that major foreign policy speech later this afternoon. we got a lot to talk about. jon: senior political correspondent mike emmanuelle live in modesto for us now. reporter: hi john, good morning. hillary clinton will portray a potential donald trump presidency as being dangerous and one that would weaken americans alliance . clinton scheduled to say that is not qualified to be commander-in-chief. >> it's important that we recognize what he has done because that's usually a pretty good indicator of what he will do and on issue after issue, we see someone who is unqualified and unfit to be president of the united states. reporter: bernie sanders continues to campaign aggressively every day up and down the golden state. sanders continues attracting large, vocal crowds, more than 9000 folds last night in davis california. sanders encouraging his party leadership to open up to all people including his supporters. a new poll suggests california is a dead heat , clinton 45 percent, sanders 43 percent within the poll's margin of error. clinton favored by older women and voters with sanders meeting with voters under 40 and independence. tenders says he is in it to win it. >> i read the newspapers, the new york times and other papers, they all say the campaign is over but then i suddenly saw hillary clinton racing to california , bill clinton racing to california . maybe they think this campaign is not quite over. reporter: sanders will do a news conference here on climate change later today, taking reporter questions and will rally his supporters who are lined up around the block hours ahead of his appearance . jon: mike emmanuelle, thank you. let's look now at some other new numbers in the race for the white house with a wall

street journalpoll showing a dead heat in california. hillary clinton leads bernie sanders just two percentage points, that is well within the margin of error . this comes as gop presumptive nominee donald trump says he wants to make a run for california in the general election. it hasn't gone republican in almost 30 years. that same wall street journal poll of california shows donald trump trailing either democrat by double digits right now. hillary clinton leads him 35 to 31 percent, bernie sanders up by even more, 62 percent. joining us all talk about this, larry sabado, director for the center of politics at the university of virginia. the man with the crystal ball is here. larry, can donald trump make it a race in california?he pledges in the general election he hopes to turn california into a red state. >> not unless it's a 50 state landslide, john, quite literally. california is one of the most democratic states, barack obama on it by 24 points in

2008. it was 10 points more democratic in the closer race of 2012 between obama and romney. this is perfectly okay to say . john mccain said it in 2008, in the spring of 2008 that he was going to compete in and win california but the goal is to take democrats eyes off the ball, the ball being the truly competitive swing states. i don't think it will work. i don't think they're going to do it. they're not going to spend a dime in california and let me add one other point, remember the electoral college. our system rewards the system that produces a california, that is let's say donald trump cuts the democratic margin from 24 points to 12 points. that's a tremendous accomplishment.

what is the reward under the electoral college system? zero. if you carry california by one vote you get all 55 electoral college votes. jon: i already hear donald trump calling that an unfair system. let's talk about the democratic race. the crystal ball says it is getting really tight there. >> yes, we have a model that doesn't depend on poles.we had a separate election model that uses other variables to determine the results and oddly, this is very rare, it shows clinton winning by two which is exactly what most of the recent polls show and of course, that means it's a very close race. we all remember michigan this year, remember when every poll showed clinton winning over bernie sanders by a mile and then sanders on michigan handily? i don't think you can trust poles all the time, you can't trust models all the time. all you can reasonably say is this really is a competitive race.jon: here's what's interesting. there were so many

predictions donald trump would have somuch difficulty uniting the republican party. that seems to be happening . it hasn't entirely gelled behind him but he's got a lot farther than many of the pundits might have suggested. in the crystal ball, you say there is mounting concern on the democratic side concerning democratic party circles that even after clinton clinches the nomination, most likely after the california and new jersey primaries june 7 she will have difficulty winning over sanders ace of young, liberal voters many of whom identify themselves in exit polls as independents and without the votes of the overwhelming majority of sanders supporters, clinton probably cannot win the general election . pretty astoundingly. >> it is astounding and look, all of us in the election field, we've got to find things wrong this year. we admitted one of them which was not projecting donald trump as the republican nominee. the other thingthat virtually everybody , at least everybody i know got wrong

