11:00 pm
bore me. john sdoe bore. the literal earl panel. and i l tonight on "red eye," tom brady no longer endorses donald trump. tom, don't you want to make america great again? and jeb bush does the -- says the washington redskins shouldn't change their names because of the way it sounds. i completely agree, jeb, exclamation point. and closet doors everywhere have swung back open. our panel will provide frivoly and mirth.
11:01 pm
11:02 pm
welcome to "red eye." hello, everyone. i'm tom shillue. let's check in with andy levy over at the news desk.
11:03 pm
andy? andy? >> hi, tom. what's up? >> you know the show started, right? >> has it? >> we are supposed to do banter right now. >> sorry, i guess. >> you know, the playful and friendly exchanging of remarks -- exchange of remarks? >> yes. >> this is very unprofessional. >> you are unprofessional. >> let's welcome our guests. she loves to wine and dine, but she skips the dine. i am here with joanne nosuchunsky. he was a lobbyist, but never stood in the lobby. he is so british he calls mesh the colony. national review staff writer charles cook. and he has been on mtv more times than the video for billy jean. next to me andrew schulz. one of the stars of "benders" premiering october 1st, that's today. let's start the show.
11:04 pm
not so fast, donald. tom brady says he didn't endorse donald trump when he made an offhand remark that a trump presidency, quote, would be great. when asked who he was supporting he said something refreshing. i don't know. he admitted, i don't even know what the issues are. i haven't paid attention to politics if a longtime. nor should he of the he is busy. he has enough to worry about leading the greatest team in history to another super bowl victory. i will go one step further. tom brady shouldn't vote at all and neither should anybody who doesn't keep up with thish view -- the issues. i never agreed with rocking the vote. encouraging people to vote for the sake of voting doesn't make the country better. it matches low information voters with low quality politicians. take a knee, tom brady and leave the voting to people like me, people who aren't really great at anything, but have an abundance of confidence in their own opinion.
11:05 pm
>> charles, haven't i just spoken for a lot of americans there? >> in saying people shouldn't vote? >> yes. >> i don't vote. mainly because i am not allowed to, but i would if i could and i would recommend at that point that no one else does. >> democracy is for the few. >> america is to the for democracy. >> watch your mouth. all of the great things are anti-democratic. >> you see it all the time. america is not a democracy. >> the point i was making is all of the good things, due process and the right to bear arms are anti-democratic. >> interesting. rick, you are laughing over there. don't you think -- if everyone who understood the issues voted we would have better politicians? >> not necessarily. you still have to have people run who are good, and i think the system is so messed up about the money in politics and who gets in.
11:06 pm
good people don't really want to run because it is a quagmire. >> if only informed voters voted and the low information voters stayed at home and didn't vote, then all of the money in the world wouldn't help you because you wouldn't take out dumb ads to convince dumb people. >> the problem is i am not for idealism like that. i am more of a realist. i want to deal in the real world. and so if we had the ability to be idealist and we had the perfect candidate and had the perfect system and we can only have the perfect voter, i would be with you. in reality we have flawed candidates and a flawed system and we may as well have flawed voters to balance it out. >> you made perfect sense there. >> anne, i would like you to vote, but maybe not all of your friends. >> okay. that sounds good. none of the other pageant girls. you have a point, especially when it comes to celebrities and endorsements.
11:07 pm
with rock the vote you can see so many celebrities coming out and saying register to vote. you have to vote, you have to vote. the media inflated tom brady's support of donald trump. it is this combination of celebrity and media that enabled these voters to not really be very informed. it is selective information and we are all lazy and will not do a lot of the digging on our own. >> it is hard to keep up with the issues and we are in a show that you discuss issues on. >> i need a celebrity to tell me what to do. >> it is true. schulz, if you don't vote you have no right to complain, right? is that true? >> no. why not? why not complain as well? why is that a rule? >> do you think people who don't understand -- should they vote anyway? like the old mtv, rock the vote. >> yes.
