children. >> in addition to having sex with minors, investigators say jared fogle knew years ago that the director of his charity was making child porn because he repeatedly sent pictures of those children to jared. subway last month suspended its partnership with jared after agents raided his home. the world's largest fast food

company announced this week their relationship is now over for good. jared fogle's attorney says his client is accepting responsibility for what he's done. now mike tobin in our newsroom. i mentioned this went on for years. >> prosecutors said in 2011 he became aware that the head of his foundation was producing and distributing child pornography. jared could have stopped it then, instead he made the choice to support it. that resulted in the additional exploitation of minors. >> jared also knows that he has a medical problem. he's already sought evaluation by a world class psychiatrist experienced in these matters, and he will seek appropriate treatment. >> now, the charging documents say fogel patrolled the internet and crossed state lines seeking sex sometimes with minors. the charges say in november of 2012 fogel paid for sex with a girl he knew was 17, then texted her the next day offering to pay a fee if she could find an

underage girl to participate in commercial sex acts with him. stating the younger the girl, the better. he's now wearing an ankle monitor until the pleas become official. >> we're hearing from his family now, right? >> right. as soon as the charges became official, we heard from his wife stating as follows, i'm extremely shocked and disappointed by the recent developments involving jared. i'm in the process of seeking a dissolution of the marriage. my focus is exclusively on the well-being of my children. subway -- jashed fogel's actions are inexcusable and do not represent our brand's values. we had already ended our relationship with jared. he's to pay money to each of the victims. >> mike tobin live in chicago. tos tar pistorius was to switch to house arrest this friday but they say he hasn't spent enough time behind bars

and they're asking the parole board to review the case. he's served ten months of a five-year sentence for killing his model girlfriend. he said he shot reeva steenkamp by mistake thinking she was an intruder. today would have been her 32nd birthday. her parents marked this day by throwing flowers in the ocean. they say the beach was one of her favorite places as a child. it could take decades for the united states and its allies to finally get a handle on the islamic state. that's the word now from our nation's top military commander. and he says there is one thing, one thing that the world must do to finally rid ourselves of this menace once and for all. one thing. and that's coming up from fox news. i'm ready to crack like nobody's watching. why? because it's red lobster's crabfest.

from the are you serious file, russian president vladimir putin would be willing to meet with president obama if president obama wants to chat. that's according to the russian foreign minister. president putin is set to visit new york next month to speak at the united nations. chances are he won't sit down with president obama. he and the president have not held a one on one meeting since march of last year when russian troops invaded crimea and russia took it from ukraine. american officials say they're concerned russia may sell iran an advanced missile defense system, which seems to be on track. it would let tehran track and shootdown aircraft and intercept air strikes near its borders. u.s. officials say russia has been testing the defenses of western nations by flying war planes near their air space. russia's foreign minister is calling for european leaders to push ukraine to obey a cease-fire agreement after artillery fire from ukrainian and pro russian forces killed

nine people this week. each side blames the other for starting the fighting. the deadly battle against the islamic state could take another 20 years. that's the word from the joint chiefs chairman general martin dempsey in an interview with a danish news outlet. he says coalition forces can use multiple tactics to cripple the isis army. but they must convince young arabs to reject extremism, otherwise, isis would just come back under a different name. the u.s. has already spent billions and billions of dollars and teamed up with allies to launch thousands of air strikes against isis but the group still controls large portions of iraq and syria. u.s. marine core harrier jets launched their first bombing runs from the "uss essex" assault ship in the persian gulf. syrian state-run media and activists there report isis militants have beheaded one of syr syria's top archaeologists in

the ancient city of palmyra. they then hanged his 82-year-old body from one of the roman columns. palmyra is famous for its roman ruins. the militants have already reportedly destroyed some landmarks there. they claim it is all part of an effort to stop idol worship. a research fellow at new america. it describes itself as a think tank that delivers impartial analysis. 20 years. >> 20 years, but it's important when you look at dempsey's comments, he wasn't looking at air strikes in the campaign. he was talking about 20 years in terms of addressing the underlie political issues, the ongoing syrian civil war. lots of factors that will take 20 years to resolve. this is a long time. >> he focus can and most

analysts say rightly so on this matter of convincing young arabs that turning to extremism is the wrong answer to their problems. so far that message is not resonating. >> i agree. the message has not been resonating. we've seen reports that even though we've killed a lot of isis fighters, recruitment is replacing them, which is why the numbers remain constant. it's about treating the underlying symptoms. this is the part of the problem that the u.s. government has had the most problems with, counterradicalization and counterextremism. >> i keep hearing from folks inside the government and outside of it, we're working on social media strategies to try to employ some of the same methods that the extremists use but for good rather than for evil. i look for it. i can't find it. >> well, it's a really difficult problem. you have isis exploiting social media and twitter, which has millions of active users. countering these messages isn't as easy as it seems.