was in saying that because republicans had 17 candidates, they would be the ones battling all the way until the last primary day, june 7 while the democrats with only five candidates and only two of them, clinton and sanders really persisting, surely they would resolve the contest well before june 7. exactly the opposite has happened. what if bernie sanders follows through on what he saying today john which is that he doesn't care what the results are on june 7, essentially. he's going to take the battle all the way to the convention, fight all the way through the convention, try to turn around the superdelegates, try to influence the platform and the vp choice. who's to say they will ever reunite fully in the way that clinton needs for the fall? jon: the tongue lashing he is getting from so many democratic party leaders might be falling on semi deaf ears because he's not really loyal to the democratic party right?

he is an independent senator after all. >> yes, but he became a democrat of convenience to run for the democratic nomination for president. let's just say his roots in the democratic party don't go very deep. it's shallow water there so yes, i don't think he particularly cares what the democratic leadership is saying, almost none of them have backed him anyway you want one more time, you say that if sanders young voters don't back hillary clinton she's going to have real trouble in the general election absolutely. if they don't reunite behind clinton, don't fall behind her and turn out to vote and young by the may for me is 18 to 35, john. i may include it up to 40. maybe 50. i think i feel better if it were 50 but it's really 18 to 35, that's her problem. she can't seem to win over that giant age group. jon: since i just turned 40 i'm excluded. thanks larry.

the entire city and they are putting up as the iraqis say fierce resistance despite heavy bombardment by us and coalition jets andiraqi artillery. this was expected to be a long drawn out fight . isis as i said is dug into fallujah but iraqi forces have surrounded almost the entire area around the city. they are pushing in. they control several smaller areas on the edges of the city but they are not in the downtown area and they are taking their time in large part because of the some 60,000 or so civilians that are there. there's a large concern for that population. about half of them are considered to be children as well so there's a real concern to take it slow but isis is being pounded by this us and coalition airstrike and there is every expectation that isis will be

driven from there but it will take a long time as we saw in other places like rahmani and secrets and other places where it didn't happen overnight, it happened over the course of several months but isis is on the defensive there and really are facing difficult numbers because of the well-equipped and well supported iraqi military the larger problem going forward , heather, is once the iraqis do take fallujah, what are the ethnic problems that led to isis's taking over there? do they pop up again? there's a large concern that the sunni split will emerge once again. heather: a lot of people worried about that prospect of the civil war. connor powell, thanks so much from jerusalem and we will talk with casey mcfarland in the next hour about that one. jon: new information about the chinese government andhow it may be ramping up spying efforts . a study obtained by fox news links the purchases of luxury us hotels to the chinese in what may be an effort to steal data from business executives and government officials. chief intelligence correspondent katherine

harris is live in washington with more on this. reporter: this new research first reviewed by fox news details a massive campaign by the chinese government or chinese control firms to buy up luxury hotel chains around the world. the reports researchers as the venues are now high risk for cyber espionage because of the chinese government's long-standing practice in its country of using hotels to steal intellectual property. >> the chinese are responsible for 95 percent of the economic espionage that we see in american firms. so rather than describe the hotel as certainly compromised, we are calling it a high security risk and any executive worth their salt would know they should steer clear of location that then bought by the chinese government. reporter: research group invent ip has done work on the past on business secrets and research findings to members of the administration's national security team area a don't offer definitive evidence that china is using these

open & secure. because no one knows & like at&t. jon: a quick look at crime stories we are following. a judge setting a january trial date for a woman accused of driving into a cloud at the oklahoma state homecoming parade. that october crash killed four people and left dozens more injured. prosecutors argue the woman plowed into the parade intentionally. her attorney maintains she is mentally ill. a judge ruling a former pro wrestler jimmy super fly snooker is incompetent to stand trial in the killing of his girlfriend. authorities charged him last year after reopening the case more than three decades later. newco's attorneys say he suffers from dementia.

