swinging including, i imagine, chris christie. >> got to do something. from politics now, let's talk about the safety of your neighborhood. we've got some statistics this morning, crime statistics that show there is a crime wave going on across much of this country. take a look at the murder rate -- >> tidal wave. >> some of the biggest cities. in baltimore, the murder rate is up 52% over the same period last year. st. louis, close to 52% as well. washington, d.c., 45%. chicago almost 20. here in new york city, a little under 10%. what is going on? many people blame the fact that police are hesitant to get out of their cars because of the ferguson effect. >> you could be a youtube moment. everyone has their phone. >> suddenly they're taking a picture of you. >> the statistics aren't lying. these are individuals being

killed every single day. in chicago, the president is supposed to be there today. shootings are up 18% versus the same time last year. murders are up nearly 20% versus the same time period last year. what happened? james coleman, the director of the fbi, was called in and said, you know what, i need to see what's going on with the uptick of murders. why is this increasing right now? he went to do that, but the white house didn't like what he found. >> our officers answering 911 calls but avoiding the informal contact that keeps bad guys from standing around, especially with guns. i spoke to officers privately in one big city precinct who described being surrounded by young people with mobile phones held high taunting them when they get out of their cars. they said to me, we feel under siege and we don't feel much like getting out of our cars. >> i don't know if director comb i communicated those views to the president directly. i will say that the available

wrong. >> trump up in arms after losing his lead in recent iowa polls. a couple of them to dr. ben carson. he's not the only one confused. why are some polls so different and what do they really mean? dana blanton, the vice president of public opinion research here at fox news joins us live. there are two polls show two different people leading. first up, the monmouth poll that everybody is talking about. ben carson is leading 32-18 over donald trump. then an abc news "washington post" poll that recently came out and the 32 that ben carson had in the previous poll, donald trump has there and ben carson is behind by the same margin. >> right. >> how can two polls wind up with results so different? >> right. there are lots of things to think about when you're comparing poelts and when you're looking at why they show different answers. so here, they're both talking to voters, right? except one is a national poll.

the abc news "washington post" paul is a national poll. it shows donald trump at the top and that's what we've been seeing all along. for the last couple of months. in iowa, that's a different story. ben carson. what's similar, though, is talking to voters an the outsiders are both at the top, right? >> how does it work? you're sitting at home about dinnertime. how does the fox news poll work. is it a computer, a person? >> right. our poll is -- we do use live interviewers, we're calling both land lines and cell phones. it's really important that people -- >> how do they get the cell phone number. >> we do a random sample. the computer picks the number. that allows everyone an equal chance of being called, right? that's what we're doing. we're trying to make sure that the random sampling and -- so

that's what we're going to do. we're going to emphasize the cell phones because so many people don't have a land line anymore or if they do, they're relying more on their cell phone. so that's how we do it. >> what do you make of people who say, you know, we're a year out from the election and so a lot changes. in iowa, santorum won a squeaker last time and before that huckabee won. what do you make of people who say i don't know how much stock to put in the polls. >> the polls have been accurate. what you want to remember each poll is how people feel at that time. right? so you need to think about when the poll was conducted. it's not intended it be a prediction or some sort of crystal ball. you know, we have about 100 days before the first people vote. a lot is going to happen. >> absolutely. >> we're going to -- campaigns will spend a lot of money. >> people need to pay attention to the polls because you say they're absolutely right.

brand new polls and what they did was they looked at voters in iowa, republicans who would go to the caucus. and keep in mind, you know, if they weren't going to go to the caucus, they were not polled the way they worked it. as you can see, ben carson leading, as you can see, donald trump, substantially, in this particular poll. >> by 14% >> ted cruz and marco rubio, and jeb bush, then round out the top five. ben carson himself has actually rolled out a brand-new commercial. it was only supposed to be seen in one spot down in south carolina. now it's a little wider. it is called outside the box. and we'd like to show you a little of it a little later on on the program. >> it is significant. i think people before they dig in on this poll, keep in mind another poll came out over the weekend, cbs had them in a dead heat. the other one prior to that on thursday had donald trump trailing by about four percentage points. this is huge. plus the way iowa works with caucuses, you've got to get in

