if you live in a super tuesday state and he haven't voted, get there. thanks for being part of "the real story." i'm gretchen. across america super tuesday voting is underway. >> i hope and believe today is going to be a very, very good day. >> with hundreds of delegates at stake, it better be a good day for the people who want to be president. >> i am confident that if there is a large voter turnout today across this country, we are going to do well. >> as some battle expectations. >> super tuesday was never anything that we thought was going to be some great thing for us to discuss. >> candidates on both sides take aim at trump. >> it matters what you say when you run for president and it really matters if you are president. >> friends don't let friends vote for a con artist either. >> while the billionaire looks
12:01 pm
for a big boost. >> we're going to bring our country together, folks. we're going to bring it together. we have to bring it together. >> let's get to it. >> now shepard smith reporting live from the fox news desk. >> at last it's here, first from the fox news desk, it's super tuesday. what's going to be yet another first in presidential politics. the most powerful republican in all of washington going after his own party's front-runner even as the votesers head to the polls. the house speaker, paul ryan, weighing in on donald trump's one-time refusal on sunday to denounce the former c jeer ku kn member, david duke. >> if they want to be the nominee, they must reject any group or cause that is built on bigotry. this party does not prey on people's prejudices. >> but speaker ryan also says he does intend to support the republican nominee, whoever that might be, intend.
12:02 pm
moments ago the senate majority leader mitch mcconnell joined the mix referring to, quote, one of our presidential candidates and his seeming ambivalence to the ku klux klan. donald trump did denounce david duke's support last week just before claiming he didn't know who he was. trump said he couldn't hear because of a, quote, lousy, unquote, earpiece even though he clearly repeated duke's name more than once. last night trump's wife melania said her husband disavows any support from david duke. >> he's not racist. he's not anti-immigrant. he wants to keep america safe. he wants to have illegal immigrants taken care of that they will not be in the country, that they don't pay taxes, that they are criminals and so that they're not good for america. >> from cnn last night, trump's rifles keep piling on. marco rubio says the clan
12:03 pm
controversy disqualifies donald trump and the controversy. today rubio compared trump to another entertainer turned politician. >> if any state in the country has experience with electing someone who runs on the promise of being some great celebrity, tough-talking celebrity, well, how did that work out with jesse ventura? jesse ventura was an embarrassment. let me rephrase that, jesse ventura is an embarrassment. >> today ted cruz hit hard on trump over a so-called secret recording, one in which donald trump is said to back down on some of his tough stances. according to the website buzz feed donald trump made the comment to the editorial board of "the new york times" newspaper a couple of months ago. they were off the record so they will not release them. if they do not release them it is prove they have something to hide. >> "the new york times" is saying it will not release that
12:04 pm
tape without donald trump's permission. i have called upon donald trump release the tapes. if you were going to manhattan and telling "the new york times" you're lying to the voters. the voters have a right to know that and they have a right to know that before super tuesday. >> donald trump responded last night on "hannity." he called "the new york times" a failing newspaper and said that some of his immigration stances are, in fact, up for discussion. >> it is negotiable. things are negotiable. i'll be honest with you. i'll make the wall two feet shorter. >> building it? >> not know ghoshable. >> taking a look at what's at stake, there are 595 delegates up for grabs. the latest polls show donald trump leading in every state with one exception being texas which has the most delegates in the most recent polling tilting towards cruz. donald trump seems so sure he'll win and win big today that he's not even stumping in the super tuesday state. instead donald trump held a
12:05 pm
rally in ohio and previewed the next big fight. >> did you ever hear of a guy named kasich? we'll save that for after tonight, right? we'll be back. we'll be saving it for after tonight because i'll tell you what, we really want to win ohio. >> that's kasich's state. he miss pronounced it. it's john kasich on the ohio governor's home turf. that state's primary is in two wee weeks. it may not be make but it's keeping him alive. he says he will drop out if he doesn't win it. in a curious case of timing there is this. a new york appeals court today denied donald trump's request to throw out a fraud lawsuit against his controversial trump university which was not a university at all. the new york attorney general accuses trump of scamming thousands of victims nationwide. trump denies the claims and says the attorney general is out to
