very, very angry, man. >> caution, you are about to enter the no spin zone. the factor begins right now. ♪ note. hi, i'm bill o'reilly. thanks for watching us tonight. most americans don't like their presidential candidates. that is the subject of this evening's talking points memo. since 1984, there has never been more negativity about folks running for president than there is today. according to a new "the washington post"-abc news poll trump and hillary clinton unfavorable category. trump 55% unfavorable. hillary clinton 5%. "wall street journal," nbc poll 58% don't like trump. 54% don't like hillary. the question then becomes can these candidates overcome the negatives? talking points believes that many american voters will stay home this time around

even though the campaign will be very intense. right now donald trump has improved his polling because more than 80% of republicans, many of whom did not support him before, are now on board with mr. trump. that support driven in part by a loathing for hillary clinton. on the other side, the numbers also more than 80% of democrats supporting the secretary, that's fairly predictable. mrs. clinton, a liberal woman, who will carry on many of president obama's policies. independent will decide who becomes the next president. here, poet candidates may have a problem. in donald trump's case he would be wise to continue his self-described straight talk but shift the adjectives a little bit. his base is firm. trump supporters love him, no matter what he does. he doesn't need to be demeaning in his speech unless it's an egregious situation. mr. trump's verbal use of shock and awe will only help him further if voters believe the insults are in context. not designed simply to shock. also the more specific donald trump is on policy, the more votes he will get. in just a few moments, i will ask him very pointed questions about terrorism and the transgendered

situation. as for hillary clinton, talking points has said this before, she needs to stop her calculated posture. there is no reason mrs. clinton should not debate bernie sanders on the fox news channel. as we said last week although she has the nomination locked up, she will reach more independent voters in that debate and she will need them in the general election. mrs. clinton should answer questions from people like me not just sympathetic journalists. and that's the memo. now for the top story. interview with donald trump. candidate joins us now from his new york city headquarters. first of all, you still believe that egyptian airliner was blown out of the sky? there is a lot of different speculation now. >> i do. in a certain way. i mean, i don't know what they used but something bad happened and we'll see. i guess they will eventually find out but i certainly do. i know that plane very well. i know that type of aircraft. and you have thousands and thousands flying millions of miles and never been anything like it. so i do and i think most people do. >> okay.

now, would you support asking congress for a declaration of war? to fight terrorism and then under that declaration it would be the groups that would be -- that the united states would declare war on, isis, al qaeda, taliban. would you favor that because if your president, a declaration of war gives you more power to defeat these people. >> it wouldn't bother me at all doing that probably should have done that in the first place. look, we are at war with these people and they don't wear uniforms. it's not your traditional war where it's a war against germany, japan, or whoever. this is a war against people that are vicious, violent people, that we have no idea who they are, where they come from. we are allowing tens of thousands of them into our country now. so on top of wars on foreign land, wait until you see what happens in the future. it's probably not going to be pretty. i hope i'm wrong about that but it's probably not going to be pretty.

>> it's speculation. >> well, its did not speculation. we are allowing people into our country we don't know who they are. some of them happen to have cell phones with the isis flag on them. i think it's something that we have to be very tough and very vigilant and very smart or we will be in big trouble. >> national security pole. i want to get you "on the on the record. wow ask congress to pass a declaration of war if you are elected? >> i would have no problem with doing it, bill. >> that doesn't mean you would do it but i will take that. >> no. i will study the facts. i will study the facts. but i would have, i think right now i would have no problem with doing it because we are at war. >> by the way, the world is at war. >> more powerful in waging the fight. now, you and i have gone around and around on isis a bit. your theory is that you take their oil away, you strangle their ability to finance

themselves and that's one of the components. >> i have said that for a long time. >> i say if you do that it's going to be a blood bat. they are not going to do it easier. how about this doe clarg that anyone buying oil from isis is an enemy of the state? that means an enemy of the united states? that way anybody who buys it, we can drop a drone on. >> well, you know, it depends who it is and everything else. i'm not sure i want to go that far because you could have -- maybe they send two barrels to england. than they send two barrels to sweden. i don't know. >> you know not the secondary market. the first guys who buy it see, i would do that i would say enemies of the state you can buy from isis and i'm going to come get you. that would dry up the -- their oil. that would put them out of the oil business as they say

this texas. >> i can tell you right now we're not even hitting the people that are buying it on site the trucks. >>. no not at all. in fact hrkts had he sameh say don't hit them that we have transmissions in of the military saying don't hit them blow the hell out of them. >> in that case absolutely 100 percent. we north hittings them. in fact, we are saying get out of your trucks. the whole thing is so preposterous what we're doing. those people i would hit so hard so fast. >> let's turn to domestic issue getting people angry. right after you, we have a talk with kirsten powers about transgendered orders from the white house, which would basically put people who are transitioning from one sex to the another and haven't done it biologically yet in a locker room is so you would have little girl,

