cruz, dr. ben carson and governor bobby jindal. we begin with howie kurt so there you have it. this is terrible for republicans and wonderful for democrats. >> "new york times" today says it will benefit left or right. the major theme of the coverage has been because this pope speaks out against excesses of capitolism and helping the poor and becauthis was a awkward, difficult headache for the g.o.p. what is far less emphasized is that this pope and his church oppose abortion. >> oh, they do? >> yes. that is part of the story. he's landing on a day when fed democrats blocked the vote on late term abortions that francis and the catholic church oppose

gay marriage and oppose contraception so it's a problem for democrats. >> first of all on the "new york times," ted cruz is up next. we're going to talk about the headline they ran on peloci versus the pope and the g.o.p. it's to the point where the media is pummelling the pontiff so badly on the plane about how he must be against republicans and how he's a liberal. the pope had to come out and say i am not a liberal. i am pushing longstanding church doctrine. i am not a liberal, he said he. >> he said some things that could be seen as leftish but he hasn't changed church doctrine. that needs to be part of the coverage. it's a humble pope, an inspirational pope. his tone and actions create complications for both parties. >> howie, great to see you.

as howie mentioned senate democrats killed a ban on late term abortions. something the catholic church isn't exactly in favor of if you paid attention in sunday school. joining me now, senator ted cruz. >> it's great to be with you, megyn. the main street media are partisan. they're obama's number one protectors and rooting for hillary. pope francis has been an incredible voice for life, marriage and religious liberty. in all three, we're seeing an assault unprecedented in the history of our country.

the democrats and media don't want to talk about the fact senate democrats stood virtually united in support of late term abortions. they don't want to talk about these horrifying planned parenthood videos. and they don't want to talk about the assault on marriage that pope francis stood up against. they don't address the continued assault on religious liberty. you know, in egypt, when we saw 22 christians beheaded by isis and the obama white house described it as they're being killed because of their egyptian citizenship, pope francis spoke out, he said their blood confesses jesus christ. i'm very glad he's with us. >> some are suggesting these republicans are going to have to avoid photo ops with the pope.

or, for example, forget the abortion thing. what about little sisters of the poor? the obama administration successfully sued to make them give the okay in writing such that they're employees can get contraception which pope francis may not love. >> megyn, you're right. i pledged if i'm elected president on the first day in office, i will instruct the department of justice to open an investigation into planned parenthood and these horrific videos and i will instruct every federal agency that the persecution of religious liberty ends that day, that means the case against the little sisters of the poor will be dismissed. i mean this is an administration, the obama administration that is litigating against a catholic charity, the little sisters attempting to force the nuns to pay millions of fines under

obama administration to try to force them for abortion inducing drugs. it makes no sense and it's radical and extreme. i'm curious if the main stream media will feel about litigating against nuns. >> the media chooses to focus on the divide between the republican party and this pope whit comes to issues like immigration or climate change. okay. those may be legitimate slips. but where is the focus on the fact he's going to address a joint session of congress that refused to sign off on a ban of 20 week abortions, of a five month old baby in the womb. they stood up and said we don't want to ban that. if there is an exception for the life of the mother we're not going to get behind that. this same media in "new york times," look at the headline about nancy pelosi. look at this. in pelosi, strong catholic faith

and abortion rights co-exist. that is fine. you can co-exist if it's pro choice. but not any income inequality or immigration you need to avoid photo ops with the pope. >> the media, as i said are trying to distract the public and lie to the public. but there is power to truth. one of the reasons i think that our presidential campaign has such tremendous momentum is because speaking the truth with a smile has power, coming out of that first debate that you moderated in 100 hours that followed our campaign raised over a million dollars in 100 hours, people went to ted cruz.org, contributed. the second debate that just ended we raised over $1 million in 48 hours, less than half as much time. >> how does that compare to your

compadres? >> none of them announced their results. what i can tell you is that in the campaign so far, our campaign has raised the most money. we've had 300,000 contributions. average contribution is $81. people go to tedcruz.org. >> 81? interesting. >> they're looking for someone to stand up. try to speak with precision. >> like a dollar fee for making you go through the process or something? >> it's great to be with you. thank you. >> now, reports the fbi recovered personal e-mails from the computer server the clinton campaign thought it had deleted. bloomberg media quoting a source saying the fbi recovered personal and work related e-mails from a private computer server used by hillary clinton during her time as secretary of

