when it is they are jacking up the prices of drugs that can save lives, what they're doing is risking destroying lives, that's not about money, that's all about being due miss to us bastards, isn't it? again, just my point of view on this subject. we'll see you tomorrow. hello, everyone. it's 5:00 in norkds and this right here is the five. the word of the day in gop politics is process. many voters are worried about the process of nominating their candidate. over the weekend, the colorado state gop convention took place and ted cruz scored a total victory, taking all 34 delegates, that without a single vote cast by a coloradan in the process, folks.
2:01 pm
anyway, colorado shrinks the lead, the front-runner has over ted cruz to less than 200 delegates, with a week and a day until the new york primary, trump holds a more than 30 point lead. yesterday, however, trump was pulling no punches on the process. >> the system is corrupt. and it's worse on the republican side. because i'm up millions of votes on cruz. millions. i don't mean like i'm up by two votes. i'm up millions and millions of votes. we've got a corrupt system, it's not right. we're supposed to be a democracy, we're supposed to be you vote, and the vote means something. >> cruz, of course firing back. >> donald has been yelling and scream i
2:02 pm
screaming, a lot of whining, i'm sure some cursing, and some late night fevered tweeting. all the characteristics i would note we would want in a commander in chief. >> this is also what trump is doing, pushing for that narrative. don't disenfranchise people, cast a vote, make it count. he's kind of setting the tone for what the argument might be, if he goes to a contested convention, we don't want to do politics like this, we want people's votes, rights, who they want to vote for, to be listened to and counted. colorado he was making it more along the lyin' ted naturalive, sneaky ted narrative, he stole the votes from colorado, what about the people in colorado. see if that sticks. >> you want to talk about the process? that is the process, they decided that way, the delegates
2:03 pm
are going to be deciding who they're going to vote for in the process. >> they cancelled the straw vote. they did it by congressional district. and then they had this weekend, the party, the colorado state republican party convention, and that's where you see that when you don't have the infrastructure, you don't have the players on the ground, you don't know the rules of the game, guess what, you lose. not only lose, completely lose, 34-0. so this is what paul maniford is -- who trump has brought on. forget about, you send in ballots with the wrong names on it, we didn't tell people, who were the trump delegates in colorado, he admitted the mistakes, give him a week or so, he's going to get this together. for right now, you have to say, those are the rules of the game and you lost.
2:04 pm
manifors says gestappo tactics. he comes to new york state a week from tuesday, and all of a sudden you get 52% of the vote, you have a chance at 95 delegates available. >> that's true, and that would be another 100 right there, but it really does stress that point to, i think, average people who haven't necessarily followed the process so closely, how sort of tied up and intricate and political it really is. i was just talking to somebody who was a delegate in colorado, she was saying for months, theres have been calls and meetings and this and that, and she's been approached by everyone. not a word from trump, he has no infrastructure, he's just kind of counting on that mega phone which works effectively in places like new york where he's well known and has this kind of a nominating process. in a place like colorado, it doesn't count at all, to americans in other states, i think it's shocking this is how it works. >> what we see, the process
2:05 pm
we're seeing, i frankly didn't realize it was this way, the votes, when people stand in line, and they vote for somebody, it's not even really a vote, it's kind of a recommendation. >> that's right. i suggest you do this, but there's no strings attached. it's corrupt, trump knew it was corrupt. this is what they do in the soviet union, they cancel votes, they have some guy in the background pick the nominee. especially in a year that's so consequential you said it, get your face in there. something to sweetin the deal or twist arms, he didn't do any of that. he knew the rules of the game. >> right, let's do this. john kasich has 143 delegates, fewer than marco rubio. he's won only will one state, his own. he's still pitching himself as the most electable candidate in the republican race. >> i'm the only one that beats
