the streets if he's denied the party's nomination at this summer's convention in cleveland. senior national correspondent john roberts has the story of the day after a super trump sunday. >> this has been very exciting, this whole process. >> reporter: the more donald trump begins to look like the nominee, the louder the drum beat grows from the republican establishment to stop him. today trump warned there could be serious consequences if the party tries to take the nomination away from him at the july convention. >> i think you would have riots. i think bad things would happen, i really do. i believe that. i wouldn't lead it but i think bad things would happen. >> reporter: trump had a huge night on super tuesday, winning three of the five states up for grabs out right and leading in missouri which has yet to be certified. his biggest win was in florida, a 19-point blowout that sent native son marco rubio packing. >> i want to congratulate donald trump on his victory, a big victory in flori florida.
1:27 am
guys, we live in a republic and our voters make these decisions and we respect that very much. >> reporter: it was a big win for ohio governor john kasich as well. after winning his home state he is vowing to stay in the race all the way to the convention. with no hope of collecting enough delegates to be the nominee outright, his only rout to victory is to deny both donald trump and ted cruz a majority of delegates. >> i don't think anybody is going to have enough delegates. i think cruz has to get like 70% of the remaining delegates and we're going into where my strength is. >> reporter: cruz who has called on kasich to drop outside says he's not against a contested convention, as long as it's not brokered by the party bosses. >> if donald trump and i both go into the convention just shy of 1237, then the delegates decide and that's actually democracy. >> reporter: there's a big difference between contested and brokered. contested, the delegates decide.
1:28 am
brokered, the party bosses decide. the republican debate is off. donald trump said he had a prior engagement. it's likely there probably will not be anymore republican debates. ted cruz's campaign has not yet made a decision whether it will ask for a recount in the razor thin race of the state of missouri. they can't file a request until after the results have been certified and, bret, that process will take about a month. >> john, thanks. hillary clinton may not have to feel the bern much longer. a big night for the democratic front-runner.

1:33 am
not only is hillary clinton not f he's feeling a lot less heat tonight as well. the democratic front-runner stormed through super tuesday and threw a big bucket of cold water on bernie sanders momentum. chief white house correspondent ed henry is covering the democrats tonight from miami. >> reporter: hillary clinton wrecked bernie sanders' midwest momentum. she's locked up 65% of the delegates and quickly tried to frame november around three big tests. >> first, can you make positive differences in people's lives. second, can you keep us safe. third, can you bring our country together again. >> reporter: clinton already taking aim at republican front-runner donald trump and trying to gently look past sanders who she very briefly kt congratulated for waging a spirited campaign while sanders tried to dust himself off by racing to the next big state, arizona, and spoke as if the
1:34 am
reality of the delegate math has not set in. >> if we stand together, there is nothing we cannot accomplish. >> reporter: while clinton aides say it's not their place to push sanders out of the race, liberal leaders seem to be sounding the alarm it's time to get onto the general election. the leaders of 20 top progressive groups posting an open letter that trump is a hate pedaling bigot who incites violence. >> our commander-in-chief has to be able to defend our country, not embarrass it. >> reporter: some established republicans seem to see a trump nomination as the beginning of the end. tony frat toe tweeting last night, quote, what essentially happened today is hillary clinton was elected president. we have 8 months of hyperventilating before it's official. although the architect of president obama's two victories
1:35 am
tweeted, the clinton campaign is going to have to raise their game. >> the democratic party should not be popping champagne. this could get very close at the end of the day. >> reporter: clinton has a bigger delegate leader over sanders than obama ever had over her in 2008. shiez not trying to push the senator out because she stayed in this race a long time in 2008. >> ed, thank you. the u.s. army's top general says his ground troops would be at high risk in a war with china, russia, iran, or north korea. general mark milley says years of combat in iraq and afghanistan, plus budget and personnel cuts, have had a cumulative effect on the service. please join me friday for the premiere of a new investigation into what many people believe is the decline of the american military under president obama. an hour special where, among others, we talk with three of president obama's four defense secretaries. here's a preview.