state. our own ed henry joins us now live. ed? >> good to see you. things could not be hotter for hillary clinton. she's been sliding in the polls. this report quoted one source familiar with the fbi investigation as suggesting as you say, that the fbi recovered not just personal e-mails but work related e-mail. why is that significant? go back to the beginning on march 10th at the united nations. her narrative was that she'd deleted roughly 30,000 personal e-mails just about yoga, her daughter's wedding. and that the rest were work related that she turned over. if the fbi has now recovered work-related e-mails, official e-mail that's were deleted that would, this would be a game changer. and suggest that she was not telling the truth on march 10th. secondary, if they're recovering work related e-mails does that raise more classified

information being on the personal server despite hillary clinton saying no. there is no classified information? i just got off the phone with nick merrill. he is in des moines taking off at the airport, leaving after the event tonight. he told me two things. he said we've always cooperated with the fbi and two, he said we simply don't know what the fbi and does not have. they're in the dark about where this investigation is going. final point, under political pressure, hillary clinton took a position on the key film "pipeline" and said she's now against the pipeline. two, there is an event at the white house with vice president biden, african american leaders and they were chanting run, joe, run. but there is more information spilling out from this fbi investigation in the days ahead. >> i have to ask you this before i let you go. you tell me whether i misread the report. to me, it was significant they

recovered personal e-mails. the report seemed to be suggesting deleted e-mails have been recovered. they have been recovered and now, will determine whether personal or work related. when i read they'd recovered work related i justifyinged they recovered ones they seemed to produce. the bottom line is that they got the e-mails and they're going through them now. >> right. both could be significant is the bottom line. there could be ones that she deems personal and deleted they've now recovered and others say that is work related and something else. in terms of work related, i think that is significant because she said i turned these over to the state department. anything work related. you've right. maybe she turned over 80% of them. 90% of them. there are other work related ones. we don't know. >> her claims are now being checked by the fbi. >> and challenged.

>> if you look at the interview, it says anybody is somebody who is acceptable to me. and then the follow up question to that was about a muslim for president. if i said that anybody who embraces our values and our constitution, obviously the question is asked in context of somebody who doesn't. of course, if they don't, i don't want them to be the president of the united states. it's fairly simple and straight forward. >> well, it was confusing the way it came out. your answer to that second question sounded absolute. you know, no. i absolutely couldn't get behind a muslim for president. so 245's what led to people believing that's how you felt. but you're stating now you have no problem with a muslim being president. you stated today that would be if he would renounce shureah law. is that where you stand?

many have come out and said is that a litmus test? >> bear in mind, in the thor tative doctrines of islam you cannot separate church and state. so, in order to be eligible to be president of the united states. you're going to have to renounce that, which makes you a heretic and an infidel. but as long as they're willing to do that, and to clearly place the united states constitution above their personal believes, that's like anybody else. bear in mind, if there was a christian running and that christian wanted to establish a theocracy, i could not support that person, either. >> um-hmm. do you care, the council on

i love to play silly games. our country does have a problem with radicalism. he doesn't want to say that muslim leaders doesn't want to say that muslim leaders make lely jous liberty for other people. but these are just silly gotchya questions. at the end of the day, i'm the best qualified candidate. looking for some strong candidate to emerge and kick down. your polling numbers are obviously not near the top. what do you make of that message? >> look, i don't think the lnc, the establishment, the donors, should try to pick our candidates.

the reality is we need to fight for our conservative principles. we're building great crowds. i think it's time to fire all the incumbents and the republicans and democratic party. they said they were going to defund my parenthood. they said they were going to stop by the iran deal. i've got more -- i'm actually angry at the republicans. >> they tried. they say they try, but they hadn't voted one replacement for obamacare. >> i wish they'd fight half as hard. they're sparking emotion. it's time 230 fire all of them and elect real conservatives.

a new twist in the republican race for the white house tonight as senator and republican candidate marco rubio hits trump on his foreign policy stumbles.