2:06 pm
hillary clinton in the fall. and there is great concern in the republican party is that we're not just talking about the presidential race that frankly if we gets blown out in the fall, which i think we would with cruz and trump, we could lose the united states senate, we would lose seats all the way from the state house to the courthouse. >> interesting concept now, what is he -- is kasich saying, by the way, that's why you have to hope trump doesn't get 1237 so he wins and, therefore, save the house and the senate? >> let's give kasich a little tip of the hat, he's running second in new york to trump, he's way ahead of cruz, who would have thought that, given the rhetoric we're hearing from cruz? >> yeah, well, whatever, kasich is in the new york race. let's be clear. he's 32 points behind donald trump, don't confuse it, he's ahead of ted cruz. he's trying to appeal to party unity, specifically in the argument he made in the latter half of his statement on the impact on senate races, house
2:07 pm
races he said down to the courthouse, many of the party elders are worried about the trump cruz effect on the ballot. that's his best argument, his hope as he said is, for an open convention. >> not because he -- he's been saying he's the only one who matches up nicely against hillary. >> that may be the case, i don't know if that's true. >> nationally, 63% think the candidate with the most delegates at the convention, not the majority, just the most delegates. they think that's the candidate that should be the nominee. >> go to wisconsin where trump lost soundly. he lost 56% of the wisconsin voters said the candidate with the most delegates should be the nominee. national review, who hates trump, they put up a poll that by the way, i went on and logged on to, 68% agree with that, so clearly the american public at least the gop side says if you have the majority, going -- if you have the plur ailty going into the convention, you should
2:08 pm
be the nonl knee. >> that sounds pretty fair, doesn't it? it sounds like republicans and voters are interested in fairness and votes being counted in a proper way. not stealing it in the middle of the night. as for john kasich, i was saying earlier, he's like the honey badger he doesn't care, he's going to stay in, he doesn't care if he gets stung 1,000 times by bees. anything can happen in politics, he's, as you said, in second place, every week something's different here, but let's see, i think in the end it's going to be a very tough argument to knock out somebody if they have the most delegates. >> will it? >> yeah, i think the rules are the rules. i mean, it's not the person who has the most delegates when you show up at the convention, if they don't get over the this remember hold. you can't change the rules because you don't like how it turned out. i know the majority of americans go that way. maybe americans can go in there
2:09 pm
and think about that, it's still, have you to play by the rules as they are. the honey badger thing makes me laugh. this is his latest plea, the april calendar plays in our favor. we're looking to finish strong and win some more delegates. not win the whole thing, because it's not possible, but we're going to win one or two more. >> war of attrition. >> but the rules aren't even made yet. they make the rules at the convention for that convention. >> yeah, i don't know, you have to stick with the rules that we have going in, but at the same time, who's to say you can't change them in four years. i don't trust guys in a smoke filled room to change the rules the right way. like you said, the public wants the plur ailty, go with the public, i don't think this party's ever he going with the public. you set up your game plan based on what the rules are, you go in to play football. you expect there's going to be four quarters. you're not going to expect, hey, let's cut this off at 3 because
2:10 pm
