"the danish girl's" alicia vikander won, breaking into tears. everybody talking about the best supporting actor snub. mark ryland took the oscar over sill vestor stallone, who was expected to win. an army staff sergeant accused of killing a virginia police officer will make his first court appearance later today. police say ronald hamilton opened fire on three officers as they responded to his woodbridge

home on saturday. ashley guindon was killed. two other officers were hurt. guindon was a half hour into her first shift ever. she's being remembered for her love of sacrifice. >> she was not only driven and passionate but exceedingly intelligent. she struck us that way as we interviewed her prior to hiring her and rehiring her. that's always the type of officer we're seeking, with that passion and intelligence. >> she served as a marine corps reservist. a vigil was held in her honor last night. a american student held by the north korean government confessing to his alleged crimes in pyongyang. at a press conference, he admitted to stealing a political banner from an off-limits hotel area on new year's day. he claims he was offered money by a member of an ohio church who wanted it as a trophy. >> i have no idea what sort of

polls. in about eight states. >> that's right. and because trump is doing so well, now on the verge of super tuesday, maybe that's why marco rubio has decided to pull out all the stops. until now, he has had a pretty steady approach to his personality. over the last 72 hours, marco rubio is letting it hang out. here he is trying to out-trump donald trump all across america. >> always calling me little marco. he's taller than me, 6'2". which is why i don't understand why his hands are someone the size of 5'2". have you seen his hands? they're like this. you know what they say about men with small hands. >> little marco rubio. a total, total featherweight. not a lightweight. i think he's going to faint. now we don't need a fainter to negotiate with china. he's not cool. he sweats too much.

that are leaving this country. we're not going to lose them anymore because we're going to have a tax structure that will keep them in our country. >> he would know. donald trump touting his tax proposals as a relief for the middle class and a way to boost jobs in the united states of america. can his tax plan hold up to the big promises? joining us now for an analysis of the presidential candidates' tax plans, chair of of the kings college business program, brian brenburg. we'll go fast because you have school. super tuesday tomorrow. what can you tell us about the fundamentals of donald trump's tax plan? >> it centerpiece is a big income tax cut. he's taking our seven brackets that we have today, compressing them to four, including a 0% rate on the first $25,000 of income for individuals and $50,000 for married couple. that's a huge, huge tax cut. >> i look at this, the second point, the highest earners who just got an increase under

barack obama up for the george bush era, goes from 39.6 to 25%. that's five below, at least five below where bush it it. >> yeah. there's big cuts across the board. including at the high end. that's going to be one of the pieces he's going to be critiqued for by his critics. >> the corporate tax, you've got to get bipartisan support. everyone agrees it look like barack obama wanted to trade off to get that decreased, and nothing happened. >> a big cut from 3 35% to 15%. that's controversial. that's in one of the issues that you're seeing bipartisan support. >> what would it mean to the overall economy? trump's plan would have 25% larger capital stocks. 6.5% higher wages. 5.3 million full-time jobs. and 11% higher gdp over the long term. we've not seen that growth the last 30 years. >> he's talking 5% to 6% economic growth. two to three time than what we've seen in recent memory. he's asking for growth. i'm not sure it's possible in

quick monday headlines for you now. the older brother in the boston marathon bombings passed a citizenship test three weeks before the deadly attack. according to "the boston globe," atamerlan tsarnaev pledged allegiance to the united states and denied terrorist ties. a navy s.e.a.l. awarded the medal of honor by president obama. he rescued an american hostage during a nighttime raid in afghanistan in 2012, shielding him from enemy fire while taking down a taliban guard.

>> amazing. ainsley? >> thanks. sportscaster erin andrews could take the stand today in the $75 million stalker lawsuit. she's suing her stalker and the hotel that allowed him to book the room next to hers and record the nude videos. they were viewed nearly 17 million times. what can we expect from her testimony, and what is at stake for the hotel chain, marriott? let's ask our legal panel. attorneys annie uzadewan and udit towalde. thank you very much for being with us. >> thank you. >> great for being with us. annie, let me start with you. does she deserve the $75 million? what can we expect today? >> well, she's not going to get the $75 million. what we could expect here is lots of tears and emotions on the stand. she'll likely talk about the impact that this has had on her and her family. she'll start with the time that she discovered the incident to

