donald trump vowing victory despite the system he calls rigged. that's ahead of new york's primary. he leads the real clear politics poll by 30 points. it may be a significant victory for him. there may be one path to secure the nomination without a contested convention. here to break it down. we had to have you on, sean. first off. let's look at that path. let's begin in the northeast. >> you know, trump has had a bad month. he's only gotten a quarter of the delegates since this became a three-man race. thing will turn around for him in the next couple weeks. we expect him to sweep the delegates over the northeast. that puts him like about 1,000 delegates. 200 shortfall. >> you have pennsylvania, west virginia, rhode island and new york and connecticut all colored must-win states for donald trump

in red. let's move over to the midwest. you say this is the pathway for donald trump, and these are the must-win. indiana likely to win and it's a must-win, but he doesn't expect to do well in south dakota and nebraska. >> part of the problem is they are winner-take-all states. indiana is an interesting case because demographically it's not that great for him. the question mark, though, is if john kasich is still in the race. he's the governor -- popular governor of a neighboring state. could bleed votes away from ted cruz and allow trump to overperform there when he really needs to do. >> interesting too, sean. because if ted cruz starts coming in third in new york and indiana, people will say really, you expect that person to win the nomination when he can't place in second any longer. let's move out to the west where we look at a june contest.

we've got a fox news alert for you right now. commercial pilots have been warning about this, and it just happened. a drone crashed into a packed jet plane, raising serious safety concerns as it was landing. >> all right. it's the first incident of its kind ever reported. >> abby huntsman is live with the frightening details for us. good morning, abby. >> yeah, the new reality of

drones. the incident happened at london's heathrow airport as the pilot went for landing yesterday afternoon. take a look. this is a picture of the plane taken by a security camera just minutes before the apparent strike. well, the pilot quickly calling in the incident, saying he thought it was a drone. the plane was carrying 132 passengers and 5 crew members. luckily no one was hurt on the flight. the aircraft only suffering minor damage and was clear for the next flight just shortly after. well, the flight was arriving from geneva, switzerland. an investigation is under way into what happened to figure out if it was, in fact, a drone that hit the plane. british airways releasing a statement saying, quote, safety and security are always our first priority, and we will give the police every assistance with their investigation. while drones are banned within five miles of any u.s. airport, there have been plenty of close calls over the past year. the faa reports on average there are 25 incidents between planes and drones every month. the unmanned aircraft pose a huge risk as they can be sucked

the governor signing it into law yesterday. patients will be able to use cannabis oil, pills and ointment, but smoking marijuana is still illegal there. brian? all right, the numbers are shocking and they are skyrocketing. 125 americans die every day from drug overdoses. 78 of them from heroin and painkillers. now, one county coroner now labeling heroin deaths homicides to hold drug dealers accountable. will this work in the fight to get heroin off our streets? let's ask charles kiesling, a county coroner in pennsylvania. charles, how will this help? >> i'm not sure if it will help, but we have to do something, and we need drastic measures to try and combat the issues of heroin addiction. and we've been looking at the -- from the coroner's statute, the death of an individual at the hands of another is a homicide.

like cumming county, if someone dies of heroin toxicity, it might be a feeling that this is indeed a homicide and we're going to start rolling those deaths accordingly. >> so your hope would be that these drug dealers who already are breaking the law taking risks, to understand that they are really breaking the law, and they're going to go to jail maybe for 20, 25 years. >> you know, the coroner doesn't have control over -- that's up to law enforcement and the district attorney's office. we all work cooperatively, but i think with the coroner saying this is a homicide, that's the death of an individual at the hands of another, these -- the investigation is the same. we're going to continue to investigate these deaths. and if the district attorney and law enforcement can -- tailor to that death, then they would be accordingly prosecuted.

