server. caution, you are about to enter the no spin zone. the factor begins right now. hi, i'm bill o'reilly, thanks for watching us tonight. no talking points memo because we have a very busy program. glenn beck will be protesting the iran nuke dual he will be here. charles krauthammer on new information that hillary clinton did indeed have classified information on her private server. first the lead story tonight. donald trump. as you may know he continues to lead the g.o.p. presidential field by a significant margin in all the national polls. causing consternation among some republicans. mr. trump will be protesting against the iran nuke deal tomorrow in washington and joins us now from his headquarters here in new york city. we'll get to the nuke deal in a moment. but, first, he i want to know what you think about this migrant crisis in europe.

800,000 it looked bike will have to be settled in germany alone. what do you think started that? >> well, it's a serious problem. we haven't seen anything like it since the second world war and it's getting worse and worse. i was impressed in one way but surprised that merkel in germany allowed this to happen because they are really flowing through all over europe. if you notice, russia is not taking and china is not taking and the gulf states, whether you look at saudi arabia or qatar, they are taking none. but some of them are. and some of them are actually being very generous. just really i wonder, you know, where all these people are coming from, exactly. and what are they representing because do you have people from isis in that group? you know, there is a lot of security risks with it. but, something happens to be done. it's unbelievable humanitarian problem. >> israel is not taking any. britain is taking a few. maybe 5,000. you know thousands will come

to the united states of migrants. now, do you object to migrants getting out of the middle east and north africa? do you object to them coming to the u.s.a.? >> >> i hate the concept of it it but on a humanitarian basis of what's happening, you have to. this was started by president obama when he didn't go in and do the job when he should have. when he drew the line in the sand which turned out to be a very artificial line. but, you know, it's living in hell in syria, there is no question about it. they are living in hell. >> so you would have intervened. >> something has to be done. >> if you were president, you would have intervened in syria, you would have removed assad as the president of that country? >> well, you know, obama said he was going to do that and the problem you have is that russia is on his side. iran is on his side and lots of other things can happen. >> what would you have done? after the gas -- >> -- the amazing thing, after the gas, something should have happened. >> what? what would you have done?

in hindsight? >> probably, probably in retrospect, they should have gone in and they had should have done something with assad. assad is not our biggest problem because assad and isis is actually fighting. so now what we are doing is we are fighting isis >> we're fighting isis, and isis wants to fight assad. we're stopping. assad has to say these people are the nicest on earth. but assad has the benefit of russia and iran, protecting him. >> now that these migrants are going to europe and being accepted, millions more can come. i think that catastrophe is going to play out. >> europe is becoming a much different place. >> sure. >> i was in paris. paris doesn't look like paris anymore. you look at the major stories in europe and before this, it's a much different place.

and on a humanitarian basis, something does have to be done. >> back in the united states, kim davis released she won't give up gay marriage licenses. what is your advice? should she have issued the license? >> well, she was released. that is good and too bad she had to be put in jail. and i'm a very, very strong believer in christianity and religion, but i will say that this was not the right job for her. because we had a ruling from the supreme court and we are a country of laws. you have to do what the supreme court, whether you like the decision or not, and it was a 5-4 decision. whether you like the decision or not, you have to go along with the supreme court. >> so you have issues of license for take what comes. black lives matter, where do you think black lives matter is at? >> i think it's very simple. i think all lives matter. >> what does that group want? >> i think they're trouble. i think they're looking for

trouble. i looked at a couple people interviewed from the group. i saw them with hate coming down the street last week, talking about cops and police and what should be done to them. that is not good. and i think it is a disgrace they're getting away witness. i think it's disgraceful the way they're being catered to by the democrats. the fact is that all lives matter, including black, white, and everybody else. we have democrats that are afraid to say that. they're apologizing because they're saying white lives matter. and these people shouldn't run for office in my opinion. >> it's not just democrats. let's roll tape. i want to you react to this. go. >> black lives matter is a way of capturing the essence of the problem we have where blacks have been killed by police officers in a way that doesn't

seem appropriate. so i don't mind the slogan. i don't mind the movement because it draws attention to the problem. >> so general powell, republican supporting black lives matter. you say? >> he's wrong. he's totally wrong. it's all lives matter. that should be the theme of the country, frankly. one of our themes. all lives matter. so he is catering to somebody. i looked at the head of black lives matter being interviewed and i said to myself give me a break. all lives matter. >> if all lives matter, then, why do you support planned parenthood and not cutting off the funding since they're the top abortion provider and now, we know, engaged in selling parts of dead babies. and you don't want to cutoff their funding. so -- >> i'm not supporting planned parenthood. someone said i'm -- i'm not. >> would you cutoff planned

parenthood? >> yes. i would. >> that was the report. >> then you have bad researchers. >> we'll take care of the people who did that. go ahead, just state it. >> people think it's an abortion clinic. i'm opposed to. that i won't do any funding as long as they're performing abortions. so i would be opposed to funding. >> okay. tomorrow, are you going to go down to washington, d.c. and be in this antinuclear iranian rally. 41 democrat senators say they will support the treaty. therefore, it will go into affect. the deal will be made. so why are you going out of washington if it's a conflict? >> well, it's a protest. and it's one of the most

