. hello, everyone happy labor day weekend. i'm kelly wright, welcome to a brand new hour inside america's news headquarters. >> i'm molly line. topping the news this hours tens of thousands of refugees escaping from terror, running for their lives to europe. but are those nations actually equipped to handle the surge? and what does this mean for the conflicts in the middle east? >> neither side backing down one day after a federal judge jailed county clerk kim davis for defying orders to issue marriage licenses to same-sex couples based on her christian beliefs. the latest in this high-profile case pitting religious freedom

against the rule of law. then we talk about a new strategy to narrow the widening gap between police and troubling communities across our country. but we begin this hour with what police in illinois are calling a significant discovery as they hunt down three men accused of murdering one of their own. fox lake police lieutenant was gunned down tuesday while chasing three suspicious men. detectives on the case now saying a key piece of evidence was recovered from the crime scene friday afternoon but they are not saying what it is yet. matt finn joins us live from fox lake, illinois with the latest. matt. >> reporter: molly, that's right. police say they have recovered that crucial piece of evidence from a field near the initial crime scene but haven't said what it is just yet. here in fox lake the atmosphere is almost kind of eerie. it's labor day weekend. this is a very picturesque town.

streets are buzzing. hundreds of boats out in the blue water. this as three cop killers are on the loose and police are urging people to keep their eyes and ears open. >> we're going rely on the public. you're the public. instinctively you know what's suspicious and what's not. simply not recognizing somebody from the area doesn't necessarily make them suspicious. suspicious could be behavior. suspicious could be some kind of instinct on the person's part reporting it. >> reporter: now in addition to that crucial piece of evidence officers are piecing together home surveillance they say they have and traffic camera video which could depict the three suspects that are on the run. the town is coming together here. there are blue ribbons all over and there was a long line in a print shop that was offering free posters of the lieutenant and the governor has ordered all the flags at half-staff.

the knights of columbus. hundreds gathering today in kentucky for the kim davis jailhouse prayer rally. that's in front of a detention center where the county latin america is being held on federal contempt of court charges. a judge had davis arrested earlier this week for refusing to issue marriage licenses to same-sex couples. now also happening while she sits in jail the state's clerk's office has actually been issuing those same-sex marriage licenses. will carr joins us live from the west coast bureau with the latest on this. >> reporter: davis could be in jail for quite some time and while she's there five of her six deputy clerks have agoode to start issuing marriage licenses to gay couples, the one clerk who has said he refuses to do that is davis' son. the couple who received licenses yesterday are now celebrating a victory that may have occurred in small rowan county, kentucky but had ripple effects all

across the country. >> at least for this area. civil rights are civil rights and they are not subject. >> i feel sorry she's there for her. but she done it to herself. >> reporter: this all started when davis refused to issue marriage licenses to gay couples even after the supreme court legalized gay marriage so on thursday u.s. district court judge david bunting went beyond what elm expected. the couple that sued this summer asked for fines instead the judge threw davis in jail. the gentleman saying he didn't think a fine would change her mind set. he said it could create problems when clerks will pick and choose laws they enforce. davis is a christian who believes gay marriage is a sin saying it's not of god and her family says she will don't refuse licenses to gay couples if she's let out of jail. >> they are not going to let her

out and she's not going to bail out. i promise you. >> how long will she stay? >> as long as it takes. >> reporter: protesters and supporters squared off outside of the courthouse. davis is defending religious liberty. some gay rights activists voiced concerns about davis being in jail worrying she could become a sympathetic figure. this has become political. mike huckabee announcing he plans to visit davis in jail next week. he also says that he's planning a rally on tuesday. and he's started free kim davis petition on his website. so far he has more than 55,000 signatures. molly. >> will carr this is the subject of our legal panel coming up later in the hour. thank you so much. >> reporter: you bet. >> firefighters battling california's largest wildfire so far this year expected to rage throughout the holiday weekend. flames torching more than 130 square miles in kings canyon national park since it started

saying you're dumb and you're a loser. we actually need a grown-up in the white house. trump has a 14 point lead over the other gop hopefuls. let's bring in ellen rattner and tammy bruce. thank you so much for being here. >> hi, ladies. >> thank you. >> let's kick off with you tammy, what do you think his motivation is. why is he doing this? >> when you notice he's a representative from wisconsin. i immediately thought of the association relationship with governor scott walker. in these polls what we're seeing is not only trump really overall actually kind of staying steady which is interesting in and of itself, he's not having a major surge like ben carson has had, but the other major change has been the decline of scott walker, of governor walker. this is a fellow who has been speaking positively about governor walker, has been quoted by many press out lets in relationship to governor walker. it's a smart move.

