federal prison. we'll catch you upcoming up. polls show national security is a top concern for voters in new hampshire this election season. but it is computer security specifically democratic national committee secret voter database that threatens to upstage tonight's presidential debate. ed henry is in man which chestm hampshire. >> reporter: this is a voter database that all of the democratic campaigns are able to share. it's run by the democratic national committee, gives them an idea of which voters they should be tar getting, what voters are saying about this presidential race and specific issues. there was a software glitch, though, so when the bernie sanders campaign was in this database, for some time they were able to take a peek at

hillary clinton's individual information. their proprietary campaign information about voters they had targeted, what kind of responses they had gotten. that drew a furious response from the clinton campaign, charms from the campaign manager that the sanders campaign had actually may have even broken the law. the dnc cut off access for the sanders campaign yesterday and then there was a lawsuit by the sanders camp to get it back. they now have an agreement to get back into this database. but what is interesting about this whole fight is it's given oxygen to bernie sanders at a time when hillary clinton is beating imin national polls like the fos one almost by a 2:1 margin. and then you have republicans like america rising pac, this republican conservative super pac, collin reed will pointing out when it comes to hillary clinton and e-mails and electronic information, this may not be something she should be talking about, saying, quote, for years she deliberately kept

all e-mails on a private server jeopardizing america's national security and part of an fbi investigation. for her campaign to attack senator sanders is as laughable as the idea that she's honest. and this fight is bringing attention to the sanders charges that the dnc has been helping the clinton camp. because look at what is happening tonight, this is the third democratic presidential debate, it's happening on a saturday evening the saturday before christmas when many people are either in church or shopping mall raising questions about whether the dnc is trying to make sure that hillary clinton is protected and any potential mistakes slip ups or anything like that don't get a lot of attention. >> and any chance we'll really see the gloves come off in this debate? there has been so much criticism in the debates before, everybody just been playing nice. are l. we start seeing now five week before iowa some meaningful conversations and attacks?

>> i can tell you both sides are so fired up and let's not for get you have a third candidate in martin o'malley that time is running out for sanders and o'malley to really make a dent in clinton's big lead. so just as we've seen on the republican side, you'd expect it would heat up. however as you aptly note, going back to the first democratic debate in las vegas, bernie sanders basically took or at least tried to take the e-mail issue off the table. and his campaign has not quite recovered. he was sort of neck and neck with clinton back will then. she's only widened her lead since then. so if the gloves are going to come off, it better be tonight. >> i know you'll be back here to break it all down. thanks, ed. so just how many americans have joined the isis fight overseas? a new bill passed by the house this week would provide a fuller picture of the danger level.

>> isis has explicitly encouraged fighters who cannot make to iraq and syria to join their struggle in other locations. we cannot wait until one of these foreign fighters and a terror safe haven attempts an attack. we must preempt rather than react. >> texas congressman will hurd, former cia undercover officer co-sponsored the bill. he joins us now. congressman, we have so much to talk about. i want to take a step back before we talk about legislation. i know in september, you as well as some of your colleagues released a report with a number of key recommendations. have any of those recommendations come to fruition? >> they have. one of the major ones was changes to the visa waiver program. it's 39 countries in europe that participate in this. and it allows folks from france or determine any, the ucht k, to

come to the u.s. without doing an interview. so what we were seeing is that many of our european allies weren't sharing information on suspected terrorists with the united states. if people lost or had stolen passports, this information from our european allies wasn't being reported to interpol. and this has to stop and we have to make sure that information is getting to us so that we can protect our own homeland. >> so you're working on that. but we also know that there are 50 recommendations in that report that you worked on. in a perfect world, all of those would be implemented, but what do you see and what would you like to see be implemented first, where are we most vulnerable? >> well, the first one and the most important to me was this visa waiver program. it passed the house a number of weeks ago, it was included in the recent budget that was passed yesterday and the

president will sign into law. this tightens up and stops people from today being able to travel to this country, making sure that he's folks are getting the information. because if we get the right information to the right people, we keep terrorists on the run and off our shores. so this is number one priority out of the foreign fighter task force that i was a member on. there are a number of pieces of legislation we'll be looking at in this upcoming year, looking at different ways of tightening up the information sharing across the federal government. >> so you you talked about the visa waiver program. we also have heard a lot of talk about the refugee program and of course a bill which would encourage regular information sharing and reporting to lawmakers. so why is it so important that congress is being constantly informed because this is such a changing face of terrorism? >> it really is. the threat that we face is dangerous. and they have made it very clear, they're looking to come

