this wednesday afternoon, he is not running but he will not be silent. that from vice president biden today, finally putting an end to months of guessing and all those pointless polls, asking what if? the vice president made the announcement in the white house rose garden. his wife and the president at his side. vice president biden praising his boss, saying it would be a tragic mistake if democrats do not run on president obama's record. his tight relationship with the white house highlighted by having some of the president's closest add visors watching him in the front row. the vice president said he didn't see any way he could win the nomination this late in the game. he mentioned his son beau who died of cancer in may and reportedly urged his father to run for the white house. vice president biden called beau his inspiration but said it was too late to join the race. he will continue to fight for the causes he supports. education ending in equality. vice president biden seemed to take a final swipe at the person

candidate 24 hours ago, when he was hitting hillary clinton in a speech in washington. he did the same in the rose garden. some of his advisers tell me he wanted to jump in but made a simple calculation as he did a final gut check, which is that he had taken some time, understandably so, to go through the early stages of the grieving process over his son beau's untimely death, and simply concluded he could not win. if he could not win, he didn't want to jump in. listen. >> i've said all along, and i've said time and again to others, that it may very well be that that process, by the time we get through it, closes the window on mounting a realistic campaign for president. that it might close. i've concluded, it has closed. >> now, you mentioned predictions on monday. fox news reported that three people close to vice president biden were saying they expected him to announce.

they didn't say that he was actually announcing. joe biden sent the same signal to the head of the firefighters union. they had multiple phone calls. this morning, he said on cnn that he was gathering the troops to go out and help elect joe biden, and said he would not be doing that unless he had gotten the signal that joe biden was getting in. we are now learning from a senior administration official that joe biden made that final decision last night. by the way, our sources on monday said he had not made that final decision, he was going to go through a gut check. came to the rose garden today and said he's not running. >> all clear for the hillary clinton express? >> yes. look, think about what's come before this. 24 hours ago, you had jim webb, the more moderate democrat who didn't get a lot of traction but was still out there as a potential alternative, he got out of the race. said he might run as an independent. just over a week ago, hillary clinton had a strong debate performance, the first in las vegas. the field is clearing for her,

now that vice president biden is not getting in. she put out a statement a short time ago, saying, quote, like millions of others, i admire his devotion to family, grace in grief, grit and determination on behalf of the middle class and unyielding faith in america's promise. it's a record to be proud of, defend and build on, and i'm confident history isn't finished with joe biden. there's more work to do. if i know joe, he'll always be on the front lines, fighting for all of us. in the last few moments in new york city, bernie sanders, a democratic socialist senator says he respects the decision and praised the president and vice president for making progress in the last four years. it's clear, we knew that barack obama couldn't run again. now his running mate, joe biden, is saying he's not running. the race is on to succeed them because they're both out, joe. >> race is on. thank you. let's bring in a democratic strategist who worked on hillary clinton's senate campaign. also the co-founder of the accountability project, a

results for us. >> you saw donald trump has 2 1/2 times the support of new hampshire. that's jeb bush's must-win state. these are not good for the former florida governor. the super pac that supports him has been spending money and fighting back up in new hampshire or the air and other states, as well. doesn't seem to have moved his polls in the slightest. there's another debate a week from tonight, and bush is planning to go after trump's credibility. voters are more doubtful than confident about the candidates making good presidents. the washington street journal poll says carson leads, satisfy thad he could do a good job. 50% are pessimistic about how he's do in the white house. rubio and carly fiorina are second and third. by a better than 2:1 margin, bush, cruz and trump are viewed by pessimism more than optimism. bush was in a nevada on federal land use. he wants to use the interior

department out of washington and put it out west so it'll be closer to the people and the land affected by government's actions, or up actions. trump supports the government's use of imminent do mamain. so far, this event, bush hasn't mentioned it, you'd think there'd be an attack, but trump seems to go up and bush down. >> good to talk to you. thanks. the biggest real story in washington right now is who will be house speaker, or whether there will be one. remember, it's the top of the republican food chain. the first republican in line for the white house. what we're seeing now in the way of who is running may not be real at all. congressman paul ryan said over and over and over and over again, he does not want the job. yet, sources are telling us his moves may be strategery so he can say, i tried. but this is not going to work. why is that?

