when writing. please remember, the spin srere looking out for you. breaking tonight. the death of more than 3,000 americans in the single worst act of terror our nation has ever known has now become a political squabble in the 2016 presidential race. welcome, everyone. i'm megyn kelly. over the past 72 hours, we've witnessed reports of a battle between the top republican candidates over an event so horrifying it's reshaped the way we live as americans. it was a clear september day a little more than 14 years ago when our nation changed forever. nearly 3,000 of our fellow citizens murdered when buildings fell, the pentagon was hit. and a plane went down in a pennsylvania field. we saw office workers running

for their lives, as a cloud of toxic dust enveloped new york city. we witnessed a commander in chief take on the role of comforter in chief, as we stood atop a ruinous heap and united a grieving nation. more than 14 years have past since september 11, 2001, just weeks ago the families gathered once more for a ceremony that's become a tragic tradition in lower manhattan. [ bell tolls ] still the tears fall for the children, the brothers, the sisters, for the parents who would never see their child graduate for high school or get married. that is one of the reasons why for the last 72 hours one of the top stories has been the fallout from what happened when the leading gop candidate for president, a new yorker, said this.

>> when you talk about george bush, say what you want, the world trade center came down during his time. >> hold on, you can't blame george bush for that. >> he was president. the world trade center came down during his reign. >> that comment set off a bitter debate between mr. trump. today, a declared republican for president, and his gop presidential rival, jeb bush, president george w. bush younger brother. mr. trump claiming he would have done a better job protecting america. >> i am extremely, extremely tough on illegal immigration. i'm extremely tough on people coming into this country. i believe that if i were running things, i doubt those families -- i doubt that those people would have been in the country. >> in moments, we'll look at the politics of it all with brad woodhouse, who agrees with mr. trump. and new york congressman peter

king who has an issue with him. plus, senator marco rubio is here to respond. but we begin with trace gallagher and a fact check on donald trump's argument that he would have headed off the hijackers here. trace? >> reporter: back in 2000 when donald trump was considering running for president on the reform ticket, he wrote about the terror threat facing the united states. saying, i am convinced we're in danger of a terrorist attack that will make the bombing of the world trade center look like kids playing with firecrackers, though he believed the method would be bombs, not airplanes. but we could find no record of donald trump ever blaming president bush for the attacks of 9/11. and this morning, trump said this. listen. >> my immigration policies were in effect, i don't know that that would have happened,

because i have very, very strong immigration -- i'm talking generally speaking, not just the southern border. >> so we checked the facts. one of the 9/11 hijackers was in the u.s. on a student visa but never attended school. and today, with or without trump's plan, that would raise a red flag. 14 of the hijackers came here on tourist visas. that allowed them to stay for six months. four came on business visas, which allowed them to conduct temporary business. six of them violated the terms of their visas and under the stepped up enforcement of donald trump's proposed visa tracking system, it's likely most of those hijackers would have been identified. of course, his immigration plan is 20-20 hind sight, because there's no record of him touting a similar plan prior to his run

for the white house. >> and at that time he was a registered democrat. my next guest believes donald trump has a good point. brad woodhouse is president of america united for change. brad, good to see you. >> hey, megyn. >> why do you agree with mr. trump? >> the last thing i want to do is come on your program and say i agree with donald trump. what i really disagree with is jeb bush's blanket statement that his brother kept us safe. you could just assert 9/11 happened on his watch and stop there and you would have a strong argument. but if you dig deeper, 36 times between the time president bush was sworn in and august 6th of 2001, he was warned about osama bin laden. he was warned about al qaeda. the very last warning said osama bin laden wanted to attack the united states, new york was a possible target. and he wanted to hijack airplanes. that's exactly what happened.

>> but his defenders say those were general warnings, not specific, and that there was no imminent threat ever communicated to the president in the president's daily belief, which was replete information that the president had to pay attention. >> there was a cia communication in july of that year that did say that an attack was imminent. they eventually walked that back a little bit. but look, the attack happened. he got 36 warnings about the possibility of an attack. and the corollary to this is in the lead-up to y2k, president clinton told his national security czar to hold daily meetings in the white house with the cia and the fbi and we thwarted any terrorist attacks. the president didn't assemble a similar sense of urgency in the leadup to 9/11. >> and you put none of that blame on president bill clinton for ignoring the threat posed by

osama bin laden prior to george w. bush assuming his role in the oval office? >> look, i think president clinton himself has acknowledged that he had opportunities that, looking back now, that he wished maybe he had taken. but when you're talking about this current discussion in the republican party between trump and jeb bush over george w. bush's role, it really just -- you can't assert that he just blatantly kept us safe if you look at what happened on 9/11. others would argue that if you include what happened after 9/11, if you include going to a war in iraq that was prosecuted on false pretenses and what happened to the soldiers there who died and wounded -- >> the iraq war was very controversial and that's been proven. but what jeb bush has been saying is that president bush united us after 9/11. and donald trump seems to be saying he would have done a better job.

