>> we'll start with something you probably saw yesterday. the president of the united states went over to the pentagon for a 90-minute briefing to find out what's going on with isis. he came out and looked to according to "time" magazine, he couldn't get behind the podium fast enough. he was trying to runoff. he had a few words to say, about seven minutes. essentially said we're in the right direction even though isis is making gains around the world. hit us in california. >> oh, yeah, i had 9,000 air strikes, we dropped a bunch of bombs. november was the all-time high. if you factor in the fact that we should have been doing this as a brisker pace for the last year and a half, if you want to factor in the fact every day they stay in business, they get a million dollars or more to bring into that organization, if you factor in a russian airliner blown up and the stabbings that were taking place in england, you see that isis is spreading. they're not going anywhere.

and the fact that they haven't gotten any ground does not release the fact that 70% of syria now belongs to isis in the area. >> 56% of americans say that they don't believe that the military is doing enough in the fight against isis. i think that definitely has something to do with why the president is speaking out as frequently as he seems to be. >> people are afraid. especially since they hit it in san bernardino. >> when you look at the woman, tashfeen malik, screen right, right there. she wound up getting a green card. as it turns out, she went through the vetting process three different times and yet they did not catch the fact that she had posted all sorts of crazy jihad stuff on her facebook page. why? well, according to the daily caller, they found out that apparently the department of homeland security may monitor americans' social media accounts to make sure nobody is

with assault rifles and grenades. and then in baltimore, an accused isis fighter claims he wasn't working for isis. he was trying to scam the terror group he says. he admits he was communicating with isis operatives, but only to con them out of $9,000 in a money wire. brand new drone regulations from the faa on the heels of an alarming new report about the dangers that they pose. starting next week, people will have to register their drones online for a $5 fee for drones weighing up to 55 pounds including all the attachments. they have until february 19th to register. flying a drone unregistered comes with stiff penalties. $27,000 for civil violations and $250,000 for criminal violations. that could include up to three years in jail. a new study also shows that one in every five drone incidents is a close encounter with a airplane. if you want that package to

are you surprised? >> yes. i'm surprised for a couple of reasons. one way to look at this, the guy knew what he was doing. >> he left a letter. >> he left a letter. he had fantasies that he was jason bourne and robert ludlum-based novel movies and five of his buddies were killed in the various efforts to bring him back. another way to look at this is, the chief investigators who investigated this case ended up testifying as witnesses for him. the jublg dge in the article 33 hearing, the equivalent of a grand jury order thad he not be tried, that he was so mentally ill and incapable of making proper decisions. so this is a head scratcher. i've never seen a case where the investigators testify for the defense. there's another very, very odd twist in here. that is, that his lawyer has been making noises in the legal community that if the case is

tried, big if, one of the defense witnesses will be either present or former president barack obama. oh, boy. >> which is a reason why it may never be tried while barack obama is president and he may order the mill tear toy cut a deal with this kid. >> he doesn't want that. i'm surprised it went this way. we've had a number of conversations about what should happen to him. >> right. >> there has to be consequences for what he did. >> so now instead of facing six months, which is what the judge in the article 32 hearing had ordered, which would have been set free, because he's served that much time. he's now facing two life sentences. could the government ask for death? yes. i don't think they will. because they probably would have announced that yesterday. but is there a basis for them to ask for it? yes, the basis is, as i stated earlier, innocent american troops were killed in an effort to retrieve him. >> one of the conversations that

