smith. a tragic turn in the search for a toddler after officials say an al getter attacked the boy and dragged him into a lagoon at disneyworld. the orange county sheriff says there is no question the boy is dead. >> we want to continue to search until we find the body. hopefully that will be today, but if it has to extend beyond that, we will do that as well. >> officials say the attack happened last night near disney's grand floridian resort. they say people watched in horror as the father desperately tried to save the child, but he could not stop the gator from pulling his son into the water. search teams have been using boats, divers, sonar and helicopters to look for the child's body. wildlife officials say they have captured five gators and cut them open but found no signs the animals were involved in the attack. officials say the gator that took the boy could be up to seven feet long. the resort is just across the water if tfrom the magic congre

do kingdom. there are signs that say no swimming but no signs warning of alligators in the area. the 2-year-old had been playing at the edge of the lagoon in about a foot of water. britain's "daily mirror" newspaper reports back in april a gator from the same lagoon chased a couple and their two young kids. they all got away that time. the attack is just the latest tragedy to strike the orlando area in the past week. the city was already reeling from the deadliest mass shooting in modern u.s. history and the killing of a singer who appeared on the music competition show "the voice." >> my heart is just absolutely breaking. this past three, four days has been horrendous on our community and then to find that a family lost their 2-year-old to such a tragedy and mom and dad were there to witness this, i can't comprehend. >> peter doocy is live about a mile from the scene of the gator

attack. any response from disney? >> reporter: they did e-mail out a statement, so i will read you what the spokesman said. it says quote, everyone here at walt disney world resort is devastated by this tragic accident. our thoughts are with the family. we are helping the family and doing everything we can to assist local law enforcement. they have protectively closed now resort beaches and recreational marinas at disneyworld. the sheriff's office says they have cooperated with authorities. wildlife officials say the parks have a great system in place for finding and removing alligators on the property, a system that worked for 45 years until last night. since this morning we have been able to hear helicopters hovering over the seven seas lagoon, a man-made lake between some resorts and the magic kingdom. since it is not a natural body of water, searchers have faced some unexpected hurdles. >> it is somewhat of a

complicated operation that we have going because this is a man-made body of water. it is a sizeable body of water and it has certain systems built in the waterway. >> reporter: so far today, trappers have found and killed five alligators on the disneyworld property. they have looked inside the alligators. so far, no sign of the toddler. >> we know the father desperately tried to battle that gator. how long was he able to hang on to his son, do we know? >> reporter: not long. i spoke to the sheriff after his press conference this afternoon who said that just a few seconds lapsed from the time this all started when the gator came out of nowhere, very quickly grabbed the boy and wrestled him away from his dad, who tried to hold on as best he could before that gator swam away. the dad had some scratches on his hands from the fight but cannot find his son. the family has been with counselors. we hope to find out their name

this afternoon. >> horrifying. peter, thank you. let's bring in jeff colwin, wildlife biologist and host of "ocean mysteries" on abc, which is owned by disney. everybody is wondering how it could happen. >> it's incredibly tragic. it's really unthinkable that something like this could unfold at one of the places that's considered to be the safest place on the planet, walt disney world. it's an incredibly rare event. you have to keep in mind that hundreds of millions of people have visited disneyworld over 40 years, this has never happened before. alligator attacks are incredibly rare. while they are predators, they primarily prey upon animals that are aquatic just like they are. like turtles or fish or birds, small mammals like raccoons. this is an incredible tragedy. unfortunately these folks were in an area where this gator, unknown to other folks, was as well. this is how all of this

unfolded. >> i lived in south florida for about 15 years. i know that gators aren't like fish, for instance. a fish in a pond is going to stay there. gators move around. >> absolutely. they are incredibly mobile. people don't realize that even though we often witness al getteget alligators in the water, they can spend many weeks on the land, especially during the dry season. they can move many miles. while this place is micromanaged, it is disneyworld, it's surrounded by thousands of acres of wild habitat, swamps, estuaries, so it's very natural for these animals to sort of ebb and flow in and out from one habitat to the next. >> the gator was said to be four feet at a main minimum, maybe seven feet. maybe half of that would be tail. how strong could a gator like that be? >> this is different news. earlier it was reported this was a small animal, midsize, maybe

