goldberg and i will analyze the most dubious things said about the paris attack. >> -- causing the terrorist thing to happen. that connection needs to be made. >> caution, you are about to enter the no spin zone. the factor begins right now. ♪ ♪ hi, i'm bill o'reilly. thanks for watching us tonight. president obama continues to divide the country over terrorism. that is the subject of this evening's talking points memo. at this point at least 31 governors have told the president they oppose allowing syrian refugees into the country. eight governors say they support the action, california, colorado, connecticut, delaware, hawaii, vermont and washington. talking points believes the argument should be moot as we put forth last night nato should declare war on isis and in doing so that alliance could move into syria and set up safe zones for refugees and the huge

problem might begin to be solved. if syrians in danger are protected by nato forces on the ground there is no reason for them to go to turkey, europe, or america. so in addition to confronting isis militarily, the 28 nato nations would be providing safe zones for civilians at risk. does that make sense. of course it does. so why won't president obama take the lead in mobilizing nato against isis? we discuss admire adof reasons last night. here is one that makes the most sense. mr. obama does not have the will to lead he in the war on terror. we have seen this before in the white house. president james buchanan who served from 1857 to 1861 actually sat on his hands when the nation was dividing over the issues of slavery and economic policy. buchanan perhaps the worst president in u.s. history allowed the situation to get out of control so the civil war began. right now president obama is in a similar situation continuing his passive posture as the terror problem grows worse. his policy is one of

disengagement. that has led to mass chaos in the middle east, africa and europe. listen to this analysis of the president on cnn usually sympathetic to mr. obama. >> he said something that was pretty incredible, according to many of the military experts here and around the world who i i have spoken to that our strategy is working. people do not believe that to be the case. the only strategy that's working is the strategy that he tends to dismiss and that's the ground troops strategy. >> wow, now, next week president -- french president hollande will visit the white house and we assume some new strategy will be announced, something. because at this point in history it is barack obama who is setting himself up for an amazing defeat should the isis terrorists strike america or continue their mass killings overseas. if mr. obama values his legacy at all, he will think long and hard about leading the nato alliance against the isis savages.

and in his deliberation, he should gaze up at the picture of james buchanan hanging on the white house wall. and that's the memo. now for the reaction governor chris christie. you have been adamant in say nothing syrian refugees in the garden state, why? >> because i don't trust this president and his homeland security department or state department to vet these folks. i just don't. >> what if they send you the names of people that they would like to move into jersey and you had the state troopers and the intelligence apparatus you have vet them? would that be acceptable? >> not sufficient. because even the fbi director says with their data base, his fbi director jim comey says we dent have the data on these folks to be able to do the right kind of background checks. he said it before congress just the other day. >> you would assume that 10,000 refugees, which is just a pittance of what there are, okay, that would come to the united states would be the people that have passports and ids and

fingerprint checks and all this. they know nobody would take somebody who doesn't have any i.d. or any history. if you couldn't get some kind of -- what i'm trying to get at is this, we are are a humanitarian nation. >> we are. >> all right. you are a christian. >> yes, sir. >> i'm a christian. the pope says we have got to help these refugees and i'm thinking if i'm a governor, i say i'm going to do my own vetting and if my people say they are okay and i would take mainly women and children, only a few men who were family heads then i'm going to be. am i wrong. >> we don't have the data bases to be able to do this at the state level. we just don't. we count on the department of homeland security and the fbi and the cia. so, this president has degraded those folks and demoralized. >> that's what i'm saying if you get a list of names and your guys in jersey can't say to you, look you in the eye, these people are safe, i wouldn't let them in. >> i'm confident that the

fbi director has said he can't do it then my head of homeland security won't be able to do it. the guy who has the apparatus of the entire fbi behind him. >> i wouldn't let them. in it seems if you have little children and their mother the threat level would be pretty low. >> again, they don't even communicate to us. we know that they have been placing refugees in states including ours without each communicating to us. >> let me stop you here. so you have refugees from around the world in new jersey that you don't each know about? >> correct. >> is that right? >> the administration places them directly with nongovernmental organizations and they do not even give the administration in the state the courtesy of the information. >> give me an example of that. >> we have about 75 syrian refugees that have come in since january. we were never advised about, never. >> where are they now? >> now we are trying to find them by going to the nongovernmental organizations. >> so like catholic charities. >> like catholic charities and others. the administration places them directly through organizations. >> the catholic charities and other charities are not

