orlando. the "on the record" team is staying to pound the pavement and investigate all angles of this horrific terror attack. tomorrow i will interview the man many call radical welcome to "red eye." i'm tom shillue. it has been 48 hours since the worst shooting in u.s. history. tonight we will discuss the threat of homegrown terrorists. the white house response, speeches from trump and clinton and guns. we have a distinguished panel of guests and dave smith. here they are. i am joined by julie rogsky, editor-in-chief matt welch, fox news national security analyst kt mcfarland and next to me, comedian dave smith. >> oops. >> let's begin. it is the worst terrorist attack on u.s. soil since 9/11. the questions begin

after orlando as they do after every act of domestic terrorism. what could have been done to prevent this? we were given the requisite if you see something, say something speech, but it seems that a lot of people were seeing things and saying things. the orlando killer's former co-worker said he is inhinged and filled with rage. other co-workers say he boasted having ties to al-qaeda and other groups which earned him a couple of interviews with the fbi. but the question is whether the fbi or agents could have done anything different comey said this. >> the honest answer is i don't think so. i don't see anything in reviewing our work our agent should have done differently. >> the problem city believe the fbi director is right. there is nothing that can be done legally to u.s.who plan toe of islam until they do it will will -- do it. that's why we should change what is allowed. if they have sympathy to

islamic terrorists whether they are u.s. citizens or not we should spy on them and tap their homes and if we find anything arrest them, deport them or hold them indefinitely without a trial. that is what you do when you are at war and your country is invaded. any objections? i don't think so. i want to get somebody who may be sympathetic with my argument. i think it is time for rules of war inside the boundaries of the country. what do you think some. >> the whole approach has been misguided from the beginning. political correctness has driven it. when we had a problem we said we want to treat everybody the same. we want to use the resources we have and we want to treat a grandmother on the way to orlando with the grandkids to -- who are going to disney world the same way we would a terrorist. we wanted never wanted to profile, but terrorists is certain behavior patterns. they act in certain ways. every time we had a terrorist attack, every time we do we go

afterwards and the neighbors say there was something a little odd or the family members said i went to saudi arabia a couple times. there were all of the warning signs and nobody paid attention to them. i think the better approach is to say 95% of the population will look at you once, but granny if you are on your way to disintoy world, have -- disney world, have a mice time. let's look at the people who have a similar behavior pattern to terrorists and then we should look closely. whether we do the things you are saying, i just think we should just look at them and follow them 24/7. we would have the resources to do that if we didn't have to worry about the 95%. >> i like freedom like you, but for me and not the bad guys. theoretically if we can separate the bad guys by spying on them, why not 1234 less freedom for them and more for me and you. >> you can conduct

investigations on people you suspect. that's not a hard dollar. the judge won't say i don't think you can follow this guy who we think is being sympathetic with islamic terrorist networks. you can get the warrant. that's not the problem president the problem is you are not going to deport american citizens. you can't deport american citizens. >> revoke their citizenship and then deport them. >> based on what? >> i know you can't do it now. change it all now. >> you can't charge someone with a pre-crime. he did not commit a crime in he committed a crime. >> i am glad you said that. >> for the lone wolf terrorist which he appears to be, he appeared to be the guy who was trying to impress his big brothers in isis. i like isis and i like hezbollah and al-qaeda. these groups are not the same. they don't like each other. he is trying to impress people

am angry about the intro still. so if someone goes to saudi arabia and they say something you don't like they lose their freedom? you want to make that an amendment to the constitution? >> you simplify it a little bit. >> you can always look back and say he did this thing and this thing. there are a lot of people who are suspicious and weird. the majority of them don't end up shooting a bunch of people. we can't problems -- prosecute future crimes. >> i want to make it a lot harder. why don't you start with my theory and go from there. can't we make it harder for people who hate this country to take action. otherwise they are sitting there. we can throw our hands up and say nothing can be done. i say we should do something. >> let's look at where this went wrong. there were warning signs. political correctness made some people decide not to report those things.

when those things were reported and those ab nor mall tees the suspicions, we put them in one box and say let's fix that. crazy guy. lots of evidence he was a kriezy guy. what was he doing with weapons like that? he was on a list. he was suspected it and they took him off the list. >> you think we should have background checks? >> we should definitely have them. >> thank you. >> here is where -- i would go to the nra, the most patriotic people in the country and say, guys, how do we make sure crazy people like this guy don't have access to these weapons. >> you know what the nra will tell you? we can't control crazy people. we don't know who is crazy and who is not crazy. >> this is not a small dismissive thing. >> i am not dismissing it. >> i am saying i don't like the nra and i will tell you what i will say is how do you determine crazy? >> it has to be al-qaeda and isis. i am saying that if the

biggest problem is islamic terrorism and i would deal only with that. if you have shown sympathy for islamic terrorism -- >> i don't want to keep looking at you. >> that's where we should invade their privacy. if you have shown sympathy for islamic terrorism, then i think your freedom of privacy is gone. >> it is for that person. why didn't they? >> good question. let's continue on this. >> the problem with all of that is to watch somebody 24/7 takes 30 to 40 employees, state, local, federal, nsa, to watch somebody. we have 2 had you people on that -- 200 people on that list to be watched all that time. europe is far larger. how will you deal with the man power issue of looking at the people? stop looking at the 95% who are on their way to disintoy world to have -- to disney world to have fun. >> i would go through the list. let's move on.