>> well, first the president goes out yesterday to the pentagon with all his -- all his -- with the secretary of defense, with the vice president, with his cia director and just comes out and says, everybody, the fight against isis is going great. 9,000 airstrikes. we've had more bombings this month than ever before. he's neglecting the fact that it took him a year and a half even to bomb the oil. he's neglecting the fact that every day isis is in power they gain an enormous amount of strength. he's neglecting the fact that there was a bombing in paris, bombing in san bernardino. there was a stabbing in london. all from isis. because they have their headquarters in syria. >> well, it's great that we're hitting the tanker trucks and the oil wells and refineries. >> now. >> finally. but it does seem like the president of the united states is still trying to convince us that we are winning this global war on jihad. even though he doesn't want to call it razz cal islam or anything else. but it certainly doesn't feel like it to the american people, when you have these attacks like out in san bernardino, or the bataclan in paris. >> and then you wonder how these people got here and then you go

back and try to recreate the admission process, and you see this pseudo couple with their sham marriage and the fact that she got three background checks, and on her website, on her facebook page, in erdu back in 2012 praising the 9/11 attackers, and also adhering to isis and talking about isis and al qaeda which should have been a disqualifier. >> should have been. here's the thing, doesn't the department of homeland security have google? all you've got to do is look on her facebook page. they didn't do it, because this is, and it was revealed in the daily caller yesterday, this is apparently federal policy when it comes to the department of homeland security they don't want to be accused of trampling on immigrants' rights so they don't look at any of their social media postings. now what's interesting is they actually look at all of our postings for any criticism of the department of homeland security. kind of big brother is watching, and if you say anything bad about them they're going to come after you, is the implicit message. but nonetheless, she was able to

them and then we left. and only we have the power on the ground to really make the difference. the sunni arabs will be with us. but we have to be there. but right now, they have no trust in us. none. none whatsoever. >> i understand. you also say the vietnam era tactic of fire and maneuver has gone away. what do you mean? >> well, we don't really close with the enemy and that's fine. but we wear a lot of heavy armor, we move forward on the battlefields, and then we use an enormous amount of firepower. when i was in the battles with the marines at fallujah, you get us in there, we're going to do the job, but there's going to be a lot of death and destruction. you can't go to war and say there's not going to be death and destruction. >> yeah. >> but the one thing, steve, i don't think we should do. some of the candidates are talking about a no-fly safe zone. >> you're not a fan? >> don't do that. >> okay. >> the no-fly safe zone makes us responsible for 4 million

tennessee titans. thank you for joining us. i appreciate it. >> absolutely. >> i always had problems with that. number one, there's free agencies after when you're drafted. i always thought for mr. irrelevant you've got to be a good sport but inside it's got to bother you. did it bother you at the time? >> not really, to be honest with you. you absolutely have to have thick skin about it. and one of the things about being mr. irrelevant, you know, that i always looksed at it, it was an opportunity. a lot of people probably look at something like that and say mr. irrelevant and don't expect a lot from that person because of the title. but for me, i didn't really care what other people expected or what other people thought it was more about, you know, how i felt about the way that i could perform and the way that i could play and it was an opportunity and i was very blessed to have that opportunity. >> so you were motivated by it. even though you did a parade, i guess they had you in a kayak? >> yeah, matter of fact, one of the -- i'll never forget. they have a parade for you out in california, to kind of roast you and toast you a little bit.

and it's just a balboa yacht club which is a beautiful yacht club, there's a lot of million dollar yachts around and they tell me i'm going to make a grand entrance on the beach where everybody's waiting and i'm going to come in on one of those boats. i'm thinking this is going to be pretty sweet and sure enough they take me around to the back of the marina and there's a little canoe with like a 5 horse power johnson engine on the back and my grand approach was on that little canoe. >> so when did you say to yourself, okay, i'm going to break through. you played a bunch of sports. you're an excellent athlete. when did things start turning around for you? >> yeah, i really never played football until i got to high school. i kind of played everything else, you know, i played soccer, and baseball and basketball and golf. and really it wasn't until my freshman year of high school that my soccer coach was like, hey, look you really need to go down and kick. i've never seen anybody hit a ball that hard. for the longest time i didn't want to do it, finally he made me go down to practice a week before the first game and they kind of said hey buddy, you're