and there are real issues some are taking with it. i appreciate you being here tonight. >> thank you so much. >> joining us now with a different perspective is new york congressman peter king, a member of the homeland security committee. there you have it, congressman king, that they all go back to the cia briefings to what george tenant was allegedly telling the white house at the time, warning about osama bin laden. and now donald trump is squarely putting george w. bush at the center of this debate, disputing he kept us safe because 9/11 happened on his watch. >> what donald trump has said is misleading and untrue and what your previous guest has said is untrue. those briefings that president bush got as late as august 6 said specifically that there was no evidence at all of any attack coming against the united states. the attacks they were concerned

about were in europe. george tenant and his memoirs said there was no evidence that there was going to be an attack in the united states. and michael moore and others who started that talk -- >> michael moore you say? the michael moore if >> the michael moore, who donald trump now is sending like a left wing michael moore waco. this is just wrong. you can have honest differences with president bush. on 9/11, he had no warning whatsoever. and he did unite the country afterwards. i lost many constituents on that day. if i thought that president bush had any responsibility for that, i would be the first to talk about it. but after 9/11, when others lost their nerve, president bush not only united the country, he united law enforcement, the intelligence agent scieagencies

brought the country together as far as fighting terrorism with a united voice. the fact is, we have an anti-terrorist infrastructure in place that's prevented any massive attack against the united states. >> president bush has been praised for uniting the country after 9/11, that moment with the mega phone lives on in the memories of a lot of the victims as a healing moment. donald trump has gotten in trouble because on the an ver anniversary on september 11, 2013, he sent out a tweet talking about the anniversary and the haters and losers, do we have it? do we have it? i guess not. in any event, he's gotten into some hot trouble for a controversial tweet seeming to make light on the anniversary referring to the haters and losers out there. in any event, does he have a point? if his immigration policies were

put in place and had been at the seem, you heard trace gallagher's report suggesting some of these terrorists may have been booted out of the country. >> the fact is, i don't know of anyone who was calling for what donald trump is at that time. but 13 of 19 of the hijackers were still in the country that were here legally. if donald trump wants to be commander in chief and he thinks just stopping illegal immigration, is he aware of al qaeda in the arabian peninsula, boko haram, isis? if he wants to be commander in chief, he better understand what this is about. right now he's talking riddles and it makes no sense. >> thank you, congressman. we are hearing more of the presidential contenders weigh in and tonight, senator marco rubio

responds on this political fight. then with israel reeling after palestinian gunman -- a palestinian gunman opens fire on a bus station, israeli officials are encouraging citizens to defend themselves any way they can. so why is secretary of state john kerry saying don't do that? plus, when hillary clinton was asked about gun control, she said we ought to look at what they did in australia, where weapons were confiscated from average citizens by the tens of thousands. tonight, a survivor of one of the worst shooting frees in u.s. history has a powerful message for mrs. clinton. >> i thought, i got him. and i reached for my purse. he was maybe 12 feet away. then i realized that a couple months earlier, i had made the stupidest decision of my life. i took my gun out of my purse. looks like some folks have had it

back now to our top story. since this debate exploded over the weekend, several presidential contenders have weighed in, in the back and forth between donald trump and jeb bush. here now is senator marco rubio.

so mr. trump tried to claim he was not blaming president bush for the attacks on 9/11, but was just saying that he failed to keep us safe as jeb bush has claimed. do you believe he was blaming george bush for 9/11? >> well, i don't know. but i can tell you first of all, the people that were here that conducted those attacks were here legally on student visas. the 9/11 attacks were the result of an intelligence failure of an inability to pick up the signals that something was going to be done, that al qaeda was going to act be nothing was done. so it was an intelligence failure, which is why the next president needs to rebuild the intelligence capabilities of the united states, which have been severely damaged over the last few years by the snowden revelations and other things that have happened. that is what led to the 9/11 attacks and they predate george bush's presidency.