to our shores. when i was chasing al qaeda in afghanistan and pakistan, they didn't lefshverage social mediae way that isis can now. al qaeda would do something called night letters, they would literally write a letter and leave it on people's doorsteps. the way isis is leveraging social media to hit tens of thousands, hundreds of thousands of people a day and radicalize them without having them in their country is unprecedented. and is this a fight that we have to stay vigilant on. and my friend colonel martin mcfallly says terrorists are moving at the speed of broadband and the federal government is moving at the speed of bureaucracy and we need to stop that. >> are you seeing enough activity out of the white house? we've listed all the things congress is doing. are you seeing enough from the leadership in the executive branch? >> one thing that i wish thisrd would do is pick up the phone,

call the director of the cia and said, listen, we have to double the amount of human intelligence that is coming out of iraq and syria in the next 45 days. giving the men and women and the cia special forces the latitude in order to do their job. because if we increase human collections, that's going to drive our targeting efforts from the skies, that will be able to drive our operations on the ground, a critical component in order to stop these terrorists. the other thing i'd like to see going on right now, there are debates in washington, d.c. on how you have a political or diplomatic solution to the problems in syria. we have to make sure that bashar al assad oig is nowhere to be found in those negotiation. he's the current president of syria. he has been responsible for killing and havinging millions of people leave his country. he is part of the problem, as well. and we can't allow him to be

part of this conversation. and one thing that we have to do is we have to be stronger against vladimir putin and the russians. the russians are claiming they're bombing isis locations, but they're also hitting rebels that are supportive of us, that we're training, that we're equipping. and that has to stop. >> and we've heard that from a number of lawmakers. so as a former undercover officer in the cia, we appreciate you joining us. i'm sure the conversation will continue. >> thank you, elizabeth. well, speaking of the russians, the fight against isis has helped forge a new bond of sorts between the united states and russia. that partnership however long it lasts appears to be paying dividends in this struggle to bring peace to syria. jennifer griffin is here. so we have heard of u.n. peace plans before in the middle east like the one that we have now on the table. any reason to think this one will work? of syria's civilthe first time war five years ago that the

world powers have met and agreed to a plan for a cease-fire and peace process. many in washington doubted secretary of state john kerry could pull it off. >> will this dothis council is clear message to all concerned that the time is now to stop the killing in syria, lay the ground work for a government that the long suffering people of that battered land can support. >> the u.n. security council voted 15-0 in favor of ending the syrian civil war agreeing to an ambitious time line to hold elections in 18 months. peace talks are slated to begin next month, but it's not clear which groups will be allowed to sit at the tail. the government of jordan is charged with determining which syrian opposition groups are also terrorists. a moment of tension emerged at the end of the u.n. press conference when kerry accused of russians of killing members of the u.s.-backed opposition.

>> if 80% are hitting opposition rather than hitting daesh, it's a challenge. and we're trying to resolve that. >> proposal to coordinate on this remains on the table. >> it's still not clear whether russia or iran will insist assad stays. the u.s. hopes elections will allow the syrian people to vote assad out of you power. u.s. position has shifted of late with kerry indicating while on a visit to moscow this week the u.s. was not pressing for assad to leave immediately, to which assad joked to dutch television, quote, i was packing my luggage, i had to leave, thousand i can stay. u.s. officials fear if they push assad out now, they will create a vacuum to be filled by isis. this is an ambitious resolution by the u.n. brokered by secretary kerry, but implementing it will be very difficult. >> it has been years since president obama said assad's days are numbered, now evidently

the u.s. staying he can stick around. jen griffin, thanks. there is also the suffering of the innocent civilians caught between the assad regime, anti-government fighters and isis. women, children, men. but these numbers help explain the newfound urgency. more than 200,000 people have died in the 4 1/2 year civil war. 12 million have escaped the violence and been displaced. more than 7 million of those displaceded inside their own war-torn country. another 4 million plus are in refugee camps? jordan and neighbors countries. more than 28,000 civilians were killed in mass shootings and attacks so far in the syrian civil war. and calls are growing louder in chicago for a change in the city's leadership. hundreds of protesters marched last night demanding the resignation of mayor rahm emanuel and the cook's county

