marriage licenses is now appealing behind bars. a federal judge says she will stay in jail until she changes her mind. the attorneys say their client will not back down. we will be speaking to 2016 presidential candidate mike huckabee who plans to meet with davis tomorrow. president obama taking some executive action during this labor day weekend, during a visit to the boston labor day council. he's expecting to sign an order for employees to get seven days of sick leave per year. it's going to be a family affair in the quarter finals of the u.s. open, serena williams beating six-time champ madison keys. she will face her sister tomorrow. look at this. >> camera, look at that.

hillary clinton is certainly feeling the burn. >> as in bernie. democratic presidential candidate bernie sanders jumping ahead of hillary clinton in the latest new hampshire poll. >> we've opened up a 9 percentage point lead that's bernie sanders according to an nbc poll showing bernie sanders leads hillary clinton 41% to 32%. vice president joe biden on the poll as well at 16%. biden will decide whether he is going to run at the end of the summer. >> it takes a lot of work to install a private server system in your basement, so i don't think it's plausible for her to say oh, i wasn't paying attention. she clearly was paying attention. >> iowa and new hampshire were the first two nominating

contests. she maintains a lead in iowa but that lead is shrinking. carly fiorina will be joining us this morning. a lot of people are wondering if it's going to be a fall of fiorina. >> she had a big debate performance on the fox news debate. you take a look at the polls now and the fall kick-off campaign. look at the top four right now. they make up about 60% of the field. 29%. ben carson -- i'm sorry, donald trump out in front, ben carson with 22%. >> a big take away from this is adding up to 60%, you have all the outsiders, you have trump, carson, fiorina and cruz beating those establishment candidates. >> it's interesting. you see the middle. it's sort of stayed tight but at the top with trump, carson, bush has come down. fiorina has come up a little bit

and scott walker who especially right there in iowa, neighboring state of wisconsin, he was supposed to win there. this was supposed to be the state and he's really struggling. >> he's not even in iowa today. he's in new hampshire on a motorcycle tour, i think this morning. >> he might be looking at other states. he's starting to spend a lot more money in south carolina for example. if scott walker doesn't win in iowa, he's got to find another place to win it. >> speaking of new hampshire, john kasich is doing quite well in new hampshire. he's got second place. >> i would love to get ed's take on this. there's been some talk lately about who is the first to drop out. is it still too early to say that? >> it is a little early. there are folks who are going to start running out of money. rick perry, he has sort of dropped off for some time and he he had to stop paying people in key states. you see the top of the field

starting to take shape, folks in the bottom aren't going to be writing checks anymore. >> what does newt gingrich the former how speaker attribute his success and why it's been the summer of trump. >> i think he learns faster than any other political figure i've known except bill clinton. he's running on winning. i will make us a winner again. if you will like to be a winner, i'll make us a winner and people come up with this these policy questions. how would you like to win? americans go i like winning. >> republicans are tired of losing presidential races. newt gingrich is right. it's not just about projecting success and winning but optimism. it's working for ben carson as well. not negativity. to be sure, donald trump hits his opponents pretty hard.

so he goes negative when he has to. >> is it a good game to get into which is fighting donald trump? carly fiorina is ramping up her attack, you recall on that foreign policy question on the radio show, donald trump stumbled and couldn't answer the question and carly fiorina came out and answered it flawlessly. she's slamming trump on foreign policy. >> i think it's very difficult to lead if you don't have the requisite knowledge and i think it's perfectly acceptable that you don't know the name of every terrorist leader. i don't always either. i do think it's important to know who our enemies are. >> as you mentioned, she's going to be on the program at 8:15 morning, so she was slamming him but she also was saying i don't know every single leader of every single group out there either and that was something that newt gingrich mentioned too. you are going to have a