11:08 pm
can you vote on twitter? >> no, you can't and you shouldn't. >> i am opposed to that too. you shouldn't make it so easy to vote. mail in your ballot. >> why not? let people vote. anybody goes to war. you can vote. anybody can get a gun, vote. why are we making a big deal about voting. >> turn down that music, tom. >> get off my lawn. >> i think voters have made some bad decisions lately. for example, the past two obama terms. he was re-elected. i didn't like that. i am telling these people i don't like they are getting out and voting. >> that's different. you just don't like the person they voted for. they have a right to vote. >> say we are not a democracy one more time. >> i think the people not voting can be a really good time. people are content and they are happy and they don't feel the need to change anything. in the 90s, for example, lots of people didn't vote. >> you vote for the person who is most like the last candidate? >> no. it is sometimes the sign that
11:09 pm
they are on the right track. >> you need to vote and if you like what is happening you need to continue voting. >> north korea has 100% voting. do we want to be like north korea? >> no. >> it is time for the most important story of the day. >> jeb bush's candidacy has been a bit of a disappointment. it could all change know that jeb has gotten out in front of a hot new issue that everyone is talking about. here he is on sirius-xm radio. >> what do you think the chances are washington should change the name of the football team? >> i don't think it should change it. >> finally someone is talking about the issue.
11:10 pm
i guess they don't find the name redskins offensive and they don't think the tribes find it offensive. >> i don't find it offensive. native american tribes don't find it offensive. >> i'm good. >> and what about the idea that it is a sport for crying out loud? >> it is a sport for crying out loud. it is a football team. >> washington has a huge fan base. i am missing something here i guess. >> i don't think you are missing anything, sir. >> what do you think? is he getting out in front of this hot button issue? no one is talking about it. >> no one has ever talked about it. the vast majority of voters don't care and they disagree with those who wish to change it. the idea that politicians have anything to do with it and they did get involved. they got involved in the copyright issues is appalling. >> is it appalling? it is appalling.
11:11 pm
>> you raised your hand. >> i care about the issue. why would you name your football team after someone who lost? >> so for the 50th time, the united states has been over run by aliens and they name the sports team after you and you are offended by that? >> you name it after someone who won. >> they obviously think you are a great warrior and they want to honor you. >> if i was a great warrior we would have won the war. >> that's not necessarily true. >> who should they be named after? >> we don't name any teams -- >> who is a name? >> the red coats. the patriots, they are a winning team. that's why they win. the 49ers, what did they find gold? cowboys. i don't know they got girls. they have girls. you have to name them -- you
11:12 pm
don't name teams after -- >> can i be debbie downer and say the patriots are not winning in syria right now because of what the russias are doing to us? >> you opened up the syrian can of worms. >> so this issue you said something i think americans have always -- they look up to the warrior in the indian tribes. the braves, the indians, but isn't it out of respect? every other town was name after an indian. i thought pop warner football? i thought it was popowanna. it was the popwanna tribe because there was so many indian tribes. >> it was popwanna. it is the popwanna football. let's go. >> but it is out of respect, is it not? >> it is out of respect and i
11:13 pm
do have to say i live on an indian tribe. i own a home in palm springs and we live on indian land. we have to pay the indians. the indians we pay our mortgage to are called agua caliente. >> hot springs. i play that. >> 50% of the land in palm springs is indian land. they own land and they are proud of who they are. there is no thinking they didn't win. they have casinos and they have a lot of land. a lot of people are proud of their tribes. i think they are doing well. i don't buy that this is the defeated, oh, the redskins lost. people are proud of their heritage. >> what do people call the agua caliente which is hot water, right? what if we just called them the tea pots.
11:14 pm
>> you are making stuff up. >> it has to be hot water. >> a tea pot warms up the water. they said i don't like to be called the tea pots and they took offense to that. >> but that hasn't happened. >> some native americans don't like to be called redskins. >> let me get you in on this. a lot of young people think the name should be inning chaed. where -- should be changed. where do you stand? >> i like tradition. football confuses me, but i am a creature of habit and i know even if you change the name people are still going to call it what they are used to calling it and what they are proud to call it. i don't think it will take much effort to change the name, but it will affect a lot of people. >> it used to be tradition that you couldn't talk unless you were spoken to. >> that's true.
11:15 pm
>> i am just saying. now you can own a house. >> no, i can't. >> only plants that are pretty can grow in the windy city. a federal appeals court ruled against a company that let weeds grow untamed. in chicago the property owners can be fined up to $1200 for weeds over 10 inches. discount inn, a company that owns real estate, not an inn confusingly sued chicago a city arguing the punishment is unconstitutionally harsh and the ordinance, quote, burdens expressive rights on to the first amendment, namely gardening. the jublg didn't buy the -- the judge didn't buy the free speech argument. homeowners should be free to strew garbage on their lawn. it is all in the name of the first amendment. it sound like a party at my place. the judge compared weeds to garbage.