12:06 pm
get him. the republican race on super tuesday is fox top story. carl is our main man on politics live at dell ray beach. carl, after all of this discussion about race it looks like trump will win and win big tonight, right? >> reporter: that's what the republican party is prepared for, and in part the actions of paul ryan and mitch mcconnell today illustrate their concern that the trump brand, well it could trump the republican brand and do damage to it as well. that's the fear and that's why you see them sort of distancing themselves not just from the rhetoric but indirectly from donald trump himself. trump is winning in most of the state polls. the only state that there's any likelihood that he won't win is texas because he has to win. winning one's own home state is pretty necessary in politics. losing it could be crippling. trump has survived these types of criticisms about the racial issue. let's not forget that super tuesday was also nick named the
12:07 pm
s.e.c. for the ncaa athletic leagues. there's some acc in there. these are southern states and the issues of race always come up in presidential politics and they have here now. it may actually help trump get some of the vote out and certainly be used against him over time as a consequence of it. shep? >> carl cameron is working dell ray beach florida for us. a big state to come. marco rubio's home state and a lot of work yet to be done. joining us, david cantonese, jacqu jacquie kusinich and john busy, a familiar face at "the wall street journal" and friend of the program. david, where are we? >> well, we are looking at in about six, seven hours we'll
12:08 pm
have donald trump coming out with a big delegate lead. he is going to win eight, nine, maybe ten of the 11 states out there tonight. i think that's why you see these comments today by mcconnell, ryan trying to get out ahead of this repudiating him but not going as far to say they would never vote for him because they're sort of in a vice here. he looks like he is on a march to the nomination and he's got leadership. their hands are tied. >> is there a place for anyone else, anyone? >> that's the question, right? marco rubio really needs a win. he needs to be able to keep on making the case. >> like where? >> well, isn't that the question? i mean, he's been playing a lot in minnesota. he's in second place in georgia. if there's some kind of upset and he can beat trump in georgia, that would be huge. at some point he needs a win in order to keep up this narrative that he is the alternative and not ted cruz. ted cruz needs a big win in texas tonight. if for some reason trump is able
12:09 pm
to consume him in his home state, it's kind of over for ted cruz because where else is he going to win. >> even if you win in the state of texas, you don't get all of the delegates out of texas. >> that's right. trump is going to come out of this with a commanding lead and the polls seem to make that pretty clear. and, you know, something else that carl was pointing out about the distancing that you're seeing from mcconnell and ryan. look, the republican party needs to bring in black voters, needs to bring in latino voters. >> he's going to win both. donald trump has made it clear he'll win both of them. >> this mumbling about david duke is going work against him in that regard, but will ryan denouncing him, mcconnell denouncing him work for or against trump? remember, this is the establishment in washington and trump has galvanized the anti--establishment vibe in the country. unclear whether it will work for or against. >> if you look closely they didn't denounce him.
12:10 pm
they didn't say his name. they were very, very careful. >> i intend to vote for the nominee. >> exactly. >> but it was a criticism of the man who is front running for the republican nomination. >> from the establishment? >> no, not -- >> i looked, i can't find. >> the other problem they've got is they haven't chosen the alternative. you have krusz and rubio. the leadership of the senate, they don't like cruz as their option. >> don't really like? >> right. right. >> they loathe him. >> but he has a state he has won. if the polls are right, he has two states he's won whereas marco rubio could be shut out again. what's his rationale? his advisors are downplaying it. we want to take second place, rack up the delegates and have the showdown. cruz will be able to come out of tonight and say, hey, i've at least won two of these. get behind me. start to coalesce behind me because i'm the one that's proven i've beaten trump. >> what does this, whatever it
12:11 pm
is, establishment, i don't think there's any establishment left, how does it play along? in other words, does the rnc share data, share money, share ground operations with this donald trump? and if so, how do they do that? >> what is the other option at that point? >> i don't know. >> because the other option is i guess start another party and put them there. >> there is another option. one other option is, well, hope and pray if you're the establishment, i don't care, hope and pray if you're the establishment that donald trump doesn't get enough delegates to get the nomination and then you have this convention where it's decided in some other way. john, i don't really understand how if the people have given most of the delegates to donald trump that the kpaert do something else. >> i think that's right. i mean, the convention comes out with donald trump as its nominee. "the new york times" had a great piece on this over the weekend. the fracture within the republican party now over what to do. one of the expectations that the