>> at this moment donald trump is giving a speech and attacking you as weak on immigration, claiming your poll numbers took a dive based on immigration. his point is, he's the toughest candidate there is on immigration, and he would have cracked down even on the student visas that allowed these terrorists into the country prior to 9/11. >> six months ago, he was saying he was in favor of legalization of the people here legally. he criticized mitt romney for using the term self-deportation. he can claim that's what he is now, but that's not what he was weeks before he ran for president. >> the other suggestion is jeb bush had a hand no not keeping us safe, because some of the terrorists who attacked us on 9/11 obtained i.d. cards or drivers licenses. does that have any merit by donald trump in >> they were here on student visas, so we have to improve that program. but it was an intelligence failure that led to that attack. again, it's quite frankly had

very little to do with what's facing our country moving forward. the threat we face today is even more serious. it is people living in the u.s., born in the u.s., some who have never traveled outside the u.s. and are being recruited by isis to join their cause. >> there's been a dust-up between yourself and governor bush when it comes to the money raised in your campaign. i raise it because your campaign communication director said here's why marco rubio's campaign has more cash than jeb bush. claiming you had $11 million compared to his $10 million. his communication director accused you of lying about your budget, saying you picked up something in the senate. then jeb bush came out and said you misled people because you have $9.7 million in the bank. he has more than you, he has $10 million. the extra million you have can only be used in the general.

they say you've misled the american people. >> that's publicly disclosed and the numbers speak for itself. the american people are very upset about the direction of the country. they've given republicans a chance to govern, nothing changes. people are frustrated. but this campaign is going to be about that frustration from us and how do we fix it. >> they're saying you misled and the attempt to seize that mantle to be the next leader that you have misled and this is characteristic of a tendency to mislead. they say you had more cash in the bank than jeb bush for president and that is not true. >> well, again, the numbers speak for themselves. they're publicly disclosed. >> then why say you have more when you don't? >> we didn't mislead.

the numbers are there and it shows what we raised. we're very comfortable with where we are as an organization and how we spend our money. the reason that matters is it gives us the resources to talk about what we will do if given the chance to be president. >> marco rubio, now in third place in the latest poll, behind donald trump and ben carson. marco rubio, you are up a couple of points from 11% to 13% and in third place. thank you for being with us here tonight. >> thank you. >> all the best. >> thank you. dr. ben carson has taken heat from the media, but tonight a first. as one publication seems to be encouraging readers to file complaints against the candidate. that's next. plus, the texas teen who became a national figure over a science project that looked like a bomb is visiting the white house. we'll show you where he went while traveling overseas and why

campaign bigger than a flea bite has broken campaign finance law. they will all break campaign finance law in the sense there will be donations received that were improperly done, and in the end, they'll settle up. barack obama, every candidate, everybody has to do this at the end and say this $10,000 went here. but the suggestion at the beginning that ben carson was suspending his campaign to go on a book tour. here's a news flash. ben carson's campaign raised more money than anyone else, and has more cash on hand or had more cash on hand at the end of the last quarter than anybody but ted cruz. give me a break. >> so your point is, if he needed money to get from one city to the next or put him up in a hotel, he didn't have to violate campaign law to do it, he could have just used the money people are donating to him. >> he's not going to lose this

election for the loss of $5,000. it's not like he couldn't get to cleveland on a coach flight. this is the kind of treatment that carson routinely gets because they refuse to treat him as a legitimate candidate. there always has to be something amiss. either it's a scam or he doesn't know what he's doing or something else. >> but, but, the law is the law, and if he traveled and the publisher paid for it instead of carson's campaign, and then he did campaign work, would he have violated campaign finance law? >> well, arguably the publisher would have violated campaign finance law, because the rule in question here is, that corporations cannot make direct contributions to candidates. they can put money into pacs but not spend directly on elections. >> but if you know that that happened, in the case of dr. carson, just click on this link right here. >> if it concerns you, just

c.a.r.e. honored ahmed, the american muslim of the year. but after muhammad and his family met with the president of sudan, a man accused of war crimes and sometimes referred to as the butcher of darfor, there are questions whether the white house shouldn't have invited ahmed to his party. ben, good to see you. so let's just start with the darfor visit and tell the visitors who ahmed with. >> it was the president of sudan, you mentioned, and he's wanted for war crimes. this is not completely unexpected given the fact that ahmed's dad has run twice for president of sudan. it's becoming clearer day after day this was a hoax and a setup and president obama fell for it because it confirms his

prestated biases against police. >> this started with whether the police and school overreacted in what clearly looked like a bomb, but it was in the hand os of a young man who was a muslim who said he was just trying to impress his science teacher. he was placed in handcuffed and everybody said whoa, whoa, don't overreact. but the controversy comes because a, there's questions whether it was an overreaction because it looked like a bomb. but b, the visits he and his family paid in the days and weeks after. how did they meet with a war criminal? he is a war criminal who is warranted -- apparently there's an outstanding warrant for his arrest for his war crimes, including beheading children in front of their parents. >> that's right. and the fact that ahmed muhammad is meeting with him is due to the fact that his family is

politically active. for a guy who assures us that cops are jumping the gun, when it comes to the behavior of the police, the president is constantly shooting first. within the first 48 hours, it was clear this was a setup and the story didn't hold together. >> what is your theory, that the father had an agenda and used his child to advance it? >> absolutely. if you look at the family history, it's clear that was happening. if you look at the clock this kid invented, he took the guts out of an old clock, the wiring, and he put it inside a pencil box and brought this into school. his sister had an incident in 2009 that was similar. >> she said she was a victim of profiling. >> everybody is a victim of profiling, and president obama buys into it, no questions asked. and it got awkward tonight.

