>> and this weekend, the force is definitely with the new "star wars" movie. blasting previous records. america's news headquarters starts right now. >> and we begin with a suspicious device discovered in the bathroom of an air france flight. it was a false alarm but there are still many questions about the fake bomb rigged with cardboard, paper and a timer that caused an 11-hour flight to paris to make an emergency landing in kenya. paul is in johannesburg with the latest. >> reporter: five of the passengers from the air france plane have been arrested. the five, who sources say are two muslims and three christians, are reportedly being

interrogated right now by the kenyan police anti-terrorism police. the flight was three hours into it when a passenger found the device in one of the aircraft's bathrooms. the plane made an emergency landing at the closest airport in ken na. the airport was evacuated by all except rescue staff and the 459 passengers and 14 crew on board used the aircraft's emergency chutes to get off as quickly as possible. i've seen a picture of this dummy bomb and it looks real. there's a large digital clock on the top and some wires going into what looks like several sticks of explosives. in paris, the french national prosecutor is considering starting an investigation. one of the questions to be as d asked, is this a dumb prank or dummy run from the terrorists? the first of such a real-looking device was found.

one final note, fox news understands the device was found hidden behind a mirror in a bathroom on the jet raising the possibility that the device wasn't placed on board at all but in paris before the plane took off on the outbound flight. arthel? >> thank you so much. we'll have more later in the newscast about what is behind that fake bomb. eric? >> arthel, one day after that dispute over the breach of private campaign data, hillary clinton and bernie sanders have kind of come to a truce. at a debate in new hampshire, they focused once again on national security and terrorism. of course, the heightened fears of terrorism as well as how well the economy could be doing. ed henry is live in manchester, new hampshire. beautiful spot. how are you? >> reporter: good to see you,

eric. you're absolutely right. there was a lot of hype pregame, if you will, about the breach of campaign data. sanders' aides allegedly dipping in and going through the clinton playbook when they shouldn't have been. information that was gleaned, a section of the information shared among all of the democratic campaigns and other sections for the individual campaigns to keep their private information. it appears that there's evidence that the sanders campaign was engaged in wrongdoing here. a lot of charges back and forth but sanders ended up apologizing. clinton accepted it. everyone seemed to move on just like that first debate in las vegas where bern fee sanders said i don't care about your e-mail even though it's being investigated by the fbi. you're right about national security. that was a big flash point and it appeared that the former secretary of state slipped up a bit by suggesting that the isis strategy is now working,

something that republican carly fiorina today said is not true. >> we now finally are where we need to be. we have a strategy and a commitment to go after isis. >> incredible, honestly. somehow a u.n. resolution about syria puts us where we feed to be? i think it's a reflection of hillary clinton and barack obama's belief that our foreign policy gets set by others. this is what leading from behind means, i guess. >> clinton, though, still has the commanding lead over sanders, 22 points nationally in the latest fox poll. interestingly, the other criticism, this was the second straight democratic debate held late on a saturday night, very small viewing audience, perhaps to protect the front-runner. eric, we've checked when the next debate will be. it's january 17th. what's significant? that is a sunday and there are two nfl playoff games on that very day. eric? >> you know, ted cruz was joking about it and saying put them on at 2:00 in the morning in alaska

pbs so nobody could see hillary. but they denied it. >> okay. ed and eric, we're going to go to the gop side. donald trump's lead is increasing across the field of candidates and may lead the way to republican rivals, others say he's not the job. >> for a candidate who used to have a hard time going after somebody like donald trump, jeb bush is finally finding his voice. he called him the chaos candidate. yesterday he called him a jerk and today jeb bush confirmed what people have already guessed, that he feels liberated speaking out against donald trump. >> to a certain extent, it's interesting to be able to post up against a guy who is not supposed to be president.

