west. major snow storm hitting colorado hard and who is digging out and next in the path? it is all "happening now". we have a lot of news to get to at the this hour. we begin with the expanding investigation in the deadly paris attack. i am jenna lee. >> and i am jon scott. officials say it was a larger operation with 20 or more people involved and an eighth paris attacker on the loose and his brother today pleading for him to turn himself in. the investigation is in three countries with authorities contacting raids in brussels where two of the suspects lived. all as loretta lynch is grilled about the justice department's aefrts to combat terrorism at home. catherine has more.

and we start with rick in paris. rick? >> reporter: jon, we know that there were seven terrorist who died in the attacks on friday night and an eighth salem who they are looking for. and the other fugitive that is involved and they are now hunting down somewhere in europe. they haven't said if it is a man or woman. we heard a female spotted. we don't know if this is that person or another. we know that there is another fugitive that was directly involved in the friday terrorist attacks and they are seeking in addition to the ones we knew about. there are 115000 french police and soldiers who are mobilized in response to the terror attacks and the french defense minister said that is not enough and calling on eu neighbors to step up and provide additional help.
10:03 am
they invoked a never before used article in the eu. asking aid and assistance to a member country who is a victim of armed aggression on the territory. other countries can take part in the air raids over syria and iraq or providing security support. last night the french military carried out seven more air strikeses in syria and targeting the isis training camp. and french police carried out raids. nearly 300 since sunday and te taining a hundred people and seizing weapons including a rocket launcher. there is searches in germ no and belgium and no cipe of the mot wanted. the belgian radical who is plotting the terrorist attacks. this mastermined believed to have fled to syria and sel ah

whose brother blew himself up. he has been on the run. and he was stopped near the belgian border with two other men in the car. the other men were caught but sela h is still on the run. and the second fugitive in the attack. >> if they have 20 and only know of seven be that are dead. there is other names to be added to the list. >> how do we prevent terrorist attacks like what happened in paris from happening here? that is the question that loretta lynch was asked before the house judiciary committee. our coverage continues can catherine herridge. >> reporter: there is a highly classified briefing for the entire house and fbi director
10:05 am
and homeland security secretary and head of ntct. it was set up after 9/11. monday's late night briefing to law makers believed that the plot is global. and scouted in paris and in the meantime russian security service confirmed a two pound bomb brought down the metro jet over sinai. fox was first to report it was planted on the plane. the fuel acted as an accelerant and making it harder for the investigators to determine the cause. counter terrorism analyst said that isis has expanded and exported bomb making capabilities and the attack in sinai shows that there is a airport insider and bomb maker to embed the device. the support network in belgium
10:06 am
has a proficient bomb maker that can build multiple devices. and one day before paris, it shows the same pattern. >> isis didn't have the the ability to attack the west in a 9/11 style attack. because they didn't have the resources or manpower. >> reporter: on the issue of refugees, the attorney general testified that american data bases are comprehensive more than what the europeans are dealing with. >> certainly not only the department of justice but all of our agencies will vet every refugee coming in to this country from the database and the interviews and biometric screening. certainly there are challenges to that process because of the situation in syria. >> reporter: earlier today republican chairman of the house