the same room, convince everyone to go the same way. it's really going to be -- >> when you look at the evangelicals and look at iowa and the move toward ben carson at this point and it is significant and when you look not just comparing ben carson and donald trump but ben carson and jeb bush. he's quadrupling jeb bush in this latest poll coming out of iowa. >> trump does not line up perfectly with what the iowa voter would want. >> absolutely not. in other polls according to the real clear politics poll and they take all the polls and average it, nationally trump is leading over ben carson by six. and in new hampshire, the first actual primary state, donald trump is beating ben carson by 16. all right let's talk about another major story that's happening right now. might be affecting you and currently the main topic at the water cooler and your dinner table. that is what is happening in crime in our country. look at these stats. they do not lie. for those of you who say it's no big deal that these -- this crackdown on the cops and behavior is having a backlash in

terms of increased crime numbers. baltimore up over 50%. st. louis same thing. washington, d.c. crime up 44.8%. chicago up 19%. even here in new york, which s was -- it was the good news story of the world, this major city, with crime decreasing when they said it was impossible, is now rocketing up for the first time in two decades. up 8.3%. >> when you see homicides, lives taken, murders increasing by 52% in baltimore, and then you look at chicago, and the president's set to be there, by 20%. they have increased right there in shootings are up 18%. versus the same time last year. so when you have this increase in the time period of 365 days, everyone's asking, what is happening? and everyone's asking the director of the fbi to get in there and examine what's going on. and when he does, and what he finds out, is that officers right now are stepping back. they're afraid to engage because 20 places across the united states are being investigated right now by the united states,

by the white house. they say, hey, we're afraid to do our jobs. and the white house doesn't want to hear it. they have people being murdered at increased rates and josh earnest at the white house wants to just play deaf. >> are officers answering 911 calls but avoiding the informal contact that keeps bad guys from standing around, especially with guns? i spoke to officers privately in one big city precinct. who describe being surrounded by young people with mobile phones held high, taunting them when they get out of their cars. they said to me, we feel under siege and we don't feel much like getting out of our cars. >> i don't know if director comey has communicated those views to the president directly. i will say that the available evidence at this point does not support the notion that law enforcement officers around the country are shying away from fulfilling their responsibilities. >> well, you know what? this is the second time i believe in let me see one week where the white house has

defended the actions of black lives matter and not the cops. mr. comey, when he did make that address on friday at the university of chicago law school, where outside the law school, as we just saw, the crime statistics are raging, he said why is this happening? well, he said it could be cheaper heroin, guns, turf battles with gangs, and things like that. but what it comes down to is so many people are taunting the police. you know they call the police, they see the police, the police are right there, they turn on their iphones, they wait for them to do something that can go viral. because when something goes viral then that police officer is absolutely toast in many situations. when something bad is happened, and one of the things they worry about is if the cop winds up -- and the police department winds up the object of the department of justice investigation. how do you think that's going to turn out? >> the director, james comey said this in the fbi, in communities of color especially young men are dying at a rate that dwarfs what we've seen in recent history, and why the white house won't hear him on

for shooting and injuring an officer cary valencia, during a traffic stop over the weekend. he then crossed into the state of kentucky where he got into a shoot-out with state police before he took off on foot. well a potential turf war to tell you about between the u.s. and china is intensifying this morning. the u.s. guided middle destroyer the "uss lassen" conducting a routine patrol within 12 nautical miles of the sprattly islands. china has claimed those islands as its own territory. chinese officials say that the u.s. patrol near those manmade islands was a threat to its sovereignty and security interests. the u.s. says it complied with international law. and this is a story i just mentioned. police, be on alert. there is a new warning out this morning for police departments all across the country. the fbi is saying a poe tngsly dangerous anarchist group, known as the national liberation militia, it was founded by former black panther members, well that group has proposed