he's not a serious candidate. >> but he is the clear front-runner. according to a new fox poll out friday, trump is at 39%. his closest competitor is 21 points behind him. this poll now has clinton beating trump 49 to 38. a month ago, trump was beating her, 36-41. it's something that carly fiorina seized upon this morning on "fox news sunday." watch. >> donald trump can't beat hillary. i think it's very clear. she doesn't want to run against me because i will fight her and force her to fight on ground that she will lose on. i will reveal to the american people over and over and over again the clinton way, say what you have to say to get elected. lie as long as you can get away with it. >> but right now it's rubio being forced to fight on immigration. cruz claims he's never supported a path to legalization and rubio

says that's not true. he supported a bipartisan amnesty bill and that cruz deserves extra scrutiny on this issue and here's why. >> when you spend your whole time saying that you're a clear talker and say what you mean and you're the only purist, i think it's fair to say, hold on a second. here's where you've been in the past on some of these issues and here is where you are now. >> reporter: as for cruz, he's continuing his swing through the south. he had a rally in alabama but made no mention of marco rubio. >> kirsten fisher, thank you very much. an unidentified person has been detained in belgium after authorities have searched a house in brussels. the prosecutor's office conducted that search as part of the investigation into the countries linked to the horrible attacks in paris. it's located between the center of the belgian capitol.

authorities, we are told, still right now trying to establish what kind of connection, if any, the person would has been unidentified may have had to the attacks in the french capital. as of right now, there's no word on what happened toed it main suspect. salah abdeslam may have escaped to syria. we'll give you the latest details on when authorities tell us the identity of the person that they have detained. a sad weekend of honor and remembrance in california. friends and family members saying their final good-byes at memorial services for three victims of the san bernardino terror attack. will carr is live in los angeles. >> the investigation continues into the man who bought the

ar-15s they used in the shootings to kill 14 people. the community of san bernardino trying to concentrate on the victims. she was ambitious and highly intelligent and then there's 52-year-old jewish man who defended radical islam. on saturday, his pastor came out and said just weeks before the shooting, farook threatened him. michael wetzel was laid to rest. he was a loving husband and father of six kids. >> he loved that family. he loved those kids. he was just the epitome of a great man. just a good man. >> while the community was mourning, farook's family and

including his mother moved out of the apartment in redlands, california, which is where he and his wife lived. the only person charged is enrique marquez who will be at a detention hearing where a judge will decide on bail. marquez is the one who authorities say bought the ar-15s that farook and malik ended up using. if marquez is convicted on the most serious charge that he is facing, che could face up to 25 years in federal prison. arthel? >> thanks, will. there's growing tension in the middle east involving the killing of a notorious terrorist by a suspected israeli air strike in syria.

they believe it belonged to the radical group hezbollah. he spent nearly 30 years in an israeli prison before being exchanged in 2008. hezbollah says israel carried out that air strike and has been vowing revenge. well, folks in the pacific northwest are facing some fierce winter weather. an unusual weather pattern is likely to bring the warmest christmas in living memory to millions across the rest of the country. senior meteorologist is live in the weather center. is santa going to have to wear a t-shirt? >> i think so in some areas across the south. the southeast, arthel, temperatures in the mid-70s, close to 80 degrees across the southern plains. so, yes, santa should pack perhaps his hawaiian shirt. we have a trough in the west and high pressure in the east and

that's what is bringing all of this storminess across the west. it's not going to be a picnic for everybody. more rain and mountain snow for the western states. the northwest really getting pounded with a lot of heavy rain and mountain snow. winter weather advisories are up. now we talk about that trough and we're going to see high pressure building across the east as all of this warm air moves northward. we're going to shatter, shatter records for christmas eve and that will be the trend as we head into next weekend. a lot of warm temperatures here across the east. cooler than average across the west with that mountain snow. if you like the snow and want to go skiing, head out west. look at this christmas eve forecast. 70 degrees in new york city. that would be a record. d.c., 75 degrees. 74 in atlanta. that's a record. really, we're going to see hundreds of records shattered across the east if this forecast holds.

some of the hopefuls have been working the campaign trail before the holiday week. the iowa caucus is not until february 1st. they have the whole month of january to make the most of it. who could be in first place six weeks from now? joining us is staff writer for the weekly standard. it hasn't been since 1996 that the caucus in iowa was passed this late in february. i mean, four weeks, five weeks, that's an eternity in politics. what could happen? >> really, anything could

happen. i remember last time around, really leaving just a day or two after christmas to get back out on the campaign trail and it was boom, boom, boom. iowa, new hampshire, south carolina, florida and a lot of things changed when you had a lot of people voting. now you have this big, long strep of time and there's going to be a lot of intense focus on those early states, particularly iowa and new hampshire. and, you know, four years ago, things were kind of about the same from before christmas to what happened actually in those early races and now i think a lot of things could really change. you've got ted cruz on top in iowa now. it's a really good bet for him to win iowa and all of that time, two, three, four weeks until february 1st, anything could happen, anything could change and it's sort of all up in the air. >> let's take a look at the iowa poll. here's the real clear politics up to the moment. it has cruz up just over 30% and donald trump nipping at his heels at 26%. rubio at 12. cruz down at 10%. i'm sorry. carson at 10%.