told cnn, that there is evidence of a wider conspiracy and we confirmed. that he made reference to the three rings of a conspiracy. direction from syria, logistical base in belgium and then the execution in paris itself and explains numb wards of 20 individuals, jenna. >> slowly unwrapping all of this. appreciate your reporting. we'll delve further in the concerns top officials have on the terrorist communication beyond the reach of intelligence agencies like encryption. we'll get into that to "happening now". president obama's strategy against isis is coming under fire. and a leading democrat law maker openly split from the president. >> i never been more concerned and i read the intelligence faithfully. and isil is not contained and isil is expanding and just put
10:08 am
out a video and saying it is their intent to attack this country and i think we have to be prepared. 30 governors oppose plans to bring syrian refugees in their state because of security concerns and they are looking at a built halting the plan until stricter requirements are met. the white house will hold a conference call with the governors tonight over the syrian refugee situation. aaron blake is editor of the national review. thank you for being here. the political winds are blowing in the president's face on the idea of bringing in 10000 syrian refugee at a cost of $1.2 billion. >> yeah, that's right. the fact that we have half of the governors in this country, almost all of them republicans
10:09 am
and a front against bringing syrian refugee in their states combined with what happened over the weekend in the debate when hillary clinton called out president obama's comments on having contained the islamic state, i don't know how the white house is going to fight back against this. they obviously feel strongly that this approach is not the right one to take. i don't think we have seen a concerted and decisive message. >> it is not often you have this many democrats splitting with the president? >> that's right, jon. it is it a problem when 129 people are gunned down on the streets of paris and the president's own cia director said more attacks like this are in the pipeline. democrats who want to be taken seriousy on issueses of national security don't have a choice but
10:10 am
split with the president. isis being contained is not entirely wrong. but being contained territorially is not necessarily meaning a containment of the threat. what his cia director is saying, the threat is exist. i don't think the president reconciled those. >> eight states said they would welcome refugees. see far, it is california, colorado, connecticut, delaware and hawaii, pennsylvania and vermont and washington. each of those states has a democratic governor. is there a political bent to this? or each state deciding for itself what is the best way to deal with refugees? >> of course, it is all political. if you look at polling numbers. republican voters and republicans generally are more concerned about the possibility
10:11 am
of a terrorist attack be in the united states. part p of this is that the party is little bit more concerned about what is happen negligent middle east. and i think thatrepublicans, their reflection of who is in the white house. republicans don't trust president obama to handle threats in any good way and this is really what this kind of boils down to at its base level. if they had a president whom they felt like was more on the ball when it came to stuff like this, we would not seen an instannous decision. >> there is a political race in louisiana where it is front and center? >> senator david viter is running for governor. and the two candidate run off is on saturday. most show that viter is behind despite that being a red state.
10:12 am
he's trailing the democrat in most of the recent polls. he came out with a tough ad, that ties his opponent to president obama and brought up the syrian refugee drama and to some people, it feels like a hail mary at the end. but we'll have a good impression of how the political message works when it comes to the vote in louisiana on saturday. >> interesting to me eliana. if the governor of colorado wants to welcome in syrian refugee and his state does see. there is no board check to keep them from walking or driving across to kansas, nebraska and utah and states that said no. >> absolutely. there will be a national reaction to this. and one of the problems to this, among both republicans and democrats, there is a distrust of the president about really insuring that the refugees
10:13 am
coming in the country are checked and that there are background checks going on on. it is similar to the immigration debate. there was a distrust that the administration would enforce the borders. there ise no problem to taking in refugee but a distrust with background enforcement issue. if there were more trusts, there would not be an issue in taking in the refugees in the first place. >> the fbi has its hands full. and check the backgrounds of 20000 people on top of that seems like a tall order. thank you both. >> thank you. >> economic sanctions easing as part of a nuclear deal, iran is ready to produce more oil. we'll tell you how much. and details on the powerful storm that left thousands of drivers stranded. and tornados in three other

10:15 am
improve breathing for a full 24 hours. breo contains a type of medicine that increases the risk of death from asthma problems and may increase the risk of hospitalization in children and adolescents. breo is not for people whose asthma is well controlled on a long-term asthma control medicine, like an inhaled corticosteroid. once your asthma is well controlled, your doctor will decide if you can stop breo and prescribe a different asthma control medicine, like an inhaled corticosteroid. do not take breo more than prescribed. see your doctor if your asthma does not improve or gets worse. ask your doctor if 24-hour breo could be a missing piece for you. see if you're eligible for 12 months free at mybreo.com. jeb bush: leadership means it's not about yappin'.. it's not about talking. it's about doing. i know how to do this because i was privileged to serve in florida for eight years. and we turned the systems upside down that weren't working. 1.3 million new jobs were created. we cut taxes every year. income rose in people's pockets. people were lifted out of poverty. children started to learn. as president of the united states, i pledge to you that

ground forces and an option president obama is ruling out. >> the one exception is that there had been a few who suggested that we should put large numbers of u.s. troops on the ground. and keep in mind that you know, we have the finest military in the world and military minds in the world. and i have been meeting with them intensively for years now, discussing these various options and it is not just my view but the view of my closest military and civilian advisors that that would be a mistake. lieutenant bill cowan. we heard from george before the break saying if you win you have to put boots on the ground.
10:25 am
what about president obama's comment that it would be a mistake to put boots on the ground to win the war? >> i think combat boots have to be on the ground. i was in plenty of battles in north vietnam where air power changed the tide of the battle. but before we put ground troops in. get an air campaign that is effective. we are averaging eight strikes a day. in bosnia fighting and iraq we were running hundreds and thousands of a strikes. we are piddling. we don't need to just talk about u.s. ground troops. we have egyptian and saudi and all members of the coalition. and jordan members of the coalition. and plenty of places to go. but the president has not demonstrated a leadership to ask them to participate on the the ground. >> we'll talk about the air