in washington, often, things are not what they seem. think congressman paul ryan is actually running for speaker of the house? he said from the beginning he does not want the job. said it emphatically. some capitol hill sources tell fox news congressman ryan is trying to torpedo his own

chances. he likes the job and life he has now. since he's called the one who can unite the fractured republicans, he's at least putting up the appearance he's in. the conditions are the key. congressman ryan demands the endorsement of every major republican caucus. all of them, which includes the hard line freedom caucus, which has its own candidate for speaker. he's calling for an end to the freedom caucus' biggest weapon, the motion to vacate, to remove the sitting speaker. he wants the rule in place that they can't fire him on the whim. several hard liners said that's a non-starter. congressman ryan is set to meet with freedom caucus members later today. the congressman is happy with his current dream job, heading the ways and means committee. becoming speaker would be longer hours, more time on the road and less time at home, not ideal for the father of young children. party leaders have been begging him to run, to end the chaos that kicked off with john

boehner's surprised and pushed retirement. some gop insiders are telling our capitol hill producer that congressman ryan knows his demands are much too high for the hard liners. they'll never accept it. that's why he's making them. he can tell husbais backers, prt and future, i tried. one source calling the thing, congressman ryan's ruse. somehow, federal republicans give into all his demands, he'd have the speaker job on his own terms. and with the blessings of all his colleagues. that's a long shot. none other than harry reid endorsed him. i'm a fan. harry reid? think how that sits with the hard line conservatives. how not to win republicans and influence them. often in washington, things are not what they seem. john boehner tells fox news he expects to be out by the end of the month. then who watop the

republicans in the house, trying to persuade the unpersuadable republicans? let's bring in a senior politics writer. ryan's ruse, says our producer on capitol hill. do you buy it? >> that's quite a plot if that is true, but even if ryan were to become speaker, which seems less possible now than it was earlier this week, given on the reporting you just recited, he'd be a weak speaker because he doesn't seem to want it. he doesn't want to fight the battles. he wants everyone in line. the freedom caucus, the hard liners. they have to salute. you know, there's always going to be another battle to fight, another battle that the speaker has to navigate down the road, whether it be to vacate the chair, the debt ceiling, planned parenthood. if ryan doesn't want the fights now, what makes anyone believe that he's going to have the steel to want the speakership

three months from now or a month from now? boehner may have to hang on longer. >> who can look at congressman ryan's demands and think he wants the job? you want to take out the motion to vacate. i don't want that. i have a political future ahead of me. i have children at home and i'm not going to be on the rose for you raising money, which is what a speaker does. i'm not doing that, republicans. we're going to do it my way or the highway. that's not a way to get elected. that's a way to say, i tried, isn't it? >> it's just another reason for all these freedom caucus members, the house liners that are going to be inclined to oppose him, to say, of course we can't support him now. they're coming out today with statements one after another. the top reason is, not that he's not conservative enough, that's what we were hearing before, now they're saying, he doesn't want it. why would we give it to him? >> john boehner just spoke on

24 minutes past the hour. three high school students from new york accused of hacking into their school's computer system, changing their grades, changing the schedules of 300 students,

including themselves. police arrested them yesterday. a menacing lot, aren't they? they're all subpoe17 and pleade guilty. a yuj judge released them witho bail. this went down on co man orkcom. the charges could put them in jail for years. what else are we learning about what happened here? >> shep, i spoke with the lead detective on this case, and he says one of the students put a device called a key logger on a school computer that teachers use. it recorded all the key strokes. that's how the student was able to get teachers' passwords to change grades and school schedules. the detective says while some may consider this a teenage prank, there are serious consequences. here's why. >> i have students that are high school age and in the college application process, you know, these are very competitive things. the integrity of the academic

system is really very important. >> the school actually noticed it had been hacked back in june. shep, the school district notified police. it took a measure to prevent further access and to crack tor the information. >> what are the students saying? >> right now, their attorneys are the ones doing the talking for them. of the three students, one is accused of essentially being a ringleader. according to police, daniel soares did the hacking and changed some of his own grades. police recovered evidence that shows alex mosquera asked soares to change a schedule, and vaysman asked him to change grades. they deny the allegations against them. if there was a conversation about grades, it may not have been serious. >> this is what kids talk about. it's been portrayed in movies, this scenario. kids joke about it, getting access to grades and things like that.

