police? governor scott walker will weigh in on the war against cops. all of that, plus geraldo rivera, "hannity" starts right now. welcome tonight. new damaging news about hillary clinton and her private e-mail server. joining us is ed henry. >> sean, this could be a blow to her campaign, using a private server to send e-mails with classified information. despite her vow at the news conference she never, ever sent classified e-mail over her personal server. tonight, the clinton camp pushed back saying this was expected, and that the intel camp as they research the documents will decide some of the information was classified. and that they will that after the fact, but that it was not classified when she pushed the button and sent it. obviously, we've heard it from the campaign before. and now some parts of her story going back to the first news

conference of the united nations have been knocked down. it will be sorted out by the fbi's criminal investigation. all of this from a political standpoint clearly weighing on her candidacy. new tonight, her favorability continues to fall. 45% have a favorable view, 53% have an unfavorable view. and others point out some did not have a favorable view of joe biden and donald trump. clearly she is struggling right now, the embattled frontrunner, trying to limit the debates. she has been ducking questions as you have seen. and out on the campaign trail, fox has obtained one script when it was flipped. clinton was trying to take out a democratic frontrunner and was blasting him for ducking debates and yes, avoiding tough questions. watch this. >> both democratic candidates were invited to a televised

debate here in wisconsin. hillary clinton has said yes. barack obama has not. maybe he would prefer to give speeches than have to answer questions, like why hillary clinton has the only health care plan that covers every american. >> interesting, because back in that other campaign, clinton and obama sparred 19 times in various debates. this time the democratic convention has only scheduled four debates. and as martin o'malley, one of the other contenders is clearly upset. the first debate is not until mid-october. by then, the republicans will have had two debates. o'malley is charging they're trying to protect the frontrunner. >> i want to go back to the original remarks, that they never sent nor received the classified information. then it became marked classified information. and reports out there are that some -- i guess the status might have been changed on some of the e-mails. what is the latest on that?

>> well, there were questions raised about whether her staff took some of this intelligence that either was or should have been marked classified in realtime. and then was doing either a cut and paste or something else. putting it into new documents. you're right, i want to stress after the report it has not been proven. obviously if that turns out to be true it will be a major blow to her campaign because it will basically rip apart a lot of arguments she has made. i think the bottom line is that is why the fbi is investigating. we're here trying to figure out what really happened. they have the criminal investigators and we'll get to the bottom. >> and the law is clear saying it does not necessarily have to be marked. for example, there is a lot of talk about satellite images, including north korea's nuclear arsenal that may have to be moved. wouldn't she know that that has to be classified and should not be forwarded and be in a private e-mail server that with ye now

is in a mom and pop's bathroom. and whether this was marked or not if in fact as some of the reports suggest there were satellite images, other images that would reveal some of our intelligence gathering involving north korea, other important hot spots around the world. her judgment would have been you would expect this is the least sensitive if not classify ied a would have handled it differently. i think the second point as well, obviously, look, she is under fire about all of this and whether there is criminal charges or not. she is taking a big political hit over it, sean. >> and ed henry, thank you for joining us. here with reaction, "the new york times" number one best selling books, plunder and deceit. rudy giuliani was on this program and says he has identified 12 specific laws that could be broken if he were investigating this case.

you have looked at the law. we have talked about it in week's past. your thoughts. >> there is one law in particular that matters. and i want -- it will take a short time, but i want to make sure that james carville and lanny davis understands. whoever has lawful possession of any information relating to the national defense, i'll get to the rest later. notice she said i never received or saw anything marked classified. that would be bad enough. it doesn't have to be marked anything if it is relating to national offense. i'm reading the espionage law. she didn't have to have specific knowledge or intent. gross negligence, removed from its proper place of custody or delivered to anyone in violation of his trust or to be lost,

stolen, extracted or destroyed. this is a felony statute. now, sean, the u.s. attorney has not said a damn thing. there ought to be a grand jury impanelled. i'm glad they're investigating, it's not enough. where is the u.s. attorney general? silent, not a word. we have had u.s. prosecutor s appointed on a lot less than this. the united states justice department under the president is in full cover-up mode. probably some civil servant patriotic citizens are trying to do something, but this requires a full comprehensive investigation. gathering all the evidence, bringing in the staffers, yes, bringing in hillary clinton before a grand jury without a lawyer, questioning her and getting to the bottom of this. this is not an e-mail scandal. hillary clinton threw our

national security on the table for all of our enemies to see. >> so any issue or information relating to defense, and you're talking about 18-2793. the espionage act. so by definition, the nuclear facilities which we know are in these e-mails, that would in my mind classify as a violation of that act. and that is only one example of what might turn out to be many. again, 33,000 of these e-mails were erased. hopefully we can retrieve some of them, right? >> well, if the law is enforced properly in my humble opinion, and hillary clinton is the democratic nominee, she would be serving the presidency from leaven worth, quite frankly. just from public information out there, the idea we debate whether or not she violated the law you will hear the supporters say well, where is the evidence? and i say we're not only