12:12 pm
leadership is putting out there is a distancing from donald trump as theof the party to preserve those congressional seats that would otherwise be put at risk, allying thally ing themselves. >> that just seems like chaos. >> they told their own incumbents, if you want to campaign as i hate trump, go right ahead. it's fine for us as a republican party. of that i've never heard. >> that's an impossible task. how can you be running in a battleground state that's important. whoever is the nominee, donald trump has to campaign there. we know hillary clinton is going to be there. they have to disa voi. >> but i do think -- >> as impossible as it is, this is the discussion that's taking place in the republican leadership which shows how leaderless the republican party is. >> democrats under estimate him
12:13 pm
at their own peril. >> that's right. he's bringing in voters before. the turn toout models will be weird. even if the candidates are disa vowing him and they tend to be republicans, they could be voting -- >> they may want to get back on the bus. >> can you get back on the bus if i starts polling? if the numbers turn around in a general sort of election, if we're sitting in early oshlgt and it looks like donald trump's about to be the winner, how do you get back on the trump bandwagon? >> you flip and you flop like politicians do. >> that's what people are mad about. >> you take a stiff drink and get back on the bus if you're a republican. >> is that what they're mad about? >> they want to beat hillary clinton. >> that's true. >> there's some clouding of zwlaumt they want to beat hillary clinton so badly that they're siding with donald trump because they think they can. >> this is march 1st. there's a whole heck of a lot of
12:14 pm
time for fences to be mended. there's going to be a lot own the other side. going back into history, so much can change. remember how vicious the obama/hillary thing was and she ended up being his secretary of state. it's in all of these guys interests, including mcconnell, he wants to be senate majority leader, it's in all of their best interests. >> it's entirely conceivable that a piece of the sanders vote may a lie with trump. if they're angry on the right, they're angry on the left. those people who are on the left might say trump is my best shot at changing zblings john, jacquie, david all will be back. where do we need to go next? what is possible for an upset? texas is possible. it's possible we don't know all

texas senator ted cruz said just this afternoon that any candidate who cannot win his home state has real problems. he's right. so today we'll find out whether senator ted cruz has real problems because his home state of texas is the biggest prize on this super tuesday. 155 delegates in all. it is not winner take all unless the candidate grabs more than 50% of the vote and there's more to it than that so that's probably not going to happen. months ago political analysts said ted cruz had a shot at getting it all. now they're asking whether he can even win the state at all. the fox business network's co

connell mcshane. the redneck country club. >> reporter: that's right. good afternoon from the redneck country club. i'm told this is a fairly popular music venue in the houston area, but for tonight at least the redneck country club is ted cruz headquarters. headquarters of the cruz campaign. he's hoping to celebrate a victory, a sorrily needed one. we caught up with him earlier today while he himself was voting in the houston area. here's a little bit of what he said. >> for any candidate that wakes up tomorrow morning who has not won any states, for any candidate who wakes up and has a negligible number of delegates, it's time to start thinking about coming together and unifying and presenting a clear choice. >> all right. so that's it, a clear choice. unifying. well, ted cruz on the delegate map, we'll tell him that, has a tall order. he must win and win big if he

wants to set up a one-on-one match-up. it's the type of pressure and reality that senator marco rubio and john kasich won't face until the 15th of the month when florida and ohio will be voting. >> the delegate map is tricky. can you explain how that works, connell. >> i know you were talking about 155 delegates, you're right, shep. it is more complicated that that. if you get over 50%, there's 47 delegates. will's still 108 left. get over 50% of those, take all three, don't get 20, you don't get any. so the bottom line is when you work through all the malhotra, it's not only a victory that matters, it's the margin of victory that will count. >> connell mcshane, there's a director of gravy there? >> reporter: from what i understand i'll be putting your application in. >> i don't need to be the director, just the consumer. connell. we'll shift to the democrats.