8 to 11 or 12 with a boy who wants to be a girl in the same shower conceivably. that could happen. and, an acharlotte observer editorialized what happened recently that's fine, we need to get over that afs little preturned by that editorial. what say you. >> it's not fine. i would generally speaking leaving leave it to the states to decide. you know, obama is getting into a very tricky territory. amazing thing is so many people are talking about this now and we have to protect everybody, even if it's one personal. but this is such a tiny part of our population. now, with that being said, protect everybody, but i would really leave it up to the states in this case. >> in your facilities, in your hotels, do you have separate facilities for transgendered? are you going to put those in? >> no, we don't. no, we don't have that. >> are you going to put them in? >> i hope not because, frankly it, would be

unbelievablely expensive knight. >> it's human rights recommendation hundreds of billions of dollars. >> it's human rights. >> i don't know about human rights. i can tell you unbelievably expensive thing to do. i think our country wants to be spending money in other things in terms of let's build more building and create more jobs or something. that would be unbelievably situation to do. unbelievably. and, frankly, the number of people woe are tog about is a small number. >> again, protect them but it's a very, very small number. >> i think it was today on the internet you put up some stuff about hillary clinton and bill clintons. kind of tawdry stuff. i'm not sure that this is a good thing to do that. >> are you talking about what i'm doing? i'm only responding to what they do. they have been -- she has been very nasty and i said i would like it to be on policy, bill. i would like it to be a

straight right down the middle and by the way the one thing you didn't mention about the polls, number one, i think i am popular with people. i really do. i think a lot of people that maybe say i'm not they are going to vote for me. i'm winning in most of the polls against hillary. >> we did that on thursday. we reported it first on thursday. >> maybe i didn't see that show. >> everybody watches every night. >> some people might not have saw it. >> they all saw it every human being on earth knows and saw that because it goes on the internet and you tweeted about it everybody reads your tweets. so that's been out. i understand what you are trying to do here is inhibit mrs. clinton from attacking you personally by saying if you play that game, then can i come back 10 times harder. i understand that. but it is -- you know that it makes the country look bad abroad and things like that. that's what worries me. i understand the clinton attack machine. i got it. and i think it has to be difficulty with somewhat.

but i think maybe caution. >> bill, i don't like doing that but i have no choice. had when she hits me on things i have no choice. you have to do it. it's unfair. you know they are dirt were place. they have been dirty players. historically. i have to fight back the way i have to fight back. >> all right. and voters will make up their mind. as i said, if it's in context everybody i think will understand it i hope you guys both just -- you are right, it should be issues, right? you and her, on the issues? >> i would rather have policy and issues. much rather have policy and issues. absolutely. >> and you come on this show and you come on other shows that are not as press tinge just as. this we understand why you come here. you are a stand up guy. she doesn't do that i think she should answer the same kind of questions you answer, you are know? >> well, she doesn't. and she goes on very few shows and i notice the other night she was on a show and they gave her setup questions and they negative g-8 their questions. i don't think you can ever say i negotiate my questions

are standing in line for three hours to get on line on an airplane. when is enough enough here. >> notwithstanding what you said i think he has trimmed his sails. i think his tone is calmer and demeanor more dignified and presidential if you will. i know he doesn't particularly like that term and i understand that. he is in a sweet spot where things are going poorly for his leading opponent and things going well for him. is he out from under the attack of come competitors who have dropped out of the race. he gets a lift in the polling because he is the nominee and everybody kind of acceptance that that is going to happen. and then mrs. clinton, she is having -- trying to stave off this whacko socialist old guy and she is having a hard time doing it and it doesn't look very good. she is declining, i think. >> causing her the much angst. >> you know, what normally happens in these presidential races when somebody gets out to a prohibited lead which is

really what happened with donald trump, for example, everybody else drops out. but the berne is under the impression now that is he not merely a presidential candidate, he is the leader of a movement. i have seen this sort of idea infect many political candidates who do better than expected and suddenly they think they are leading a movement and it's hard to get them to quit. they don't want to disappoint their supporters and betray the ideals of a movement. >> what else does he have to do? i understand that the sandinistas have made an offer to go down there and lead that movement. that's a little shaky down there. last word, brit? >> my last word? >> your last word. >> trump is in a good spot. she is in a tough spot she is declining in the polls. what remains to be seen is how long it will last and what happens when the democrats finally dispose of bernie sanders and turn their full fewer i can't understand fire on trump. >> more insanity as mentioned over transjeopardied issues. you'll not believe what the charlotte newspaper is

these places don't have shower stalls. it's just showers. and you say to a traditional parnghtd that's acceptable? >> well, what i would say is that, first of all, it's not a boy who wants to be a girl. it's a person who was born with male genitalia who experiences life as a woman or a female. >> be that as it may. >> well it, does make a difference, actually. >> it does make a difference in the locker room situation. >> let me finish what i'm saying. the point is, first of all, unless they are gay, they are probably attracted to people of the opposite sex, meaning in this case they would be attract to do boys. >> transgendered person. >> the point is, this person isn't attracted, most likely because they are gay. >> it doesn't matter who they are or what they are attracted to. >> you have to let me finish just one or two sentences so you can let me finish what i'm saying. would you say lesbians shouldn't be in a locker room with females? >> as long as they're biologically the same.