at a new hampshire prep school now facing a lawsuit in a case that's all one of its graduates convicted of misdemeanor sexual assault. owen labrie was found to be of assaulting a female classmate as part of a sexual competition among upperclassmen. the victim parents now suing the school, saying it fostered a culture of misogyny and male privilege. heather: politics extreme weather alert now. the southern plains bracing for severe thunderstorms and prolonged heavy rain. torrential downpour threatening to cause even more flooding then texas has already seen as that state continues to struggle and recover from a month of record rainfall. unbelievable. our meteorologist maria molina is live in the weather center, she's been tracking it since the early morning hours.

we were talking earlier today. you say the worst is not over yet that's right heather. we've been picking up so much rainfall across this region. i want to show you some of the rainfall totals from this week. many areas picking up four or even six inches of rain and you factor in the fact that we are getting more rainfall and the ground is already saturated, that's going to bring additional issues. we have ongoing river flooding, roads that are flooded there and any more moisture could worsen the flood conditions out there and taking a look at the radar you see it'sstill busy across portions of central texas and eastern parts of that state and because of this one threat we have a number of watches in effect and those maroon ones, those are flash flood warnings . it's either where flash flooding is imminent or where it is currently occurring and we have had reports of some water rescue taking place across the state because of all this heavy rain and flash flooding that just continues and you can see this storm system thing across texas, spinning in that moisture, producing that heavy rain. through at least friday night. we are talking still another day or two to go here with heavy rainfall in the forecast.

their charter boat began to sink. officials say the vessel is something in the water off bloodwork island. the coast guard was alerted but another workboat in the area told everyone to safety. the captain of the charter boat airlifted to a hospital, to others treated for non-life-threatening injuries. everyone on board was wearing a life vest . heather: some of those children were just in elementary school, how terrifying. new details in that apparent murder suicide that took place at ucla last time this hour yesterday. professor william klug gunned down at an engineering building on campus. the gunman has been identified as mighty sarkar. he then killed himself. that shooting sparking a campuswide lockdown and troubling reports about security on the campus. joining us now on the phone, pat brosnan, a former nypd detective and consultant. i know you review the video and read reports about what took place there. we can learn from it, what worked well and what went wrong. >> good morning. yes, there's a couple of

things. number one, the difficulty with any situation whether it's ucla or whether it's a mole is that the police and municipalities despite how closely they work together showed yesterday that the communication has been seriously enhanced in recent years, there's no kind of flying blind in these initial minutes and in this case the initial 90 minutes where they had misinformation, they had factual inconsistencies. they had all manner of misrepresentations about, first they thought it was a male and female, they thought there was a rifle involved, they thought there was an active shooter at loose on the campus when in fact they both were dead. heather: is in that type of thing, misinformation to be expected in a break-in situation where police and students are just trying to gather information and figure out what's going on? >> we are getting better at it. but any active shooter

situation and the explosion, any major incident is shrouded in fog in the early minutes, sometimes the early hours until the facts become clear and the clouds separated by the investigation. police moved in because their primary goal is to protect and serve, minimize civilian casualties and all casualties so they had only one eye open and were able to develop the facts that you saw at 310 or 315 when the police chief announced the actual facts as it relates to the matter so that's the reality.any criminal event that unfolds. >> they're communicating better so there's a flipside. >> i wanted to ask about that communication because you saw so many different law enforcement agencies confer, basically all hands on deck, all of those turning out and a big problem here, as you would know, 9/11 was there was a communications problem. one entity couldn't necessarily communicate with

the other. how good a job were they doing in los angeles and are we doing nationwide in these major cities of communicating in an emergency situation likethat? >> excellent . and when you look at it against 9/11 when the towers went down we are light years away in terms of interagency communication between municipalities and the various federal state and local authorities, 100 percent. what that cloud can do is read off the same thing and that's critical. as it relates to developing active shooter scenarios, one agency may be plugged in from a student wide frequency and the other already may not. it's light-years ahead and all those agencies think together and they work very well let me ask you about locked doors. there were a lot of students and we saw these pictures all over social media of students time belts and things like that because the doors, at least some of them were able to be locked. there was a problem with that.