>> yeah. i know the audio's not great, but we understand what you're saying. i just want to show everybody some of the reasons why you're so alarmed and why you're recommending such extreme measures when it comes to drug dealers. look at what we're dealing with in terms of heroin abuse. in 2002, when you used to bring up heroin, you used to think something, eh, that's about the '60s. that's all done. that's passe, but it is skyrocketing here in 2013. and there's no community that's immune. unlike where you have different drugs in different communities in different areas, this seems to be nationwide. do you see it that way? >> absolutely. even -- i mean, williamsport like cumming county is a very -- you know, have seen drug issues over the years, but not to the magnitude and the number of deaths. last year we had 25 drug-related deaths. nine of those were heroin toxicity. so the numbers are increasing even in rural areas. it's across the country.

the heaviest rain. some areas reporting well over a foot of rain already across that region. so we do have a flash flood emergency ongoing and warnings are in effect out there. so a lot of caution to heed out there across southeastern texas and even extending in through parts farther north across eastern texas. again, the threat across texas today is really the flood threat. we could potentially see an additional six to eight inches of rain across some areas. we do have a number of watches in effect. the other concern is that later on today and also into tonight, we could be seeing severe weather. some of these storms across southern texas could bring some large hail, damaging winds and even isolated tornadoes. that's going to be very dangerous as well as we head into later on today. otherwise east of the storm system that continues to bring rain across the plains, we're looking at very warm temperatures. i mean, you could be at 79 degrees today in new york city. 82 in chicago. 80s widespread across parts of the southeastern u.s. but behind this system, a lot cooler out there. in denver, your forecast high only at 39 degrees. by the way, some of the colorado foothills picked up three to

round, usually if you choose your delegates, they're going to vote for you every time. >> the delegates are all bound on the first ballot, those who are bound, but there are still some unbound on the first ballot. but then the second ballot and thereafter, it's a real wild card. for example, what happened in georgia, donald trump won. those delegates are bound to vote for him in the first ballot. but at the district conventions on saturday, ted cruz walked away with most of the delegates who will vote for him if it goes to a second ballot. so trump either has to win 1237 before the convention to lock it up or win in the first ballot. >> it shows that. >> also this week the message was pretty clear. they're looking to win, the trump people, on the first ballot, that's it. a lot of these people are going to head to the hills after they're bound. but there are some must-have states for donald trump to get that first-ballot victory, right? >> there are, and a number of them are coming up inment next couple weeks. first, you've got new york, let's look at the map, with 95 delegates. the week after, you've got five contests, connecticut, maryland, rhode island, delaware,

pennsylvania, 172 delegates between all of those. trump will probably take those. indiana is coming up as well. it's a little bit of a toss-up. ted cruz is probably going to do well there. south dakota and montana, that's probably cruz territory. then when you head west, new mexico not a lot of accurate polling there. we don't know how it's going to go. california, a new cbs news poll has got trump up 18 in california. he's got to be happy about that. washington, there have been no reliable polls. oregon seems to be sort of trending toward trump. and washington state and oregon tend to kind of -- i don't want to say they move in lockstep, but they're very similar. >> if he does not win everything in red -- >> then he doesn't make it to 1237. so cruz is playing very hard in california because if he stop him there with 172 delegates, that's it for trump. >> but as you know, northern california is much different than central california. it's much different than southern california. and los angeles is very different from san diego. >> exactly. >> and orange county. so do you really need a strategy going forward? it's not just go there. >> and it's such a huge state as well.

and in the media buys there are smo expensive. he's not going to be playing much in new jersey. new jersey was already on the map. he's got christie there, he's way ahead in the polls and feels he doesn't need to pay a lot of attention to that. after new york, pennsylvania, connecticut and maryland, california will be the next big focus for the trump campaign. >> is there a suggestion that that map trump gets the big states, new york, new jersey, pennsylvania and california, is there a suggestion given historically they have voted democratic, they may go for the republican in the general? >> i think new jersey you could make that case. california, i don't think so. you know, california went for ronald reagan in '84, but i don't necessarily think that it's going to go for donald trump or ted cruz or john kasich. >> it could change the map a little. >> the trend which is a great name from real clear politics on earlier. he thinks that trump is going to get there. listen. >> trump's had a bad month. he's only got about a quarter of the delegates since this became a three-man race. but things are going to turn around for him in the next