11:16 pm
one of the weeds got pay back on the judge. >> summertime. >> if -- is the judge's ruling a troubling expansion of judicial power? >> no. i am a defender of the first amendment as you can imagine, but what this gardener is essentially proposing is equivalent to me saying i am allowed to write what i like. i can therefore stack paper seven miles high in my yard. of course i can't. it is a collection. it has thouing to do with speech. it has nothing to do with speech. >> but you buy the ruling on political speech. >> absolutely and flag burning. and if you want to wear a t-shirt that is a line where action and speech are with one another.
11:17 pm
this is not speech. it is maintenance. the conflation of the two is ridiculous. >> i struggled with this issue a little bit because i am aggressive about property rights, the personal property rights. you should be able to do whatever you want on your property. however, if you are doing something that lowers the economic value of my house, i think that's where i have to draw the line. weeds to me, that's -- that doesn't pass the straight face test. that's a bunch of weeds. you weren't there and you let it over grow your house and it is causing the neighborhood to go down in value. i think the judge was appropriate. >> anything that cause itself to go down in value? >> that's where i draw the line. the judge's words were troubling in how far he went to say that means you should be able to do this and that. i don't think he should have gone that far with the
11:18 pm
examples. >> the weeds are not right. >> if your buddies moved into a neighborhood you would lower the property values. >> i don't think you should ever let us into the neighborhood. i come from my parents. i crash there on the weekends. should they be able to grow the weeds or not? >> this is how the dictators become evil. i think in a lot of way these are good guys and then somebody complains and they say i want to grow my weeds 10 feet. just kill them. so the judge is a dictator? >> not the judge. the judge is actually a nice guy. if i was the judge and it wasn't america i would be like kill them and anybody else who has plants, you kill them too. >> what if it was lovely
11:19 pm
flowers. >> if these were flowers no one would be complaining. you know what i love about america is we can defend our bad habits with the constitution he just did a really bad job of it. >> a bit of a stretch. we are in agreement on that. when we come back, good news. matt damon apologized. bad news, not for "we bought a zoo." stay tuned.
11:20 pm
11:21 pm
11:22 pm
another hollywood actor is forced to clarify controversial comments. this time it is screen ledge end end -- legend -- >> matt damon. >> in an interview with "the
11:23 pm
guardian" the" we bought a zoo" star said you are a better actor the less people know about you and sexuality is a huge part of that. whether you are straight or gay people shouldn't know about your sexuality because that's one of the mysteries you should be able to play. the internet immediately unleashed a torrent of anger with headlines reading "ma damon tells gay actors to stay in the closet." so a-list actor -- >> matt damon. >> -- about what anyone accused of homophobia would do. he called his gay friend. here is -- >> matt damon. >> -- on ellen. >> i was going to say actors are more effective when they are a mystery. and somebody picked it up and said i said gay actors should get back in the closet. which is like -- i mean -- it is stupid, but it is painful when things get said that you don't believe, you know what i mean? and then it is represented that that's what you believe
11:24 pm
because nobody -- in the blogosphere are there is no penalty for taking the ball and running with it. >> matt damon. >> that was matt damon. >> go to the gay guy first. >> what do you think? what was matt damon saying? he said there is a lot of mystery. >> the reality is he doesn't want to just keep actors in the closet. he wants all people to be mysterious and not talk about their -- what is so crazy about this is he assumes that no one knows your sexuality unless you say it which i don't know you probably do. you have that gaydar. >> i do have gaydar. i have a really good gaydar. >> i never know who is -- >> that's just -- it means you are straight. >> he can't tell. he is spooning with guys.