vermont, bernie sanders home state. everywhere else they think they're in command. they think it's close in minnesota. that's why hillary clinton made a few stops there today. they think her juicing turnout may turn minnesota very tightly in her favor and could give her a very big night. here's clinton a little earlier talking about that. >> i was very disappointed that he did not disavow that. that is the kind of statement that should be repudiated upon hearing it. >> she's already you can see there training her fire on the republican front-runner donald trump and if she's looking past bernie sanders and getting ready to for a general election. >> does senator sanders have a strategy for staying alive? >> his senior advisers say that

once super tuesday is done there are only a couple of states left. that's the clinton strong hold so they think once this moves to the midwest and the west they'll do a lot better but the problem is the map. he is falling behind big time. if she has a big night tonight he was explaining a little earlier after he voted in vermont his way forward. watch. >> our hope is that we can win a number of states and in those states that we don't do well obviously we want a larger vote. the goal of today is to end up with as many delegates as we possibly can. >> so he's referring to what you mentioned, those proportional delegates. he can come in secretary almost everywhere tonight and walk away with delegates. the point is the math is going to get difficult for him real fast. hillary clinton coming here to miami where i am tonight, she's already looking ahead. two weeks from today when floridians vote, you have 250 delegates at stake. they's trying to show this is a

it's the super delegates. they can either like it or part of it. >> she's got the win in the bag. they have a strategy now. >> trump voters, you don't hear that much from sanders voters regarding clinton or do you? >> you do hear boos when bernie sanders mentions her name at rallies. >> we would never pivot to her. >> no, you don't hear that. there's a different scenario going on, the democratic primary than the republican dynamic. bernie sanders said today he's going all the way to the convention so that's sort of an emphatic statement for another guy who's only won one state. look, there's two sets of primaries tonight. there's the south where hillary will roll up double digits in states like alabama, georgia,
12:38 pm
texas. he has to win a massachusetts, minnesota, colorado, somewhere to claim the victories to have a reason to go on. >> but does he? in the month of february he raised $43 million. more than the next two or three combined. >> right. that's why he can keep going is because he's still raking in money, but, again, if he doesn't have the delegates to go forward, what happens? yeah, he'll get to the convention. he'll get a good speaking spot at hillary clinton's convention in philadelphia. >> if you had the money, why not spend it? >> maybe, or maybe not. maybe you consolidate and you accept fate at this point. look, the machinery is beginning to click into gear here. you have a democratic machine that's been really left intact. it hasn't fractured the way the republicans have. and you've got bill clinton ready to campaign for hillary. you have the sitting president of the united states ready to campaign for her. a democratic party that is
12:39 pm
unified. the republican party, meanwhile, that machinery is in attatters. this will be a race to watch in november. it seems to favor hillary at this point. >> i read in politico today unnamed insiders in the trump camp saying he will not self-fund in the general election, he will absolutely not and doesn't have the organization to compete. >> we're going to see because a lot of the same insiders that were cited in that publication in july said that he could never win a single vote in a primary or caucus. trump has proven a lot of us wrong, humbled a lot of us. i think tonight hillary is going to start looking forward. tonight in her speech she'll start looking towards trump. she wouldn't make a contrast with sanders. she's ready to make that contrast especially as she sees the in fighting. >> is there a big group of moderates say i don't want whoever the democrat is, let's go with trump. he seems right on point.
12:40 pm
>> moderates in the democratic party? i'm sure it's possible when you're talking about reagan democrats who don't like hillary clinton and may be skeptical of her on a lot of different levels. it's not possible in 2016. to add to what david was saying, when you talk to bernie sanders voters what they say right now, a lot of them, it's not that i hate hillary clinton, i just really like bernie sanders. yeah, i'll probably vote for her but now i want to vote with my heart even though i'm not voting with my head. they don't add that last part. >> you have to be careful what you wish for. >> jacquie's right. you would see a unifying democratic party. the sanders voters would be disappointed but they would unify generally around hillary. david's point is very much worth taking seriously. we have underestimated trump's capability. yes, he doesn't have the field organization, he doesn't have the national organization, doesn't apparently have the republican party. >> or the data behind him. >> but look where he is in the
12:41 pm
campaign. this is really an extraordinary event. it has a lot to do with u.s. demographics, about economics, about the last 10, 15, 20 years in the united states, of advantage and disadvantage for people, income inequality. all of those things are playing into this election. we can't under estimate this vibe, this site that is propelling him forward. in "the new york times" article i thought it was very interesting that the person sounding the alarm to take trump seriously was bill clinton. the campaign was sort of laughing at trump watching the debates. >> oh, no. >> bill chin top said, no, this guy is tapping into something. we better take him very seriously. >> the man of reason. >> it will look very different. >> she's finding herself.