it was unclear whether the president was going to meet with him. he meet with him briefly. and that was a bit of a downgrade from the star studded event we expected where the president was going to knight him, give him the order of merit and declare him the greatest scientist inside of newton. >> the new york mayor made september 27th ahmed day. jordan's queen wanted to meet with him. the google co-founder photographed him at google and on and on it goes. ben, great to see you. >> you too. also developing tonight, as america's best ally in the middle east is dealing with what may be the worst terror attack we've seen in weeks, new remarks by john kerry are causing controversy. over the weekend, a palestinian man went on a stabbing and shooting spree at an israeli bus station, at the height of the weekend rush hour, killing one

soldier and wounding at least ten civilians. israeli officials have encouraged citizens to protect themselves any way they can, but secretary of state kerry is suggesting they refrain what he refers to as self help. >> we want to see calm restored and the violence stopped. i think everybody in israel and the region would like to see both of those things happen. we continue to urge everybody to exercise restraint and restrain from any kind of self-help in terms of the violence. >> so after that devastating attack on the israelis, they did fight back, and the murderer, the terrorist was killed. but then another man was also killed who the understanding is

they thought he too was a terrorist but he was in fact an innocent bystander. and that's led to pushback on the israelis, as well. but mark, was secretary kerry out of line in his language? >> of course he was. restrained self-help, as in don't take steps to protect yourself? that's just mindless. he doesn't even acknowledge them to be terrorists. he said in the next sentence, he called them random acts of violence. the same words that president obama used to describe the attack on a kosher deli in paris. these are not random acts of violence. they are premeditated acts of terror being incited by palestinian leaders. the president of the palestinian authority said "we welcome every drop of blood spilled in jerusalem." that's the moderate leadership. hamas is putting out videos giving instructions on how to stab a jew. if they want to restrain something, tell the palestinians

to restrain their incitement of terror. >> how about it, mark hanna? >> that's what john kerry has done. he's told the palestinians to restrain these acts. but megyn, what you said before, basically about this bystander that was innocently killed, he was killed by an israeli security forces and then there was a mob of angry israeli jews that basically were kicking him in the face and throwing -- >> let me ask you about that. it sounds like the israelis believed wrongly that this guy was part of the attack. it's not like they were just sitting this and decided to kill a guy. this was a terrorist attack under way. >> it speaks to the amount of tensions flaring up in the region and any kind of bluster isn't going to solve that. there's no question that israelis have the right and the responsibility to defend themselves. nobody is telling the israelis not to defend themselves.

what they're saying is a steady hand is required. we can't get into this cycle of retaliation that's happened for the past 60 years. to say this is a problem of the obama administration, this has been going on since barack obama was alive. mark knows that. he's a smart guy. >> you're doing the same moral equivalency the obama administration is. i don't see any israeli leaders putting out videos how to stab a palestinian. president abbas gave a speech -- >> let hanna finish. >> they're inciting terrorism. the president of the palestinian authority gave a speech a few days ago where he said we pledge we will not allow filthy jewish feet into the holy sites into jerusalem.

they're inciting this. >> go ahead. >> the head of the palestinian authority has a tremendous record of saying hateful rhetoric using this kind of terminology. but do we hold netanyahu and the israelis to a higher standard? you bet we do. they're a liberal democracy in that part of the world with an advanced economy. we have a deep heritage we share with them. so we hold our friends, our allies to a higher standard. so for those people out there pointing and comparing these two, they're the ones making a moral equivalence, not the obama administration. >> i have to go. great to see you both. also tonight, new fallout from what happened when hillary clinton was asked about gun control and she endorsed a plan for mass confiscation. and judge napolitano

australia. trace? >> megyn, when hillary clinton made the comment that a gun buyback program was worth considering, she added she's not sure how it would be implemented in the u.s., but said, the australian government, as part of clamping down on automatic weapons, offered a good price for buying hundreds of thousands of guns. that was in 1996 when 946,000 guns were bought back and destroyed and it wasn't just for automatic weapons, it was for pump action shotguns and rifles and semiautomatic. and it wasn't voluntary, because the guns were registered. if you failed to join the buyback, you risked being thrown in jail for possessing an illegal weapon. overall homicides went up after that. there have been no mass shootings since 1996, but gun ownership in australia is believed to be the same or higher before the buyback. the national rifle association