1:36 am
>> when it became apparent, mubarak had to go, the military urged caution. but the president pushed for his immediate removal. >> literally the entire national security team recommended unanimously handling mubarak differently than we did, and the president took the advice of three junior back benchers in terms of how to treat mubarak, one of them saying, mr. president, you got to be on the right side of history, and i would be sitting there at the table and say, yeah, if we could just figure that out, we would be a long way ahead. >> fox news reporting, rising threats, shrinking military debuts friday 10:00 p.m. eastern and reruns saturday at 5:00 and sunday at 9:00. the battle over the u.s. supreme court is on. the president nominates a successor to antonin scalia. the president says it's about a principle, not a person.
1:41 am
today i am nominating chief judge merrick brian garland to join the supreme court. >> this is precisely the time when we should play it straight and treat the process of appointing a supreme court justice with the seriousness and care it deserves. >> mr. president, it's a great privilege to be nominated by a fellow chicagoan. i am grateful beyond words for the honor you have bestowed upon me. >> thank you. >> the question is, will he have a hearing and will he be taken up by the judiciary committee. he will not be. people can choose to meet or not meet as they say fit, but this nominee is not going to be considered. >> president obama today nominating judge merrick garland. he is 63 years old, graduate of harvard. he clerkd for justice brennan. he's the chief judge of the u.s.
1:42 am
appeals court in district of columbia, and he was nominated by president clinton and confirmed back then 76 to 23 by the u.s. senate. as you heard, it doesn't look like the senate will get a chance to vote on him this time. let's bring in our panel. steve hayes, amy walter, and charles krauthammer. charles? >> mcconnell is exactly right. when you had josh ernest on, he did a yeoman job trying to pretend it's about principle. this has nothing to do at all about principle. as we know, when the shoe is on the other foot, the democrats refuse to confirm justices that were suggested by the g.o.p. ever since the supreme court became a super legislature with the abolition of the striking down of all the abortion laws until 40 years later striking down all the laws on gay marriage, it has been a political appointment. the idea that the president said today this isn't about ideology,
1:43 am
it's about competence, is nonsense. all that was destroyed with the bourque nomination, the most highly, competent, highly qualified nominee ever struck down entirely on ideology, and when obama was in the senate, he fill bibustered alito. >> i think this is going to be a harder argument for republicans up in 2016 to make than it is for mitch mcconnell. those republicans up in 2016 -- exactly. it's easy to see right now while it's still early and they still have to worry about their republican base and potential primaries but as we move into the fall, this is an issue that they're going to have to answer for and they better have a better answer than this isn't about the person, this is about the process and democrats would do the same thing. we're going into a year if we have trump at the top of the ticket where those candidates are already going to be under
1:44 am
incredible pressure and they're going to likely get pulled under by that nomination. they need some way to distinguish themselves. >> even if you turn the whole thing around, steve, and it's ruth bader ginsburg's seat open on the court and it's a republican president and you have a democratic congress, is anything different? >> no. it's exactly the same and both charles and amy are right in that respect. here's a better argument, this is basically reassertion of legislative power. that's what this is ultimately. i think charles is right on this raw political back and forth about this, but i do think there's some principle involved here. you saw the president of the united states exercise his power beyond, i think, his constitutional power on obamacare waivers, on delaying the obamacare mandate, on libya arguably, certainly on immigration. he himself said that he didn't have the power to do what he ultimately did. this is the legislature standing up and saying, look, this is our

1:49 am
i have to thank the people throughout the great state of ohio. i love you. >> to win the states that we won and to win by the margins and especially, look, this is my second home, florida. to win by that kind of a number. [ applause ] >> is incredible. >> today my campaign is suspended. >> no. >> the fact that i have even come this far is evidence of how special america is. >> to those who supported marco, who worked so hard, we welcome you with open arms. >> donald trump had a big night. he may even win missouri. we will find out probably in a couple weeks as those results are official. he is leading by a couple thousand votes at this point. and the delegates, as of now, this doesn't include the latest out of missouri. there you see it, 673, 111, 423. the magic number 1237. if he doesn't get there.