what it calls a halloween revolt. it encouraged supporters to ambush police officers. that group has also asked members to wear halloween masks and use bricks, bottles and firearms to attack our nation's police. well, remember this photo that went viral this summer? two dogs hugging. how cute was that? it ultimately saved their lives. they were about to be put down until that photo became so popular on social media, but these dogs still need a home. >> can't guarantee that they'll be adopted together. but we certainly will try. so we do everything we possibly can to get them adopted as a team. >> okay. so here's the outcome. mission accomplished. kayla and kyra were just adopted together by two women in atlanta. and look at how happy they've made those ladies. those are your headlines. >> a nice finale to that story. >> certainly. >> thank you. all right coming up on this particular tuesday, the video is

judge andrew napolitano joins us right now. >> a couple of easy questions. >> no kidding. okay, so for folks who have been in a cave, what did lois lerner do wrong? >> lois lerner defieded how to enforce the law against groups based upon their political ideology, or her perception of their political ideology. >> so did she do it evenly? >> no! she made it very, very difficult for conservative and libertarian and conservative christian groups to get a tax exemption in order to raise tax-free dollars to use to spread their message. a right that every group of every political stripe in the united states has. >> and you know, something like that would help a particular political party in advance of ap election, wouldn't it? >> it certainly would help the democrats. and what she did was to drag her feet so long, in holding up on the approvals, that these groups missed one, and in some cases, two federal election cycles. and the e-mails, the ones that

the irs didn't destroy, the ones that it found, showed that there was such an antipathy in the federal government to the supreme court's opinion on citizens united, that this was done intentionally, on command from the white house, in order to attempt to neutralize the effect of citizens united. citizens united is the supreme court opinion that says any group that wants to can pool its money together and spend it on political activity. >> so the department of justice is not going to, you know, investigate any further lois lerner. they're that going to prosecute her. is this a political decision? >> it comes at the unfortunate and i'm sorry to use this word but i must, dark intersections of federal law enforcement and national politics, where occasionally, politics trumps law enforcement. because, under the constitution, the president is the chief law enforcement officer of the land. he can choose, through his agents in the justice department, who to prosecute and who not to prosecute.

>> well, you know, judge, and we've covered the lois lerner thing since the get-go and the worry is probably from the white house, if you prosecute her, we're going to find out about things going between the white house, and the irs, and that would not be helpful to the cause. >> this is the same reason that the bowe bergdahl case is not going to be tried. because when the president's fingerprints are on a criminal prosecution there is no trial because he could be called as a witness. >> so here is the $64 billion question. >> i know what's coming. does it have to do with mrs. clinton? >> yeah. if they're not going to go after lois lerner, are they going to go after hillary clinton with the illegal server? >> i think she's in a different category. i think she is so high profile in her inappropriate behavior is so well known, she's under the scrutiny of the best team that the fbi has. i don't think politics will enter into that. but i honestly believe they will decide whether or not to prosecute her on the basis of the evidence. then it's up to the white house to decide whether the prosecution can be had. >> the chief law enforcement officer for the united states is barack obama.

spring. get ready for your life to revolve around tax season as well. you can work for an accounting firm. all the four major firms, i've brought those companies to your guys over and over. they're hiring. benefits are great. they really embrace working moms. they really embrace diversity. and the benefits are very strong. a life as well as working to death in the spring. >> always seems to be a demand for software developers, or engineers. >> if you can write an app, godspeed to you, kids. >> you don't need a job. >> it is amazing what these software app developers are making. especially, again, in california, talking over six figures for these jobs. but you've got to have a bachelor's degree, at least. a lot of these really helps if you have a masters and beyond. >> back to a degree in computer science. and then there's mechanical engineering. what kind of job would that lead to? what kind of degree do you need? >> you design, you test, you supervise. they run machines, think engines, airplane engines,