so cruz is way up there and he's been gaining. is there a sense that because of the evangelicals and fading of carson that cruz will pull it out there? >> absolutely. again, i think that's good money for cruz in iowa. but let's think about what happened to ben carson in just really a month. he was on top of the polls in november and then by the end of the month he was on his way down and he is where he is now. so really anything could happen. that being said, cruz is i think a much stronger candidate than carson really ever was and he has a network between evangelical pastors in iowa and a home school network that cruz has really cultivated and tapped into. so, again, a good chance. but you never know what could happen in that month. there's a lot of sort of intense battles over different ideological questions and questions about policy that could really change things as people in iowa paid closer attention to those issue sdpls and whoever wins, when they hit

new hampshire, that is where trump is ahead. let's look at the flip-flop between trump and cruz and trump has more than doubled the number with cruz with rubio and ted cruz tied at 12. christie coming on strong, kind of, 11% in new hampshire. so, you know, what happens if ted cruz runs into the trump wall in new hampshire? >> i mean, we could be looking at if cruz wins iowa and trump maintains where he is right now, those could be the two candidates and at that point you have to wonder what the republican establishment, which doesn't really care what either of those candidates does. i think there's a lot more opportunity for variance in new hampshire because, as you pointed out, marco rubio and chris christie are vying for that maybe establishment or more establishment friendly role in new hampshire. new hampshire really likes to go against where iowa is. so you could possibly see either of those candidates breaking through or either of them

holding back the other and not really able to consolidate around one of those candidates. but again, that month -- really more than a month, january and into the first week of february, is a long time and people don't really make the decision in new hampshire. if you talk to people who know this day well, really until the last couple of days. >> and finally one point with trump, leading in south carolina, can you explain briefly, he's further ahead than george washington was. he's got like 39%. 21 points ahead of cruz in the national poll, right? so far ahead. how does that impact the individual states and delegates and some are saying, well, what happens when the rubber hits the road? >> well, this, i think, is going to be a really interesting test case for whether the sort of old style now of individual state primary contests really does give way to a national primary. we don't have a national primary

but if you look at where the polls have been in all these early states, all the way through south carolina and nevada now, which is going to be an important state, they tracked with the national polls. that's been different than i think in the past. you're seeing, again, with cruz breaking out in iowa, some changes in that but cruz is also going up in the national polls as well. i think it really hurts trump to not win in iowa. i think that's why cruz winning here is really important for him and for the party. again, if trump bounces back and has the comeback kid narrative, he's in a really good position because of that position he has in the national polls. >> that's a good point. maybe bill clinton didn't win new hampshire he said i'm the comeback kid and everyone thought he won and he didn't. left that impression. michael, good to see you. >> thanks, eric. >> arthel? >> did you see it? tina fey and amy poehler return to "saturday night live."

joining me is david, a fellow at the hudson institute and director of veterans against the d.o. good to see you, michael. >> sorry about the long title. >> hey, no problem. great accolades and accomplishments. we already know that the bomb was fake but made with a bomber how does something like that get past through security? is that something they should have been alerted to? >> well, originally, six people are being detained. now it's down to four people. i'd be very interested to know whether these four individuals took items on the plane separately and then started piecing this thing together in the bathroom as a dry run. as an intelligence officer, that's what i'd be looking at. the four individuals being detained, did each one have a

part in this? did they sit in different locations on the plane and did each one have a role in assembling this in the actual bathroom? i would hate to think that somebody could get on the plane with this already assembled and have it pass through screening. >> however, i go back to this stopwatch looking device. >> right. >> how did that pass muster? even if it's in a suitcase? it had to be in a carry-on. >> well, if you just carry it separately, it doesn't really come across. i look at the actual picture of the bomb. it's cardboard entities taped together and a timer placed on top of it. there could have been several people on the aircraft with a timer like this or simply a very bad hoax. if it's a bad prank or hoax, those individuals need to be punished so that other people don't know that they can do something like this and get away with it. >> right. >> terror doesn't have to succeed to work. everybody on that flight was scared. people flying today are scared.