overwhelmed with all the evidence i say where is the grand jury? why isn't there a grand jury? where the hell is the u.s. attorney and the district of columb columbia. >> you know, loretta lynch says she is beyond the political -- i remember you being on my program talking about peaimpeachment an perjury and justice. and a president who lost his law license. they have been able to escape so much over the years. my guess is that they think they're going to be able to parse their words and say marked versus received and get away with it with the american public. legally, it seems like there is a cover-up going on, and i don't

know enough confidence in the attorney general to be sure she didn't do anything about it. does she skate over there? >> well, there should be a grand jury in washington, d.c. we have a public integrity unit that could get involved and the criminal division, the justice department, the attorney general who should appoint a special prosecutor but she won't. the fact the u.s. attorney should in fact impanel a grand jury, it's only that it is hillary clinton that they have not. her hands are all over this stuff. and this stuff about marked classified. that is totally irrelevant. that was lawyered, and if the lawyers were not read into these programs they should be investigated too, quite frankly. it's not a matter of specific intent. that is government information. that is national security information. it applies to everyone, especially the secretary of state. sean, when she put that server in her barn next to her house in chappequa, and when that information was moved to denver

the republican committee is asking for a pledge from all gop presidential hopefuls. fox has confirmed that several campaigns have been asked to sign an agreement vowing they will not consider a third-party run if they don't got the nomination. the move appears to be directed at donald trump who was appreciated on the issue during last month's debate. and the three who are suspected of killing a law enforcement officer of fox lake now say there is no indication that the suspects are still in that area. lieutenant charles gliniewicz, you see him there, was shot tuesday after radioing dispatchers to tell them he was chasing the man on foot. police say he only described them as two white men and one black man. i'm jackie ibanez, now back to "hannity". >> ♪ ♪ ♪ welcome back to hannity.

so the second gop debate is quickly approaching and the excitement is building fast, not just for the voters. but carly fiorina's camp appears to be happy. the hewlett-packard ceo could make it onto the main stage. she joins us now, republican presidential candidate carly fiorina. i have to give you a lot of credit. there was a huge social media outburst if you will, about you getting on that stage, especially after your performance in the debate. and i said so myself. ben carson stood up for you. donald trump stood up for you. i have to believe you're happy about that. >> i am grateful for all that support, yours, ben carson, donald trump, and thousands and thousands of grass roots activists in the country. i'm the only candidate in the country that clearly moved up to the top 10 from the lower tier. i'm now in the top five from national le statewide poll.

it really frustrates me as a conservative, you know, this false narrative that is advanced by democrats every election season that republicans, conservatives are racists, that they're sexists. the war on women. i don't see any of that. and that frustrates me. what is your response knowing that that is going to be the predictable attack especially in the main event in 2016? >> well, you know it's interesting because on your friend laura's show, i said it's the media asking those questions all the time. it's not the voters or grass roots activists. or the conservatives. they don't ever ask me if i'm running to be vice president. they ask me what will you do about things as president? what will you do about the iran situation, the capital, the out of control government? those are the questions they should be asking. >> yes. is there a fear -- but knowing the playbook of the democrats, i think you have been of all the

candidates probably the most out spoken in criticizing hillary. do you think there may be some fear that they will be called sexists, if some men that are running make a legitimate attack against hillary? oh, here it is, the war on women, maybe they're trying to avoid that narrative that we know democrats love to advance? >> well, i sure hope not. because if a candidate can't take on the democratic frontrunner, then that candidate can't win an election. so i agree with you. i have been the most outspoken about hillary clinton as well as the democratic party. sean, the party as it now looks the policies as they push forward are undermining the character of this nation. they're undermining the foundation of this nation. they're undermining the security of this nation. we have to take this on. so i am going to keep taking her on as long as she is the frontrunner, and i'm going to keep taking on the policies that

are ruining this nation. >> i worry every day that 93 million americans out of the labor force, 53 million in poverty. 46 million on food stamps. record debt, insane, and then have you a foreign policy where america is not leading which i think is putting the entire world in jeopardy. last question, you watched this hillary clinton server scandal. what are your thoughts about it. you know a lot about it, obviously as a ceo working for hewlett-packard. you believe this is a conscious cover-up? >> of course, of course, there are a couple of things not in doubt. and you're right, sean, we're at a pivotal point in this nation, it's why i'm running for the presidency. but there is for doubt that she purposely put a server in her basement in order to shield her communicati communications. there is no doubt there has been a cover-up. there is no doubt she has been exchanging classified

welcome back to "hannity." and the controversy on the hillary clinton e-mails, late last week we learned that bill clinton sought state-department approval but was denied to give speeches to north korea, the congo, and countries with atrocious human rights policies. and here today, the author of "the cash." and breitbawe have a secretary state, a clinton foundation, we have money flowing into the foundation while she is secretary of state. and also arms given -- arms embargoes lifted off pretty bad countries. is there a connection?