four or five feet. there's a huge threshold of strength difference between a medium size gator and seven foot gator. a seven foot alligator is incredibly strong and would be impossible to manage in its element, its aquatic world. i would find it very difficult without having the appropriate equipment and help to manage a gator that's seven feet in length. a smaller gator, that's different. of course, i'm talking about an expert. >> yeah. we saw the video just now of a couple gators lurking with just their eyes and tip of their nose out over the surface of the water. >> you know from living in florida, when you would see these animals in the wild, they are amazing as predators. 95% of their body is underwater and resembles the water. the only thing above are the eyes searching for prey. they also hunt at night so it's

very logical that they would see something close to the water's edge and pursue it as potential prey. the great tragedy is unlike an adult human being which would be a challenge, a child is much smaller. but i have no doubt in my heart that this family did absolutely nothing wrong and they fought as hard as they could to save their precious child. >> just a freak primal event in one of the most polished places on earth. it's just unbelievable. jeff, thanks. >> thanks, jon. a few miles away in orlando a gunman slaughtered 49 innocent people on sunday. now we are waiting to find out whether federal prosecutors will charge his wife. a federal law enforcement source tells fox news prosecutors have put together a grand jury to investigate noor salman. that source says they are looking to charge her with murder and attempted murder and failing to warn officials about her husband's plans. we have fox team coverage. phil keating is at the suspect's

home with more on the investigation of the wife. first, steve herrigan. we are hearing the gunman phoned a television station during his rampage? >> reporter: it's remarkable, the details we are hearing of what exactly went on during this three-hour rampage in which 49 people were killed. the gunman had time to make at least five phone calls during those killings. he made three calls to 911. in one of those he pledged allegiance to isis, he called an acquaintance to say good-bye and called cable station news 13 where he told a somewhat startled overnight producer i'm the shooter, it's me, i am the shooter. he did not go on air. he simply wanted to make sure the station knew about the shooting and was covering it. we have a man determined not only to kill as many people as possible, but also to get attention for it. >> there's also some new information i understand about the weapon the killer used?

such a callous comment from the father of the man who perpetrated this heinous act. phil keating live in fort pierce, florida, outside the gunman's home. the killer's wife, where is she now? do we know? >> reporter: that's the million dollar question here. she is absolutely not here at her apartment complex that she shared with the killer. too many cameras here. she's essentially in hiding. she was spotted briefly late last night, once again in the dark, once again in a car, her face covered from the cameras, then they sped away. the wife's name is noor salman. she remains in hiding at an undisclosed location. her father-in-law who you just heard from, the father of the mass murderer, keeping her location a secret, saying she is only no longer in the area. federal law enforcement sources tell fox news that prosecutors and investigators seek to charge or indict her for numerous felony crimes, including accessory to 49 counts of

murder, 53 counts of attempted murder, all for knowing about her husband's massacre plan but doing absolutely nothing to stop it. however, in the past hour, the u.s. attorney on this case will not say whether an arrest is imminent. >> i'm not going to speculate today as to any charges that may be brought or indeed, about whether any charges will be brought in this case. it is premature to do so. >> reporter: the 30-year-old noor salman was born in the palestinian territories. about ten years ago she emigrated to the east bay of san francisco with her family. she ended up meeting omar mateen online. three years ago, she married him and moved here to fort pierce. >> we are learning more about the killer's past as well. >> reporter: yeah. turns out that mateen appeared in a documentary about the bp oil spill shot in the year 2010 and he appears in a scene while

he was working security at a pensacola cleanup site. >> everybody just get out to get paid. they are hoping for more oil to come out and more people to complain so they'll have jobs. once people get laid off here, it kind of sucks for them. they want more disaster to happen. >> reporter: little taste of the cockiness of omar mateen on duty, speaking about people who make money off disasters. at the time, mateen was employed by g-4s secure solutions usa inc. that company, his former employer, releasing a couple points about their experience with mateen today, saying they had no record of any complaints about mateen's behavior. in 2007 he passed a fullback ground check, criminal history, employment, drug, medical. in 2013 he passed a second backgrou background check.