survivor of a deadly beating in a church in new york said he tried to save his brother's life by cpr after the brother collapsed after a relentless

beating. the survivor made the comments while testifying against his half sister. prosecutors say she, the teenag teenagers' parents and other church members got together and brutally beat the 19-year-old brother as part of a twisted ritual to get him to, quote, confess to sins, unquote. cops say the 19-year-old brother died in the hospital. they say the suspect had punched and kicked the victims, hit them in the genitals and whipped them with an electrical cord. that is said to have happened last week at the secretive word of life church in the town of new hartford, east of syracuse. neighbors call it a consult. they've heard dogs barking, chants. followers shun the outside world. the mother's lawyer says his client was too weak and timid to stop the beating. he's also suggested the church ritual was a response to rumors that the brothers had molested other members. investigators say there is zero evidence that the brothers ever

hurt anybody. rick is live for us this afternoon. rick? >> reporter: shepherd, the judge would not allow cameras to record christopher legend's testimony. just the walk in and out of court. he was meek, timid and difficult to hear even from the front row. he only looked at his sister one time, when he was asked to identify her in the courtroom. chris said he and his family were in church services from noon until 7:00 or 8:00 p.m., and told to stay after for a meeting, where he and his brother lucas were asked questions. he didn't say what about. when he stopped answering questions, he said the beatings started. first with a punch to his stomach, then an electrical cord to his chest, back, legs and genitals. when asked who was beating him, he named his parents, half sister, sarah, who was in court today, and fellow church members, joseph, david and linda. chris says he was forced to wear ear muffs so he couldn't hear

conversations, but later watched his brother suffer and die. >> why are the parents the only ones facing manslaughter charges, rick? >> reporter: well, the da says it's possible the charges could be against the other defendants who are now charged with second degree assault. especially, that could happen, considering chris' testimony was all six of the defendants took part in the beatings of him and his brother. other people could also be charged, including the pastors, tiffany irwin, who chris says orchestrated the punishment. the da spoke about it after court. >> we are looking at everybody that was involved in this incident. we will present all of the information that we have to the grand jury, along with the charges that were originally filed and any other charges that we feel are appropriate. that would include depraved indifference murder. >> that grand jury will meet sometime in the next 45 days, shep. >> rick, thanks. a supervisor at the immigration and customs

enforcement agency is accused of recruiting his employees to have sex parties with his wife at his home while their kids were in their rooms watching movies. that's according to the san diego union tribune newspaper, smh. it reports the agency is investigating the claims. the newspaper reports it obtained a complain that shows the supervisor recruited immigration and customs employees during work hours, and that in some cases, the workers were rookies who may have felt intimidated or felt maybe they'd get a promotion. the newspaper reports the supervisor's wife also worked at the agency, and part of the complaint reads, and i quote, kids are told that mom and dad are working on a project with the other couples and not to disturb them, nor knock down the bedroom -- nor knock on the door for at least an hour. ice officials released a statement that reads, it does not tolerate abusive or inappropriate behavior, and takes allegations of discrimination or misconduct

extremely seriously. we have a senior judicial analyst. sex parties in the house there with the kids watching the movies. >> that's the problem, is the location. i don't want to start an epidemic of this, but sex parties are not a crime anywhere in the state, obviously. it's consenting adults. but if you do it in the proximity of children, that could be impairing the welfare of a child. it could even be endangering the child, which is a higher degree of crime. it would depend upon the perception of the child as to what's going on there. what the government is concerned about is an intimidation factor. the workplace can be intimida intimidati intimidating. your boss says, i want you to come to my house and have sex with my wife, are you free to resist? now, asking that question is not a crime, but it can get you fired and it can give the employee who was victimized a cause of action against the federal government for creating and preventing a hostile work environment. >> the government has to do something. >> yes. the government has to

investigate. its failure to investigate will perpetuate a hostile work environment, or will make the case easier to prove when it goes to a jury. hey, judge, they knew about this. we complained. did nothing. the government's hand is really forced here. >> this report says measures were apparently taken to ensure the privacy of all parties at these parties. employees were not allowed to bring their cell phones into the home, and they were checked upon arrival at the sex party houses. the complaint also says, and i quote, the parties take place while the kids are watching movies in their rooms. kids are told mom and dad are working on a project with other couples and not to disturb them or knock on the door for an hour. >> the more organized this is, and it sounds it is, the more repeated it was, the more regular it was, the easier it is for these people who orchestrated it to be fired and for the people who were there, claiming they were intimidated, to bring a lawsuit. >> apparently, there have been a

newsroom. good to see you. in new york city, a police officer died after a suspect shot him in the head. the police commissioner said the officer and his partner were chasing an armed bike thief 120th street and fdr when they got into a gunfight. the officer died at a hospital. cops found the shooter five blocks from the scene on 125th street and first avenue with a gunshot wound to the leg. dozens of the officer's colleagues lined the hospital driving, saluting as the ambulance carried away his body. the commissioner called holder an extraordinary individual with an exemplary record. he was a five-year veteran of the nypd. he's the fourth nypd officer killed in the line of duty this year. his father was a police officer. his grandfather was a police officer. he is being remembered by new york's finest today.