the rest of the candidates have to push back against everybody not just trump, of course. this is a good way to do it to use a proxy. that's what he is for governor walker, to say things they might not want to say or get in the mud and isn't necessarily going injured by mr. trump. >> ellen, rebel not the most well-known congressman. he's a member of the budget agricultural committee. what do you think much what he's saying? >> i don't disagree with tammy. on the other hand, i think all politics is local as said former speaker tip o'neill. the fact is that wisconsin is a very intellectual type of constituency. they go to school. they go university. that kind of thing. i think that what is going on is he is playing to his constituency. and they, obviously, don't like trump as much because they are more intellectual. he's going after donald trump

because donald trump is not so intellectual. >> you had me when you started talking about tip o'neill. but let's move this -- trump is not someone that pulls punches. he's been out there. he's going after media personalities that he feels has gone after him. for instance this latest interview with hugh hewitt. what do you think about the way he pushes back at the media. >> i got a few letters after my name and i'm going back and forth on trump. so to ellen's point it's not that you need to be dumb to be interested in donald trump. that's a mistake. but i do think that when it comes to the choices voters are going to make we're less than five months away from iowa. people are back network. people are going back to school. the next debates are coming up. people are looking at this seriously. trump represents something very important. but i think they are also going to get tired of everyone being

called dumb or a dope or a loser because you can't end up hating everyone at the end of the day and the american voter is smart, whether they have letters after their name or not and decide because they love this country who is going to be best to get her back on her feet. >> ellen, will people start paying attention more in the fall and think about tone and think about who they want to be the leader of the country? >> i do think that. i want to clarify it's not that i think donald trump is necessarily not so smart, it's that the comments of the congressmen are showing that donald trump is not so smart, which is, i think, meant for his constituency. but i do think people are going to pay a lot more attention to this race, it's going much more interesting. the next debate is on september 16th in california at the ronald reagan library. >> just around the corner. with that looming, mr. trump could be asked some pretty specific questions and about foreign policy which was what some of these questions that he thought were gotcha questions were about, foreign policy. do you think he'll be ready for

that debate in two weeks. >> let me tell you. that was a favor for what hugh hewitt did for donald trump. he's running for the presidency which is being commander-in-chief. you want to know in the immediacy of what america is facing so you can make certain decisions about the military, you know the advice you're being given is correct. this is a heads up to every candidate and the newbies. donald trump should be thanking hugh hewitt so he's aware of some of the nature of the questions being asked instead of being upset he was challenged or asked a very basic question. this could help him if he learns from it in the debate. >> what do you think, ellen? >> you know, there was the same kind of critic jim that happened in george w. bush when he was running for office. he wasn't that schooled in world affairs, he didn't know everything, he said he knew about mexico because he was the texas governor. they went after him. it did not stick. i don't think this is actually

hillary clinton picking up a major endorsement as she campaigns in new hampshire. earlier today, democratic senator gene shaheen announcing her support for clinton. both events are very for the clinton campaign. this isn't a state where she's been slowing ground with that e-mail controversy still swirling around her campaign which today takes yet another turn. molly what's the latest on this? >> reporter: hillary clinton says her family paid technology specialist personally, separate from his state department salary to maintain her private e-mail server because the family quote continued to need his technical assistance. he worked on clinton's 2008 presidential campaign and then with her at the state department has been asked by congressional investigators to testify about that private server and the 30,000 or so emails clinton said she deleted because they were of a personal nature. his lawyer said his client will

continent. we know what it is, war, conflict and facing a situation that force you to flee. we're not talking about immigration, economic immigration flow in majority. we're talking about refugees towards which we have a moral and legal duty. >> joining us now ambassador john bolton a former u.s. ambassador to the u.n. senior fellow at the american enterprise institute and a fox news contributor. sir, good of you to join us this afternoon. does the united states bear some of the blame for the refugee crisis we're seeing taking place in europe? >> yes. i think because of president obama's policies not paying attention to the region, not trying to resolve some of these conflicts, dealing with the islamic state in particular, but it's also a problem, i think, that the europeans have helped bring on themselves in the

statement that you just heard is one of the reasons for it. if the europeans are saying to people fleeing isis and syria, iraq along the turkish border and jordan if they are hearing the europeans say dome europe it's no surprise they are going europe. let's be clear what international refugee law provides. the responsibility to grant asylum belongs to what's called the country of first asylum which for almost all of these people coming out of syria and iraq is turkey. but it's perfectly obvious turkey is letting these people right on through into eastern and central you were and eastern and central you were repaying the favor. sending them to austria, austria sending them to germany. >> it sounds like a russian roulette these refugees will go wherever they can and the countries, it's up to them to let them in or to kick them out. the number of syrian refugees is growing on a daily basis as you know.