down the road as the indian river community college where just last year they booted him out of his application for trying to attend the police academy which reportedly he and his father then ambushed the administrator of admissions saying you wouldn't let him in because he was a muslim. >> phil keating, thanks. people who know the gunman's wife are giving us lots of information about her, including what she did before she settled down with a killer. that's next. and we are watching action on the floor of the u.s. senate where hours ago, democratic senator chris murphy launched a filibuster of sorts to force a vote on gun control. that's washington senator patti murray at the microphone right now. he's gotten some help, obviously, from fellow lawmakers. we also saw republican pat toomey of pennsylvania join in, saying it's time to get something done. we will keep an eye on this, let you know of any developments.

we are learning more about the orlando shooter's wife who could face charges including accessory to murder for her husband's crime. people who live near the couple say they find it hard to believe she had anything to do with the worst mass shooting in american history. one neighbor who lived across the street from her childhood home described her as very nice and beautiful, but quote, not the smartest. records show noor salman married the shooter several years ago after leaving her own arranged marriage. as we have reported, investigators say they believe she knew about the terror plot and even drove with her husband to buy some of his ammo. a law enforcement source told reuters that she could face criminal charges as early as today. joining us now, fox news legal

analyst mercedes colwin. we know a federal grand jury has been convened to hear charges in her case. what could she be looking at? >> certainly accessory. we are talking about 49 counts of murder and 53 counts of attempted murder which is tremendous. so there are lots of counts, a lot of information to go through. but the grand jury has to look at number one, what did she know. because it's so interesting to me that she's never said to these investigators i'm going to seek spousal privilege. anything my husband said to me is privileged, i don't need to discuss it and she can never be coerced to discuss it in a court of law. >> she has been helpful. >> she's been extraordinarily helpful. so what's -- certainly what may happen down the road is there will be some proffer with the federal prosecutors to say look, i will be very cooperative but i need a guarantee that you are not going to come after me. so i'm going to sign an agreement and i'm going to be very cooperative but don't prosecute me in the process, in

the mix. they are going to be very aggressive, as you can imagine. >> she's described as having been, if you might call it, an oppressed wife. her family says for instance, when her father was sick, that her husband wouldn't even allow her or didn't want to allow her to come visit him, that he was kind of keeping her under his thumb. is that a defense? >> that's a great point. she's certainly going to say at some point, if these charges do arise, she will say i was under tremendous duress but here's the catch here. you can't have this defense of duress in these catastrophic cases and these mass murders. there isn't case law that really supports that. she would have to show that at the moment the crime was taking place, she was literally threatened by her husband. if you don't cooperate, if you don't help me, if you don't go into that disco i will kill you or kill your entire family. that's the only conceivable way if it's going to apply at all, but we know that's not true. she already admitted that she

said he had left to allegedly go with friends. she wasn't with him at the night of the disco. there's no evidence to show she had that imminent threat of bodily harm or death for her to be cooperative with her husband. >> let's hope there aren't any other killers out there like this guy mateen. let's hope if there are, they have a conscience. would there be any kind of prohibitive effect, if they see that look, you know, this guy goes out on a rampage and his wife ends up doing 15, 20, 40 years in prison, would that have the kind of effect that the prosecutors might hope for? >> well, great point. certainly. that's one of the reasons why they are going to be so aggressive with this particular person because they are going to say we don't want copycats. >> we are not looking at one or two years. >> if she is an accessory we are talking decades. because we are talking so many counts, multiple counts will add up. decades. >> even if she tells them everything she knows, she's already taken a lie detector test, we understand. she's tried to be as cooperative

as possible. >> but the prosecutor can still say, unless there's some sort of agreement. we don't know if she has a lawyer or if there's an agreement with the prosecutor, we don't know what's taking place. all we know is she is being cooperative. frankly, if her story stays as it is, i thought my husband was going to do this, he told me he was going to be with friends, i didn't think he was going to do this, i tried to dissuade him, there's so much back and forth, at the end of the day when she goes to court and says i'm going to assert spousal privilege, they can't use that testimony. she won't be able to be forced to testify against herself and not going to be able to be forced to testify against her husband because of that privilege. none of that is taking place. it all depends on that agreement. >> if she says something, those 49 people could still be alive. >> exactly right. >> thank you, mercedes. the owner of the pulse nightclub says she plans to create a memorial to victims of the massacre. of course, right now, that club is still a crime scene and closed.