concern for rip currents which we'll be talking about in a moment. temperaturewise, you are seeing the temperatures climb into the 90s, the exception is across the west, out there, we've had temperatures below average and today as the case yet again, high temperatures in the low 70s and this trend will continue here over the next few days. it will be thursday when we start to see a shift in the weather pattern, we see cooler air moving into parts of the northeast. temperatures will be shifting into the 70s and 80s. starting to feel more fall-like out there. we're tracking the risk for severe weather today across parts of the plains. you can see it rooted across kansas and iowa, large hail, damaging winds and flash flooding possible. not only today, but as we head into tomorrow as that storm system continues to move south and east. across the atlanta, it's still hurricane season and we have tropical storm grace battling

it became very real, very quickly. i went into the video. as you saw in the clip, that's what i saw. so then i reacted from there. >> so, with this technology, john, you're able to actually hit a button on there to sound an alarm. so you've actually set up a few cameras here in our green room as well to show us how this technology works, right? >> yeah. i've got a camera in the green room that we've set up earlier. you'll be able to see what's going on in the home. if you don't like what's happening here, you can either sound this siren or hit the emergency call button which will call local police near the device. >> so you can do it on your phone, you're able to zoom in on the camera and see what's going on in high definition? >> yep. if we wanted to look around, see what's happening, you could do that from anywhere. >> how many of these cameras were set up in your home? >> two cameras on the first floor. as you can see, i had coverage on the front and back door. my thought was that if somebody was going to break into the house it would be through one of those entryway. >> to be clear you were 100

miles away and you get this push notification there was movement in your house. he had a knife in his hand as we well. had you been home at the time, this could have been a huge problem. when you sounded the alarm, what happened? >> so i wasn't sure if the guy was actually still in the house. i was on the phone at the police at the time i sounded the alarm. the police department had an immediate response. i think they took the situation very real and so when i sounded the alarm they were actually already outside waiting for the guy to come out. and so as you can see in the vid video, once the alarm sounded, he moved out pretty quickly. i think he had been in the home 60 seconds before the alarm went off. my take was that he thought he was getting away with what he was doing. >> you were able to call emergency services there and get him on the phone. john, obviously i cover technology here. >> sure. >> and i hear from viewers all the time over the years how frustrated they've been trying to set up home security systems

specifically. what happens happened is exactly what the descending justices like scalia and roberts all said. this is going to create mass confusion. in this case, it's gone beyond confusion and incarceration for a person who has very strong convictions. the irony, ed, is that she was put in jail by a republican judge and she, herself, is a democrat. this is not about partisan issues. this is about the constitution. >> you're right. she's a democrat. most of the media does not mention that fact, which is very interesting. i want to press you on the fact that over the last six, seven years of the obama administration time and time again you said this president is acting unilaterally and is going outside the law. so the supreme court -- i hear what you're saying but they've now spoken. won't there just be chaos around the country if you have more clerks like this saying i'm not going to follow what the court said? >> well, we follow what the law says. the court says something and it's not fully implemented into

law and enabled until the people's representatives pass that law and specifically prescribe what it looks like until the executive subscribes it. this is civics 101. three branches of government act in concert with each other. one can't overrule the other two. jefferson warned about judicial tyranny and said this happens when you let the courts make law. that was followed by hamilton, adams, jackson, lincoln, who disregarded the 1857 dred scott decision. the courts then said that black people weren't fully human. i don't think anybody said we've got to follow the law because that's what it said. abraham lincoln ignored it because he knew it wasn't right. i think we're missing the bigger point. it's not just religious liberty but whether or not we're going to follow our constitutional prescription of three branches of government or whether we're going to have people that act independently of the other two

sunshine? two new apps promise to detect dangerous conditions caused by that ultra violet light, like melanoma. now with these apps, do we need to be wary? >> absolutely. the apps that claim that they can diagnose skin cancer are dangerous, because a lot of times they will misdiagnose the benign mole and will call it a melanoma and a lot of times they will miss melanoma and call it benign mole. >> saying they deceptively said they were able to accurately analyze melanoma risk. but why can't they? >> i think it's very hard just looking at the picture to determine whether the mole is benign or malignant. it takes years of clinical practice. >> that's why you went to school, right? >> for 12 years. a lot of times it's not just

looking at the mole but the history that goes with it. >> technology may not be able to tell that when you just download an app. how do these work, though? >> basically by algorithms. they compare the picture to other pictures and some apps that score a little bit better that would have a board certified dermatologist look at the apps. even those apps miss 90% of melanoma. >> taking a picture and looking at a different picture several months later, if you have a different angle, it may rook like it's growing or changing shape. >> correct. >> and it may not be. >> right. >> which one do you like? >> there is an app called um skin check. it's a good app to keep an eye on the mole, take the picture that will send reminders for self exam. anything that's educational is good.

