across western mexico. here's a look from space at the sheer size of hurricane patricia. it's now been downgraded to a tropical depression. mexico breathes a sigh of relief that things weren't so much worse. texas meanwhile is bracing for heavy flooding. a powerful storm system has already soaked that state, flooding roads and derailing a huge freight train. now the remnants of patricia will bring more of what they need the least, rain. much of texas is under a flash flood watch. fox chief meteorologist is tracking it all from the fox extreme weather center. rick, looking behind you, it looks pretty bad. >> well, hereby's the deal. it was the strongest storm we've ever seen in the western hemisphere. but it wasn't the biggest. it's actually a very small storm in size. only extending out around 30 miles from the center of the storm. it kind of this readed the needle here. there's not a lot of population. it's also not an area we've been

able to get in or they've been able to explore and see what damage has been done. been hearing a couple reports there is extensive damage here. once they can get through all those roads that have partially beenwashed out. that right there, very quick moving. any time you have a hurricane move over land. especially the kind mountains here in the sierra nevada. now, that's one storm. want to show you another storm. remember last week, we had all that flooding across southern california, those mudslides. then the dust storms and floods in arizona. now here towards texas. or we had it earlier this week. this is seven days of a storm. now drawing up a lot of moisture here from patricia. now those two things come together. that moisture is bringing big problems. we've had big problems in texas for days. now it's going to be enhanced here across this eastern and southeastern coastal areas in

texas other the next couple of hours. major flooding going on. the town up here in navarro county has had over 18 inches of rain in 30 hours. there's going to be more coming throughout the day today. significant flooding. anywhere you see this red, we have flash flooding going on. includes areas just to the south of san antonio. i think the worst of that rain is going to be pulling off towards east. by the time we're done with this today into tonight, we're going to see another few spots maybe 8 to 12 inches. tomorrow, it really targets still eastern texas. take a look at this. parts of louisiana, parts of mississippi, potentially seeing a plus-12 inches of rain. flooding event. >> some of those places have already been hit so hard already this year. thanks, rick. >> mexico is spared the brunt of patric patricia. but mexican officials are warning residents not to let

the university before the football game. evidently there was a car that crashed into one of the crowds there along the parade route. there are reports now of multiple fatalities. oklahoma state university has set out a tweet reading, quote, oklahoma police are saddened by the tragic incident. our thoughts and prayers are with those affected. obviously, it's a very fluid situation there. police are there investigating, trying to figure out if this was an accident or perhaps this was intentional. we're going to bring you the very latest information as it comes in to the fox newsroom. as we move on, it's just a couple of hours. in just a couple of hours, the body of the first american soldier member to die fighting isis in iraq will come home. army sergeant joshua wheeler's body is set to arrive at dover in delaware. he was shot during a rescue mission that saved 70 hostages from the islamic state where

they had them held in a prison in iraq. he later tied of his injuries in a firefight. the 39-year-old soldier is being hailed as a hero whonto the gunfire to defend his kurdish partners who were taking the lead on that raid. we're going to take a look at sergeant wheeler's remarkable life coming up a little bit later in the show. it is remarkable. just look at that large chest of medals. plus, two congressman weigh in on if the death marks a change in the u.s. mission in iraq. we'll bring you the arrival ceremony, what the military calls a dignified transfer, live as it happens this afternoon. with only 100 days until the iowa caucuses, ben carson is knocking donald trump out of the top spot in the state. new iowa polls show trump's numbers there are slipping and carson is taking the lead.

the man many thought would be the republican front-runner jeb bush is drastically cutting his campaign staff and focusing more narrowly on early states. bush is in charleston today where he spoke to a crowd of hundreds and will sit down for a town hall meeting in just hours. garrett tenny is following all the developments and he joins us now in studio. >> jeb has done well on several fronts. fund-raising, leading the way among republicans, as well as organization and size. all those things cost money though. they haven't been showing up in the polls. that has a lot of top donors concerned about what the future holds. on friday, his campaign announced its taking a more lean and mean approach going forward, cutting payroll, downsizing its headquarters by more than 50% and reducing travel costs by more than 20%. bush told reporters in south carolina not to worry and said he's going to put more focus on early primary states.