twitter has been cracking down on it. private companies trying to crack down on it. isis is getting out its videos rapid fire. >> i watch how well campaigns, political campaigns in the united states use opposition research to nick at and cut apart their opponents. and you wonder if -- and i'm being serious here, if the government could employ some of those people to tear down this ridiculous ideology. >> you actually raise a good point.d media strategist, psychologists. they have those people on board. this is not to suggest they don't. but these are people that can help counter the measures overseas. i don't want to criticize the state department too much. they do have departments of people working on this on a daily basis. but you have people around the globe in multiple languages trying to get out the extremists' messages. >> they give us these long time

periods. they talk to us about 20 years or so. frankly, according to the people inside, to prepare us as a populous that this is not a tomorrow solution. >> that is something that i think is smart for political leaders to do. you don't want to enter with air strikes, you don't want to enter with forces or any type of military operation and think it's going to be short, quick and easy. we saw the problem that's gotten us into in the past. you don't want to oversate state your military victories. we've hit a lot of sites, we've made progress. those are military gains. we've gotten 10% of the territory backp we need to transit it into long-term political solutions. we need a comprehensive plan for dealing with iraq and syria. i think the administration should get credit on the military side but it's the political side, the underlying side that we'll still see problems in. none of the candidates on the stage right now are really addressing those with solutions that i think are noteworthy. >> haven't heard much. nice to talk to you in person. >> you too.

very much enjoyed flying back in the days of freedom to be bleeping golden. the nfl's regular season is a little more than three weeks from kickoff. it's still not clear whether tom brady will miss any time. talks continued today over deflategate. no settlement yet. that despite a judge today saying a settlement would be the quote logical and raggal thing to do. lawyers for the league and the players union once again meeting with a federal judge today. either tom brady nor the nfl commissioner roger goodell was in court. as we've been reporting well forever now, the league has suspended the patriots star quarterback four games over deflated footballs in last year's championship game. they say he also destroyed a phone they say to keep it from an investigator. brady denies he knew anything about the footballs and didn't try to hide anything. rick leventhal with the news

outside the courthouse. there are reports that brady's side had an offer on the table. do we know anything more about that? >> we're hearing that brady agreed to a one-game suspension instead of four if he didn't have to admit to any knowledge of any plot to deflate any footballs only that he failed to cooperate with investigators by not turning over his cell phone. and the nfl refused to give in on this point and the nfl attorney in court today made it clear why. the league believes that brady lied under oath right to the commissioner's face. the league says brady absolutely knew about the deflation of balls, that it wouldn't have happened without his direction and he should be punished for damaging the integrity of the game. daniel wallach still thinks brady will win. >> historically they side with arbitration awards 90% of the time. but this case is not like other arbitration cases. >> wallach is confident that you can go ahead and draft brady for your fantasy football team, shep. >> isn't he? >> and the union argues this is

really about a lack of warning. >> indeed. in court today, the nflpa attorney jeffrey kessler argued long and loudly that the collective bargaining agreement requires players to be told in advance if they're subject to discipline for doing certain thing, for example, violating the drug policy has clear penalties spelled out. but there's no warning or precedent for punishment if you're generally way air of someone else's misconduct or for failing to turn over a cell phone. there's never been a uniform system for testing the footballs before and after the games or allowing for weather or other factors affecting the footballs. the rep spoke briefly on his way out of court today. >> first and foremost, we're going to honor the judge's request that we keep our settlement discussions confident shall. we believe in the fight tore our players. the conversation will continue. but that's the only statement

we're going to have. >> ultimately this will likely come down to arbitration case law and judge berman promises he will try to reach a decision by september 4th so the patriots know who to start on opening day. >> rick leventhal in new york city. the personal details and sexual fantasies of government service workerses and government workers may soon be available on the internet. it's part of a cyber attack on ashley madison. the matchmaking website for cheaters. their slogan, life is short, have an affair. hackers say they posted personal information from millions of people who signed up for the site. and the ap reports 15,000 of those e-mail addresses could belong to u.s. government workers and members of the u.s. military. it quotes a french firm that monitors leaks. this could open up users to possible blackmail. the hackers say they posted the information with a message,