suiting up on friday night. that's kind of how that started. >> and next thing you know, you're one of the finest kickers in the league. ryan before that, though, not only mr. irrelevant bothered you, you also had an incident when you got caught under the flag, correct? >> yeah. that was -- that was pretty funny. we were playing up in indianapolis last year, and if you're not familiar a lot of times the nfl games for the national anthem they'll have a, you know, a huge american flag. it's actually pretty awesome, but it covers the entire field and i always like to hit a kickoff or two right before the game starts and i was out in the middle of the field hitting my kickoff and i saw all the service men and women coming from our sideline with the flag, and usually i thought i had another minute or two, and unfortunately i hit that kickoff and next thing i know they're running at me, it was decision time for me, i could either run to the colts sideline and be on their sideline for the national anthem, which would probably be pretty embears aing and i could hit the deck and try to go under the flag. split second decision that's what i decided to do. ended up being stuck under the

flag for the national anthem. it was only about three minutes but it seemed like about 30. it was the longest national anthem of my life. >> and your new career has produced a three-year deal with $7.it million. mr. irrelevant also a new dad, kr ekt >> yeah, absolutely. my wife and i just had our first son about 3 1/2 months ago. and man, what an awesome experience that's been. it's a blessing beyond belief. >> and ryan you got this other thing that every kicker has that's successful. you can perform under pressure. you know you're only as good as your last kick and you were playing almost with house money to get here. how does your mind-set today now that you have the contract, you have the significance, and you have the success? >> you know, honestly, i really don't think about any of that stuff to be honest with you. i don't think about a contract or success or anything like that. it sounds so cliche but honestly i try to get a little bit better each and every day. and at the end of the career, we'll talk about all that stuff. but, right now, it's just trying to get better each and every day.

all right. it's 28 minutes before the top of the hour on this tuesday. in just a moment taya kyle is going to sit down on the couch with us because you went down to texas to interview her. >> that's right. we did a lot down in texas. we'll tell you about that in just a few minutes. first i've got some headlines. comedian bill cosby now turning the table on several women who've accused him of sexual assault, claiming defamation. cosby just countersuing seven women who had sued him. he claims the sexual assault allegations have hurt his reputation so much that they ruined plans for a new tv show. the 78-year-old denies all sexual assault allegations against him, and has not been charged with a crime. a coffee throwing match erupts at a michigan tim horton's drive-thru. an employee appears to launch a cup of scalding hot coffee and doughnut holes at a customer,

even spitting at one point. the customer retaliates throwing an old cup of coffee back through the window. things apparently got to this point when another employee said that she wouldn't throw out the customer's empty coffee cup. they need to chill out a little bit there. a businessman going viral after turning the tables on some panhandles in iowa. he saw these two on the side of the road claiming to be broke and hungry. he then offered them a job. but they turned it down. the businessman then made his own sign, saying offered these guys a job, they said no. don't give them any money. that happened in iowa. >> those are your headlines. >> in the mean time he made impossible shots immortalized in the hollywood block buster movie "american sniper." >> but, what if there was a rifle that could turn a novice

shoot-out thanks to a new series of high tech rifles by tracking points. >> it's a hit. >> oh. >> this is an m-800 designed as a replacement for the m-110 and m-14. it's branded as the world's first smart gun. >> it does all the shooting for you. >> this is the weapon right here. it weighs about 15 pounds. it incorporates fighter jet tracking technology. so i could just point it at the target, calculate the wind speed and then shoot. and the gun does the rest. the idea came from a chance meeting between john mchale, the head of tracking point, and chris kyle. >> i started telling him what i was thinking. we sat down for a couple hours and said what are the variables. how do people make mistakes? the spirit of chris kyle is in this gun. >> what is your hope to do with this technology? >> well, we want to get in the hands of our first responders.

we want to get in the hands of our military. and you see they're here. right? we saw what happened in san bernardino. we saw what happened in paris. and this weapon would strike fear in the hearts of extremists. >> taya trained up in just a few days with the help of max underwood. a marine who served in afghanistan. >> what was she like to train? >> we had some rough spots but it's all about staying relaxed. >> it's still, you know, a weapon that you have to know how to hold the right way. you still have to do the trigger pull and lock onto your target and get back to the target that you locked onto. so there's a little bit of stress at first. for me it's a learning curve and i kind of like the challenge of it. >> wow. you got it. >> you make this look like you're a pro. >> well, the gun does all the work for you. i mean, it's incredible, really. >> okay so you're going to show me how to do this? >> yep. >> okay. >> did i get it?