roughly 300,000 refugees from syria, iraq and afghanistan fleeing those war-torn regions and the continued threat from isis. where can they go? the problem europe is faced with and for that matter the united states is how do we defend against terrorists slipping into these countries under the guise they are refugees. >> it's very hard. some countries in eastern and central europe have granted political asylum to populations of christians threatened by the islamic state. populations of yazidis and other minority muslim sects that face religious genocide. this is a definition of what constitutes political asylum, persecution or fear ever asylum. wanting to get out of some place because of economic reasons or civil war is not enough. i come back to tissue of turkey. the international community wants to deal with these refugees, the place to deal with them is the country of first

asylum because ultimately you want people to have a chance to go back to where they came from. that's the best solution. meantime letting them come to europe guarantees they aren't going back. >> are you surprised by turkey's demeanor and behavior in this matter? >> i think their conclusion is that they can't handle the hundreds of thousands that have come across from syria. i'm not sure i agree with that. i think a proper international effort could deal with them. turks are not being responsible here. it doesn't stop after they get to bulgaria then hungary then austria then germany. we've seen pictures of thousands of people trying to get through the channel tunnel into great britain and it just goes on and on and on. europe's policy here is an utter disarray. this will cause real problems for the european project. >> i hear you loud and clear. before i let you go, germany chancellor angela merkel has pledged to grant asylum to

. now to the high-profile case pitting religious freedom against rule of law. three same-sex couples are enjoying life as newlyweds in rowan county, kentucky while the clerk is in jail. davis' attorneys now say the only way she would stand down would to be take davis' name off the marriage licenses. her attorneys adding the license with their client's name on them, they are not valid. the chairman of liberty council agrees. >> the marriage licenses that were issued this morning, it is our position and the position of

the clerk of rowan county kim davis those licenses are void. they are not being issued under the authority of rowan county. clerk's office. and they are not worth the paper that they are written on. >> so that was actually kim davis' attorney there. let's bring in trial attorney and former prosecutor and a criminal defense attorney and trial attorney. thank you both for being here. this has been a fascinate case to unfold. presidential candidates have been drawn in. arkansas governor mike huckabee said kim zafs in federal custody removing the doubt of criminalization of christianity in this country. is this a matter of religious freedom or is this about a woman not upholding her oath? >> i think it's about the latter. a woman not upholding her oath. separating out her feelings we

can't have officials to take oaths to uphold the laws of the united states and states where they live and deciding unilaterally they disagree with them. >> what about the argument davis is making and how political this has become. >> it's outrageous how the legal system has been politicized. you have people speaking out of both side of the mouth. they know full well the constitution is the supreme court of the land, that's what supreme court justices do and they are required and she was required to enforce the law. in one sense they say sanc turn ary cities should be enforced. but when it's a political thing and advantageous to them this woman has a right not issue these marriage licenses and it's this division and improper outrageous abuse of a legal system being prostituted for purposes of political gain that's so divisive in destroying this country.

>> what do you think? some people make this argument she's a resister. she's pushing back against supreme court decision that shouldn't be made and she's standing up in that regard? >> she certainly able to do that in her own personal life. but to essentially deny everybody in rowan county because she's not just denying homosexual couples the right to marry but heterosexual couples. she can step down and do anything she wants in mother-in-law life as far as taking a stand about the supreme court's decision. but to do it in her official capacity is completely in error and potentially even criminal. >> i agree with that. let's not forget she put her hand on a bible, i would imagine and swore to uphold the laws of the state and the federal and state constitutions. she's abdicated that responsibility. the bottom line is it's disgusting to me that people are

using religion -- i'm a devout catholic and i understand there are laws sometimes we have to execute that we may not like. we took a responsibility and there are avenues for her to take if she doesn't like it and that's to get out. for people to say she's being persecuted as a christian because she's not following the law was the same arguments during the civil rights movement when they blocked entrances to prevents black people to get into college. >> davis' attorney said this is the same time somebody has been jailed. he compared her to martin luther king jr. what's disconcerting about this, they feel uncomfortable she's in jail. could the judge have done something differently or are his hands tied? >> his hand are kind of tied in this situation. the judge can't unilaterally bring charges against her. that's been looked at by the

d.a. in rowan county. so the attorney general's office in kentucky is looking that. the judge didn't have a lot of options. company have fined her or taking the step of putting her in jail. >> he an opportunity, gave her an opportunity for a number of different things. she wants to eat her cake and have it too. she can walk away from that position. have deposition do it. she refused to take every accommodation possible. the judge was making a strong statement government officials have sworn a responsibility to execute the laws and that's exactly what they are supposed to do and if you don't do it you go jail until you're willing to comply. >> we only have a couple of seconds here. is what kim davis have done different from other folks who say i don't want to bake a cake for a ceremony. is that different? >> absolutely different. she's a public official. she's a state actor. entirely different. once again we're talking about not just sort of an emotional reaction, that's a different