>> they're not really cuts in the sense of we're asking people to move out into the field where it matters. we have i think the largest campaign operation in south carolina. it's going to be bigger. it's going to be focused woining. >> the first in the nation state of iowa has a new leader among gop candidates as well in dr. ben carson who takes the top spot from trump in two separate polls released this week. carson jumps ten points from the last iowa poll in august with 20% of likely gop caucusgoers choosing him as his favorite. trump fell four points to 19%. yesterday, dr. carson was asked if he now expects to be a target of the donald. >> well, guess it really depends whether he's a gentleman or not. if he does attack me, i will continue to talk about the issues. you know, i just really don't buy into the whole attack here. i'm just not going to do that. >> last night, trump didn't hold

so what will happen at the final vote, expected next week? one member of the freedom caucus, congressman nick mulvaney, joins me now. you had said previously a small handful of members had reservations. >> well, some reservations. come in mind, our support for him was not an endorsement. we were not able to get the requisite level of support within the conference or within our caucus to actually endorse. none of us were interested in given into his demands. specifically, the demand that we change the rules of removing the speaker. >> okay, so you said he had to meet your terms. i assume you had to meet some of his. what were his terms for you? >> the ones we don't really spend that much time on is he wants to spend more time with his family. he doesn't want to travel on the weekends and so forth. to be honest, we didn't ask

those questions. if you can do the job, you can do the job. we don't really care which days of the week you work. we're just going to look at the results. the issue for us was he wanted to change those rules regarding vacating the chair and we simply weren't interested in doing that. it's a long standing constitutional tradition in the house. we're just not interested in doing that. we had some conditions with paul about trying to change some of the rules. we were satisfied he was committed to those changes. we feel like he was willing to do what we asked him to do. we weren't going to give in to his primary condition on removing the speaker. >> is there a conflict there? you said you do back ryan but as a group you don't necessarily endorse him. we know you were endorsing a congressman out of florida, congressman webster. what's the distinction there? >> it's one of those internal rules that probably is boring to everybody. if 80% of our group votes a particular way, we try to vote

as a bloc. we simply said, look, we can't get to that 80% threshold. we got to almost 70% which is a pretty good number. we said look, you want 70%, we'll give it to you. >> if you don't have that 80%, are you assuring your constituents at home you'll be working with the potential new speaker of the house? >> well, i mean, i imagine paul's going to be the speaker. i look forward to working with him as speaker of the house. i don't understand that question. >> you said you don't have the 80% but as a group you do need to work with the speaker and the other factions in the house. can you assure the constituents you'll be willing to make a compromise? >> in terms of the speaker, yes, we're going to support ryan now that he's running for speaker. there are members of the house freedom caucus who will not support paul. there are friends of webster. there's honestly some people who have had some bad history with paul. specific to those men and women.

we are continuing to learn more about that horrible accident. oklahoma state university's homecoming parade. we're just now getting in still photos of the scene. authorities say a car crashed in to a group of spectators along the homecoming parade route. we know and have confirmed multiple injuries. local reports there in oklahoma say at least two people are dead. what was the motive if it was intentional? obviously, you're look at a picture of one of the many medical helicopters that flew there to stillwater, oklahoma. we're told at least four medical helicopters were dispatched. oklahoma state university sent out a tweet reading oklahoma state university is saddened by the tragic parade incident earlier this morning. our that's rights and prayers are with those. a big investigation there going on in oklahoma.

budgetary issue and nondefense spending than he is about defending this nation and the welfare and protection of the men and women who serve it in uniform. >> republicans claim president obama's veto the defense authorization bill is nothing more than playing politics at the expense of america's national security. the bill funds the pentagon and passed both houses with bipartisan support. we're going to hear from the republicans in a minute. first, to democratic congressman of the house armed services committee. we understand you voted for the bill originally. know you have some reservations. are you going to keep your vote to override the president or switch and why? >> i certainly do have reservations. of course the department of defense ashton carter was very clear about the concerns he has and the way in which the present bill that is vetoed is

structured and paid for. he says and i have to assume it's correct the way it's put together does not meet the needs of the military. hampers their ability to defend this nation. those are his views on it. i suspect the president at least took that partly into account. there's the question of the limitation called sequestration and the way it affects not only the department of defendant but also the other necessary parts of government. the fbi, other agencies that do protect this nation here on the homeland. all those things are in play. the president was very clear. he was going to veto this bill. help said so for the last six, seven months if it was not put in a certain form. >> i guess i'm -- >> so where i'm going to go on this -- to your question. i would hope we would do so.