1:50 am
i should have said the democratic side. if trump doesn't get there here is what he said. >> i think we will win of the election. if we didn't, if we are 20 votes short or if we are 100 short, and we are at 1100 and somebody is at 500 or 400 because we're way ahead of everybody, i don't think you can say that we don't get it automatically. i think it would be -- i think you would have riots. i think you would have riots. i wouldn't lead it but i think bad things would happen. >> first of all, i assume he is speaking figuratively. if we go into a convention, whoever gets 1237 delegates becomes the nominee. it's plane and -- plain and simple. >> we're back with the panel. a.b., what about all of this. >> i don't know where to begin what is a riot versus a figurative riot. i do think we are at a place right now where donald trump is either the nominee or contested convention, period. we have been there for a little while. that became more clear last night. i think the question now is what on earth does a
1:51 am
contested convention look like? we have made all these assumptions and theories about how donald trump could be stopped before we get here. what does it look like at a convention? something that we have never seen before. now, the one thing that the quote, unquote, establishment or annual at this trump folks have is they pro better than the trump organization how to mobilize these delegates. but, at the same time, i don't know if that works. >> donald trump is not coming to the debate and there is no debate in salt lake city as of now. just to give you incapsule legs of this. donald trump said he was not going to come. then john kasich said if trump's not there, i'm not going. so then we had ted cruz. and we offered ted cruz a town hall. he said he is not going to take that so the debate went8úu away. that is the progression of how it unfailed itself this2( morning. i think it's unfortunate. it would have ban good debate it would have given each of the candidates more time to talk. i think that's donald trump didn't want to come.
1:52 am
i think you saw in the last debate with four people on the stage that he was trying to fill 1 minute 15 seconds. when you go beyond plusser and pollings and don't have policy to poll from that's why it gets hard. is he going to fix every problem with a good deal. >> he always says he wins these debates and points to the polls. >> the drudge poll and he says he wins. i guess he is the best judge of who is winning. look, they certainly haven't heard him. right? >> clear live winning in the vote. >> it certainly hasn't hurt him. i think what happened yesterday is we now have a clear, conservative alternative to donald trump. and it's ted cruz. there is no argument aboutid this anymore. if you want to stop donald trump, and you want to back a conservative, you are backing ted cruz. john kasich can stay in. he has no path to the nomination. ted cruz is the only candidate who could possibly beat donald trump just in terms of the number of delegates. not getting the 1237 but could enter the convention with more delegates. he has a tough -- that's a tough job for ted cruz
1:53 am
because the electoral terrain is not very troendly for him coming up. >> we talk about the contested convention and possibilities. the other side there is a possibility that this momentum just takes donald trump to 1237 and he easily gets whatever he needs. i think it's 63% of the remaining delegates in the winner-take-all states and others. >> right. i think that's quite possible. i think last night iaa referred toes it t. as a 3-foot putt. let's say he comes to within a hundred delegates. you reminded me a 3-foot putt at the could be difficult especially on the 18th hole. i would give it to him. that's what he is saying. the thing i don't understand here is kasich. in about 10 of the debates complains he is getting ignored not getting enough time. whining about it again and again. he and carson here is he being offered two hours without the interruptions of trump just him and cruz, he could present his case and he turns it down. i don't know what game he is playing. i think it might actually help to stop trump people that he stays in, because he
1:54 am
can take away some delegates in the northeast. but, nonetheless, i have to think in the back of his mind, even though he denied it, i think he has the idea of being number two in a trump ticket. and that may be what he wants. it would serve trump well. >> cruz is out there saying kasich is in the race and he is denying the consolidation behind cruz. but to charles point, in some of those northeastern states, he competes against trump better than cruz does. >> it keeps splitting those votes. i think that's very true. i could also see donald trump doing better in those northeastern states than a traditional, would. he is going to do well in new york. he is going to do well in delaware. is he going to do well in pennsylvania and connecticut. these are states that, yes, kasich can take some votes but some are winner-take-all, new jersey winner-take-all. >> down the row, third party does it develop in the republican party. >> no chance. >> i don't think so. >> i think it's possible. >> that is it for the panel. but stay tuned for your voice in our contender's app.
