garrett jr. outside of phoenix at a wal-mart after he tried to pawn the gun bruised in the first four of the shootings. 11 confirmed shootings in voox. and while there haven't been any serious injuries. there have been several close calls a 13-year-old's girl's ear was cut after a bullet shadowed the window of the car she was riding in. officials aren't certain that he is responsible for the seven other shootings. >> are there others out there? are their coup cats? that is possible. we will continue to investigate. tonight, i cannot give you a whole lot more detail as interviews and search warrants are underway. >> and while the while the investigation continues, merritt's father is saying the arrest is a mistake. the son is a family man and there is no way that he did this. while merritt hasn't been formally charge the 21-year-old is facing a range of problems, criminal enendangerment, assault and

welcome back. new theory in the case of bowe bergdahl. army investigator testifying he walked away from his post, bergdahl did to it be a whistle blower did to try to expose leadership problems. this coming at the hearing to determine if bergdahl should face a court martial and spend the rest of his life potentially in prison. michael walsh is a commander of the army special forces. warrior diplomat joins us with his reaction on this. great to have you this morning first of all the general who did the investigation, who interviewed this man, spent countless hours interviewing bergdahl testified yesterday and he said essentially painted a picture not of a deserter but a whistle blower.

he said derg dal felt luke he knew more than his superiors and more qualified than his fellow soldiers. he felt things were going terribly wrong at growth outpost concerned for fellow soldiers. he felt he needed to run away 19 miles to get back to the main base to warn people, to warn his superiors there. what is your reaction to that? >> first i find that testimony from bergdahl a bit hard to believe. anyone who spent a day in afghanistan knows that you are not going to walk 19 miles to anywhere through some of the most god awful mountainous terrain. he further testified that bergdahl wanted to purposely create a search for him so that it created some kind of pr event that would then get the attention of the generals out in afghanistan at the time. as you mentioned, i took command the day that bergdahl walked off his base. i can tell you without a doubt that men and women were harmed, that they were killed and injured, looking for sergeant bergdahl.

and i think needs to be held accountable. i commend the army for hopefully sending him to a court martial. and i look forward to seeing this thing play out. secondly, sorry. >> i was going to say another superior testified that he felt that bergdahl wasn't adjusting properly. said he seemed very off o. he said that he went to his superior and said, look, you need to check this guy out. and his superior, this man testified, told him to basically stand down. there are also assertions and testimony that bergdahl had some sort of severe psychological defect it. it seemed like might have been crazy and should not have been there in the first place. your reaction? >> well, general also testified two things one that he believed bergdahl was of sound mind when he joined the army. yes, he was not adjusting well, but so what? a lot of soldiers struggle out there in those kinds of conditions. and you handle it properly through the chain of

command. what you don't do is try to desert your post and deliberately put your soldiers in harm's way. that's against every code we understand as soldiers to not put the men and women standing to the left and right of you in harm's way. >> we just have a few moments. do you think he should spend the rest of his life in prison? >> i think certainly should be court martialled. i know without a doubt that men and women were killed and injured looking for him. including my own, which were being deliberately faded into ambushes by the taliban who knew we were looking for them. and then, you know, lastly, there may be some time served for the suffering that he endured. but the men and women who didn't come back don't get anything. >> have to wrap it up there. we appreciate you joining us this morning. >> sure. >> have a wonderful weekend. >> you too. >> the qatary sheik speeds through quiet beverly hills neighborhood and it's a all caught on video.

administration. i think it inevitably leads to the conclusion that they're using the irs as a tool to crack down on conservative groups and other groups that have a political philosophy that they don't like. >> there is nothing scarier than that what blows my mind is a keep part of the democratic get out the vote plan for every national election. every presidential race involves giving money to preachers to get out the vote. i have seen it. this is not speculation. that happens. i have watched it. so, the irs never, that i'm aware of. cracks down on that. because it helps democrats. do they? >> i'm not aware of that. i think that's really what the problem here is, look, the irrelevancy has massive power. they have a lot of discretion. they can choose what possible violations are going to go after and what they are going to let slide. and when we have seen the last few years of irs enforcement, it seems that every time they are enforcing these laws, it's against free market groups and in this case it's against veterans groups. you want to see actual treatment at this point. >> the moment you