i think the president's veto ought to be taken seriously. we ought not overright it. and solve the problems the department of defense has with the present bill. >> i'm going to take this as a no you're not going to vote for the overright. are both sides playing politics or managing to in a corner here in the sense one of the president's big issues is it prohibits the use of money from this bill to transfer prisoners to guantanamo. can you articulate any other reservations you have with how this bill is structured and what it does that doesn't affect the military in a good way? >> well, there are many, many parts of the bill. it's one of the most complex bills congress passes every year. i do have serious reservations about it. this bill puts us on a path to spend $1 trillion over the next 25 years on rebuilding our entire nuclear arsenal. when i happen to think there are

things that are much more important within the department of defense to spend our money on rather than rebuilding all our nuclear bombs and delivery systems. i have a very serious problem about that for example. we're going to have to spend money on dealing with the fact that terrorism is real. we have to spend money on upgrading our troops making sure they have the right equipment available to them -- >> you don't think this bill -- >> no, and i think it also does restrict the programs that are within the department of defense. the way in which a destructionist -- does not give the department of defense the long-term certainty of funding that is necessary for programs that literally go on for decades. that's a very, very real problem in the detailed management of the department of defense. the bill is not structured in a way that provides that kind of certainty. those are structural problems that can and should be dealt with. we do have an opportunity to deal with this in a way that solves the structural problems

need us the most -- >> when you say -- >> we had a soldier killed yesterday in iraq -- >> we're going to get to that -- >> -- we have no budget -- >> congressman, we're going to get to master sergeant wheeler. i want to understand, help us understand, by this veto, does this mean our troops aren't going to get paid? does this mean retiree benefits? what is the real effect of this veto on the military and those who risk their lives everyday to protect our country? >> this is the entire military defense budget. it has to do with pay. it has to do with paying the troops out there right now. more than anything else, giving absolute assurance to the families that are watching our brave men and women go fight for freedom and keep the fight off of our soil, and i think it's the most reckless thing i've seen this president do. that's my bill. that's my amendment in there. i've had it three years in a row. what the president seems to be doing, the reason the nation

should listen today, because the president is more concerned about bringing terrorists with american blood on their hands to u.s. soil. i simply am saying not a chance. >> well, you're saying it. we'll see if it becomes law as it relates to gitmo. obviously, the president wants to be able to do what he wants when it comes to that. one of the reasons he vetoed this. i want to move on to the point you brought up. master sergeant wheeler. who quite literally ran into a firefight after he was sent there in a support mission. do you think this changes the paradigm of the u.s. mission in iraq? say what you want about the president's promise to the contrary.

parade. i want to bring in steve, formerly with the fbi, for some more insight on this. what is going through the police's mind. as they know the investigation? >> first is the response, the first effort has to be toward dealing with the -- with the victims. >> lots of them, too. >> lots of them. coordinating with the rest of the emergency folks and getting everybody cared for and ton t t hospitals. and then securing the scene. securing a scene like this can be difficult. so you need to -- >> people were running through the scene as they were trying to get away, people were leaving? >> they say it was incredibly

chaotic. victims were everywhere. that included men, women and children. there's really no word on why the driver crashed into the state or how the driver -- >> we've seen these situations before where it was medically related as well. >> is it a crime? is it an illness? no idea of what caused this. police have to sort this out. what they do, you know, in the moments following this, in the minutes following this, affects the outcome in a lot of different ways. this is where police, one of the many kinds of situations where police really earn their -- >> a press conference by authorities. i think it really behooves them to get out of this situation early on. like we're seeing right now, there is speculation on whether or not this was a tragic accident or of course malintentions. we'll wait to the fact that we hear the police come out.