attorney general. the leaders are under fire for complaints of abusive policing and lack of accountability in the police department. this protest was the latest in a wave demonstrations since the release of a video showing a white police officer shooting and killing a black teenager. we could learn as early as monday if and when baltimore will retry officer william porter to manslaughter. this week a jury failed to reach a verdict in the first trial of an officer charged in the death of freddie gray. the verdict and legal fallout could of course be a stunning setback for prosecutors who are also handling the trials of five other officers involved this gray's death, those all scheduled for the beginning of next year. a former baltimore assistant state's attorney joins us. do you think they will retry porter some. >> i do. they have staked so much political capital into these trials. >> there has been a lot of discussion that in order to get a conviction of some of the other officer, you'll need

officer porter's testimony. he was one of the officers involved in the transport of freddie gray, but not necessarily charged with the most serious of the crimes. but in court, you have a situation where folks were saying that the prosecutors saying that william porter is a liar, he's lied to you. how all of a sudden could you use his testimony or any of his statements in any of the next trials? >> prosecutors are allowed to say one person has lied in one trial and then put them on as a witness in the next. the key to officer porter's testimony was that he said that mr. gray asked for help. and that is really pivotal to the prosecution's theory of the case, which is that the officers were aware that he needed help and then they failed to assist him. >> is this a case where marilyn mo mosby so overcharged these crimes that the jury gets

blinded by saying we can't convict him of involuntary manslaughter, maybe he didn't get help, but is this a case where you have overcharging and making it so much harder to get a conviction? >> i think that the standard for conviction of beyond a reasonable doubt is so much higher than the standard for charging. and i do think that not all of the officers should have been charged in this particular case. and the charges do seem a little bit overblown considering the actions that she alleges they committed about. >> in the couple days since we've seen the mistrial verdict come out -- result i guess we should say come out, has there been any indication that charges will change, that we will start seeing plea bargains and programs marilyn mosby will have to be more realistic about this? >> the only rumor is that she will have to offer officer port porter immunity in order to use him in the subsequent trials. but there hasn't been any rumors

of any possible plea offers. and frankly, i don't believe that the officers would take any pleas because they believe they act the reasonably considering all the circumstances. >> at least one member of that jury agreed that officer porter acted reasonably and wouldn't convict him. big picture now. just got wrord from tword from baltimore sun that morning marked the 330th homicide in baltimore. the crime rate has skyskyrocket. is there a feeling that there has been so much focus on fredky gray at the expense of the rest of baltimore and its public safety is this. >> i believe that there is. and if you look at the resources that the mosby administration has porn into this case, expert witnesses, paying expert fees, that is unheard of. there were cases that i would beg and plead to just have the evidence that we did have

tested, let alone bring in outside witnesses and put all of this effort into one particular case. if you just look at the number of prosecutor, she has four or five separate prosecutors assigned solely to the freddie gray case. that is unheard of for baltimore city. >> we'll see how it plays out over the next trials. her husband is now running for mayor, so could be a big preliminary gamble. appreciate your insights. we'll bring you back as the case develops. coming up, president obama makes a stop in san bernardino on his way to hawaii. kevin is traveling with the president. >> reporter: great to talk to you. five hour trip from d.c. to california, but the president spent three hours on the ground meeting with victims' families and first responders. i'll tell you what he had to say about that coming up. and a blast of wintry weather causing a major headache for drivers. what does the forecast look like to your holiday travels?

president obama has arrived in hawaii for his annual holiday vacation with his family. on the way they stopped for several hours to comfort the families of those killed in the terrorist attack in san bernardino. kevin corke is traveling with the president and he's now in hawaii. hi, kevin. >> reporter: you're right, the president wrapping up a receipt busy friday. you may remember he had his year end press briefing at the white house and then as you pointed out made the trip to california to meet with the victims' families following the worst terror attack on u.s. soil since 9/11, a very long and emotional day. for the just for the president and the first lady who of course did heat with the victims' families and first responder, but clearly for the responders themselves. listen to what the president said afterward.