>> yeah. >> nice. >> nice. i closed my eyes and blinked. sorry. >> and you still got it. so there you go. >> no blinking. >> and you still got the target? >> blinking could throw a shot as anyone who shot a gun can know. but this thing i did not miss at 350 yards and you were an awesome trainer. and so was max. >> taya explain how that -- how does it work? >> well the thing is that after heather had it tagged that's why she could blink. first you have to tag it so there's like a red dot that when you're looking through the scope you line up your target and you hit that, you tag it -- >> do you pull the trigger to market? >> some of them you do and some of the other models you push a button. after that you're good. so you can untag and retag until you have the hit where you want it. after that you just bring the gun back up, and when the gun finds that dot, and lines up with it again and calculates all the angles and ballistics and earth rotation and all that it fires. >> even on a moving target? >> yeah. >> once they tag it, and that

person's head moves -- >> right. >> the bullet will find it. >> well, it's not -- >> yeah you have to move the gun and as soon as it lines up with where you tagged again calculating for all the angles and everything. >> incredible technology. the creator met with your husband chris kyle and said what are the things that you have to think about it and he made a gun that thinks about those things for you? >> yeah. >> that is the coolest part. you have to know a little bit and you have the same safety precautions and all of that stuff. >> amazing. and you trained up for about a week to learn how to use this. you had a marine trainer who served in the marines. wonderful young guy who did this and you beat the nra world shooting champion. that was impressive. and it was a four-hour shoot-out. so when you're shooting for four hours that is exhausting. mentally and physically and she did it. a champ. >> won a whole bunch of money for a good cause and you're going to be back in the next hour, right? with heather? >> in the next hour we'll talk more about the foundation that you're raising money for and the good work that you're doing and

drones have become a big topic of concern here at laguardia, and many other airports across the country. they've made unannounced visits, not only at the u.s. open tennis tournament here in queens, but also at the macy's thanksgiving day parade. and no doubt hundreds of thousands will be given as gifts this holiday season. and that's why the faa is now requiring people to register their drones. the fee will be $5. drones weighing between about a half a pound and 55 pounds must be registered with the federal government by february 19th. now, what if you don't? well the penalties are quite steep. civil penalties range up to $27,500. criminal penalties, up to $250,000 along with a prison term of up to three years. clearly this has become an increasing problem, something like 100 pilots or more every month are reporting close calls. back to you.

donald in the lion's den. right? he's right in the center. >> yeah. >> and all the lions are going to tear him apart. but the question is, is he going to have faith and belief in the common sense of the american people, come across as presidential, magnanimous? you want to jab at some of the other candidates, i think that would -- you know, that's in order. but i think now is the time for him to turn up the substance, and doesn't mean you can't be entertaining and wistful and self-deprecating, that would be nice. but i think it's time for him to turn up the substance. he has an enormously strong core of supporters. but now it's time to build it out. and tell the establishment candidates, you're messing with the wrong guy now. and take it to the next level. i think cruz -- i wouldn't expect cruz to take a full hit on donald trump. i don't think that's cruz's style. i don't think he's going to do that. i think cruz is going to come with a lot of substance. as far as marco rubio and jeb is

concerned i think they're going to rye to put points on the board. these numbers are terrible for them in these new polls out today. just absolutely terrible. >> as we wrap up the year, how long do you think it's going to be before we see the kaepts in the single digits start to drop out? >> i think it will start happening, may be a few in january because they don't want the utter humiliation of having maybe negative percent, if that's even possible, in iowa and new hampshire. but right after iowa you'll have a number of people dropping out. after new hampshire, depending on how he does, i don't know where rand paul is going to be but i don't expect rand paul staying in it unless he gets some significant uptick in new hampshire. >> yesterday in listening to mark levin, and maybe you on your show, i didn't have a chance. but rush limbaugh. they're really upset that donald trump for the first time used the term maniac to talk about ted cruz, they said well is that how he's going to label all conservatives, because most people look at ted cruz as a conservative's conservative. do you agree that that might have been a little different

