hurt. also, how much money would it take for you to become a criminal? a lot of people say just $2,000. let's get to it. >> announcer: now, shepard smith reporting live from the fox news desk. good afternoon from the deck. ben carson is closer than ever to tying the republican front-runner, donald trump. that's according to a new cbs times survey. it shows donald trump on top with 27% and ben carson just behind at 23%. there's a margin of error here. see that? plus or minus 6%. so that is a statistical tie. no other candidate can even see that high. we'll show you how quickly ben carson has surged. he has nearly four times the support he had last month. in the same time, donald trump gained only a few percentage points. carson's gains come at big prices to his rivals. look at how support collapsed for jeb bush and scott walker.

both had double digit love last month. but the love has died. in fact, scott walker is on life support at 2%. most candidates are out of the public eye today while they prep for tomorrow's debate. not donald trump. he, as usual plans to own the news cycle and the narrative. he is set to lay out his national security plan. that after he spoke to thousands of supporters just last night in texas where the polls show illegal immigration is a top concern. the crowd ate up his promise of mass deportations and a huge wall. >> you look at crime in so many different places and you see gangs. many of these gang members are illegal immigrants, they're rough dudes. they will be out of here so fricking fast. >> it's disgusting what's happening to our country. we are a dumping ground for the rest of the world, we are a dumping ground. >> that's the type language that apparently brought out these

protesters out. they rallied outside with a giant donald pinata. all of this because that's where we are now in american politics. we have coverage of the 2016 race and another big boost for bernie sanders. karl cameron in los angeles where donald trump is set to be at trump tonight and on a big, big boat. hello carl. >> hi, shep. he'll be on the deck of the u.s.s iowa here in los angeles. they are expecting a pretty big crowd. it seems a hastily arranged event. it's sponsored by a super pac, a veterans group. mr. trump will be coming here and he's been saying for weeks that he will lay out his plans for the military for tax cuts for fixing the economy for jobs and trade. and we haven't yet seen specifics. tonight on the decks of this battleship, he'll obviously be talking about his military plans, as well as he will fix the veterans administration.

but in all of his speeches, he makes tremendous promises and they don't have a lot of specifics. this was just last night. listen to what he had to say about this issue he'll speak on tonight just a few hours last night. >> our military is going to be so strong and so powerful and so modern that technology we have it. but it's not working. we're not allowed to use it. we have no fear. i want to make it so strong and confident that we never have to use it. >> well, we'll see exactly what he plans to say tonight in terms of how would he pay for a growing military? what would he do about outdated machinery that was going to cost a tremendous amount of money to upgrade arm amounts? how will he pay for that without increasing the debt? one of the things we talk about all the time. he talks about it in his discussion with china. >> you could always have mexico pay for it. the attack ads are coming

tonight. it ought to come tomorrow night. it ought to be a whooping. >> scott walker got on the bandwagon on the megyn kelly show. not jeb bush's campaign itself but the independent super pac that he raised money for before he raised -- new hampshire and south carolina. with ads both boosting bush's candidacy, but there's also a component of attacks that's going to come from the super pacs. one in the form of a digital ad that's airing now. you put on the web and you hit the video. you'll watch a lot of ads these days. this is one of them. the bush super pac going after trump. >> we lose everywhere. murders, prime. very, very stupid people. you're finished. the american dream is dead. give me a break.

>> my message will be an optimistic one. because i am certain we can make the decades just ahead the greatest time ever to be alive in this world. >> the symbolism couldn't be less than a bat to head. donald trump is a dark face down a dark alley and jeb bush is a sunrise over america. that's not the only attack. the club for growth, the fiscally conservative organization that has been hammering conservatives and democrats alike for not being fiscally conservative. they go after republicans. they're criticizing trump saying he'll raise taxes. trump has responded to those ads with yet another tweet saying, in effect, the club for growth is a sleazy organization that looks for too much political influence through money and he will not raise taxes, he'll lower them. >> jeb. >> carl cameron, there's the big boat where the donald will talk tonight. i'll be watching the debate. >> it's on the cnn tomorrow.