time's up because ashley madison ignored their demand to shut down the site. the details include names, addresses and photographs plus phone numbers and credit cards, even sexual fantasies and so-called ideal partners. the parent company of ashley madison has called the data breach a crime. the fbi reports it's investigating. fox news senior judicial judge andrew napolitano is live at the newsdesk in new york. military and government workers. they used their military and government e-mail addresses. >> i guess they probably did, shep. it's one of the reasons why they were so identifiable. it's very interesting because federal law is pretty clear that it is a federal crime to access someone else's computer or computer signal or server without authorization. only the federal government can do that. but the federal government has to decide if it wants to try and investigate and prosecute the people who did this. >> well, along the way, a lot of

people have to worry about their stuff. so if people are very quietly going oh, no, i was on ashley madison, nobody can know this, what can i do to protect myself? is there anything anybody can do? >> there's nothing anyone can do. it's in the hands of renegades that is trying to destroy the website and the culture that produced the website. many of the female profiles on ashley madison were online fakes. they were put up there by the ashley madison computer whizzes in order to generate more traffic in order to generate more clicks in order to generate more advertising revenue. so ashley madison will probably be out of business as a result of this. we don't know if they have insurance for it. we don't know if there's an exception in their insurance policy for the criminal acts of third people. my guess is that a lot of people will be hurt and there will be nobody left to sue.

have targeted about a hundred empty homes and in neighborhoods facing mandatory evacuation. he canceled all days off for deputies to increase patrols in the affected neighborhoods. u.s. troops are helping crews out there battle more than a hundred wildfires across the six states. one state official says the resources are dwindling across the nation and that competition to get extra help is fierce. trace gallagher in our west coast news hub in los angeles. what's the plan to stop the looting, trace? >> well, shep, local sheriffs said they plan to increase patrols in the area. but if it's not safe for the rbts, it's not really a great idea to send deputies in there either. with thousands under these mandatory evacuation orders, it is primetime for burglars. all residents returning to the area will have to show identification to prove they live there. problem is there's still no timeline for had enthey might get to go home. there's good news coming out of the lake chelan wildfire, winds

are letting firefighters build containment lines around the threatened homes. bottom line is when you get back to your neighborhood your home might still be standing but all your stuff might not be inside. shep. >> and the soldiers on whom we reported, they're training today? >> yeah, the 200 soldiers are now in the classroom today learning how to protect themselves in a wildfire environment, from deploying fire protection tents to setting containment lines. the soldiers we're told will get 37 hours of training. the plan then is to deploy them on friday morning. they will likely be assigned to eastern washington to help fight the north star fire. listen to one of them. >> the community called on us and that's what we go do. we fight all enemies, foreign and domestic. so this is obviously a domestic entity. >> back here in california, 2500 residents in a christian camp had to be evacuated because of the rough fire in hume lake.

may become the first hurricane of the 2015 atlantic season. forecasters at the national weather service expect tropical storm danny will strengthen as it slowly moves west over the atlantic. this is not a problem for tomorrow, not at all. this is down the road. but it's about 1400 miles east of the caribbean's lesser antilles, and it's moving bowling ball style, like hurricane andrew did back in the stay, bowling ball style toward -- well, you can see. forecasters say it's generating tropical storm force winds up to 70 miles away from its center. the system could threaten land by early next week. keep you updated, no panicking, not now. president obama is set to visit new orleans next week nearly ten years after the most destructive hurricane in u.s. history. hurricane katrina slammed into the gulf coast on august 29, 2005, and caused a surge that breached the -- well, that wiped out the coast of the state of mississippi and then sort of a

all in these satellite images. you can see how the water was back in the year 2000, then relatively high at 1200 feet. here's how it looked in july. wow, water levels drop 1100 feet. that's near a point that would trigger a water shortage. quite the difference. but a billion dollar project to tap deeper into lake mead will hopefully change all that and keep water pumping to nevada neighborhoods. our chief correspondent jonathan hunt is live on the shores of lake mead now. >> hey, shep. we took an amazing and i have to say slightly unnerving journey deep beneath lake mead to get an up-close look at an engineering marvel that is almost complete. >> i was unaware that human beings could actually build something like this. but they've done it, and it's extraordinary. >> reporter: and it is.

600 feet down and three miles along a dark narrow tunnel. the culmination of a seven-year, $817 million project. this is the end of the tunnel, and this is the critical point. up above us, 40 feet is the hemispherical cap. think of it a giant bath plug. above that lake mead. and in a few weeks time that plug will be lifted and those waters will flood this tunnel. because it's at the bottom of the lake, it will guarantee the water supply for thirsty las vegas even as sinking lake levels threaten to leave the other two much older water intake tunnels above the water line and effectively useless. >> when you consider the fact that we're responsible for providing water to 2 million people and 40 million annual visitors to the economic engine of the state of nevada, this is a responsibility that we don't take lightly.