couple weeks. we expect him to come pretty close to sweeping the delegates out of these northeastern states, places like new york, rhode island, connecticut. that puts him a little bit over 1,000 delegates. so about a 200-delegate shortfall. >> a couple things going in trump's favor real quick. this idea that people's votes are being taken away. it's getting a lot of traction. that's going to help him get people out to the polls and china is now saying trump's an irrational man. just making the case for trump. >> absolutely. >> john roberts in from the trail on the couch. >> good to be inside where it's not snowing. >> a couple more days in new york. we have results soon. meanwhile -- >> president obama heading to saudi arabia amid over that country's role in september 11th, 2001. what does hillary clinton have to say about that? >> i don't really know about that, george. i'll have to look into it. >> really? brett baier with reaction, top of the hour. next, how is steve's

their home. the couple lived near john and received death threats from an unknown neighbor earlier this year, and they were in the middle of a legal battle. they've not been seen in a week and are now feared dead. u.s. troops arriving in japan overnight with the help of rescue efforts after two earthquakes there killed at least 42 people and left 10 others missing. well, this is the death toll. and the 7.8 magnitude earthquake in ecuador now climbs to 272. it's being called the strongest quake in decades. crews searching for survivors there, but they're also struggling to reach the hardest-hit areas. there have been heavy rains and massive landslides there, as you can see. in the meanwhile, the west coast is now on a high alert as more earthquakes could possibly hit areas around the region that's known as the ring of fire. that's in the pacific. and johnny depp and his wife, amber heard, they they are very sorry about smuggling their two pooches into australia last year. listen to this apology.

system is rigged. is it working? >> it is working for him. and it is a very powerful message on the stump for him to deliver. his audience is very loyal to begin with. but when you start getting into the system is rigged, they say, yeah, you know, kick over the table in washington. start over again. so it's a powerful rhetorical argument. it's not the best argument overall because everybody knew for months and months and months what the system was going to be. the fact that we're focused in on these states where they have state conventions and pick delegates is just the fact that this race has gone on a lot farther than people thought it was going to before a nominee was going to be chosen. so everybody knew the rules, but still, this is a powerful argument on the stump for trump. >> i mean, if the rules don't change for donald trump to come out and say that he's not in favor of the whole process, a lot of americans are anti-establishment, so they're going to jump on board with this. we had eric trump on the curvy couch earlier.

this is what he said about the process. >> it is a corrupt system. he's 100% right. look at colorado. the people didn't even get to vote. that's not democracy. i mean, people in the united states, they vote. and here you have a little boys club and they decide who they want to be commander in chief. we live in america. people get to vote. and the fact that my father is millions and millions of votes ahead, yet delegates keep on getting stripped from him, it really is a broken system. >> so that's going to be their push. win on the first ballot. if it goes through another ballot, the system is broken because so far ted cruz has done a great job at accruing delegates. >> yeah, he's better organized. that's the bottom line. if trump gets over 50% which he's poised to do in new york and he starts compiling these states especially in the northeast, he could get to 1237. most analysts think he's going to come just shy. but clearly we'll have the most delegates going in, but it's possible that he gets the majority. >> sure. so there's another big story out there, bret, and it's about saudi arabia. and ironically, it's the

president, in terms of timing, is going to be visiting saudi arabia shortly. you've got a bipartisan group of senators led by senator cornyn and senator schumer that are pushing to get rid of the sovereignty rules that allow -- that prevent people from suing other nations. for example, the 9/11 families for suing saudi arabia, for playing a role they believe in the killing of 3,000 americans on 9/11, 2001. hillary clinton and bernie sanders weighed in. do you support the president who says i don't want to see this rule go forward, kill it in congress, or do you support the families and these two senators? listen. >> i don't really know about that, george. i'll have to look into it. i'm not able to take a position. >> it's been around for several years. >> well, i know -- i know there's been an issue about it for quite some time. >> how do you intend to vote as a senator? >> well i need more information before i can give you a decision.