but a spokeswoman for the owner says the offers to help have been overwhelming and the plan is to rebuild the club as a place of safety for the lgbt community. terrorists could be headed to europe to try to launch attacks there. that is the word from a french security official who says investigators are looking out for small groups of extremists from syria. that official says belgium's intelligence service issued the warning. isis has threatened to hit the euro 2016 soccer tournament which began in france last week. the country has been under a state of emergency since isis gunmen and bombers killed 130 people in paris last november. back to our fox urgent now, senate democrats trying to force action on gun control. they are pushing for expanding background checks and making sure people on terror watch lists cannot buy guns. democratic senator chris murphy of connecticut vowed to speak as long as he can to try to force

congress to act. whether it's an actual filibuster is up for debate because a filibuster is designed to stop legislation, not force it to a vote. the republican majority leader mitch mcconnell says gop lawmakers are open to keeping people on terror watch lists from buying guns, but says legislation must include protections for people who could be listed by mistake. also today, donald trump says he will take up the issue with the national rifle association. he says they will discuss ways to block people on terror watch lists from getting guns. coming up, the nra responds.

the crash happened a few weeks ago in phoenix. he did survive. the couple had been arguing after the woman found out her boyfriend had hiv. in new mexico, a wildfire is growing and quickly moving towards people's homes. that's what the sheriff told a local tv station. it is happening outside albuquerque. officials say the fire's moving too fast to fight on the ground so they are using aircraft instead. and a rocket destroyed while trying to land in the atlantic ocean. here's a look from cape canaveral, florida. the rocket did successfully send two satellites into space but spacex's chief elon musk says it suffered a rapid unscheduled disassembly.

legislative session. we don't know if they discussed this at the time or if donald trump suddenly said this is on the floor of the house today, this is on the floor of the congress, we need to talk about this now. but i understand more meetings with the nra will be scheduled in the future. of course, the nra worried that people mistakenly end up on those lists and they should be able to have due process and be able to buy a weapon if it's found they are innocent. donald trump going after a number of familiar themes today, including again reiterating this idea that there needs to be a ban on immigration for countries that are hotbeds of terrorism. really kind of looking at president obama, what he said yesterday, and hillary clinton, in saying you do it your way, i want to do it my way. this is the way he would do it. listen. >> we have to stop on a temporary basis at least, but we have to stop people from pouring into our country. we have to stop it. until we find out what the hell is going on.

>> reporter: donald trump saying basically this is an issue that we have to address or we are going to see more of what happened in orlando, more of what happened in san bernardino. he says this is an issue that will quote, eat our country alive. >> perhaps not surprisingly, trump also took a swipe at secretary clinton. >> reporter: yeah. and in doing it really from the angle that he did this yesterday in greenboro, north carolina, the donations that have been coming into the clinton foundation, he says hillary clinton puts herself up there as a champion of the gay and lesbian, trans-gender society community, yet at the same time, her foundation is taking millions of dollars from countries which have very harsh penalties if you are gay or lesbian. here again is trump. >> if you look at what hillary clinton has done with women, number one, from certain countries, her foundation has taken millions, tens of millions of dollars from countries that

want to enslave women, want to enslave women. as for as the gay community, they kill gays. >> reporter: as you pointed out a short time ago, donald trump has got to do something about the high negative numbers. he's at 70% right now. close to 90% among hispanics. those are not numbers that will win you the white house. we will see where he goes from here. >> john roberts, thank you. bernie sanders may be getting ready to drop out of the race but it might not happen for weeks, according to politico which reports the vermont senator has not sent out a fund-raising e-mail in nearly a week. the website also points out last night was the first time sanders didn't hold a rally after a primary or caucus. hillary clinton won the final contest of the year, the washington, d.c. primary and met face-to-face with sanders behind closed doors. both campaigns put out statements talking about working

together to defeat donald trump. but only the clinton campaign mentioned unifying the democratic party. mike emanuel live in hampton, virginia, north of norfolk. mrs. clinton went after trump on national security today. >> reporter: that's right, hillary clinton went after donald trump saying after all the twitter rants and conspiracy theories, it's time for substance and how best to respond to attacks, clinton also made reference to a very specific threat. >> as president, i will make identifying and stopping lone wolves a top priority. we will assemble a team from across the government, private sector, our communities, to get on top of this challenge. i will make sure our law enforcement and intelligence professionals have all the resources they need. >> reporter: clinton also said there is a need to make sure that terrorists do not have access to weapons, specifically assault weapons. >> so do we know what sanders was hoping for during that meeting last night?

