because of her christian beliefs. she is offering a remedy for the showdown. what is the remedy? kristin davis is there. what is going on? >> reporter: kennedy the remedy is simple if you believe kim davis's attorney, name removed from any same section marriage certificate that her office hands out. davis wants to be signing off on same section marriage because she believes it goes against god's another. for her this is heaven or hell decision. her opponents say this is not personal buy leaves. this is about elected official obeying the law. with kim davis behind bars, had morning her deputy started out same-sex marriage licenses. first one to get one left hugging and crying. they spoke with reporters and weighed in on davis's faith. >> i don't -- licenses should be given out. this isn't a blessing this is a license. >> what does it mean for same

sex rights in this country? >> it means, at least for this area, civil rights are civil rights and they're not subject to belief. >> in many conservative christian circles kim davis is hero. republican presidential candidate mike huckabee will hold a liberty rally for davis in kentucky next tuesday. he calls this the quote, criminalization of christianity. >> kim davis because she followed her convictions is put in jail and is not given bail. this is unbeliveable moment in american history. and i think it may wake people up because who's next? are pastors next? >> reporter: now the judge in this case davis will remain behind bars for at least a week because, remember yesterday, when the couple suing her asked that she not be sent to jail provided she agreed to let her deputies do their job. davis refused. in their words, kim davis holds the key to her own jail cell. kennedy? >> kristin, thank you very much

for the report from washington, d.c. so i will turn to you. andy levy, what should happen here? i mean, you know, here is a woman who converted to christianity in 2011 when her mother-in-law passed away. she is fervent believer and believe god's love trumps all this is law of the land according to a supreme court decision. so where should we find rationality? >> to me there is not even discussion here. she, elected official refused to do the job. refused lawful court order to do they are job. she is in jail. she chose a government job. she is being paid by the taxpayers of rowan county. as long as she is being paid by them she can't refuse lawful service to them. governor huckabee is great guy, like him a lot. he is 100% wrong on this. >> legislature in kentucky doesn't convene until winter. winter time. around january. so they're the ones who would have to formally impeach her. she is elected official.

she is not backing down. what do you do, let the woman rot in prison? >> perhaps. she is welcome to resign her job. if she doesn't want to do her job, which, a part of her job is a clerk of the court in that county, in kentucky to issue marriage licenses. americans and government workers and particularly elected officials do not get to pick and choose which laws they follow or enforce. and to conservatives who are upset about this, they have been very angry about president obama making his own laws for executive actions and directive. so you ought to be very upset about this as well. >> abstracting, picking and choosing. now, andrea, if were muslim and used her muslim faith as justification for not enforces laws. >> wouldn't be talking about it. it wouldn't be in the headlines. i doubt that this muslim person you speak of would be thrown in jail immediately. there is a double-standard i think. but, andy's absolutely right.

country? >> i mean, look, he seems incredibly loved, if you look at the pictures we've been showing live. packed, a large crowd, packed. i mean texans, they support very, very deeply the rule of law. they support their officers. but this is something that is happening across the country. i mean, we alerted it as came in. kate steinle murdered by illegal immigrant. we're seeing just a summer of lawlessness escalation of crime in cities. "usa today," "new york times" highlighted this. when is it going to stop? >> is this a turning point? do you think his death is a turning point? is this one of the moments you look back and realize -- >> i hope so. i hope so. i don't hear a lot of rhetoric coming out of washington, d.c. that is pro-police. >> yeah. >> i hear contrary. that you have bad apples. and some police can act, you know, aggressively but what you don't hear is real support for police. we got numbers just this week showing police recruitment,

those who want to enlist down. this disproportionally affects and hurt communities that need it the most in these cities. these cities run by liberals and democrats. these are blue cities and lives are being taken every single day. you don't hear people standing up for blue lives matter as much as you do for the other. >> maybe they will. hopefully they will. what is it going to take? it will take murder arriving at your doorstep. murders are up dramatically in more than 30 cities across the country. new orleans, baltimore, you name it. they're going up. it will reach a point where people in the cities are so angry about what's happening they will make a stand and they will allow the police to step up and do their jobs. and the police will no longer fear for their lives. they will be able to do their jobs as they see fit. >> obviously, andy, there is a disconnect between the people who protest lawfully and peacefully in the street asking for criminal justice reform. >> right. >> and murdersers who go out and

pick targets, police officers and law enforcement officers. you both and i have family and friends who wear the uniform. >> yeah. >> how does it take away from criminal justice reform movement when we see murders like this? >> you see this on every issue on all sides. sarah palin was being blamed for ads with the targets on them. then you have one side saying oh, you shouldn't do that. then the script flips. then side saying you shouldn't do that is suddenly one saying you should do that. >> yeah. >> 26 police officers or law enforcement officers have been killed this year. that is 26 too many. last year at this time it was 31. if you go back even further, the number is higher. as i said, that is 26 too many this year. but, it means, that what we're hearing about a war on cops, et cetera, i think is being overblown by the media. i don't think there is wave of anti-police shootings going on here. >> yeah.