we didn't like -- you had momentum going-forward and we didn't want that team to win. >> trump and cruz want to use the rules against kasich, because the old rules say unless you've won eight states, you can't be the nominee. >> they want to throw that out? >> everybody -- that's why you have rules, because everybody wants to win all the time. you can't rewrite them, you have to set the rules ahead of time. everybody in here, wants to be the nominee and the president. this is why people hate politics. you think you know what you're talking about, and then all of a sudden it's like, look here, oh, no, not you. >> there's 42 rules in the rnc. more than half of the rules, the ones that really count are deemed temporary. they'll figure out what the permanent rule is going to be a week before the convention. >> this sounds like a different cun, right? >> you put your vote in, it becomes a recommendation when it gets to the convention. someone who is not even running right now -- >> rubio could win this whole
2:11 pm
thing. >> or waters, how about waters. >> think about this for one second. if rubio is doing what john kasich is doing. you got to think that's the play that the gop is going to go for. >> i beat hillary head to head, bigger than i beat -- bigger than kasich beats hillary head to head. >> he should have stuck in, he could have played king maker. >> he still has more delegates than kasich. and more status. >> he got -- >> let's give everybody a realistic update on this. >> okay. >> right now, donald trump, even with the lead he has, would have to win more than 60% of -- >> 60. some people have it higher, 60% or so of the remaining delegates from now on, in order to get to 1237, paul maniford said -- >> what does cruz need? >> 80 something. kasich needs 120. how is that possible? paul maniford said he expects this will go to california, that
2:12 pm
means june, no candidate, nobody will get to anything, even in the front-runner's top delegate counter's estimate by the california primary. >> hang on to this. what would the media do if any other candidate had this happen to them? check out this cover of the boston globe from yesterday. the paper created a fake front page, imagining what a trump presidency might look like, and other media outlets covered the story as if it were real news. >> how about that stupid boston globe, it's worthless, sold for $1. did you see that story, the whole front page, they made up a story that frump is the president, and they made up the whole front page is a make believe story, which is really no different from the whole paper for the whole ing. i mean, the whole thing is made up. >> new york times bought the globe in '93 for $1.1 billion. and sold it in 2013 for 70 -- they lost 94% of the value of that company. >> it was bought eventually for
2:13 pm
$50 million. you can't even get an apartment in new york for $50 million. this is a classic hail mary from a failing newspaper. that said, it is opinion, it is satire in the tradition of this country. i can respect a stab at humor, and -- i can't imagine them doing it to bernie sanders, though. they could have followed that logical conclusion, had people in bread riots. >> imagine they did it to hillary clinton? >> what's the -- i get, you want to have some fun. are they that desperate for an eyeball? >> we're all talking about it? >> you know, here in new york, the new york daily news is on their own agenda going -- the tirade against trump. you see this in newspapers. the philadelphia papers have done it to some extent too. they think that trump is running a campaign unlike any other, and they're willing to do things unlike -- >> no, no, this guy is a potential democrat. >> this is the whole front page.
2:14 pm
they didn't just do a fake -- >> it's not in the cartoon. >> this is the whole front page, where they -- >> i know. >> deportations to begin, i think a lot of people in america would like that. >> we're starting with you, juan. >> it's like the new york times do it, when you talk about the post and the daily news, like they have this back and forth, left and right, you see them doing things on the front cover, where they're being cheeky and sarcastic, it's not normal for the globe. it would be like doing -- the new york times doing something. >> you know what it reminds me? people are on their deathbed, instead of flowers, vote against barack obama. this is what the globe is, they're dying, this is their last wish. >> i'm going to leave right there. hillary clinton lost for the seventh straight time to bernie sanders this weekend. why is she putting out new attack ads. that including snl's amazing take on hillary subway gaffe coming up.

