and -- if they show he showed a reckless disorder for human life in shooting in the area of the pier they can secure a second-degree murder in this case. >> the gun was reported stolen and sanchez found it he said on the bench. the defense attorney said it went off accidentally while sanchez was mishandling it. so ashley, what do you make of that? does this bolster the argument of an accident. >> it gives him a defense at this point. and that is a whole point to get more information and get the entire story and what law enforcement has done.

there is a number of other charges and a ton of others to be charges. he is a convicted felon and illegal for him to have the gun and deported and the gun in and of itself is a crime. that could life a lead or beyond. fell no murder is an option. at this point they are trying to determine the evidence and determine which charges are appropriate to go forward. they will try to get as many big charges as possible in this case. >> the hearing is to establish whether there is enough evidence to go to trial. do you anticipate possibly the charges down graded or others being added? >> it could happen. but here in california, the preliminary hearing is just a probable cause hearing. and so i wouldn't be surproduced if the judge gives the danyh6n<

permission to go forward for purposes of trial. that is clearly a separate issue. standard of proof and proving his guilt beyond a reasonable doubt is higher than what the judge is bound by. i am interested to see with what the judge will do with the charges currently filed and if the da will file more charges as ashley mentioned. >> sanchez is a mexican national ñ ?a states five times before he shot kate. and ashley, do you believe his immigration status will find its way in the case somehow. >> i can tell you, the defense will fight hard to keep that out. and the judge will decide if it is relevant. it doesn't appear to be relevant. i think the state will try to get it in, but the defense will

we are waiting for a new conference on the search for three men who gunned down a police officer in illinois. the town of fox lake is rallying behind the victim's life. she is pushing through her grief to show support for the law enforcement. >> we lost somebody yesterday. a husband and son and brother and a friend. >> and joining us with the latest is matt fin live in chicago. >> reporter: it is day three in the search for the suspects who are called cop killers. and the set back with a woman who lied to police about spotting them. she was filed withul filing a false report. she will remain in jail until

drivers are expected to hit the road in droves this labor day webbing. but more cars means more distracted drivers. some of them texting behind the wheel. state troopers in tennessee have come up with a unique way to crack down on the dangerous behavior. jonathan is live in atlanta with more on that. >> reporter: police are getting more creative in how they bust texting drivers. in some cities they're posing as construction workers or panhandlers to get a look inside your passing vehicle. in tennessee they're using a big rig. >> blue honda accord just passed on the right. >> reporter: tennessee state
