venue was returned to los angeles. it cuts both ways. >> it is set up for an appeal. >> it is always in an appeal. >> this officer, when we learned that the officers were to be charged separately and not as a group how was he getting chosen to go first? >> it is a mystery and to me as a mistake. he had nothing to do with the arrest or putting freddie gray in the hand. there is considerable evidence that hey helped freddie gray. of all of the people to go first, it doesn't make a lot of sense. marry lanmosley whoxd is the prosecutor mishandled. claiming murder before she knew the facts. and for this porter gets charged

with a bunch of crimes. a lot of them. and what hurts mosley's case. the fatal spinal injury happen when gray stop up despite the leg restraints. that undermines mosby's case. >> i want to ask you about the officer. how in the trial impact what happens to the other officers? , does this set the precedent. if he is found not getting. would the others be found not guilty. >> it depends on what he said. who else is going to defend the officer than the officer himself?

but he may impliicate. >> would you want to be the first to tell your story. >> if i am william porter i would want to go first. i would say i didn't nothing wrong. my guess he is not going to point the finger of blame. my guess he will go with the medical examiner. but for the actions of freddie gray, he would will be alive today. >> what about the time line of all of this? and as far as finding justice and what does a resolution look like for this case and others charged? >> it is hard to say. it is such a powder key in this city. and anything can happen. a lot will depend on what will happen to william porter and the first trial. there will be six different

nev >> american allen gross speaking out for the first time about his imprisonment in cub a. he set up internet connections when he was arrested for allegedly spying in 2009. we followed his plight. this is what his wife told me about the prison conditions. >> i know his cell is tiny and he shares with two other. the lights are on 24 hours a day and a lot of times no water. things crawl nothing his food and it was difficult for him. >> it was a full year before his release. and gross said he first thought he would be freed in a matter of

a week or see. >> did you think in the early days, boy, the u.s. government will get me out of here in a week or see? >> i did after the two weeks. and then i said to myself. where are they? i figured. i didn't have any idea i would be there five years. i knew i was in trouble. >> and he has a great sense of humor. you saw that with the sprue with scott pelly. he was released and then shortly after that diplomatic relations were established between our two countries. and see rick, we are learning about the circumstances of allen gross's imprisonment and what took him out. what is notable to you about the process?

>> these are the types of things that happen and we don't want to appear and sound too callous. when you work overseas this is what happens. we want to be empathetic to families who haveñi family membs kept against their will. with the alep grossuation and bergdahl, we have seen the obama administration formalize the discussion about host amg. there is a presidential envoy for hostage affairs. this is an appointment at the state department and they have a full bureau of host amg affairs where they work on hostage affairs. this is dangerous. congress should step in and

crush this. >> why rick? >> there doesn't need to be i[pit says to syria and to cubad iran and hesbollah and isis. grab an american and negotiate with the state department. and tell them what you want and what promise to be changed. it is it a dangerous slippery slope that the administration doesn't seem to find a problem. >> allen gross and bergdahl are different situations. but to get the americans back home, a prisoner swap was used. we are hearing that from the iranians. if you want jason, we want x number of iranians back.

what will it take to get americans who are in prison back home? >> it means that the u.s. government is open for business when it comes to hostage swaps and deal making and having the special envoy for hostage affairs with a formal office in the state department is a dangerous idea. you are right. jason's case and allen's casexd and bergdahl case are all different. i worked on several. grace and mat whang they got in trouble with the qa ta ri government. they should hire ñinonu.s. government officials. there are expert organizations that know how to deal with this.

>> i am curious about the other option. we have talked to their wives on the show. she just wanted her loved one home. if that was my husband, i would give anything. and so if that is what it takes or a ransome. that's what you would like to do. if you are not the u.s. government you can't release the prisoners. what are the options? >> families having the flexibility may pay cansome. i think it is a bad idea. you can't prejudge what a family will do. they are not thinking of about what means for others. we get that. let's give them the flexibility to do what they do. hire the

proper experts free and clear of the policy that the u.s. government would make about a hostage ransom or prisoner swap. let individuals do what they want to do. by the way, they may pressure the government to make statements and to do certain things. it shouldn't be that the government is in charge. >> it doesn't feel like the family has a leverage. what do politics have to play in all of this? we have seen it involved in with the taliban. and releasing bergdahl and we wanted diplomatic relations and the u.s. government or this administration opened diplomatic relations from cuba. that's what they want in iran. we have seen the nuclear deal and department of reaches.

and see what do politics play in all of this? what does it mean for the families with loved ones overseas in prison? >> it is it less political and more policy changes. but the other governments want a change in the u.s. policy. and the u.s. will be pressured to do it. the media has a big role to plai here. certain individuals on the today show or fox the public gets out raged and politicians are moved by media or public outrage. the u.s. needs to resist the idea of formalizing and taking control. let the families and help the families. work with the fbi to do secret help. >> you think it is too late?

from time to time. nothing like this. >> police say the 19-year-old man died of smoke inhalation and burns. well, immigrants are in this country illegally, should they be allowed to drive legally? a group of oregon thinks so and they're suing to overthrow a law that outlaws licenses for illegal immigrants. their main argument is that it hurts immigrants' chances of finding jobs. dan springer is live in portland with the latest. >> legal experts say this lawsuit is a long shot. two-thirds of oregon voters rejected the law giving licenses to illegal immigrants. it was a referendum on a law passed by the state legislature. the campaign against the driver's licenses they say was racist and aimed at hurting a powerless minority group, specifically illegals from mexico and central america. the other argument they're using is the state doesn't have hey legitimate reason for denying illegal immigrants to the ability to drive in oregon.

we spoke with an immigrant who's been driving in the u.s. without a license for 27 years. >> if it's i wi ae's legal to g driver's license, there's more opportunities to find a job as a driver. you know, to move around the city with confidence. >> but a vast majority of the country disagrees. 40 states require legal proof of residency before issuing a driver's license. in oregon, a blue state, 35 of 36 counties voted to prevent 9ñ oregonians for immigration reform led the effort. leaders say it wasn't about race but, rather, jobs, national security and m4oáwhat's right. >> there is no inherent right for somebody that's here illegally to be able to get a driver's license. that isn't a constitutional right. they don't deserve it because they made it here illegally. >> a recent study concluded illegal immigration costs