so it works regardless of whether or not it's an actual bomb. it still terrorizes. >> sure. i want to get to that point in a moment but i want to stay here with this fake bomb. is there something behind it? could isis be testing the system? >> yeah, they do dry runs. they want to test the reactions of intelligence and security. officials and systems to see what we do. much like the warnings to l.a. and new york, you saw l.a. shut down a school system and new york label it as a hoax. so it's a dry run. if this is an actual dry run, very concerning. again, very interesting to see how where these four individuals sat on this aircraft. if they sat together, they could be a bunch of friends playing a joke. if they sat in different locations on the plane and assembled it at different times throughout the flight, that's very concerning. >> maybe there are u.s. marshals back on the plane like there was

after 9/11. >> definitely intelligent sharing. we should be in nigeria talking to these officials to see what information they are getting. i'm sure we are. >> okay. so if these -- we don't know if this particular situation was a terrorist group doing surveillance, if you will. but if it is, what are the authorities who are, you know, held to keep the system safe, if these bad guys are testing the system, are the security analysts testing the system as well to make sure that it remains secure? >> yeah. we need to make sure that all tools are available to law enforcement and intelligence agencies to look at these things. the individuals being questioned, we need to find out if somebody paid them to do this. if it was a prank. but there's always intelligence to be gleaned from things like this, both for the terrorist organization and intelligence agency. this looks like a dry run now or

stepping up their search for the so-called affluenza teenager, now offering a $5,000 reward. ethan couch killed four people while driving drunk two years ago outside of ft. worth, texas. his lawyers argued that he was too rich and spoiled to know right from wrong. a judge gave him ten years probation and he's now missing. here to talk about it all, criminal defense attorney and david wool, defense attorney and senior associate attorney, good to see both of you. >> same here. >> hi, arthel. how are you? >> i'm well, richard. let's start with you. if they are caught or even spotted in another country, richard, can authorities arrest him on the spot or does that country need legal documents from the u.s. requesting their arrest? a whole lot to cover. >> there is a whole lot to

cover. let's start with the mother and son. first of all, ethan is now 18 years old. he can make his own decision. that's first and foremost. i see a scenario where he says, my mother took me out of the country and i didn't have any choice. he's 18. he's an adult. now that they are fugitives, so to speak, well, more him, if she's caught aiding a fugitive, she could also be in trouble. there are a lot of unknowns. we have to first find them and find out what the story is. we don't know if they left the country. if they did leave the country, there are extradition treaties with certain countries and there are not with other countries. we have to locate them and then determine how to get ethan back to justice where he needs to be prosecuted as an adult. >> so david, whether they are out of the country or still in the u.s., what -- again, as richard pointed out, we don't know if the mother is in fact with him, if she's aiding him or not. if she is aiding him, if she is

with the son, what kind of charges would the mother now face and he's not a kid. is this ethan couch even in deeper water? >> well, the mother could face accessory charges. i doubt very much they have left the country. this kid got the deal of a century. he's 16 years old. in most jurisdiction, prosecutors would have filed a petition to have him tried as an adult. that would have meant ten years in prison. he got a juvenile jurisdiction and got probation, no jail time, and the idea is that he would flee the country just because he was seen on the video doing beer pong, drinking beer when he's under age does not make any sense at all. so my guess is, he's hiding out somewhere in the community, probably with the mother's assistance while they figure out what to do. they have probably contacted their lawyers. if you flee the country, you risk having the whole deal set aside. prosecutors can then have the case transferred to adult court for probation purposes and the

penalties get far, far worse. so it would be the dumbest act imaginable. i don't think it happened. >> meanwhile, it could be kind of dumb that they are even hiding right now, even if they are hiding wherever, inside of this country. >> correct. >> that's not good either. that's making it worse. richard, let me go back to you. what about the system that let him out in the first place due to affluenza? is there any possible legal or criminal repercussions there? >> first and foremost, he was tried as a juvenile. he was convicted of a crime at 16. he's a juvenile. the way the juvenile system is set up, it's set up for rehabilitation over incarceration, where the adult criminal system is just the opposite. as a juvenile, they wanted to have him to have an opportunity to have a second chance, essentially. this is not the type of guy, unfortunately, as we see, that deserves to have this second chance. >> so now that he's -- go ahead. >> arthel, it wasn't the