obligated to tell you. >> they are not. >> they just show up these people go through newark airport with no credentials. >> they have credentials but they go through catholic charities moves them to threw and other types of nongovernmental organizations. the administration, that's why today they have a rushed phone call this afternoon to have a conversation with the governors to try to convince us that we should do this. our point to them in the letter i wrote to them i said you don't even show us the courtesy of telling us that you are going to put people into our states and you are doing it already anyway. >> unbelievable. >> yeah. it's incredible. >> it really is because i want america to be a humane place, an example for the rest of the world. and you know how many refugees we took from southeast asia after vietnam and all of that. >> my point to you on, this bill is we want to be a humane nation but our first job. >> is to protect the people here. >> that's right. >> i don't think a 6-year-old is going to throw a bomb on anybody but i could be wrong. now, did you watch president obama's press conference from turkey yesterday? did you see it? >> i did. >> what went through your

mind? >> that this is a guy and i said this on saturday. this is a guy who lives in a fantasy world. he lives in world as he would like to see it not the way he it is. for him to say the things he said the other day from turkey are just fantasy land. >> stands out. >> started off by thursday saying isis was contained. >> was embarrassment, for sure. >> then he says our strategy is working. our strategy is working. tell the families of the dead in paris that our strategy is working. >> hillary clinton, do you think she would be tougher on isis than obama? >> no idea because if you listened to her in the debate on saturday night she said this is not america's problem but america needs to lead. i mean, that's the typical double talk from a politician who has been around washington too long. >> she did call for a no-fly zone in syria against president obama's policy, mrs. clinton did. >> right. as have i and others. anyone with any lick of common sense would call for that. >> now, if you are the presidential nominee of the republican party, do you go

of the terrorists who killed 130 in paris so mr. hamid apparently knows that all the hundreds of thousands syrian refugees are peaceful, not involved with terrorism. that's amazing, is it not, mr. goldberg? >> yeah. this is a common theme, bill, on the left that we should let these people in, these refugees in because they need our help, which they do, and anyway, very few of them are terrorists. i'm sure progressives don't see it this way. i'm sure they don't think of themselves this way. but what it comes down to is that they are willing to sacrifice a few hundred innocent lives just so that they can show off their progressive credentials so that he can say you see how good we are? we want to help these poor people. these poor refugees. you know what? a lot of people want to help these poor refugees but there is a legitimate concern about even if 99%. even if 99. 5% are good

people, we have a right to worry about the other half of 1% because they could do tremendous damage. >> and have done. i mean, the guy involved in the terrorist attack got into france as a syrian refugee. it took them a couple of weeks to wipe out these people. i have to dispute this. i don't think that the progressive community really cares about but the progressive community. and i will put forth that i, at the beginning of the program said if nato declared war on isis, and nato goes into syria, they could establish safe zones for syrian refugees and they could all come back from europe, all come back from turkey, wherever else they are because the nato forces would protect them. i don't think progressives would support the nato troops in syria, bernie, i don't think they would. so they really don't want to solve the problem, do they? >> they want to let people in because they honestly think that they need help and they would get help the way you described it, too.

look, but this fits a liberal theme and that theme is that anyone who is against allowing refugees in is some kind of bigot and they don't give any credence to the other side. there was one liberal, are you ready for this? chris matthews of all people came up with what i think is an interesting idea. last night this -- his program he said when these 10 syrians come in, the united states government should separate out the young men and say go back to syria and fight for your country because there are people here in america who say americans should go to syria to fight for your country. that doesn't make sense. we're not going to go to syria to fight for your country while you are leaving your country to you don't have to fight for your country. for chris matthews, that was a pretty good point. i live him credit for that. >> bernie goldberg, everybody, when we come

thanks for staying with us, i'm bill o'reilly in the legal segment tonight three very controversial matters. first up actor charlie sheen saying he has the h.i.v. virus a problem for mr. sheen because he has had a number of sexual partners. here now attorneys and fox news analysts kimberly guilfoyle and lis wiehl. somebody has h.i.v. they don't tell their partner. they have criminal liability? >> absolutely. in california he is looking at least a misdemeanor if you have unprotected sex with somebody, you know you have h.i.v. even if they consent to it that is a misdemeanor charge. i have got the statute right here. any person who willfully exposes another person with that disease to someone else is guilty of a misdemeanor,. >> a misdemeanor? this is a disease that could kill you. >> let's go forward. >> he said on "the today show" he had unprotected sex with two women knowing he had h.i.v. bam he has admitted to a misdemeanor. >> he admitted to that on tv. >> admitted to that on television. two counts one year on each. if you stack them. now, felony. it's harder for the prosecution.