going after him as opposed to jeb and rubio and rand? >> we don't check in with each other before our shows. but not surprisingly, i said something quite similar on radio yesterday. i think we have to be really clear on what's going on here. it is the outsider candidates, versus the establishment. and the outsiders are, you know, they have about 65% of the electorate. okay? so it's carson, cruz and trump. for the life of me, i don't understand why donald trump thinks pointing the, you know, the laser down at cruz is smart. you want -- you want to just get rid of these -- these insider candidates. expose the divide in the republican party. and urge those guys to either move off the stage or start compromising with the american people. but, cruz, i don't think that was a smart move. and i don't think it made all that much sense. i mean a maniac? he was doing -- he was doing what he was sent to do by his constituents.

and you can argue that the tactics are of the filibuster didn't really work. i mean i see that point. but a maniac? i just think that's kind of loose verbiage which i don't think really advances the ball for trump. i think he's best when he's going after the establishment candidates. >> all right. we'll know tonight for sure how it all works out. and tomorrow will be our post game show. talk a little bit about this. everybody's still horrified and a little worried about what happened out in san bernardino. how did tashfeen malik, who was radicalized years ago, she posted all this crazy stuff on facebook, and laura, as it turns out, the department of homeland security when they vet these visas, they don't look at your social media, they do look at americans' online accounts to see if they criticize the dhs but she was able to walk right in, after three vettings, yeah, she's fine. what twitter? >> well, political correctness, literally, kills. okay. we have the office of privacy in the homeland security department, that apparently vets

all of its decisions with the aclu, so they decide they're not going to scrub social media. when we get hired by anybody, all of our social media is looked at. and it's smart to do so. because you learn a lot about someone by looking at their social media. but here they refuse to do so because they believed it would be probably part of the stereotyping of all muslims, terrorists, or you know, the aclu would be unhappy because it would be -- >> they didn't want to hurt anybody's feelings. >> but they are -- again, they're treating someone's presence in the united states as a right. you don't have a right to come in to the united states. it's a privilege to come here on a visa, or to become a citizen. now we're just like tossing off these visas like it's nothing. and it -- i think, again, why are the outsiders so popular? why do so many people still like trump, despite what he said about the muslims? or maybe they like him because of what he said about the muslims. because people have no faith in the federal government's ability

to do its basic job. to keep this country safe. we had 10,000 unaccompanied minors crossing the border in the last two months. now, millions of people are in this country, on visas, and who've become permanent residents who probably -- we have no idea what they said on social media. are they really the type of people we want in the country? we have no idea. >> you want to come to this country and if you want to marry an american citizen they ask you about the marriage to make sure it's not a sham marriage to get citizenship. when it comes to muslims they don't ask that. because a lot of them in some cases are arranged marriages and they don't want to come off as judgmental. how did that work out for the 14 people who are dead in san bernardino? >> well, they're dead. okay. so i'd like to hear what their family members think about a federal government that puts islamophobia and the concern about that ahead of the safety and security of all people, from all races, all religions, and backgrounds. america now is seeing, as the curtain is being pulled back,

and insult me to my face. let's have a debate on syrian refugees right now. >> okay. so the ring is set. >> the ring is set. so let's talk about what's going to happen tonight. cnn is hoping that the republican candidates trump and cruz kill each other in the ratings. destroy each other for the nomination. and there will be questions that will ensure that. but in my view, you may not see a punchout between donald trump and ted cruz. >> really? >> the smart money is saying that they both have too much to lose in going for the knockout punch tonight. ted cruz, one of the best debaters, not only in the country but in the world, argued nine times in the u.s. supreme court. but at the same time, donald trump has the capacity and we just saw it with one word, one phrase, one sentence, to deliver a right cross, a left cross, a knockout punch. okay, cruz is the boxer here. but they're both great counterpunchers. they both wait, and they may both count on other candidates