cab is the best way to get around. >> oh, my god, i love it. i hear ya. that happened to me. snl had some fun with hillary clinton's subway ride. last week the democratic front-runner lost to bernie sanders in wyoming, and he's fighting hard to catch up with her in new york city. bernie's been working to narrow it by questioning her qualifications and now her judgment as well. >> a candidate who receives a large amount of money from special interests. a candidate who voted for every disastrous trades policy, which does millions of jobs, you know what? maybe her judgment is not quite as high as it should be. i want to get away from this stuff. i respect hillary clinton, i've known her for 25 years. what i want is a debate on the real issues, impacting the
2:20 pm
middle class of this country. >> bernie, why did you pull it back in. why did bernie throttle back. yes, bad judgment, lying, et cetera, et cetera. don't vote. >> i don't think this is about bernie. i think he realizes he can't beat clinton on delegates. she has 98% of the super delegates, those are local party leaders, they're entrenched in their support for hillary clinton. she's going to get the nomination on delegates. he's hanging around in the event the catastrophic happens. she's becoming indicted somehow. it's becoming less and less likely. i think that's his game, i don't think he's going negative on her, i think that game -- that ship has sailed now he's going to be the likeable bernie sanders that has a future in the democratic party going-forward. >> i love the way the democrats do it, he's jt sort of like, she's trash, she's a liar, i don't want to go there, i don't
2:21 pm
want to say it about the candidate. i can't believe that the sanders folks aren't more hysterical. all these young peoples go to rallies, he keeps winning but he can't possibly win. i can only think they're socialists, the people that are voting for sanders. they can't do math, they realize they don't have all these votes and they're not getting anywhere. it's amazing to me. >> he's been beating around the bush, he wants to call her a liar and someone you can't trust, but he won't say that. >> he's finally settled on bad judgment, i think that's going to stick, if you look at the three things he said, voted for the iraq war, wall street money. in a democratic primary, those will destroy a nominee. the thing is, he's been late to attacking her and going dirty, just as the republicans waited too long to go dirty after donald trump. now he's going dirty late and all that does is create chaos
2:22 pm
and deteriorate her standing as she goes into the convention. >> pretty good. >> beat that. >> you know what, i feel for bernie on this, i think it's not the case that he's won more primaries. he doesn't have more delegates, he has exceeded expectations, he's done tremendously well. and everybody, you know, from the newspapers to the party never knew that bernie sanders was going to raise this much money. he's raised more money than hillary clinton, it's been a phenomenal performance. she is winning. she has a lock on the delegates. it's possible that higher turnout. >> if you look at the raw delegate count. they're 200 apart, it's close. you add in the super delegates, and it's completely impossible. because those people are bought and paid for. that's where the outrage is, it's so close. >> please, please, please. >> she has all these super delegates lined up. >> republican indignation here? bought and paid for delegates? >> it's true. >> did i miss the first segment of the five today?
2:23 pm
>> where eric was complaining about -- >> let me finish my point. >> what about the new me? >> because i don't think if you're going to say they're bought and paid for, no. in fact -- >> they decided before the people in their state voted they were going to support hillary clinton. why do you do that? that's a backroom deal. it's not even against the rules. >> bernie's strategy is to those super delegates, if he can win new york and then he can gain some momentum through the acela corridor here in the east and flip over to california and win california, there will be so much pressure, trump like pressure at the republican convention, but in this case at the republican convention, that the super delegates would have to complaining. >> losing 7 in a row. or 7 of 9 and then -- >> these are smaller states. wisconsin is open independent. >> a lot of people -- >> here's the reality, though. >> if he can win in new york -- >> one at a time, guys. >> here's the reail sti, and correct me if i'm wrong.
2:24 pm
these delegates are never going to flip. >> the super delegates. >> yeah. >> no, they can flip. >> i know they can, but are they going to? >> it's like the -- i mean, just in recent history in '08 with obama and hillary clinton, they flip, they went to barack obama. >> to follow up on your train metaphor thing, bernie sanders and the acela and the quiet train. he's not making enough noise. >> you know what he said yesterday? i'd like to do as well as i can. what does that translate as? i don't expect to win new york. >> it's all about new york city next tuesday. coming up here, would the cia's director defy the next commander in chief if his agency was ordered to waterboard terror suspects. john brennan's answer and donald trump's response ahead. you loved brad. and then you totaled him. you two had been through everything together. two boyfriends, three jobs...

when president obama took office in 2009, he banned the use of enhanced interrogation techniques to get suspects to talk. they vowed they'd bring the program back. the cia's director said his agency would never implement it. >> absolutely i would not agree to have any cia officer conduct waterboarding again. >> they chop off heads and drown people in a cage with 50 people in a cage. drop them right into the water. we can't waterboard. we have a huge problem with isis which we can't beat. the reason we can't beat them, we won't use strong tactics, whether it's this or other things. >> i don't take a lot of what he says seriously. he's more of a political guy.