you're asking me to give you a decision about a situation and a piece of legislation that i am not familiar with at this point. and i've got to have more information on that. so you've got to get some information before you can render, i think, a sensible decision. >> do you buy those answers, bret? >> well, listen. this has been around for a long time. >> yeah. >> the justice sponsors against terrorism act has a lot of support. it essentially would allow the 9/11 families to put saudi arabia on trial in a u.s. federal court because of what is believed to be some connection between financing the 9/11 hijack hijackers, you remember the "60 minutes" piece with the 28 pages. one hour after hillary clinton said that, her campaign came out and said, you know what? she does support the bill. and that was very strange. she made a point of saying i'm not going to jump to conclusions. >> yeah. >> and then one hour later came out with a statement.

fox 26 houston's sally mcdonald live on the ground with the latest. >> reporter: this is no joke out here this morning. we are in the middle of an historic flood event happening right now in houston, harris county. we've seen such a significant amount of rainfall overnight, and it continues to come down. close to 20 inches in some areas where i am near bush intercontinental airport. we've received upwards of 11 inches. i can tell you that bush airport has a complete ground stop right now. you'll want to twentiy definit with your flight carrier. right now we're along what's known as a service road here in houston. this is one of the main arteries into downtown. the main roads are moving fine, but you can see that this road is under water. lots of folks have been trying to come down here and make it through. but it's just not a good idea. emergency crews scrambling to put up barricades at places like this because so many people are driving into the high water and are completely caught off guard

this morning. we have more than 100 high-water rescues going on right now. hundreds if not thousands of homes have taken in water. and just about every school district in the greater houston area is closed today. this all happened, keep in mind, in the middle of the night. so a lot of people went to bed, they heard the rain. they heard the thunder and lightning. but if it's not your routine to continually check weather updates and turn on the news in the morning, a lot of folks were getting up 5:00 a.m. when it's still dark outside to head into work, and places that don't typically flood are flooded this morning. houston no stranger to major flood events, but this one is definitely going to be one for the record books. our photographer can turn around here and see all of the cars that are getting just about up to where we are. they see our camera. never a good idea when you see a camera, you know that it's probably not a good idea to drive down this road. so we're sort of acting as the roadblock this morning for a lot of folks because emergency crews are scrambling to get those roadblocks in place to save

engine or they could crash through the cockpit window. those people are all okay. huma abedin may have to spill what she knows about the private e-mail server. the state department now agreeing to let judicial watch question several government officials over whether or not sensitive information was mishandled through that e-mail server system. a judge still has to grant approval for the deposition, but fox news senior judicial analyst, judge andrew napolitano, says there is already a conspiracy afoot. listen. >> two judges have already found that there was a conspiracy in the office of the secretary of state, mrs. clinton, when she was the secretary of state to avoid and evade federal law. >> well, also on the list to be questioned, white house counsel sheryl mills, state department staffer patrick kennedy and the guy who set up the server, brian magazineliano. george clooney is backing hillary clinton for president, but is the reason behind his

in many cases. and if they do vote, their vote isn't really representative of what it should be. we have this delegate system which is a sham. >> there are a few states that pick delegates by convention. it's their choice how they allocate delegates. the candidates participate in the process. it's been going on for a month in each of these states that do a convention. but ultimately, about cleaning things up, it's up to the delegates. >> so will the rnc consider new rules to keep trump from the nomination? let's talk to former chief of staff to president george w. bush, karl rove, and democratic strategist joe trippi. they're sitting next to each other in our nation's capital. good morning to you guys. >> morning. >> morning. >> karl, let's start with you. there's stories out there that republican leaders are considering rewriting convention rules before the convention. i don't know if they've done those in the past years, but given the fact that donald trump has been so effective saying the system is rigged, all these party bosses are pulling the strings, this would be a terrible time to do that, wouldn't it?