as of right now, we do know unfortunately there have been three fatalities and 22 injured. it looks like they were outside, perhaps a hospital awaiting more people arriving, so perhaps the scene is -- it's still transpiring. >> you can see the investigation still going on. you can understand the amount of chaos, you can hear it in the local -- you think about a saturday, folks are off, you have to call people in and then you have to first evacuate all of the injured. what happens on these scenes? what are the police doing now, an hour, an hour and a half into this incident? are we yet at the investigation point? are they trying to figure out what evidence they have? >> there's multiple things that have to go on. certain things like any physical

they said the intersection is still closed down, the investigate difference team is still working. and i want to bring in steve pemerantz, former fbi. they were asking for witness accounts. there were hundreds it if not thousands along the parade route. why is it so important that all of that information get to authorities immediately? >> one of the things we learned in the recent conference thpres it's a crime. it's a crime scene, a criminal investigation. it takes on a different hue. so they will charge that person with something. we don't know what yet. we don't know if it was deliberate or accident al and the way we get there is by interviewing witnesses. what took place, what actually transpired. and in order to do that, you have to get the witness interviews and get the evidence

and some of those people saw something and can answer some of the most critical questions. >> we heard one question at the very end, someone said do you know how fast the vehicle was going and he said not right now. but can they find out that information? >> maybe not down to the last mooil, but presumably again through some forensics. there could be tire impressions and skid marks and that can answer some of that. and the witnesses can tell you approximately how fast. >> you have that part of the investigation when we were listening to the police chief, driver was arrested. they said we wouldn't do that if we didn't have probable cause. that's number one. >> right. >> but number two, they said that there is a mandatory not breath test, but blood test in this case. that has to be fairly conclusive, isn't it, in terms of whether someone is intoxicated or not? >> yes, assuming that we're dealing with an alcohol intoxication. we don't know yet driving under the influence of something. we don't know what that something is yet. >> but there is a substance that

you could be driving under the influence of that wouldn't show up in a blood test? >> yes, a variety of illegal drugs for example, not all of them will show in a blood test. >> one of the things that we also learned was unfortunately the number of fatalities may also go up. he said that right now they can confirm that three fatalities have occurred, 22 injured. how does that play into the scenario here? if we do see more fatalities, obviously that would probably mean more charges. >> of course if the number of victims will affect the way they charge somebody. i mean depending on again a variety of -- the totality of the circumstances. but certainly the number of injured and particularly the number of dead could change the outcome. >> well, we'll obviously ask to you stick around and we'll bring that information to our viewers as it becomes available. it is right now 2:00 eastern. kickoff there in stillwater, oklahoma about an hour and a

accident. reports say a car quite literally barreled into the crowd. one witness reports people flying 30 people into the air, quote, like rag dolls. we'll have more on this as it becomes available. we will go to the other big story of the day. residents in an already saturated texas are now preparing for more rainfall as remnants from hurricane pa vish sha make way across the state. the national weather service says parts of texas have received more than 18 inches of rain since friday. will carr is following the story from our western bureau. >> large parts of texas got a lot of rain in just a short amount of time. you mentioned some parts getting up to 18, up to 20 inches in

some areas of texas. about 50 miles south of there is. we actually saw a train derail, a union pacific freight train, a creek nearby overflowed, then it washed away the tracks, knocked the train over. two crew members jumped out, they had to swim through the water before they were picked up by a swift water rescue team. thankfully they weren't injured. the 64 car train was hauling cement and now there is concern over diesel from the train leaking into the water so they had a hazmat team on scene. large parts of texas are still under a flash flood watch through sunday or monday. the dallas area has seen more than 7 inches of rain over the past 24 hours. there are also flash flood watches for waco which has had a record amount of rainfall. austin, san antonio where there were reports of a man being swept away while walking his dog. there is also watch in ft. worth where some drivers had to abandon their cars when