>> is donald trump qualified to be president of the united states? >> well, as i said, the most important thing a president will ever do is provide for the national security of our country. up until now, he hasn't answered serious questions about national security. up until now, there should be questions about any candidate that's not able to speak with clarity and seriousness about the national security set threat that is we face. the job of the president is to ensure a policy that allows a private sector to grow and prosper. and if you can't articulate that, you cannot be commander in chief. >> fox news, senior political analyst. now, is this the argument about why an older doesn't make the most sense? >> well, it depends on the outsider, may began.

he brought a philosophy and a broad con september of foreign policy with some specificity in details to the task. and that is something we have yet to see as marco rubio krktly points out about donald trump. he makes the point that foreign policy is the province of the government. not just the government, the federal government. the executive branch of the an falls principally, there therefore on the president. and i've always thought the conduct of foreign policy and national defense. that is an area where donald trump, to date, to be fair, to date has not said very much. he said he's going to build the strongest military and he's talked ant his negotiating skills and how he put them to work as president, how he would

negotiate and how he would get along with putin and others. but so far, that's about all he's really given us. he promtss more and perhaps, in time, he will produce more. i do think it's not unreasonable to say that he needs to. >> he's promised more subjects, but then he's had an interesting exchange with hugh hewitt. this is how trump answered. >> you have to have a certain -- people can't know exactly what your tensions are. you want to have a certain amount of -- you want to have a little guesswork. this has nothing to do with lack of knowledge. i will tell you, i don't want to broadcast my intentions.

now, that does not mean if you have a military operation in mind or a particular counter attack of defense that you would articulate that. but it does mean when somebody talks about some possibility like pakistan going rogue, which is certainly not old the realm of possibility, you've got to do better than say i toent want to tell you. i think that's probably not going to stand. i think perhaps he knows that and will attempt to have better answers in the future. over time, he d be -- you know, he'll be expected to have some more specific annals. >> how big of a roll do you think that played in trump's full numbers in that cnn poll. a lot of people are saying look at this other poll.

not just in this race, we don't cite those polls. anyway, how big of a roll do you think the foreign policy exchange that trump had on russia and putin had on the softening side of members. >> it's really impossible to say. i'm a little concerned about that poll. plus or mile nous margin of error. it's hard to know what everybody was thinking. there's going to be more said about this. and more answers will be expected. it would be to raise the issue in a way it comes up again and again and again. >> meantime, trump retweeted something called marco amnesty last night.

>> the last time we did that, the 14-year-old girl was raped in a field. her rapist was found guilty. she was forced to marry him because she was no longer a virgin, was now tainted and unacceptable to be married to anyone educational. >> i don't get it. we are who we are. and these guys sound like they're asking them to sacrifice all they stand for in order to serve their country over there. >> yeah, imagine this, too. you're a 20-year-old kid and you're serving your nation. and on your u.s. base, you actually see child rapists and ped files and hear the screams of little boys at night. and you're told i's an afghan criminal issue. of course there's no policy. but they were allowing this to happen.

i don't know if they don't want to offend the rong people. frankly, i can't get anywhere on this you shall shoe in the armed services committee. >> who can reverse it? who can get martlin back in? >> the secretary of the army. the problem is a former congressman. >> why wouldn't they want this? why are they against him? >> because they're all chummy. they ooir all buddies. we've been bringing this up three or four months now. this martlin case has exposed that there have been hundreds of soldiers and marines now exposed to these child rapists on their bases. this isn't like danny quinn alone and unafraid. this was happening on u.s. bases where you had hundreds, if not thousands of u.s. military personnel.

in jail. >> here why there's an issue. apparently, mark, her lawyer is saying the governor's office looked at the new form and said these are valid. i don't know what the hubbub is about. >> what does the aclu want? do they want her to go back to jail? >> ultimately they want her to issue a certificate that everyone else gets. if she gave marriage a fifth try and she got a certificate that was altered in this way, she would take exception to it. some people feel humiliated. it shouldn't be different certificates for different people. >> that's what the issue is. it's more of how it feels than the actual effect. in other words, the governor -- >> that counts for a legal challenge, arthur? >> i don't think so. the governor has said this is a valid marriage license. unfortunately, this is such a new thing that it takes a while for everyone to kind of come around. she was voted into office, this wasn't the law. >> they shouldn't have to come