you. thank you so much. it was a beautiful morning in hawaii where kievin is, different story in michigan, a slippery wintry mess. whiteout conditions yesterday sent several cars spinning off the road or crashing in to each other. one stretch of u.s. 31 north of grand rapids was shut down after, get this, a 50 car pileup. the snowfall was intense, but brief. and as you can see from the pictures there, not much snow actually collected on the ground, but the below freezing temperatures iced over the roads making them increasingly dangerous. janice deep is in the fox weather center as the storm continues to move across the country. >> yeah, we're dealing with in some cases the first official snowfall of the season across the great lakes and the northeast. short lived, though. and in some cases this is record-breaking, the fact that we haven't seen snow in some of

these particular areas that will see feet of snow this time of year. so buffalo, watertown, up towards grand rapids, the temperatures will soar over the next couple of days. contrast that to the incredible amount of snow across the west. feet across the mountains. this is typical of what we see during an el nino. a lot of snow, cold air across the west and particularly warm for parts of the northeast. that's the last 24 hours. several storm systems moving in and leland, just a taste of the forecast along the east coast, we'll be pushing 70 degrees in morning city. for d.c., 72, 73. we are certainly going to set some records for christmas eve. back to you. >> as we were saying earlier, rather than milk and cookie, ice cream for santa and the reindeer. thanks. >> you got it. still ahead, the long arm of the law catches up to one-time

fascinating. joe, the fox news poll asked democratic and republican voters if they were to hear a temporary ban of nonmuslims, u.s. >> mikmuslislimuslim, and trump's name was attached, 25% would support it if donald's name was he attached, 45% with no mention of trump. so is that a stigma on trump? because i'm a little surprised at this poll and i want your reaction. >> there are two things i want to point out. trump provides context to the poll. most people are associatesing the ban on muslims with what trump has been saying. so when trump's name is added to the poll, a voter may get more context which may increase the likelihood that they wouldn't support it. to give you another example of how these polls need context sometimes, just yesterday a poll was release that had said 30% of republicans supported bombing the hometown of alladin in the disney movie. so there are contexts that need

to be in place for these. trump is taking a lot of heat for these statements and it's definitely dominated the debate. i don't think it will dominate the dough bait tonigebate tonig. >> angela, agree or disagree? >> here's what i believe. the fact that our president is not showing leadership in protecting the homeland, people are buying guns and they don't want muslims to come to this country and that's not america. so we need leadership from the white house, but we're not going to get it until we get another republican president to replace -- >> that supports banning muslims? if that's unamerican, why is the republican party so far behind it? >> this is not your so he. elizabeth is asking the questions. so let her continue. >> so we'll shift. i want to bring up one more poll before the debate preview. this in poll, it says 2016 democratic nominee preference, and you can see with clinton and sanders, hillary clinton at 56%,

bernie sanders at 34%. in november, 55% and 32%. we've seen it stay fairly consistent. but for the first time, there is a possibility that those two may spar tonight. angela, do you think there is a potential that we could see either the gap get closer or wider after tonight? >> the gap is going to stay wider. we'll see another lackluster performance and a love fest for hillary. i feel sorry for bernie. i feel sorry for o'malley. because people want to see their potential president under fire, but hillary clinton is not under fire. and they're doing the debate on a saturday night right before christmas, so about 70 people will watch it. >> but do you think, joe, that there is a possibility that there could be some sparks? we know there have been a lot of controversy, dnc said the sanders campaign acted inappropriately and systemically accessed the clinton campaign data. is there a possibility that there won't be quite as many

softballs thrown at each other? >> i don't think that issue will really come up. i've used this program that they're talking about, i use it pretty much every day with with my company. this was a glitch and the dnc has to be careful here to make sure that they don't show favoritism. i think that's important to be remembered that they -- >> but they already have. you say it's a glitch, but the dnc says the sanders campaign took advantage of that. >> except that, without getting into the details of the program, there is no way to really use any of that to their advantage unless they downloaded it which is shown to not be the case right now. so as far as this is going, this situation is done. their staffers will argue over it because it gets press coverage, but in the end they won't spar over this. what they will spar over is the foil of the republican debate that just occurred. they will go after sort of the war on terror, the spying on other americans, data