11:25 pm
i thought we were friends. >> what are you doing? >> it takes a longtime to figure it out. >> you own too many sweaters. >> he got caught being in his moment of hollywood honesty and then the liberal pc crowt came after him -- crowd came after him. but he absolutely said that it would be better for gay people to just not be out if you want to be an actor because the mysterious stuff works in hollywood. >> what if he said the same thing for people who are straight like being married. the way it helps young stars to be appearing as single. someone like yourself for instance. >> i appreciate the actors who keep their private lives kind of private. they are out of the paparazzi's you know, photos and all of that. and because then when you watch their work, you are really just seeing them perform. for matt damon to say this when he is giving his
11:26 pm
interviews and giving his personal opinions and going on these shows he is not living a mysterious life by offering these opinions. it is like why should i take this man's word when he is saying this? >> do you have a boy friend sphwh -- boyfriend? when did you get a boyfriend? >> who are you dating? >> what does my business have to do with you? >> andrew, do you keep mysterious? >> now i am worried about this guy she is dating. he is probably mysterious. >> you and all of america. it is the guy you keep posting on instagram? >> you follow me on instagram? you can follow a photo or two. >> are we talking matt damon? >> yes, matt damon. >> i see through this [bleep]. he has a movie coming out and this is how you get buzz. you say something racist, homophobic or sexist and every end of every interview or clip that comes out or blog that
11:27 pm
comes out says he is staring in a movie "the martian" coming out. he is a smart dude. he went to harvard in that movie. >> he has plenty of continue verse see. last week he said no black directors on "project green." >> it is part of the controversy. he is milking the system. >> he didn't really say that. he said something that was interpreted as being un unsensitive. do you think it is all publicity? >> no. >> i love this guy. >> it is horrible when people say you mean things that you don't. having said that and given his politics and his readiness to jump on the various ban wagons it is maybe good he experienced it from that end. >> isn't that it?
11:28 pm
>> i don't know his record, but he does jump on the ban wagons. >> he is part of the pc briggade. so the fact that he is now getting whipped back into shape by that same crowd i think is justice. the fact that he made a mistake. that was exactly what he said if taken to the next degree would stay in the closet. the pc crowd came back and he would race to ellen and call up the gay friend and say can i get cover and she is the deputy of the pc briggade. so she will race in there and help as well. it is all hollywood scratching each other's back for a movie. >> he makes an interesting point in terms of -- >> oh i thought i did. >> examine you. and you. >> he starred in the movie about liberace, right? he played a gay dude that liberace and him were boning and stuff. here is the thing, it didn't
11:29 pm
affect him as a stray guy to play the gay character, but unfortunately it does affect gay actors when they try to play a straight character. the mystery only works one way which is kind of unfair to put out there. >> i never saw that movie. >> great film. >> palm springs. >> half time with tv's andy levy. don't touch that dial.

welcome back. time to find out what we got wrong and what we missed from tv's andy levy on the news deck. tom brady walks back donald trump endorse meant -- endorsement. i think i deserve credit for making it through your monologue without vomiting. brady is going to another super bowl victory? i guess that's true if they don't have to play the giants. they won't have to play the giants. charles you said america is not real a democracy. maybe you can take that commie talk with you back to scotland or wherever the hell you are from. >> i just probably read more
11:36 pm
books about america. >> i don't have to read books about america, charles. i am american. >> which language are they written? >> american. >> i will lend you some after the show. >> as long as they are in american. >> they will be. >> you said tom brady shouldn't vote and nor should anyone keeping up with the issues. you should have stopped after nor should anyone. don't vote, people. don't do it. you are buying into the system. rick you said you are a realist and you want to deal in the real world. rand paul 2016? >> oh andy. even i don't believe that is true. >> i never supported rand paul. >> never? >> never. >> not as a candidate. >> joanne i agree that -- he
11:37 pm
never said he was endorsing him and now he backed off the endorsements that he never made. >> i do think too that brady is happy to get any press that doesn't have to do with the flood gate of the he is trying to milk this now for everything and get as many pressers with this as possible. >> that's a good point. andrew said let anyone vote who can fight in a war. it sounds like star ship troopers. >> that's how i live my life. >> it is the ce-ed showers -- co-ed showers isn't it? >> are you right there. >> i am in time square. >> i thought it was a great movie. >> jeb has no problem with the redskins. you say the candidacy has been a bit of a disappointment so far. it is pretty good jeb hasn't had a good campaign.
11:38 pm
>> from that perspective -- >> sorry you are disappointed. they are disappointed are they not. >> charles you said the fact politicians get involved in this issue is appalling which we should make clear is what jeb said. >> correct. jeb2016. >> andrew, you said they need to change the name of the team because you don't name teams after things that lost. not all teams can be named white guys. >> there were white people who like the english. >> don't even start. >> you lost to democracy. >> tell him. you better believe it. >> i felt not enough people got your joke. >> thank you. i appreciate it. i thought it was an excellent joke.