dangerous flash floods hit the area. >> the 18 wheeler went around me and then some of the trucks went away me and were honking like what are you doing. i'm like i'm not going. i have a little car. i didn't think i could make it. and so i stopped and freaked out and called 911 and they were like stay there. >> a lot of people don't realize exactly how powerful moving water can be. think about this, 6 inches is enough to knock a person over two feet, enough to move a car. we saw the train get derailed there in texas. and with that in mind, it can be extremely dangerous. the national weather service in houston and gallon investigation son is asking for people to simply stay inside and avoid the roads. >> will carr reporting live. thank you so much. and now we will speak with spokesperson for the union pacific railroad. jeff, thank you so much for joining us today. we've been watching these pictures develop out of texas

and specifically the image of the water. when did you first learn that you had suffered this loss? >> well, it was certainly something to weak up to this morning. the train was passing through the area approximately 3:30 this morning when it hit the low patch with the water over the track and the crew put the train into emergency stop to try to safely stop the train. came to arrest in an area where the creek bed overflowed and water was rushing over the rails. fortunately they followed protocol and got to a safe place where they were able to contact union pacific officials as well as local emergency responders and we were able to work with navarro county and get their water rescue team out there and bring them home safe. >> tell me what you were

transporting and how do you even begin the cleanup efforts for this. >> well, this train is what we call a unit train. it was carrying 64 loads of cement which is something that we carry on a regular basis here in texas as we help build roads and houses and everything. as far as cleanup, it's going to take a while. we're kind of at the mercy of mother nature and waiting for the waters to subside so we can get heavy equipment out there to lift the cars back up and put them on the track. we'll also have to do extensive repair work to that track so that we can get those cars moved out. we'll be looking to salvage as much of the material that is in the railcars as we can so that we minimize the impact that it has on the immediate area. >> how many train cars are we talking here, how far does it stretch? >> the train itself had 64 cars

on it. fortunately 19 of them did not derail and we're in process of pulling those out northward to clear the area and give us room to work. so we have better than 45 cars that we'll have to be working on and get them picked up and cleared out of the way. >> can you give us a sense because it's hard to tell from the aerial pictures, was this the major train thoroughfare through texas or was this sort of a second taker track that this train was on? what is the disruption to commerce there in texas not the only because of the floods but specifically because of this derailment? >> well, this track that runs north/south is a major thoroughfare. fortunately we have a couple of other tracks that run north and south in the immediate area. so we're able to reroute some trains if necessary. it will obviously slow some things down in the immediate future as we get the track reopened. we have some contingency plans in place to reroute trains or we may need to hold them for as

>> exactly. there were v.a. employees that were zeroing out wait times in order to earn performance bonuses or appease managers. >> are we pretty certain that now we have a realistic picture at least on how bad things are or is there still folks cooking the books as far as you all can tell? >> we haven't seen any evidence that there are still folk cooking the books but we have seen a gap between what veterans perceive their wait types to be and what v.a. reports they are. and that's a credit to the way the v.a. measures wait times and also an aging or old and out of date scheduling system. >> imagine a government facility being old and out of date. i will not stand for it, not as commander in chief, said president obama. has the top echelon of this administration done enough to focus on this problem and to try to fix it or is it simply too bill big or do they simply not care in your mind?

our viewers updated. >> thanks very much. hurricane patricia slammed in to mexico's western coast as a category 5 hurricane. by this morning, the weekend storm had been downgraded to a tropical depression as it moved inland and northward. remnants of the storm are now a problem for the united states especially texas. another powerful storm system had already drenched the state and now patricia will bring even more rain. one person has been swept away by the floods in san antonio. he was rescued. they also caused a freight train to derail south of dallas. the crew of the train was rescued, as well. and as we look at these pictures of highways covered in water, we understand that mch uch of the state of texas is now under a

anytime you're talking about a special counsel, there is still uncertainty there. >> kevin, i want to bring up the fbi. what do you think could happen if we do start to see more as a result or more investigations into the former secretary? >> well, i think it's a pretty hard argument to make that she didn't mishandle classified information. so i don't know what the fbi has got on her, i don't know where the investigation will go. i think ultimately it will be probably a presidential level political decision as to whether or not the justice department actually prosecutes. if they find something. but look, there are politics all up and down this. i think the fbi has, you know -- hopefully they can conduct a very nonpolitical case in this case because it's really tough. this could be the next president of the united states and whether or not they can really get to the bottom of this and then make the decision with with the white
