traction, in swing states, a third of republicans say they would not support trump. his rivals signaling they fear trump less are dispersing their fire. on a three-day swing in iowa to ramp up emphasis on the first caucus state bush dismissed trump as a lightning rod for anger. >> you can't be the large voice in the room disparaging people and dividing people and calling people idiots. >> he zeroed in on rubio for missing senate votes, including an important one in the pentagon yesterday. >> they should vote when there's a reauthorization of the defense bill when they're gutting the military. they should be there and voting for this because it's important. the military men and women need our support right now. >> rubio, who trump before called weak and lazy. toured a business in new hampshire and defended his absenteeism. >> i'm running for president, when you run for president, you're going to miss votes and miss time as other candidates have had to do in the past. >> rubio has missed more votes that are his fellow senators running for president. rand paul missed the least.

tomorrow house republicans will meet to select their nominee for speaker. current majority leader, kevin mccarthy considered the front-runner and has the support of outgoing speaker john boehner. jason chaffetz and daniel webster are also running. webster was endorsed by the house freedom caucus. the full house vote will happen october 29th. we'll have full coverage tomorrow. the senate has passed a $612 billion defense policy bill. the president obama has promised to veto. president is unhappy with the measure increases defense funding while congress refuses to add to the domestic spending

budget. foreign countries are getting important information about people living here in the u.s. maybe even you. but it is not from hackers. it is from the irs. correspondent rich edison tells us how that works. >> the internal revenue service is sharing u.s. taxpayers' personal information with other governments. at least 34 countries like kab canada, mexico and india. says a "wall street journal" analysis. the irs is mostly sharing information of foreigners with accounts in u.s. banks. those says it could also divulge the information of americans living abroad to those countries. conservatives say this is a dangerous practice. >> what we're doing is we're putting the tax collection cart ahead of the national interest horse. we need to rethink whether or not it's a good idea for purposes of bad tax policy, to have these international agreements. >> opponents question whether our countries can safe guard this information.

the u.s. government has fallen victim to hackers accessing personal information of hundreds of thousands of citizens. they point out one data leak could compromise taxpayers, especially foreigners to extortion or kidnapping or ransom demands if foreigners acquire their information. >> all it is is one rogue employee, one rogue anybody and somebody's life potentially at risk. >> the irs claims the data is secure. in a statement the agency says before exchanging with a particular jurisdiction, the united states conducted detailed reviews of that jurisdiction's laws and infrastructure concerning the use and protection of taxpayer data. cybersecurity capabilities, as well as security practices and procedures. >> the reason for all this -- a newly implemented law called faca, designed to address tax evasion, it requires foreign banks to provide to the federal government information about their account holders, who are u.s. citizens. many countries have agreed to do so, as long as the irs offers them the same information about their citizens and residents.

essentially the u.s. is giving information to get it. brett? >> rich, thank you. stocks were up today, the dow gained 122. the s&p 500 finished ahead 16, the nasdaq picked up 43. a federal law enforcement official confirms to fox news the justice department will begin the early release of 6,000 convicted drug criminals, later this month. last year, the federal sentencing commission decided that close to 50,000 inmates would be eligible for the reduced sentences and official says the majority of those released will be transferred to halfway houses and drug rehab centers and a third will be handed over to immigration for possible deportation. meantime an intelligence bombshell. an examination of allegations from a whistle blower who says his bosses told him to soft-pedal bad news about the world's most dangerous neighborhood. senior correspondent adam housely has the story. >> for several years, starting in 2010, form centcom analyst

william says he and his colleagues were told not to report certain facts on terrorism in the middle east. >> it didn't fit the narrative, it didn't fit the current operating theme is that al qaeda is decimating. >> a narrative that meant some significant terrorist activity was downplayed and wouldn't always make it into reports. instead replaced by information about the local economy or even the environment. information that does very little to help paint an accurate security situation for leaders and troops on the ground. >> we were seeing attacks left out of reports. that's what we were seeing and when i would go to the section and talk to them about it, or confront them or put it up through the command, it wasn't being followed through with. so they were just being left out of these reports, which is not giving the commander the proper picture. >> after several years trying to use the chain of command. coatle expressed his concerns to the c.i.a. c.i.a. days later had a security clearance polled. he was instructed to drive to