see, this is the big thing that you -- the big mistake. the transgendered person, very few of them, all right, and whatever their mention and emotional state is, i think, should be respected. i don't have any problem with that but where are the rights of the 90 plus percent kids from traditional homes, where are their rights? >> i don't like this idea of this traditional thing. i mean, i'm not a nontraditional person. the fact that you are open and welcoming to other people has nothing to do with traditional. >> open and welcoming so they can be in the same shower. >> here's the thing. first of all they are not in your shower. they are in another shower next to you. but the point is, if you want to have a separate area for them, in this sort of transitional period, i would understand that because it bothers some people. all i'm saying is i don't think it should bother you. i don't think this person is not preying on your daughter. the person is not a pervert.

bill, this case of the six officers edward nero's case was the weakest. second degree of assault. two counts of police misconducts and wreck lazarus enendangerment all resulting in the arrest of fred request gray. had nothing to do with him in the van. of all the officers, him and the other officer who made the arrest, officer officer miller, they have the weakest of all charges. >> what about the reaction in the community, everybody feared that there f. there were acquittals in the case. we have had one hung jury for the first officer, now officer nero is acquitted. any sign of any unrest in baltimore? >> not at all. that's the narrow thivener that's out there i want to challenge. i appreciate this. that somehow baltimore is out of control because of what's happened. yes, there were riots last year. so far in both trials there has not been anything relate to do violence. nothing associated with people getting out of control. the way the judge, judge barry williams who decided this case the bench trial not a jury trial was appropriate. judgment was ren diserred in this case. i don't want this national

narrative that baltimore is out of control and can't handle judgments in court. >> all right. no, listen, the proof will be what happens. now, we have five more trials, the trial that was in the hung jury. and in that case, in those cases, do you expect more intensity on the part of the public? >> i expect more, let's put it this way. more attention in those cases those are the more serious ones. officer goodson next case. he was the driver of the van. second degree doe prafd heart murder, manslaughter, more serious charges. what the other cases that involve the actual van part that resulted in freddie gray having an 80% severance of his spine, i expect more emotion or attention it though the cases. the bike officers that was officer nero and officer miller i don't expect the same type of attention. >> has the issue of mr. gray ever been raised in the

sense that he was a drug-involved person. the reports are he was a drug addict. and a street level dealer. and that his interactions with police escalated over the years because of his narcotics involved. has anybody ever spotlighted that? has that been a topic of discussion because, as we know, baltimore is a fairly serious drug problem. >> i have with the heroin capital of the world discovery channel and others for 40 years baltimore has had serious heroin problem. for over a decade, this city has experienced some really harsh policing under then mayor martin o'malley and governor o'malley and presidential candidate o'malley where 100 folks locked up in the city of 600,000, bill. each year. and 30,000 of those arrests thrown out lack of probable cause. relationship between the police and the community bubbled up with freddie. freddie gray is a bad example. long term problem associated with the police and

baltimore. >> is it drug-related because there are so many narcotics this the town and the police obviously have to deal with these people every day. >> yes. but they need to have probable cause to make an arrest. when you have 30,000 arrests out of 100,000 being thrown out for lack of a probable cause. that's a problem, bill, for any metropolitan area. >> it might be that the system is year whelmed which it sounds like it is in baltimore. >> it's a bad arrest. >> i think all americans, no matter when a citizen dies like freddie gray did, it's never the citizen's fault in the sense that freddie gray didn't get up in the morning and say i'm going to do something and i'm going to die. >> freddie gray's lifestyle for many years, led him to this terrible thing which is not only impacted him and his family but all the police officers and that lifestyle should be condemned. i mean, this narcotics trafficking is awful. it is devastating. >> it has been condemned. >> by good people like you. you know what we're dealing

thanks for staying with us, i'm bill o'reilly. campaign 2016 segment tonight, tonight at this point the real clear politics average in polling has a dead heat between donald trump and hillary clinton. amazing situation since just a few weeks ago mrs. clinton is far out in front. with us here in new york city carl rove. we interviewed trump earlier in the program. it doesn't seem like is he changing very much. he launched this pretty vicious attack on hillary clinton and bill clinton on the internet just today. surging in the polls without really much of a change in persona i would say there are two things happening to him. one is for whatever reason between march and may or april and may he is doing well among independents, 46-30 in the fox toll 42-37 nbc. tied in the cbs poll. every one of them a distinct improvement from where he was a month ago. if you want to win the