2:30 pm
he got his e-mail hacked, he was caught lying to congress. is he even going to be the next director of the cia. >> hbo has a thing called spy masters. it interviews every single one of the former cia directors. he lined up with president obama's idea on terror. it's not necessary to do that right now. aside from undermining the next president. why tell the bad guys what you're willing and not willing to do. you should step away from that, i do agree with you, whoever it is, most likely if it's a republican president, they'll be someone who lines up a lot more with the republican ideas of how they interrogate terrorists. >> getting stuff done, yeah. >> didn't they carve out an exception for the ticking timebomb scenario? even obama keeps that in his back pocket. >> it's more for the ex-gent

2:32 pm
>> the senate intelligence committee under democratic leadership hung these guys out to dry. obama was talking about prosecuting cia agents for saving lives. >> that's why you don't want to put cia agents in a position where we as americans have any divide about their tactics that we know we support. we need that agency, it should function, it should be effective. >> you're having this conversation on this level about what's happening at the government and what everyone really means. with the general public hears is, you have people who are doing these barbaric things, chopping people's heads off. and we're afraid of words and hurting their feelings with micro aggressions in response. and that's why you see people out there saying, you know, among trump supporters, they're willing to support anyone who's willing to do or say anything to get something done. they're sick of this semantics you're talking about. >> i don't think it's a semantic argument. most people know when it comes to torture, they're not --
2:33 pm
>> nobody's -- i mean, they do that in fraternity parties. >> i'm not saying waterboarding is not torture, i don't think we're having a conversation on waterboarding in particular. we're worried, we're concerned, we're afraid that no one's standing up -- >> we'll do predator drone strikes and blow people to pieces. that's fine. we're not going to splash some water on them, that would be weird. it's just better to kill them? >> under the definition of enhanced interrogation technique. we've decided that playing loud music and sleep deprivation was too harsh as well. making sure the terrorist stays awake for two or three days at a time, it's not right to do? >> and a caterpillar on the shoulder really bad. >> this is the same guy who's slicing children's heads off, killing nuns, burying people in

in a wide ranging exclusive interview this week, president obama was challenged on hillary clinton's e-mail investigation. and he's defending his former secretary of state. >> i continue to believe that she has not jeopardized america's national security. what i've also said and she's acknowledged, there's a carelessness in terms of managing e-mails that she has

stumbled over his explanation. i mean, that was kind of stagserring, when he's stammering. he said there's a certain carelessness in terms of managing her e-mails. it isn't about intent in this case. you don't need intent. carelessness right there is breaking of the law. and then he went on to say, there's classified and then there's classified no there isn't. >> you're either pregnant or you're not. she broke the law plain and simple. he was receiving for the prosecution there. >> there is classified. >> the problem is, there are 22 e-mails at the highest level of top secret. at least 22. 22 we know of. i agree with kimberly.

she doesn't think she committed a crime. how do you know if later in that same sound bite you say, i didn't talk to the a.g. he must be talking to someone to have that theory. he must be one of these two has to be alive. >> he would know if somebody -- he would be told by intelligence. if somebody had taken -- acted on that information. he knows that nobody apparently has done back. loretta lynch, the attorney general if you look at the theory of people saying, obama is sending signals, these folks, their compromise, their integrity is in question. >> i love how he says there's a strict line between myself and the dog.

kind of like the red line in syria. he never interferes in investigations, except when he said, there's not a smidgen of corruption in the irs or he said, trayvon could have been my son. how about the cambridge police acted stupidly. the guy interferes with investigations constantly. how do you know. he basically says she's innoc t innocent. he hasn't been briefed. you can't have it both ways. >> it's either political which he denied or he's been briefed which he denied. >> i don't think he's been briefed on the case. if that comes out, you have a whole new ball of wax. what happened at the masters yesterday. did you see jordan spieth let the championship slip away? they're calling it one of the shocking collapses in golf history. see what speath had to say about it right here.