>> reporter: it sounds like pretty significant changes in policy and also democratic party process. the two candidates met face-to-face for nearly two hours in washington, d.c. last night. a clinton aide talked about unifying the party. a sanders spokesperson mentioned a variety of issues when the two democrats are seeking common ground. sanders also wants changes to how the party picks its nominee. >> we need major, major changes in the democratic party in converting it to a party of the people, welcoming working people, welcoming young people, and we need an electoral process which is worthy of the democrats. >> reporter: the primary season is now over after hillary clinton's win last night in washington, d.c. but clearly, bernie sanders wants to make his mark on the party and its process. >> thank you, mike. for the first time in nearly four years, more than half of american voters say they approve

strategy of beating up on the media and gaining favor with voters that way. >> but doesn't he need the media? doesn't he need to get his face out there and his ideas out there? >> well, that's what's interesting about donald trump. while it is typical for people to beat up on the media, what's atypical is how much donald trump has benefited from earned media or free media, that is news coverage of his events. what's just so interesting is to watch him at his rallies which are often carried live on cable television, and at that very rally, sort of decrying how dishonest reporters are who are giving him the publicity to begin with. it's a very interesting relationship. i expect it will only grow more contentious as the general election wears on here. >> most presidents and presidential candidates have not exactly enjoyed warm relations with the press, but he seems to take it to a whole new level, calling reporters disgusting,

dishonest human beings, for example. >> well, he certainly is using much more colorful language than we are used to but that's the case for almost every topic. it makes sense that it would be no different when talking about the media. and you know, ironically, that's what keeps him in the news cycle, using words like disgusting and you know, at one point he called reporters a real beauty, sort of disparaging remarks like that that are guaranteed to get him headlines. it really shows that he has a mastery of keeping himself in the news cycle like almost no one we have ever seen before. >> it also has the effect for his fans of inoculating him from future negative press coverage down the road. >> well, that's exactly right. when you think about the times that he's attacked the media, there's often been another major story of the day he's eager to see drop out of the headlines. take, for example, when he held

his press conference to talk about what he did with charity donations to different veterans committees. during that press conference he was highly defensive and turned in a very personal attack style way on the reporters covering the event. that in a way took away from the major story line of people asking questions about where that money went to with the veterans groups. >> do you see any indication that his hard line against reporters and the press, does it have any effect on the coverage that he's getting? >> it's hard to say. i don't think it does. take for example "the washington post." they have been quote unquote, banned from his rallies. well, reporters from "the washington post" are still going to the rallies, still doing the good work they always do by covering him. so as much as he wants to speak orters and attack people by name, even at his rallies and on social media, people still keep filing away coverage every single day. >> have you been banned yet? >> i have not. we have had a number of a.p.

reporters called out by him on twitter but we have not, to my knowledge, been banned at this point. >> all right. thank you, julie. smile. you are going to jail. a judge in ohio locked up several women without bond apparently because a couple of them cracked smiles in their mug shots. that's what a detective there tells a local news outlet. police say the women assaulted a mcdonald's employee because she was quote, working too slowly. the detective says the judge did not let the women post bond because he saw those big grins. meantime, in texas, a man is suing harris county in the houston area. christopher johnson says deputies assaulted him during his mug shot. here it is. johnson says they held his neck and choked him for about 30 seconds. the sheriff's department reports they often have to hold up the necks of uncooperative inmates. johnson said they also told him to stop smiling but he says he

definitely saved lives. trace gallagher live in the west coast news hub with that. the hero actually went after the shooter a couple times, right? >> reporter: he did. in fact, by the time jon meis entered the picture, three others had already been shot. his first impulse was to get the gun away. that's when he noticed the shooter struggling to reload and he hit him with the pepper spray. then meis actually grabs the gun and runs away, clearly trying to get the weapon as far from the suspect as possible. as the alleged gunman fumbles with a hunting knife, meis comes back, jumps on the suspect and holds him until help arrives. to this day it remains unclear if jon meis acted on instinct or had formal training. we do know the shooter had a lot more ammunition and meis is widely credited with saving lives. when police first interviewed the gunman in 2014, he admitted that he opened fire on what was meant to be a murder-suicide and told police quote, i had to give