>> well, yeah. in fact, recognize this. the republican national committee has a rules committee. it sets the rules for the meetings of the republican national committee, for the election of the national chairman and so forth. it does not make the rules for the convention. it can give advice. it can make recommendations. but the rules for the convention are set by a committee of 112 people, 2 from each state, territory, and commonwealth. who meet at the week before the convention and set the rules. most of those rules have been in place for most of 160 years. they're very rarely any significant change in the rules for the convention. and my suspicion is with all of this conversation, the chairman of the rnc rules committee says he wants to make some recommendations. the national committee man from oregon says we must throw out the precedent of using the house representatives rules. this is much to do about nothing because at the end of the day the rnc rules committee can make recommendations, but it's the

rn -- it's the republican national convention rules committee that actually does the work. >> you know, and joe, one of the things a lot of people are learning is that the primary system is so different in so many different states. some have a convention. some pick their delegates in different ways. some caucus. some just actually go out and vote. but what donald trump has been effective in a little while ago we were talking to bret baier, and he thought it was effective, is the same thing that bernie sanders has been talking about, how the system is rigged. and that does seem to resonate with people out there. >> well, it's certainly going to resonate with his supporters, and bernie with his, but the reality is, look, the rules in both parties can't stop someone who's getting 50% of the vote across all the states. somebody who's enrolling actually ends up with the nomination if they're consistently getting over 50 prepare the reason you're having all these questions and issues this time is because on the republican side, trump, yes,

he's winning and cruz has won some, but no one's dominating yet and winning over a majority of the delegates. if that starts happening now through the rest of the way, i doubt there's going to be much of a contested convention. if he can do that. if he were, none of these rules would matter at all. >> yeah. >> but he's not. and that's why, frankly, since 1976, there has not been a contested convention because at some point, a front-runner takes over, and the party starts rallying behind them. it started with 17 candidates this time. certainly not -- certainly trump's performed well, but he's got to pull -- start doing much better to actually take it to the convention without these rule as plying. >> let's imagine for just a moment, we're on the mclaughlin group, exit question, real short, joe trippi first up, does donald trump get 1237 at the first ballot? >> yeah, i think he will. >> karl? >> i think it's very much up in the air. because we're going to come down

donald trump still lashing out against the new york primary system ahead of tomorrow's vote. he says the delegate process is rigged, but is he right, and will this hurt his chances at a

convention in july? joining us right now, peter johnson jr. peter, is it rigged? >> regrettably, the system is rigged. let's look at new york state. delegate selection. 27 districts total. three delegates per district. more than 50% of district votes needed are in all three delegates. if you don't get more than 50%, the runner-up gets one. the other folks get two. let's look at the new york democratic primary in this state. delegate selection is actually chosen by the voters. you vote for a person who's pledged to a candidate. all pledged candidates selected proportionately, superdelegates already selected. critically let's look at what donald trump is talking about. the new york congressional districts with regard to the gop primary. 27 districts total. three delegates per district. more than 50% of the district votes needed to earn all three delegates. and chosen by the party leaders. based on the candidate's primary result. these leaders select -- select

the delegates not tomorrow in new york but in may. >> sure. >> so the state committee men, 300, decide who are the delegates going to be on the gop side at the convention in july. >> sure. ted cruz has been very effective at winning. >> he has. >> delegates at these conventions. but then donald trump has been very effective in saying hey, did you know that this state, this is how you did it? didn't you want to vote? >> unfortunately to a great extent, americans' vote do not matter in these primaries. they get one, maybe two if they're lucky votes at a convention. >> right. >> after that, the state party leaders the people who bring the delegates to the dance, will have those folks dance. they will decide in the end if it's on the second, third, fourth, fifth, sixth ballot. donald trump needs to win on the first ballot if he wants to win this race. and obviously he does. his chances diminish after the first ballot because of the way gop and dem party bosses run american primaries. they have continue