work each day, but was not permitted to get out of his car. he was assigned to cleaning and trash duty. >> it was a violation of the rules and in now 39 years or 29 years of practicing, military justice. i have yet to see the treatment that was afforded sergeant first class coatle down at centcom, it was horrific. >> coatle was court-martialed last year in what he says were fabricated charges, the most serious, pornography on his computer. he was acquitted on four, one dismiss and he received an honorable discharge. the concern is two-fold. the manipulation of a central intelligence report and the crackdown on a whistle blower. >> this is not surprise me that somebody who is being a patriot, trying to raise some serious issues, raise issues that could actually cost americans their lives, now he's being retaliated against. >> we're supposed to dot right thing and the command is supposed to support that. no matter what.

welcome back to "special report." republican presidential candidate and kentucky isn't that correct rand paul in our senator seat tonight. senator, the latest average polls has you at 2.3%. if you look at the state-by-state polls today, florida you're at 2%, ohio at 3%, pennsylvania at 1%. how do you turn that around and what do you tell supporters who say we're just not seeing it? >> you know, i'm thinking about

going to joke school or something. maybe i need better jokes. i've been told i need better hair, i need to be taller, i need better clothes. you know how many people tell you you have to do something different to bring your polls in. but i'll keep saying what i believe in and that is government is too big, debt is too big and we have to do something. really the problem is not just the liberals, not just the democrats, it's the right and left spending too much money. i'm the only one saying that, that it's really an unholy alliance of both sides. some republicans and some democrats getting together to bust the budget. >> but you're running for president but also running for senator at the same time. >> i'm doing better in that race. >> there will be a decision at some point. when do you think that will come? >> i'm going to let people vote. i think the polls don't accurately represent our organizational strength in iowa. we have chairmen in all 99 counties in iowa, hundreds of precinct chairmen. we have hundreds of students rallying for us. i would hate to give up and say

the students aren't going to get a chance to vote for someone who truly thinks you shouldn't be putting somebody in jail for marijuana, that really we shouldn't be at war everywhere around the world all the time and really that there isn't another way, that there isn't a third way. >> laura. >> transpacific partnership, i know you voted against the trade promotion authority. donald trump is against it. hillary clinton comes out today and is against it. what is your position on the super secret document that nobody has seen? >> i can promise you once i take a final position, i'm only going to take one. hillary has been on both sides of this issue. i don't like tpa giving special authority to the president. i think we have too much power going to the executive branch and away from congress. absolutely i didn't want to give this special power or special pathway for it to come through. i was also very annoyed that the trade agreement was classified. >> why was it classified? >> i have no idea why a trade treaty would be classified. i'm still complaining. when i meet leadership in the hallways of congress, i'm saying

why in the heck do you classify -- >> they don't want people to see what's in it. >> there was some staff members and we spent an hour, hour and a half in there and i'm not so sure i was even given the final copy because the final copy has come out recently. i like to read things so i'm going to read it first. i'm in general for trade. for trade because i think trade enriches us all but i don't like the organization of international bodies controlling our trade. >> three political operatives very close to your operation are about to face trial for alleged pay for endorsement scheme. are they innocent? >> i don't really know innocence or guilt or the law. the law is really complicated. this is sort of campaign finance regulations. and a lot of it is how you report things, whether you report things. in fact many things can be all legal and then someone tries to say they're illegal. and so i really don't know the details of the case. they didn't work for me, by the way. none of these people worked for me. >> isn't this kind of --

>> people going after them? >> are they going after them or are they possibly guilty? >> well, it took four years for people to charge them. the person charging them is in the obama justice department. and i believe the person who's in charge of the investigation testified before congress and when asked 30 times whether he knew anything about lois lerner and all of the other e-mails that were missing answered 30 times that he wasn't going to respond, that he didn't recall. so when someone has been investigated for malfeasance, i wonder whether it is politically motivated. >> senator, thank you. that is it for the panel. stay tuned to see hollywood's consistent take on the 2016
