confederate flag group charged with gang related crimes. >> i don't have safe at all. >> caution, you are about to enter the no spin zone. the factor begins right now. ♪ ♪ hi, i'm bill o'reilly. thanks for watching us tonight. kate's law, donald trump, and ben carson. that is the subject of this evening's talking points memo. as we predicted here on the factor, democrats in the senate blocked a vote on kate's law today. that is the bill that would impose a mandatory five year prison sentence on any illegal immigrant convicted of an aggravated felony who is deported and then returns after being deported. five years mandatory. the reason the democrats blocked kate's law is that it was attached to defunding

sanctuary cities which the left does not want to do. foolishly, instead of simply voting straight up on kate's law, the senate put both pieces of legislation together. everybody knew that would doom the vote. everybody knew it yet, the republican leadership did it anyway. that's what makes americans furious with the political system in washington. on gretchen carlson's program today senator rand paul actually tried to justify the situation which is just another reason paul will never be president of the united states. the truth is, politicians are playing games with our safety. >> democrats believe -- local law enforcement are better judges what keep their communities safe than donald trump or bill o'reilly. the safety of our neighborhoods and local committees should not be a pawn for a republican latest gamut tied to failure to act on comprehensive immigration reform. >> senator reid are, the

five times, and you can't get a strict law punishing illegal alien felons passed? when that happens, you don't have a functioning government. it's hard to believe but the far left in america actively opposes kate's law. recent editorial in the "new york times" actually sympathize with the man charged with killing kate, quote: mr. lopez sanchez was a homeless man with drug convictions. but no record of violent crime. the bullet he fired was found to have ricocheted off the pier, suggesting that he had not targeted anyone. the suggestion that it was a horrific accident could well be true, unquote. well, here's' the truth. juan lopez sanchez was convicted of seven felonies in the u.s.a., including selling hard drugs. he was deported five times.

he came back six times. he broke into a car in san francisco. he stole a gun. he recklessly fired that gun in a public place. and kate steinle died. yet, he is portrayed as a homeless man who just might have committed an accident. it's unbelievable -- unbelievable is too gentle a word. finally, i'm not going to give up. senator charles grassley, a hero on kate's law, is trying to get a stand alone vote. >> thanks to many people, including t v's bill o'reilly, for keeping this issue constantly before the people of this country. this part of the bill then thamed by bill o'reilly commonly referred to as kate's law has become so important to many americans.

kate's law is all about a mandatory sentence on people who should be locked up for a mandatory period of time. bill, you actually have to have the guy to convict him and put him away. sanctuary cities prevent you from grabbing the guy as you know. the san francisco police had the guy. and when dhs said hold him for us, we want to get him, they said oh, no, we are a sanctuary city and they released him. in order to get him, you have got to end sanctuary cities. >> okay. look, i'm for ending sanctuary cities. the way i would have done that if i were mitch mcconnell would be to get kate's law passed first. i hope you are wrong on that. >> i hope i'm wrong, too. >> i know there are some far left nuts in the senate, but their seats are at risk if they vote against this law. because any opponent can just hold that up and say you want this irresponsible person as your senator? so that's number one. but you get that passed first. then you go back to

sanctuary city defunding. all right. because at least you get something out of it. right now nothing is out of it. >> but there is no reason we can't go to kate's law by itself. i'm afraid that they are not going to pass it because they are so adamantly opposed to any mandatory minute municipal sentencing. i hope i'm wrong and you are right. >> that would destroy the democratic party which is what the republicans should want. >> we ought to have that vote and put them on record. >> that's right. >> we can separately have the vote on ending sanctuary cities. >> that's right. >> they don't work without each other, bill. they need both. >> i have talked to all of the senators who had questions about the mandatory sentencing. there are some republican senators who don't like that. i said to them, look, this is about protecting kate steinle and everybody else. it's too late for kate, but it's not too late for everybody else. but, in addition, if you have kate's law, law enforcement then can sweep out of the gangs because it's a crime even to stand on the street

then. if they have an aggravated felony conviction. they don't have to make a case against them. they sweep them up. that destroys the criminal alien gangs. let the democratic party vote against that. but you have got it really make the case for the american people so even liberals, not crazy left, but even liberals say, you know what? this is wrong. pressure is what's going to get this done, senator. >> i totally agree and that's why your role in this is frankly indispensable because of the bully pulpit you have. that's why we should have a vote on a free standing kate's law but also a vote on a free standing bill that defunds the sanctuary city because we need them both. >> that's fine. >> i have made that case to our leadership and i'm going to make it again we ought to have those votes. >> now, i want you to tell senator mark kirk, a republican from illinois, that he better wise up. he was the lone republican who voted against defunding sanctuary cities and kate's law. he better wise up, this man.