things like that. also there's structural engineering which is to build bridges. but the mechanical is really the great degree to have. the jump in the positions available, 5% between now and 2022. and you can earn anywhere between 50, maybe 100k. again to start. that's the big thing here. if you're looking at a career, these are the ones to kind of -- >> you want to be that person, come in and look at a company and give them advice on how to make their company leaner and meaner, but it's tough to do that at 23. you say management consultant. what kind of background do you need for that? >> obviously you're going to need a business degree. it would really help you to get your masters. but you get a lot of travel in a job like this. you get a lot of variety. you're going in to different clients, different places, and it's consulting. so you're saying here's what you can do better. here are my ideas. and believe it or not, even though these are kids we're mostly going to be talking about, 23, 24, 25-year-olds, because of the experience they're getting in their degree, companies really seek after them because they're the freshest minds that are out on the job.

hampshire, south carolina, and get real momentum going into florida, where he believes someone like a ben carson would not be able to really make a huge difference. because of the size of the media market. >> he's winning such a ride margin already in the south carolina poll. but laura, cnbc, this is going to be the cnbc debate, they're going to focus on the economy. you would think this is going to play to fiorina and trump's strength. wouldn't you say? >> absolutely. i think both of them are going to be doing really well in that debate. i thought at the last debate, if we started talking about things like, well, ben bernanke, if he raises the -- if interest rates go up, what does that mean? or if jessica yellen does this, what does it mean? i'm not sure most of the other candidates other than kasich would have great answers. but you know, trump gets this. he understands the way the business world works. fiorina clearly does. carson, that's not in his wheelhouse. that's just not where -- >> so much pressure on kasich. this is time for kasich, because he's got his budget background. he knows how to perform.

he's done this. he's got the wall street back ground, as well. so he's got to be able to articulate that and send out above a very loud crowd. >> might be his day. >> i think everybody has to remember that the carson appeal isn't just his demeanor. people say oh, he's a nice guy. that's not it. it's not -- that's part of it. but in iowa, it's his social conservatism. the fact that he stands unequivocally for life is very appealing. and they see other candidates kind rf, they're -- you know, they're pro-life. all of them are pro-life. something about ben carson. it's in his dna. >> sure is. >> clearly as a doctor, he seems to have a lot of credibility on that issue. >> consistency for sure. >> there's a brand-new ad, and you were talking about smaller media markets in south carolina, ben carson has put up an ad, it wasn't supposed to run, but it did apparently a couple of times in south carolina, it is a 30-second ad, and you know what? you watch it, and it's really good. it's got a potent message. we're going to play a little snippet of it for the folks at

good intentions. i'm going to give them -- be charitable, kernel of good intentions that we want people to be safe and be respected. i get that. but it's turned into, it's morphed into, for many people, a political get out the vote drive for 2016. i think it's transparent. i like josh earnest, or some of the other, you know, well-scrubbed staffers at the white house, why don't they put on a cop uniform, police uniform, why don't they go into one of the more troubled areas of the united states, inner city baltimore, l.a., chicago, and why don't they try to do this job day in and day out. with being taunted, comey is exactly right. i've talked to police in new orleans, omaha, new jersey, and over the weekend in birmingham. and i will tell you this, there is a feeling among police officers that i've spoken to who approach me to say, it's a nightmare for us. when we are looked at with such suspicion by so many people. we all go up to them and say thank you for what you're doing and they do appreciate it. but there are a lot of good cops out there.

i'i've been an elementary school teacher for 16 years. it is really difficult to afford living here in san francisco. i went into foster care my freshman year of high school. i think there was like 9 people living in a 3-bedroom house. claudia: 40% of the mission rock housing will be for low- and middle-income families. there will even be housing for people like micaela who are coming out of the foster-care system. micaela: after i left the foster-care system, i realized that i just couldn't do it on my own. not knowing where you guys are gonna go that night and just stay, like, it sucked not knowing that. mission rock -- it's completely different from anywhere that i've lived. it looks so much prettier. the atmosphere -- it just gives off possibilities. like, i have a chance. i can print out like six different ways to get to work. i would be proud to have someone like micaela be my neighbor. i would love to have somebody like claudia be my neighbor.