what advice to give people if they find themselves on campus if they find themselves in that situation to protect themselves? >> always just run and run as fast as you can. heather: exactly what the police told them not to do, they said stay where you are. >> i disagree . we perform active shooter scenarios regularly across the country. if there's an opportunity to flee the scene you should read absolutely run. not to put yourself in harm's way but if you think you cannot run because of the context of where you are hidden, for incidents you see the guy that's being described, lock yourself in. make yourself small. hide in the closet. all the things today which was very effective and the reality is this. get out of there and when you are done, it's much safer than if you remain there and if someone were to cause you. for me it's a rational,

heather: breaking new details now about the friend of the san bernardino terrorists. prosecutors say henrique marquez had ties to a group charged in 2012 with plumbing to travel from california to afghanistan in order to fight with al qaeda. mrs. marquez awaits trial on charges he provided the weapons that were used in the attacks that killed 14 people back in december. william luncheon s is life for us in los angeles with the latest. how do i know this and what are authorities saying? reporter: marquez as you mentioned was the friend of the former neighbor of the san bernardino shooter syed farook and his wife. he purchased the two guns used in the attack, two of them and the gunpowder in the pipe bombs that failed to detonate. he had also planned earlier attack that failed. here is what is stunning. the fbi claimed that marquez and farooq acted alone and were not part of the network. now however contradiction

from federal prosecutors who say marquez was tied to quote, a group of jihadists who had planned to fight with al qaeda in afghanistan. police arrested that group, for men in 2012 as they prepared to travel from la to the middle east. the jury convicted them of conspiring to support terrorists and murder us soldiers. they got 25 years in prison. the fbiis essentially the investigative arm of the us attorney's office, 99 percent of the time they are on the same page. yesterday however the fbi talk to its earlier conclusion , telling the "l.a. times" and i'm quoting, the fbi three thoroughly investigated the alleged connections between marquez and the four individuals arrested in the 2012 terror plot and concluded there were no direct ties to any of the four. you have us attorney saying one thing, the fbi saying another. how will this play out for marquez who has pled not guilty to aiding syed farook? one of those felons is going

tito jackson, radio talkshow host and a fox news contributor. thanks both of you for being here. angela, given what donald trump hassaid about in some cases mexican or hispanics , is this a lost cause for republicans? >> it's not a lost cause. the one gesture is not going to make a difference in the minor minority community and one issue, one person, we can't do that in the republican party. just by hiring a latino doesn't mean they will be able to get the boat. what do we have to do is going to these communities, grassroots advocacy, advocacy advocacy so i don't think it's a lost cause and the minority community is not monolithic so i don't believe all latinos just care about the immigration issue or the mexican state. jon: also true sent tito that a lot of hispanic voters are socially conservative. >> they are socially conservative but there is a broad perception among the hispanic community that to paraphrase kanye west, the

republicans and mister trump don't really care about us. that may or may not be fair. >> i said paraphrase. but you see him mister trump and the party that wants to build a wall to lock people out. not design a bridge to bring people into the american family and they see themselves being unfairly blamed for policies americans put in place. your member during hurricane katrina when our own department of labor relaxed worker protections laws that enabled american companies to bring in workers from mexico and even thailand. [overlapping conversation] >> we are not mixing them. this is a continuing. no we are not. this is on a continuum so what you have to do if you want to bring hispanics into the party, you need to show them that you care about them