campaign. over the weekend, you heard the french bombing raqqa. and russia the numbers are a dozen to two dozen strikes per mission. why? because that is about where we are at. that is the spectrum we are in, in syria as far as the air campaigns. we get a news alert every day. and around that. and why is not it more from anyone? >> yeah, this administration refuses to aggressively pursue. they are see worried about collateral damage. and the unfortunate loss of civilian life. and indeed, it is unfortunate. but the reality is, we go after the head of the snake there in raqqa. if we don't, they will conduct operations in paris and looking to do it here in the united

states. we do not have a willingness in this administration to pursue an air campaign that has an impact. last friday we got a single target jihadi john and put a predator missile on that guy. our intelligence is very good. we know where command and control centers are and logistic and planning centers and leadership of isis. why don't we go after it? because the administration is it afraid of civilian casulties and people would be upset with us. the president of france said they would be pitiless and i think the russians will be the same. they will rain bombs down on isis in a manner that will make a difference. and unfortunately we are not. >> what is the risk of that.
10:28 am
>> if russia is the leader, we'll never see bashare assad which is a stated goal in syria. if france keeps going on there we'll have a good ally. but the whole dynamics of the battle of isis would change if the russians take a leadership role. it will not be the outcome we want. it is fine to fight isis, but isis is the centerpiece, but also a side stage of what is going on in syria. and what our own nation's goals and objectives are in respect to getting rid of assad. the complexity is difficult to follow even for me who follows it every day. in the end of the day, we the united states is not taking a leadership role. president calling for patience. patience is why we had this in

paris. isis is not worried about the united states. >> we have to run for breaking news that is related to all ofs. we thank you very much. >> fox news alert. you are looking at a british airways boeing triple seven, scheduled from london to boston landing right now in boston but with all kinds of concerns after this b airways 213 had a passenger try to access the cockpit in the middle of the flight. we are told that that passenger was restrained and the plane is touching down normal willy. often they will land in airports in the northeast if the planes are scheduled in other parts of the u.s. it is coming in half an hour ahead of schedule. this british airways 213 has