>> i think there is, sean, i mean, the oldest adage in washington, d.c. is follow the money. and hillary clinton as secretary of state as the e-mails are now confirming had had interlocking and intertwining relations with the duties as secretary of state. it is important because foreign entities are sending the clintons money to either their foundation or their pockets in the terms of speaking fees. she has the power as the chief diplomat, the secretary of state, to make vastly important decisions to the people sending the money. the clinton aides are talking about steering money to the clinton global initiative to foreign governments. >> then we go back to the original argument that i kept pointing out, that is that you have saudi arabia and amman,

with atrocious human rights records, especially women. she never publicly criticizes these countries, and they're giving millions and millions to the clinton foundation. did they buy her silence? >> well, you know, i think they did. look as secretary of state you can do things for the benefit of somebody or you can not do things for the benefit of someone. and for somebody like hillary clinton who has been outspoken on women's issues since she was first lady in the '90s, to be silent on these issues as secretary of state is very interesting and puzzling. here is the thing we all have to recognize, in the foreign cultures, for example, in the middle east and latin america and asia, you're talking about in some instances countries that have political cultures that are all about bribery and getting favors from government officials. and these are the very places that are sending large sums of money to the clintons. and all you need to do is look at the inconsistencies and her

posture as secretary of state. and you have to believe these two instances or these two events are connected. >> but all of these are happening at the same time she is secretary of state. they're still fundraising for the secretary with some countries she may have to deal with as secretary of state or her husband is speaking in. now presidents have to put their faith in blind trust. in other words they want to avoid any appearance of impropriety. what about ethics laws? >> look, the federal laws are clear for federal government employees. and that includes hillary clinton. she is secretary of state, appointed by the senate. it is very clear you cannot use state department resources or federal government resources for the benefit of a private business that you run or your

spouse or family member runs. or for the benefit of a private charity. so whether it's the speaking fees or the foundation she can't be doing that. >> why would bill clinton want to give a speech in the democratic republic of the congo, an enemy of ours, a sworn enemy, and even north korea, he had ties with this guy from iran during the times of the arms embargo. i want to understand is it just solely a financial motivation here? >> i think it's financial, but also psychological. he wants to do what he wants to do. look, if you look at the e-mail traffic. north korea, the democratic republic of congo, both come with ideas of him speaking in these countries. he doesn't dismiss them out of hand. what he does is go to the department and say hey, i'm thinking about doing this, what do you think? it's only if they say it's not a good idea that they decides not to do it.

with all the sensitive issues going on with these countries that he would even entertain the idea of taking this money just shows what they're willing to do for money. >> that and the silence on women's rights issue abuses, taking money from countries like saudi arabia. my last question, the clintons have been known to skate. if you had asked me if the president had sex with an intern, lies about it, is impeached and survived, i would have said no way. white water, cattle issues, the clintons seem to survive. does she survive this? >> i think it's going to be hard. it's going to be hard because you have a couple of important dynamics. number one you have people who raised this issue at the department of justice. they did not dismiss it out of hand. so now they're on the record saying there is potentially a problem here. the second thing you have to keep in mind is relationships between president obama and clinton is not great. just go back to some of the statements made in 2008.

the say her name efforts to make visible the pain of our fellow americans. they have said other outrageous things. why is the democratic party aligning with this? >> i don't get it, but you should speak out whether you're republican or democrat or anyone in between anyone who is involved in police violence we need to speak out about that once and for all. i'm here in san antonio, texas, earlier today i spoke out about the cold-blooded assassination of a deputy sheriff over in harris county outside of houston. you look at darren goforth, he now has a widow and two children because all he was doing was pumping gas in his squad car and somebody came up and put 15 shots into him. why? as the sheriff's office said, because they suspect he was wearing a uniform. that is outrageous, that is not the america we grew up in. and where our children grew up in. we need to speak out against that and protect the men and women who protect us every single day. i'll stand up for the law

enforcement officials. the police officers, the sheriff's departments and the troopers any time they're under attack. >> and we have a big supporter, sheriff clarke, who i know is a big supporter of you. last night, they recorded 84 murders so far this year, more than double the 41 at this point last year. do you think this is related to what happened with michael brown and darren wilson and freddie gray in baltimore? are cops afraid to do their jobs? >> yeah, i hear that from law enforcement around the country. they're very concerned. the irony is when you think about the "black lives matter" movement out there. who are some of the biggest victims in the cities? they're african americans. they're some of the very people who need other help from law enforcement. the overwhelming majority of law enforcement in this country are standing up, doing the right thing, putting their lives on the line every single day.

yeah, if something does something wrong we should hold them accountable. i'm the first governor in america who signed a document saying if there is a death of a person in custody there needs to be an independent investigation. why? because it protects not just the public, it protects the police officer. because overwhelmingly they're doing their job. we want to make sure the public knows that where we don't see this kind of nonsense where they're targeting police officers or sheriff's departments or anyone who wears the police badge. >> what do you think about the cambridge police, he has been virtually silent here. we have a war against cops, assassination of cops filling their cars with gasoline. why isn't he weighing in on this? >> this is yet another example where the president of the united states needs to put politics aside and stand up and do the right thing. lead in the country, that is what leaders do. i knew that as a county executive, governor, chief executive, you have to stand up