when it ends, live analysis will begin here on fox newschannel. like that sunshine, that light in the forest. you finish up over there and change the channel. all the people you now, the brett and the o'reilly, they will all be here and they'll be talking about what happened. when you're done with that debate, click it over here. they'll all be here. bernie sanders is now leading hillary clinton in another poll out of new hampshire. he is. the democratic socialist is up by seven points in the monmouth university survey. this is the fifth straight poll that shows bernie sanders leading secretary clinton in the first primary state. wow. it has him beating her among women by four points. senator sanders calls himself a democratic socialist as i mentioned and the "wall street journal" is getting into the middle of this. the newspaper is reporting that his campaign proposals would cost at least $18 trillion over a decade. most of it for a government run

single payer health care program to cover every single person. the "wall street journal" estimates that that health plan alone would cost $15 trillion. but senator sanders says that number is "not the reality." >> they oversignificantly exaggerated the cost of that and forgot to tell the american people in that article that that means eliminating the costs that you incur with private health insurance. >> so that's eliminated. senator sanders did not go into detail about covering the cost of his proposals. but he did say he will demand that the richest americans and corporations pay what he calls their fair share of the taxes. fox coverage continues at henry live in washington. bernie sanders is now leading. >> that's right, shep. not just in new hampshire, but there have been polls in iowa suggesting the same. we were at a rally not far from washington, d.c. manassas, virginia, there are 3,000 or 4,000 people there.

manassas is not exactly a liberal area. between more liberal northern virginia and the more conservative part of the commonwealth of virginia. bernie sanders has those screaming fans out there. you've seen him at these rallies. i've been on the road with hillary clinton. she doesn't get crowds anywhere near that at various events across the country. her campaign insists that's because they're focused on organizing and they're going to get people to the polls and to the caucuses in iowa and that some of these folks who are turning out for the sanders rallies are along for the ride and are not actually going to turn turn out for him. we're going to find out if that's true or not. >> hillary clinton's campaign has been counting on the woman vote and it has dropped like a stone. what happened? >> it's gone down 29 percentage points in this new "washington post" abc news poll in terms of democratic -- clinton leaning democratic women who were for her to the tune of 71% back in july. down to 42% now.

hillary clinton on the road in iowa yesterday made clear that she believed she's going to survive this storm. listen. >> i've been in and around enough campaigns to know that there's an ebb and flow. polls go up and down. people's attention and decision-making changes over time. i feel very confident about where we are in the campaign. >> obviously she was a front-runner in 2008. all of that did not turn around for her. they're looking for a much different result this time, shep. >> ed, thanks very much. as i mentioned, tomorrow night after the republican debate here's where you belong. we'll have live coverage at 11:00. followed by miss meggin and sean hannity. plan to spend the night with all of them. i'll be in bed. they'll see you then. actual. one of rick perry's supporters is asking for a

refund. a $5 million refund because he donated $5 million to a rick perry super pac but it's not clear whether he'll get his cash back. according to the reporting of politico, a top perry donor says the super pac should shut down and return the money now that the candidate left the race. but a leader of that super pac told politico they're trying to figure out what the law allows them to do with the now $13 million still in the bank. super pacs have been around since 2010 and the supreme court citizens united decision. politico reports, not many ended up with so much cash on hand when their candidates folded. we'll watch and see what happens with that. crews are searching through miles of muck for some women and children who got caught up in a massive flash flood. they were in a van and an suv when the floodwaters knocked them off the road. look at this. one of the victims, a child, said to be just 4 years old. ahead, the race to find any

the floods hit a polygamist community which warren jeffs ran. he's behind bars for sexually assaulting girls behind what many called a cult. you can see rescuers pulling people from muddy waters. a wall of water and debris swept an suv and a van downstream yesterday. all of the victims women and young children that. official went on to say the community was caught off guard and probably unaware of the flash flood warnings. keep in mind, members of that sect, if you will, are typically not allowed to watch television or go online. our chief correspondent jonathan hunt is live in our west coast news hub this afternoon. what's the latest on the search for the missing women and children? >> shep, it is ongoing and it is increasingly desperate. one adult and three children are still missing. 100 law enforcement personnel are involved in the search. the governor of utah is sending