incompetent contracts. forget about deals from any standpoint. looking at real estate, or war, we could have had a much better deal, a stronger deal. we should have doubled up the sanctions and negotiated for strength. we're getting nothing from this deal. you look at certain countries opposed to it. now, all of a sudden, saudi arabia came back. what are they get something do you know what we're giving them in terms of weapons and money? it's absolutely -- >> it's a -- >> it's an embarrassment to the country. look, it's very important. our prisoners should have been released before we started talking to these people. >> that is right. all of our allies who didn't step up in syria didn't want to do anything there. now, they're getting what they deserve because they're too afraid to do anything. they were -- they're in favor of

the iran nuke deal. you're talking germany, britain, and france, yeah, yeah. yeah. yeah. your strategy seems to me is go it alone. you won't be able to rally anyone against iran in this situation. am i wrong? >> well, look. you could have -- if we had the right leader, those countries -- and russia going to make a fortune. they're making a lot of deals to send massive missiles all over iran. we get nothing out of this deal. they're going to spend $150 billion like a payment to make a deal that is bad. they're going to spend $150 on terror all over the middle east, probably all over the world. this deal is incomprehensible. it should have never been made. now, the problem is you'll never put that good together in terms of sanctions. >> that is right. >> it's a big problem. >> so you're going to protest tomorrow and just let everybody

decision saying they are right. the sheriffs are right. you feds cannot enforce the states to enforce those gun laws. >> okay. so it was a 5 to 4 decision. >> he yes. >> and the brady law was some restrictions on the purchases of guns. the sheriff in montana sheriff in arizonaside we don't like that law. we are not going to enforce it scalia and the conservative justices said you don't have to enforce it now it's coming back to bite them on the butt. >> they are saying federal government cannot compel states to compel federal program. look at the case here refusing ms. davis to issue the same sex licenses that is individual, constitutionally protected right that. >> so it's a personal right. >> correct. >> versus a regular. >> hab to bring the case. >> wait, wait, wait. hold on, somebody has got to do what? >> i think someone has to

with us now former police commissioner of new york city ray kelly. new book out today. first of all, do you think that there is war on general on cops? are they in more danger today than they were a year ago. >> could very well be. probably don't have enough information. we have seen recently disturbing patterns or the event that happened in houston. we saw illinois and, call in aurora, there is another one in las vegas. calls like this are not that unusual for the police. acting out, of course, firing shots changes the equation tremendously. >> a few minutes ago we played a sound bite by general powell who said i don't have any problem with black lives matter. as you know black lives matter have openly called for harm to be brought to the police.

now, they say they were joking, nobody believes that. this is a militant group. these people, black lives matter, do they have an influence at all? >> certainly very, very possible. and, of course you have to say the natural follow up to that is all lives matter. but this is what apparently gets them upset. and rhetoric, i think, can very well play a role. we know that the assassination of two new york city police officers in december was a direct result of this kind of rhetoric. this kind of talk in the aftermath. >> cited on his website the guy who murdered the two police officers. >> exactly, yeah. >> now, when you were police commissioner here, you had stop and frisk. and primarily in the poor neighborhoods where there was a lot of violence. that dropped murder rates in those neighborhoods. since the liberal mayor bill de blasio has taken over and bill bratton not a liberal is a police commissioner, they have stopped the stop and frisk programs in east new york, bush wick, the bronx, places where it's

violent and the murder rates in those neighborhoods have gone up. are you say saying that de blasio is directly responsible for that? >> no. i'm saying that the reduction in stop and frisk. they haven't totally eliminated reduction certainly plays a role. >> if you are a young person who has a gun, and has a tendency to carry a gun and know you are not going to be patted down chances are you are going to carry that gun. >> you said in an interview that this stop and frisk ar so avoidance is going to get people killed. >> i you if you rememberly believe that. >> then de blasio is responsible for getting people killed. >> i say in the book that lives will be lost as a result of this. >> he is pushing it. when bloomberg was mayor and giuliani was mayor they would let do you it? >> absolutely. the tone comes from the top. the feeling, as far as security is concerned, comes from the mayor.

a couple of months. i you think what he is trying to do obviously with the meeting in warren with some of the donors. he is trying to line up to see whether he has got what he needs. but i think if i were him, what i would do is do what reagan did in 76 when he ran against ford for the nomination and two weeks before the convention he announced that he would take richard schweikart, a liberal, let's call him a moderate republican senator as his running mate, in advance, this is pretty rare, as a way to balance his ticket to get him over the top. it didn't work. but you think what biden should do, what i would do if i were him, i would announce in advance, if she would accept it, that elizabeth warren would be my running mate. think of, this everybody assumes if biden joins the campaign he is going to immediately inherit all the sanders support and go live on a desert island somewhere. in 1968, that's what happened, bobby kennedy came. in he took over all the