12:42 pm
snus one tier. >> even though it's not hosted in any way, i didn't see it hurting either one of them very much personally. >> let's watch some of the demographics today. let's see how women vote. let's see how african-americans vote. let's see how latinos vote. that will determine a lot of the trend going into the national election. if you see a big turnout of african-americans and latinos, that would theoretically benefit hillary in a national election. whether they're voting for, you know, the democrats en masse now will be an indication of what might be to come. >> the republicans have been talking about a silent majority. what are they, angry, young white men. so as much as we talk about
12:43 pm
hispanics, african-american and women, trump is betting on a different demographic that you are going to boost white male turnout. you don't hear that talked about. that is the base of his coalition. that's the only way he wins. >> david, jacquie, john, thank you. this was fun. >> pleasure. >> enjoy your super tuesday. >> the head of the fbi and apple's top lawyer are both testifying on capitol hill this afternoon. something that will affect all of us, on whether the fesds should be able to force apple, a private company, to be able to force them to enter a locked iphone. in other words, saying you must do the following. next, the arguments from both sides. each has an argument. we'll hear from our senior poe legal analyst, james napolitano. his advice is, tell them to go straight to hell. you'll hear that from him coming up. thinking about joining her daughter's yoga class. she was thinking about her joints. but now that she's taking osteo bi-flex,

case. both apple and the fbi are making their cases before a panel in congress today over a court order that would force apple to hack into a san bernardino shooter's iphone. apple's top lawyer is expected to testify soon. he's argued that helping the fbi hack into the phone would leave hundreds of millions of apple owners of apple devices vulnerable to cyber criminals and other hackers. the director of the fbi, james comey, telling lawmakers he doesn't see it that way. >> i hear folks talk about keys and back doors. i actually don't see that this way. there are issues about back doors. this is about -- there's already a door on that iphone. essentially we're asking apple to take the vicious guard dog away, let us try to pick the lock. >> apple scored a major victory over the fbi in a separate but similar case. yesterday a federal judge in new york rejected a government's request in a drug case, one that would have forced apple to extract data from another locked iphone. fox news senior judicial analyst

judge andrew napolitano is here. congress is involved. >> congress has no right to ask them to justify its position in litigation in federal court. he should tell the congress to go to hell if that's what they're going to ask him to do. if they're interested in whether or not apple can help the fbi without violating privacy, that's one thing. if they're going to brow beat him into submission, they're not going to get to first base and they have no right to interfere. the case is before a federal court in that's a separate branch of government. congress does not have the right to interfere. yesterday a federal judge in brooklyn ruled against apple in a -- in favor of apple and against the fbi in a similar application. the two judges, brooklyn and los angeles, are the same rank and level so they are free to disregard each other so the ruling yesterday is not going to determine the outcome of the case in california. >> what do you make of the case itself?
12:49 pm
>> the fbi says these crepes had confederates. the confederates are probably out there. we don't know who they are. we need to know who they talked to on the phone, therefore, because they are dead, they have no privacy right. apple should help us get into the phone. that's the government's argument in a nutshell. apple's argument is you can't make us work for you. you can't make us create something that doesn't exist. you want us to destroy our own -- our own product. it will destroy the privacy of hundreds of millions of people, including you, because the fbi and the congress and the supreme court, most of them, use apple products. so a court will have to decide it. in my view the decision was appropriately decided yesterday. it can hire apple engineers away and the brightest minds but it can't make apple work for it. >> the government can figure out a way? >> yes. >> but it can't compel a company
12:50 pm
to do it? >> correct. there are surprising allies in this. general michael hayden who ran the cia and the nsa in the bush administration, former cia director james woolsey who ran the cia during a portion of the clinton administration. both have sided with apple in this saying if apple is forced to make the key, they're calling it a key, it's basically software that doesn't exist, once they use the key to get into a single phone, that key leaves a footprint. the chinese will hack into that foot print within about two minutes of apple or the fbi having used it and then all privacy is lost. >> that makes sense. thank you. >> you're welcome. there he is a storm brewing right now.