in national guardmen to help. because of the delicate nature of this, searching through piles of debris for children who might just still be alive. no machinery is being used. the entire search is being done by hand. a short time ago at a news conference, the lieutenant governor spencer cox, says he's never seen anything like this in his life. listen here. >> our hearts and prayers go out to the families and -- of those who have lost loved ones at this time. we just want hilldale to know that we love you, that we're thinking about you and that we're here to serve you. >> and of the nine dead, officials say three are adults, six are children. shep? >> those officials calling this a wakeup call. >> in fact, those were the

precise words used by the mayor of hilldale, apparently going out to watch these thunderstorms and the resulting flood is a fairly common activity in hilldale. and many of them were out doing exactly that yesterday when this extraordinary flood came through. here's mayor barlow of hilldale. >> it's a wakeup call to the community that this is real. we get these big floods that go down as long as i can remember down the creek. we know that a 100-year flood is going to come sometime. this is tragic because i don't recall this kind of a fatalities with the flooding. >> now, officials say, shep, they still hold out hope that they might find that one adult or one or more of the three children still alive. as we approach the 24-hour mark since those floods came through, that hope begins to fade. shep? >> jonathan hunt, thank you.

just in to fox news, pictures of the flooding that's destroyed homes in california. this is san gabriel, a suburb, if you will of los angeles. homes torn apart by these rushing waters. this morning, we saw a dramatic res crew nearby. look at this. a man and his dog got stuck out on the los angeles river in the northeastern part of the city when heavy rain strig erred flash floods this morning. you can see crews pulling the pair to dry ground. no word on how they're doing at this moment. a pair of enormous wildfires wreaking havoc in california and burning down hundreds of homes. so far one woman reported dead and officials have said the fires have forced more than 23,000 people out of their homes. those who can return aren't finding much of anything. ryan has details. >> this list from fires is mind-boggling. what they're going through. >> it's been incredibly bad. for california.

enormous fires going on. this is a current look at those fires. there are a dozen in all. the two big ones, the valley fire, about 100 miles north of san francisco. it's burned a size bigger than milwaukee. it's 15% contained. the second one is the butte fire that's outside sacramento. it's about the size of tampa. it's a little bigger. they say it's close to 40 3ers contained. still, people are coming back, next to nothing. we've seen video and pictures coming out of these areas in california. homes charred. what's left of people's livelihoods. the woman who died, this is what's left. she was in her 70s had a care-giver. she called fire officials but they couldn't get there. that's how fast they're moving. firefighters, more than 11,000 of them on the ground trying to fight these things. a lot of them have never seen anything eye quite like this. this is what's left of a carport. just ruins. firefighters, again, working very hard to set up lines.

they're moving quickly. they're burning fast and growing. what's left of those. a fence still smoking. power lines on fire. tree stumps. scenes like this. these are the areas of people getting back. otherwise, just straight out of something awful. >> years of drought triple degree temperatures, no rain, humidity so low it's in the single digits. they had been warning us this was coming and sure enough, it's here. ryan, thank you. it was a crime and a cover-up. that's what investigators are saying after a college student died during an apparent hazing ritual. now more than three dozen fraternity members face charges and dramatic accusations. and the university's response. hazing as murder. and college students as suspects. it is a very serious case and the details are next.

because we should fit into your life. not the other way around. 37 minutes of members of a fraternity, a fraternity in new york city are set to face charges in a case of a 19-year-old pledge who died after a hazing ritual and a brutal one. investigators say the fraternity went to huge lengths to cover it all up and now the charges, they range from assault to murder in the third degree. we got a picture of the pledge coming up here. michael deng is his name. he was trying to join the baruch college chapter of pi delta psi. this was december of 2013 when investigators say the fraternity put this guy, michael deng and other pledges through a ritual known as glass ceiling. happened during a weekend retreat to the poconos in pennsylvania. couple of hours west of