the embarrassment to her and her family, psychological counseling and medications, not to mention the 17 million who have viewed the video. on the other hand, marriott will argue they're not liable. this is a lunatic stalker who got the private information because he tricked the hotel employees. however, this is going to be a poor argument. they're going to be stuck with liability because they had a duty continue to disclose her information, let alone giving her room number and placing him in the adjacent room. on the other hand, they are -- they're going to start to diminish the damages here. what's going to happen here is they'll say, look, no publicity is bad publicity. it's going to be the classic argument that, you know, she got more famous health care reform more opportunities, and guess what, she's added a new gig. >> yeah, and annie, you mentioned that -- >> and "dancing with the stars" -- >> you mentioned that. a lot of people saying she's gotten more famous because of this. watch. this we'll show you emotional

its guests for reasonable protection from any criminal acts of a third party. that means to maintain the information, the confidentiality of its guests' information. they didn't do that. and for them to talk about how they're not liable, and this is solely on michael barrett, that's not true. the invasion of her privacy occurred within the hotel and was preventable by the hotel. >> the hotel somehow allowed him to get the room next to her. what happened? how did it happen? do you know? >> yes, basically he went there and tricked them. they say he tricked them into giving the information. guess what, she's a public figure, they placed him in the at jaysent room. it will come -- the adjacent room. it will come down to what the jury says. i think she'll get the liability. it will come down to when they think the $75 million is reasonable. given the circumstances, i find

a 95-year-old nazi medic who served at auschwitz will stand trial in germany today. hubert zafke charged with more than 3,000 counts of accessory to murder. all of the charges stem from a one-month period in 1944. prosecutors say his unit put gas to chambers to kill jews, and he also helped run that concentration camp. he was a medic at auburn wit when ann frank arrived. he says he did nothing criminal. back at home, the cruise ship damaged badly in a storm again forced to return to port. royal caribbean tweeting that the "anthem of the seas" will return to new jersey to avoid another storm. it was badly damaged three weeks ago when it sailed through 30-foot waves and hurricane-force winds. some passengers suing over the vacation nightmare. those are your headlines. back to you. >> i think it's probably a good call. >> yeah. >> go home early. >> be safe. >> thank you. meanwhile, hollywood's holy

we've also added $2.30 to our debt. and the forecast for the next couple of years doesn't look any better. let's break down the numbers with peter morici, economist and professor at the university of maryland. good morning to you. >> good morning. >> okay. i wasn't a math major. but that kind of math is going in the wrong direction. >> absolutely. you know the debt's going to start increasing as a share of gdp again. the big problem, america is not growing fast enough. so the government has to borrow to do the things we need. >> well, why isn't the economy growing? >> well, globalization has been kicking heck out of the u.s. economy. we haven't managed it well. we have this huge trade deficit. first we had it with japan. now we have it with china. n workers of demand for the products they make. and those manufacturers they could put out of business, they were big r&d factories. that's why productivity growth is down. >> professor we've got a graphic we're going to put up. since the 1960s on average, growth in the united states has been a little north of 3%.

3.1%. but since the obama administration, it's been at 1.8%. now, is that because of policies of barack obama? or is it just the way the world has changed? >> it's policies of barack obama, and frankly, before him, george w. bush. yes, because they haven't done much about china manipulating the currency and sending lots of exports here. and also, with obama, you know, these regulatory policies that he's imposed, you know, volumes and volumes of regulations, a good example, small banks can't make loans to small businesses. we're actually losing small businesses faster than we're getting new ones started. and you know, they're really dynamos of innovation in ways that are very difficult to measure and see at times. >> you know what professor? as we look at the political landscape right now, there are two candidates who've been talking a lot about trade deficit and how things are rigged. and of course that is bernie sanders and donald trump, right? >> absolutely. this is one of the big appeals

hadn't -- had been snubbed like leonardo dicaprio had been nominated this many times. but i think what really got people going was when he did a lot of the things like whoop ki goldberg in the background with the white actress couldn't get her lines out while the black lady was trying to get into the scene. it was so over the top that hollywood was racist. even some of the comments he made about the, you know, the sorority girls and things like that. i think america's really quite sick of it. it was fun to watch the audience's reaction where they had a tepid response to clap. >> kevin, here's the thing, if hollywood didn't come off so condescending to the rest of the world, they know more about the environment, they know more about the planet, they know more about society and the rest of the world just can't catch up to them and then to see them being accused of this and the stats don't lie for the last two years, not one nominee, and you know, i am not a thespian nor do i teach acting classes down the street so i'm not going to be the judge whether they're right