, not just talk about them. >> you know what santino? we had shown them that we care about them. if you recall, george w. bush got 45 percent of the hispanic vote. you one more by getting 60 percent of the black vote in ohio, 11 percent nationally. it's not a lost cause. we just don't talk the talk, we do walk the walk. our policies and actually help communities, not hard then. it's been liberal policies that hurt our community. >> angela, stop that. it's not true. i tell you something, when you tell people what obamacare? that's not liberal? >> let me tell you, that's from the heritage foundation. [overlapping conversation] yes, john. we've got to give john some space. jon: we're getting a little ways away from our core topic which is can republicans open the tent and bring in more hispanic voters. you know, i'm sorry angela that donald trump said some things in his announcement speech about mexican rapists and so forth that did not endear him to the hispanic population. can he walk back some of those comments effectively enough to win hispanic voters? >> number one, he shouldn't walk them back in the country cannot afford another obama administration.

these policies that were put in place, they've actually harmed our country. having said that, donald trump has spoken back about women, there are so many things he said that are inappropriate but people believe john that he will create a more prosperous america so i think it comes out the things that you said. you will know them by their fruit and donald trump has created jobs. jon: santino, does the economy trump all? >> i'm going to tell you this. what mister trump ought to be able to do and i think he's big enough to do it is say i'm sorry when i've offended someone. start there because as a businessman he has said these trade policies have hurt american workers. i can hear that. but when you paint a community with a broad brush, you lose them. you miss your point. do i feel they are a lost cause? in 2016 yes but long term i hope not but youcannot offend a people . [shouting] right now, can you stand her? >> the school district has condemned the driver's actions. the bus company says she is no longer employed there as a bus driver. heather: authorities say a texas middle school teacher has turned herself in to face a felony charge of continual sexual abuse . of a 13-year-old student. one of her students. she, the teacher, eventually became pregnant with the 13-year-old boys child, this among allegations that the parents knew about the relationship and possibly even encouraged it. joining me now, addie williams and also mercedes along, criminal defense attorney and foss attorney legal analyst.

what kind of punishment should the future face? >> she's looking at a serious punishment. texas treat this seriously. it's a felony in the first degree, 25 years to life in prison. very high stakes . heather: mercedes, she argues that the parents knew about the relationship, they condoned it, they quote, expected it according to her lawyer but he spent the night at her house repeatedly and she would drop him off at home in the morning just in time to take the bus. how does that all factoring? >> what creek factor are we dealing with? that's in terms of mitigation and the parents will plead that this teacher if she does take a plea, if she does get convicted ultimately it will be the mitigation of the second but in terms of absolving her of any liability or criminal liability, it's unlikely. >> it's a statutory offense but it could lessen her penalties. >> absolutely that if they believe it because right now

we read the complaint and certainly that's what the teacher is alleging that she had parental consent but you would had opportunity to do that. they are going to look for independent corroborating facts to support that. were there any other eyewitness elements to this? were there the digital, text messages or something to support these allegations that the parents knew . jon: heather: and the defense says the teacher showed up at family partiesand family events so you could see witnesses. was she at this birthday party and that type of thing? >> that's what the defense is going to do, bring in as much testimony as they can . >> this apparently was a continued relationship that went on for some time, ebony. this is sexual abuse.some people may hear about this and say what a lucky kid. this kind of thing can destroy young people's lives and destroyed future relationships. >> absolutely and i think the people saying that are only looking at the gender. if this was a 30-year-old girl and twentysomething man's people would not be saying that.

when it's a female offender to a young boy people do take that road but it's horrible and the continuous element is very important. there's a 30 day requirement for that to be deemed continuous and in this case they're talking about 120 days plus. >> the individuals that are most abused in sex crimes and are the silent victims are the boys. the boys don't come out for that exact reason. people are like hey, you're a man. this is great. you are with a teacher. meanwhile, it breaks my heart that that teacher would violate a student in that way and change that boy's life forever. >> this relationship moving forward i can only imagine. heather: the parents face child endangerment? >> yes. that's a great point. if they do come forward with that evidence and the defense says they encouraged it, this is what happens , it's a misdemeanor up to a year. a mission will also count if they knew anything about it. heather: as the mom of three boys i think that's horrible. great to see you.