they pledged allegiance to isis, but according to president obama he was not directed by them. the president called omar mateen a homegrown terrorist who was inspired by hop grann tau -- propaganda on the internet jievment we see no clear evidence he was directed exter nationally. it does appear at the last minute he announced allegiance to eye sill. to isil. there is no evidence that he was directed by isil and there was no evidence he was part of a larger plot. >> this is semantics. dave smith, he was part of a larger plot. murder americans and he murdered the americans where he saw them. it seems like it is a larger plot. he has no connection and he is doing it in the name of isis. he says it on the 9-1-1 call. why even say that he is not really connected to isis when

he obviously is. >> no matter how many times obama says isil we are calling it -- >> what is it? >> it is a dis to israel. it is the islamic state of the levant. if you have the islamic state of iraq -- when obama does that it is a dis to israel saying you are really -- it is a lot more than just a rock in syria and it includes your jurisdiction. >> there are people in that part of the world that want to include israel. >> if there is a crazy person and an american citizen who decide to swear allegiance to isis, that's different than someone who got radicalized and is kcted to the -- connected to the network. there is a distinction. >> what is the distinction? why bother? maybe there is a distinction in a laboratory.

why is that the message? >> the laboratory called the english language. >> why is that his priority? >> let me answer your question. because he is the president of the united states and even if you don't like him and i don't like him he is trying to say to people that there is not a large plot that he was part of that you need to be scared of. there is something you can be more scared of which is these guys want this to happen and those people messed up in the head decided they want to make isis or isil happy by doing this. that's harder to come back. as he says as the commander-in-chief there is not an active plot will as far as we know. we do not have evidence right now. but that can change. >> to matt's point he pledged allegiance to isis and pledged allegiance to hamas and there is a distinction. hezbollah is a shiite

to battle stations and the president says immediately it is a gun control issue. let's not offend the muslims by calling them radical extremists. the conservatives , everybody rushes to that battle station and they say it is political correctness. it is so much bigger than you think it is. this is global jihad. this is war against western civilization. this is like the nazis in world war ii. this is like communists during the world war. we are not going to defeat this. we tried for 15 years and we have yet to come up with a strategy that works. we have made it so much worse. both presidents made it worse. >> that's a great point. kt who worked in the reagan administration and this guy who hangs out in the seediest libertarian bars.

mass shooting inside an orlando gay nightclub. [gunfire]. >> the shooting carried out by one single person killing 49 people and wounding 53 other. the white house and the fbi say the gunman, omar mateen appears to have been a homegrown extremist. >> there are strong indications of radicalization by this killer and a potential inspiration by a foreign terrorist organization. we are going through the killer's life, especially electronics to see if there was anyone else involved in directing him or assisting him. so far we see no indication that this was a plot directed from outside the united states and we see no indication that he was part of any kind of network. >> the orlando community is

coming together ho honor those killed in the shootings. tens of thousands of people also attended other vigils across the u.s. and overseas. no now he will pay his respects to the victim's families. the killing of a french police officer and his girlfriend on monday was an act of terror. that's according to a government spokesperson there. the suspect stabbed him outside his home before killing him inside. the 3-year-old son was found unharmed. bernie sanders is set to meet privately with the democratic nominee hillary clinton tomorrow. the meeting will take place in washington, d.c. which is holding the democratic primary the same day. i'm kelly wright. now back to "red eye." >> on monday the two presidential candidates gave speeches addressing their --

the orlando masacre. hillary clinton would make the fbi targeting of lone wolves a priority. she also took a shot at a certain someone. >> inprogram terry -- inflammatory anti-muslim rhetoric and threatening to ban the families and friends of muslim americans as well as muslim business people and tourists from entering our country hurts the vast majority of muslims who love freedom and hate terror. and it is also dangerous. it also plays right into the terrorist's hands. >> meanwhile, donald trump renewed his call for a man on muslim immigration to america. >> we cannot afford to talk around issues anymore we have to address them head on. i i called for a ban on san bernadino and was met with scorn and anger. many said i was right to do so. although the pause is temporary, we must find out

live from america's news headquarters, i'm kelly wright. good morning. here is a look at the news. president obama will travel to orlando on thursday to pay respects to the victims of sunday's nightclub masacre. mr. obama has called the shooting an act of terrorism and hate. around the nation the vigils are being held in honor of the 49 people killed in the attack and the survivors. at the same time we are learning more about the man behind the deadliest ms. shooting in u.s. history. the fbi says there is no evidence of a plot and the killer, omar mateen, expressed support for several radical groups. one witness reports he spotted mateen drinking at the gay

nightclub on several occasions before the masacre. he was killed in a gunbattle with police. and new information out of france this morning about yet another terrorist attack. this one involving a police commander who was stabbed to death yesterday outside his home in a suburb of paris. the victim's girlfriend was also killed as well. their accused killer has been identified as a 25-year-old man with a past conviction for recruiting terrorist fighters. earlier this morning france's president revealed that more than 100 people have been arrested so far this yary and his country has potential terrorism threats. nearly a thousand miles north of orlando, florida mourners gathered to pay tribute to another victim of gun violence. this was the scene last night in new jersey. the hometown of christina grimmie. hundreds took part in the candlelight vigil including her family, friends and fans