>> returning to break news out of the boston. british airways 213 making an emergency landing in boston. a passenger reportedly attempted
10:35 am
to gain access to the cockpit. we are learning from the massachusetts police that a female passenger was restrained in the flight for trying to enter the cockpit. we don't know why. all we know that troopers on the jet bridge are going to take custody of the unrestrained passenger. and they will investigate the incident. the plane is making a slow or urgent move to the gateway for the gates to take place. this was supposed to land in boston in a short while. it is be an emergency landing because of the security incident. it is one to watch closely. we have no indication that there was terror related. we want to watch it out of boston. a female passenger restrained for trying to enter the cobbing be pit.
10:36 am
as we learned from the massachusetts state police and others. i will bring you that breaking news. >> russia dropping bombs on the isis strong hold of raqqa. and moscow confirmed that a bomb brought it over on egypt and killing all 224 people on the plane. captain chuck nash is a retired navy captain and fox news military analyst. what do you make of the russian's immediately start over the bombing campaign over raqqa. are they serious about going after isis? >> i tell you, john. they are not worried about collateral damage. the weapons and aircraft are no where near the precision stuff we use. it is a clear message to the leadership of isis, and that is, you just screwed with the wrong person. putten, you know, you hear about
10:37 am
politicians talk about bringing people to justice. this is putin's quote. he will find them and we'll bring them. >> and words matter when you take on an enemy like this. >> it is said before many, many times. we refuse to identify the enemy. the current face of the enemy is isis and before that it was al-qaeda and al-shabaab and all of the other groups. it is from the same poison ideology. it is radical islam. until we deal with things like the french. where did they get the targets that they pounded? they got it from u.s. intelligence. why haven't we pounded them? our rules of engagement are see restrictive. because there might be a collateral damage civilian
10:38 am
casulty. we swore off the target. the french and russians are not worried about those niceties right now. >> collateral damage is long a concern in the highest levels of the pentagon according to another fox news military analyst. ralph peters wrote this in his column. the generals who won world war ii would start by levelling raqqa. civilians would die, but those remain nothing raqqa have emgraced. isis as the germans did hitler. >> they still have paris. it is see against the way we conducted warfare. when you look at vietnam. they picked out targets in the white house and our guys were
10:39 am
not allowed to bomb surface to air missiles because they start yet to fire on them. and see here's the thing, war are fare is the most destructive of all human endeavors, and try to make warfare efficient is ridiculous. and taking an organization designed to fight and win in that kind of endeavor is challenging. and the more restrictions you put on it, the less and less victory is likely. >> isis has taken a lot of pages from the hams hand book. building command centers under the hospitals and inviting a bombing that looks bad on the news. >> absolutely. it will get media attention and you will have everybody out there beating the drum and unfortunate. but when you look at a bombing trucks, the oil trucks, they
10:40 am
took out a bunch of oil trucks, well maybe the reason they were not striking them in the first place because of civilian drivers driving them. maybe that is the kind of thinking that goes into this sometimes. you know, at some point, you have to think what is the ultimate affect of that oil getting through? the old principle of affect effect. you have five people on a trolley track and another person on the other one. and you threw a human body in front to stop the trooly that is murder. but if you flipped the gate. maybe you have a case for that. we get too wrapped up in that sometimes. and we ought to be thinking the more we dawdle. the more the enemy gets broader in range and in depth.
10:41 am
to take them out takes greater blood shed and loss of treasure. maybe it's best sometimes to go in and get the job done. >> and that's what vladimar put and i know the french seem to prepared to do. we'll keep annie and see how it goes for all of the parties involved. captain chuck nash. thank you. >> you beat. >> back to the logan airport. we'll watch the flight pull in a gate to unload a restrained passenger. it was due to land in boston. and there is a security situation on board. and the plane just landed and we are hearing about what happened. initial reports said the female passenger wanted to gain access to the cockpit and has been restrained on the plane. we are hearing from british airways.
10:42 am
our customers and crew deserve to have a safe and we do not tolerate abusive behavior. they requested police meet the flight due to an unruly passenger. when we hear the news, it is natural to think about terrorism because of the situation in paris and beyond. but we don't know anything of that nature at this time on this flight. we are watching what is happening in logan. and there is no police around the plane. but the passenger is restrained in the plane and escorted off. >> shocking finds on the way terrorist are communicating with each other. we may have to give up personal privacy to stay safe and has the cia director on the lookout. >> i anticipate that this is not the only operation isil has in

new concerns and terrorist may be beyond our reach. and kath cathherridge said the authorities found a play station that was an intriguing find. the feds trying to determine if it was a form of messaging between the terrorist. we know they communicated. and that is a big worry for officials here at home. >> of greatest concern, it gives small groups and individuals the potential to inflict damage on a scale restricted to nation states. and while states are largely rationalactors, the same does not apply to terrorist and criminals. these apps and these devices that now allow the terrorist to operate without fear of penetration by intelligence services. this is the first example of this. i will be interested to see what

10:49 am
this is why there was no chatter in paris and see low. that's what we relied on. it is one of the foremost issues to figure out how to solve this. >> in the meantime, what do we do? >> we have to go back to basics and we should capture them and i am not a military expert with boots on the grouped. but if we don't have people to snatch them and interrogate do them. and what apps and devices. we have to get on the inside and figure out counter measures to these. we can't just export analysis after they blew themselves up. we have to do the human intelligence. >> maybe a combination of hellfire missiles and intelligence on the ground. >> can you ban encryption.

10:56 am
completely with social media, you have to identify every one of their channels, everybody's who's using it. even though you stop one, they start another one right after that. it's a little more difficult than that. it's not impossible to do it the same way that companies came together to address child porn being traded over the internet is similar to the approach they need to take to this. they need to get people involved. you have splinter groups that are out there taking the fight to the enemy and in cyber space. there's variety of ways people are being taken off the grid. >> groups like anonymous, like hacker groups for example, how effective can they be? >> i think they can be effective.