11:39 pm
we also should not have a new orleans pellican. they lost this that oil spill. i'm back! i'm back! i'm telling you! >> judge says weeds aren't free speech. you are about as absolute supporter of the first amendment there is, but this is ridiculous. you said you can't -- you couldn't stack paper as high as you want in your yard. why not? it is your yard. i wouldn't say it is a first amendment issue, but why couldn't you? >> i could do it -- if i do it above a certain point they will stop me because airplanes will fly into the paper. >> thisy will actually blow off. >> there is always ways to stack the paper. >> so many variables. >> rick you said you draw the line at something that lowers the economic value of your house. why?
11:40 pm
why should your neighbor worry about that? >> we like economics and we like pretty things. >> i respect if you were a judge you would have killed the guy. >> yeah, and everybody with plants and of oner vegetables. >> i am all for that. >> those are plants too. >> absolutely. >> i agree with damon that it is great when actors are mysteries. i wish they would shut the hell up about politics. >> good point. >> rick, you said damon assumes nobody knows an actor's sexuality unless they tell everyone. and he says whether you are straight or gay people shouldn't know anything about your sexuality because that's one of the mysteries. but as other people .ed out straight actors who were married talk about their families and they bring their families -- matt damon brings his wife to award shows, so i guess he shouldn't be doing that. >> exactly. the second that a gay person
11:41 pm
talks about their family in anyway it is like oh you are throwing that in our face. but then like every single straight actor can have a wife with boobs falling out and that's not thrown in my face. >> and god bless them for it. >> exactly. >> but he is a total hipocrite on this. you said damon is smart. he went to harvard in that movie . also in real life. >> he didn't go to harvard in real life. not true. >> yes he did. >> not everything you see in the movies is true, andy. >> in this case he did. >> dwre to disagree. agree to disagree. >> this is fun. this is my first time doing this. >> thousand i think he maybe didn't go to harvard. people never disagree with me. i can pretty much say anything i want. you are calling me on it and i like it. rick, you say damon raced to his friend ellen to clarify what he said. to be fair he was scheduled to be on el lean because he has
11:42 pm
the movie -- on ellen because of the movie. >> do you think he brought up to ellen ask me about this controversy? >> absolutely. once it happened it was just incredible timing for him. >> and one more point. i went to harvard. >> so did i. >> yeah, everyone. >> harvard yard. >> gotta go. >> thanks, andy. >> time to take a break. more stories when we come back. now here is what's happening on the next kennedy. >> hello, fans of "red eye." on the next "kennedy, it

jessica chastain is talking about getting people to pouf vees if you look at films like "electra" the problem is studios, they try to make kick ass women sexualized and they have to be in a cat suit. yes that does appeal to the male moviegoers, but women love take sexy moviegoers as well. look at batman. and what about this superhero? >> matt damon.
11:47 pm
meanwhile he doesn't think feminism belongs in hollywood. she explained in an interview that film making is not about gender. you can have five movies directed by women and five directed by men. it create separation. i am having trouble and i will consult with feminist andrew levey. >> who is right on this? >> as a feminist i can understand what ms. chastain is saying. i will point out chastain says as a good campbel she says look at ripley in "ale 11" --" ale -- alien." by the end of the movie she is in panties and a tank top.
11:48 pm
feminism is not about labels and if women are not comfortable with the term feminist it is okay. it is her mouth and her choice. you are agreeing with andy levy? >> yes, and i am also agreeing with the idea of working and having a job with hollywood. there are lots of younger, pretty women who will take your place. if you don't like it, you don't have to work there. we have beautiful women in the movies. they are the reason that guys go -- >> not all guys. it gets gay men that the theater, right? >> skin sells, sex appeal sells. i like jessica chase tan a lot. i believe she challenges the stereo types on a lot of things. she has a point.
11:49 pm
she is the most diverse actress i have ever seen. i think she has the stage presence to be able to say look don't just put me in the bach for certain roles because i am beautiful. >> that's it. she is sexy when she is banging on the glass door in "zero dark 30". every time she wrapped on the glass i was like i love this woman. she doesn't need a skin tight suit. >> why can't we have both? most british actresses are beautiful and not all-americans. there are many films that need women in the scantily clothed outfits. >> what is sexier, cat suit or no cot suit? >> i prefer no clothing, but this is almost a [bleep]