manhattan. for glass ceiling, police say the pledges were blindfolded. they had to carry backpacks filled with 20 pounds of sand across a snow-covered field. at the same time, the fraternity brothers charged at them and tackled them. the autopsy showed michael deng wound up with significant and severe damage to his head, his torso and his thighs. police say at one point he fell, hit his head and blacked out. according to the police, some of the guys carried him inside the house but didn't call 911. instead, investigate tors say they called the chapter's national president who told them to hide any items connected to the fraternity. while the teen was out cold, the fraternity members stripped him, changed his clothes, googled his symptoms. and after more than an hour, police say he finally arrived at a hospital and died a day later. now a grand jury, it's recommended charges against 37 people, including the fraternity's now former national

president. officials say they're making the arrest in waves so they don't overwhelm the courts. officials at baruch college said they didn't know about the retreat. they banned the fraternity and pledging for all fraternities and sororities. officials told us, we owe it to michael and his family to hold accountable those responsible for the senseless death of this promising young man. pi delta psi cut ties with the baruch chapter. heather hanson is a trial attorney. they're charging a fraternity. >> yes. >> with a series of crimes. a fraternity as if it were a person. >> you know, it's interesting. we've seen this with corporations. it's inching towards personhood with supreme court cases. we saw it with the bp oil spill, they were charged with a crime. it wouldn't be that the fraternity would go to jail. they would pay hefty fines if

found guilty of third degree murder. >> not all of them, but some of the 37 charged with that. >> they were charged with third degree murder. usually you see fraternity charged with manslaughter, usually hazing. the fraternity itself was charged and five members charged as well. >> under the law, does that mean that you should have known or you did know that by doing what you were doing, something like this could very well happen? >> it's in pennsylvania. pennsylvania first degree is intentional, second degree is with a felony and third degree is an umbrella for all other murders. yes, it would include that. it would include recklessness and depraved heart and involuntary manslaughter is charged. that's a situation where it's more than an accident. this grand jury has really done its homework and metaphor a very long time and was meticulous in getting the charges together. the third degree murder charge may be a stretch here. but the involuntary manslaughter charge takes everything that could be charged here.

>> there's probably less hazing than i was in college. there's still hazing. you wonder what the outcome this will have across the country to a fraternities? >> two things come to play. this prosecutor and this grand jury is looking to make an example. charge the fraternity itself with a crime. almost unheard of. the other thing that's great the. the family itself filed a lawsuit against the fraternity. one of the things they want and you see this in these cases, they want pledging to be obsolete. they want there not to be pledging. pledging equals hazing. you see that the school has taken that step to take away all hazing in that school and pledging rather for fraternities and sororities. whether that will happen across the country, i don't know. we see at least one of these cases a year where hazing leads to a death. so it certainly seems if pledging is not done away with, it should be modified. >> what institution would be -- look, where i come from, if you were to step up and do that, they would rebel against you in

ways that the rebel flag, forget it. you cut out pledging, please. >> once the pocketbooks get into play, it is the right thing do. >> they're kids. they need supervision. we didn't know it at that age but we were wrong. >> kids are trying to fit in and you got to set a standard. >> it ain't worth it. you tap your own keg. you don't need help. >> you can have plenty of fun without it? >> i did. >> thank you. we're hearing from the only survivors of that tv news shooting in virginia. vicki gardner was giving a live interview last month during a local news morning program. police say a former reporter at the station opened fire and killed the reporter, allison parker and photographer adam ward. vicki gardner, you may remember, is the woman being interviewed from the chamber of commerce, took a bullet in the back. now she's giving her first interview to greta van susteren. >> it was rapid fire all in this

fox report now. hundreds of refugees escaping war and terror now trapped in a no man's land between two countries. they're trying to enter hungary from serbia. refugees have nowhere to go now. some tried pushing and shoving, but police blocked them. president obama saying just in the last hour, the united states needs to work with europe to resolve the crisis. meantime, turkish media report a boat packed with refugees sank in the water on the way to greece. 22 people, including four children reported dead. overall, the number of refugees entering the european union just broke a record in august for the

vladimir putin. he's urging other nation toss follow his example and offer military aid to syria's government. russia has backed president assad through a bloody civil war which killed and estimated 250,000 people. western officials say the dictator used chemical weapons against men, women and children. assad taken over sections of syria. u.s. officials say president putin has been stepping up military involvement in syria, has been sending in all kinds of stuff to set up a military base along the northwestern coast and there's satellite evidence of exactly that. a spokesman for the kremlin wants to work with the united states to solve the crisis. he called moscow and washington indispensable. what are the latest developments from president putin. >> shep, the u.s. approach to taking on isis and syria has been to support moderate rebels. they helped to create the problems and he must go.