all right 14 minutes before the top of the hour. that woman right there erin andrews is expected to take the stand later today in her civil trial against a nashville marriott hotel, just days after the sportscaster left the courthouse in tears following testimony in her stalking case. >> yep, abby huntsman is here with the latest. >> you guys, the horrible story. a nightmare no one would want to relive. she'll be taking the stand just hours from now. erin andrews is expected to share her emotional and painful story on what it feels like to have your privacy violated. andrews is suing the owners of the national marriott hotel at vanderbilt university for $75 million. back in 2008 michael david barrett called the nashville marriott hotel, asked if andrews was staying there. barrett then booked a room next to hers, rigged the peep hole, secretly videotaped her in the nude and posted the video

platoon horses who have served in arlington national cemetery. they're being retired due to medical reasons. kennedy we have here to my right is a 15-year-old standard bred. he's got a lot of energy. he's a great horse. completely able to be ridden. more of the experienced riders. then we have quincy, to my left, who is very personable. and like i said, also served at arlington national cemetery. very honorable service and we're looking for the best possible home for these horses. >> and what are you looking for in a home? somebody obviously with horse experience able to house them. do you need any financial wherewithal to prove that you can afford it? >> yes, sir. we have a very thorough vetting process for the adoption package. it is currently a seven-page application that the adopters would fill out and then submit to the caisson platoon. each horse is adopted out individually. we're looking for a different -- we're looking for a different characteristics in each adopter. so for kennedy, the adopter would have plenty of riding

experience. he is a little bit temperamental so someone with riding experience, and/or horse training experience would be ideal. quincy on the other hand has disease which basically he's lame in his front teeth so anybody who has worked with the disease or works closely with aer iffier with experience would really be the ideal adopter for quincy. >> lieutenant, have they changed out of their work? is that why they're being adopted? >> no. so these horses are not -- haven't fulfilled their age requirement for caisson platoon. like i said, quincy is only 11 years old. he has a long life ahead of him. kennedy on the other hand is 15. so both pretty young horses who are still able to be trained. so, able to be ridden and worked with. >> and of course, he got the majesty of knowing what they've done and what they've already done for the country so you're going to have a special horse on your hands along with a great cause. thanks so much. >> that's right. >> thank you. where do we find out information

a fox news alert. a pentagon staff sergeant accused of killing a virginia police officer on her very first day is just minutes away from facing a judge. >> prosecutors say ronald hamilton could face the death penalty. kristin fisher is live in washington with more. hey, kristin. >> hey, good morning. this active duty army staff sergeant was assigned to the pentagon could now be facing the death penalty. ronald hamilton is charged with first degree murder of his wife. the officer was on her very first shift. she was sworn in on friday and even welcomed to the department in this post on twitter with a warning, be safe. but the very next day officer guindon and two other officers were responding to a call about a domestic disturbance when they approached the front door, the suspect opened fire.

>> does he have experience with that? >> i'm not sure. tuna has an expiration date. >> please don't give me a tune in fish sandwich. >> i promise. no food. that is the great neil cavuto who is never off the air. what's next, march is almost here according to reports which means it's time to look back at how the stocks fared in february. >> nicole petallides is live at the new york stock exchange to break it all down as we look in the rear view. >> that's right. good morning, steve, ainsley and brian. well right now we are looking at stocks slightly higher this morning. when that opening bell rings at 9:30 dow futures a higher open to the tune of about 20 points. going nowhere fast at the moment. for the month of february, how did we fare so far? the dow is up 1%. the s&p 500 up nearly a half of one percent though the nasdaq is to the down side. oil is down four months in a row. gold has been gaining. big picture what are the traders watching overall? well they are keeping a keen eye. they're certainly feeling a little cautious at this time.

we've had warren buffett come out. he seems a little more optimistic and says any of those presidential candidates who are putting down the economy, well that's not necessarily the case. and the debate has been bringing some noise to the market over all. take a look here at the next screen, as well. big picture, though. we've seen that materials, and financials here have been under some pressure, and this is now here's what we're looking at this week, as well. the jobs report on friday. we are looking for the jobs report, 193,000 jobs added. that will be more than 151,000 in january. and that unemployment rate to stay the same at 4.9%. under president obama, we've seen the unemployment rate drop but we've also seen americans dropping out and getting frustrated and no longer looking for work. i also wanted to welcome ainsley earhardt to the show! >> thank you nicole. love you guys. >> well deserved ainsley. i'm really excited going forward. >> me, too. >> this is really a great step. >> you've been a great friend every step of the way. thanks so much, nicole. >> go get 'em.