work. we'll talk to them about his disciplining. hello, everybody at home. it's the labor day weekend here. we want to take a look at the weather conditions across the country. we are feeling very summer like out there, anywhere from the plains to parts of the northeast. some of these forecast high temperatures for today. you'll be in the 90s in new york city, also in the city of boston and also as we head farther west. even hotter in dallas. 100 degrees for your high temperature there. meanwhile across parts of the west, temperatures have been relatively cool. this pattern will continue over the next couple of days as we head into tuesday, wednesday. it really won't be until thursday that you'll notice a big shift in the weather pattern, where places in the northeast will be much cooler out there. cool front is moving eastward. it will bring those storms and cooler temperatures. if you live in the south temperatures should stay toasty especially across parts of the florida panhandle. we do have the threat for

when you fail to lead, what happens over time is your options diminish and situations worsen. that happened in ukraine and russia and in syria. this refugee crisis -- it was heartbreaking beyond belief but entirely predictable. the u.n. estimates there are somewhere between 43 and 60 million people on the move, trying to escape conflict zones. and so we knew this was coming. it has absolutely been a lack of leadership on obama and clinton's part. >> carly, it's ed henry. i want to give you a chance to defend donald trump but also maybe your line of attack against hillary clinton in the days ahead. you're in new hampshire this weekend. hillary clinton was there, hitting donald trump and other republican candidates on the issue of women's health and she was saying -- it sounded to me as she's trailing bernie sanders in that state of new hampshire now, that she's trying to revive this talk of a war on women.

>> reporter: good morning. hundreds of police officers are already here. it's a couple hours before visitation begins at antioch community high school, alma mater of joe gliniwiecz. the casket has just been taken into the high school where the funeral service will begin. most of the police officers have gone inside. it's been raining this morning. lieutenant joe gliniwiecz was killed in the line of duty last week. three men are believed to be responsible for the lieutenant's death. the lieutenant radioed for backup and said he was chasing three suspects, three men, by an abandoned concrete plant in his town of fox lake. he was found there, shot to death. his service revolver was recovered. police haven't said if that was the murder weapon. police haven't provided new details about their investigation. they do have new video but

quickly and panic sets in, which is one of the worst things that can happen during a life or death situation, when you're talking about potentially drowning out there with these strong rip currents. it can quickly turn a fun day at the beach into a deadly situation. i went to the beach to learn what it takes to survive a current encounter. across america's beaches last year, almost 60 drownings occurred to swimmers getting caught up. it may seem like a scary statistic, it shouldn't stop you from having fun in the sun. >> it's a flow of water from the shore line out in the ocean past the breaking waves and out past the breaking sea. >> there are ways to spot a rip current with the naked eye. observing the beach from an elevated level. >> white foam water right here leading out is somewhat of a rip current. you can see the difference in the color of the water.

>> when scientists study the movement of the ocean they often pour a harmless dye into it to spot the rip currents. pat and i are going to show you a few tips if you do get caught in one. right, pat? >> yep. are you ready to get in the water? >> sounds good. let's go. now getting into the water was a little tough on this strong surf day. once we got out there, i learned some survival tips. >> first, remain calm. do not panic when you're in this situation t will not pull you under water, only pull you out further into the ocean. you need to remain calm so that you can swim back in. >> tip two, keep your eye out for the green flags. >> there's an area of about 80 yards of green flags that you can swim between. >> finally, to break free from the rip, swim parallel to the