a spokesman reiterated that president putin's approach in supporting the assad regime is counterproductive and suggested this instead. >> what we would prefer from the russians is a more constructive engagement with the 60-member coalition led by the united states. that's focused on degrading and destroying isil. we would welcome russia's participation in that effort. >> meantime, the state department says that secretary of state john kerry has made three calls to his russian counterpart in the past ten days, shep. he's trying to get clarity on this russian buildup. >> bashar al assad spoke again today. >> he spoke with russian media and shirked off any blame for the problems in the country saying there are other issues that have to be dealt with before political reforms there. saying "it's impossible to achieve real success as long as bloodshed continues and people don't feel secure. we won't achieve anything until

we defeat terror in syria." they did not mince words when responding to that. >> this is the same man who drops barrel bombs on his own people. so let's keep it in perspective when we're talking about assertions he's made against fighting terrorists. he is the reason that isil has been -- and other extremist groups have been allowed to fester and grow and sustain themselves inside syria. >> assad also said that his country needs to embrace all of its people, including the kurds. shep, of course, our officials in the u.s. saying too little too late. >> thank you. five air traffic controllers have just uncovered a serious problem that they say could cause commercial airliners to crash. that's the reporting of the agency that protects government whistle blowers. the federal aviation administration has now confirmed, this is a problem which the feds tried and failed to fix last year. according to those whistle blowers, the problem happens when pilots control centers or airline dispatchers change the

flight plans and they've already filed. they reportedly do this often to avoid bad weather or other jets, for example. but the problem, apparently, lies with the computer systems that the controllers use. the feds say those computers cannot identify multiple flight plans for the same flight. critics say this could lead to confusion. even a possible crash. if a controller clears a flight for takeoff based on an outdated flight plan. the feds say air traffic controllers in detroit identified the problem, but it could affect any flights nationwi nationwide. they're still working to fix it. meantime, in sweden, passengers landing at one airport might not realize that nobody is inside the control tower. there's a tower but nobody is in it. we'll show you where this is here. it's in the northern part of the country. officials say about a dozen commercial planes land at that airport each and every day. the only difference is the air traffic controllers are not

there. they're 90 miles away. they say cameras feed in video as controllers guide the flights in or the pilots in for the landings. so far it's the only airport of its kind out there with its sort of bi-camera 90 miles away traffic controlling. which is comforting. the u.s. and europe are testing this very concept. we have a former senior official with the federal aviation administration here with us. >> i remember we were having in the news business, somebody said we'll have one weather guy and he'll work for all the stations. got a station in california, a station in miami. your station in miami, it's nice outside when it's raining. i wonder if they couldn't have similar problems with air traffic controllers 90 miles away? >> i doubt it, shep. realistically, this is a great technology. we need to get it out there more. if you can deploy this technology, you can provide coverage to airports that

currently don't have any air traffic controllers. >> in the same way, you could cover, for instance, chicago's o'hare from new york's kennedy someday. i remember when they took the tollbooths out, there will still be a human in there watching over the thing. there are no humans. >> necessarily, the human eye is not always the best thing out there. we can deploy technology now that gives us infrared to see through bad weather or thermal to see if there's animals on the runway before they land. supplement it with controllers. we need to get it out there. >> i believe you. then there's this matter from the whistle bothers who have come up with a problem that can make planes crash into one another. is that an overstatement. that's what they said. >> i think it's a gross overstatement. at the end of the day, you have responsible controllers, monitoring the path of an aircraft. if there's any kind of issue with separation issues, potential interdiction with
