9:03 am
be eventually at war with us on our own soil because this is not a criminal act. we have to start separating this. this is an act of war. we are at war with an enemy who is infiltrating us and until we find that vigilance collectively and individually, we will miss all these times because no one individual can put it all together. >> what's interesting center, it's perhaps a more of a trend that authorities can look for now. he's kind of not really loan walls. now they have spouses. look at san bernardino. look at the lives they are investigating. >> go back to james comey's comments. we investigated this man multiple occasions and went on. there wasn't enough there so you look at what happened with these gun store owners and this particular one, otis gunn works who had to tell
9:04 am
him we don't carry body armor but then it was a red flag. this guy wanted to buy guns and body armor, they heard him carrying on a phone conversation, texting multiple times. the gun store saw enough red flags to use their own discretion not to sell them anything. okay?and which they have the right to do, they can do that at their discretion, turn away anybody. there were red flags all over the place. back to the fbi investigation and maybe i put this in julie's lap, why wasn't there enough there at that moment in time when we know about his activities, we know about his travels to saudi arabia. >> you raise an excellent question. i remember when james comey came out and said we couldn't have done anything better at the time and i thought that was a really premature statement to make ahead of the fbi because he didn't know. it was 24 hours after the attack. you don't know what they missed or didn't miss. more information is coming out about the wife. about his email exchanges. about the gun store you just about and the fact the fbi came out and said so prematurely that you know, we looked at there's not much more we could have done. i don't know if that's the case. it may turn out to be but i thought it was a premature statement for them to make and as you point out rightly, there were warning signs as well. there were pieces of evidence

that in retrospect, it's 20/20 but our retrospect could have been. >> i want to talk to you about the family and about what we knew about the dad wanted to run for president, all his soliloquies, just check out youtube. in favor of the town man, he was in the halls of our followed state department not long ago. this guy was out there, he was knownand he just said about the white , how how far can we go? should we be keeping an eye not just on the people get flag who been traveling but also the people around them? >> you also want to know how close were the father and son ? and you really want to know the footprint of the wife and we are not hearing as much about her today and that's disconcerting. what's she doing going and destroying hard drives? if she was my ammo, she would have been the perfect candidate to go by a high-powered rifle.
9:06 am
>> exactly. >> we talk about all the gun control and the need for gun control and i'm sorry, but elizabeth warren wouldn't know a trigger from the muzzle. she has no idea what she's talking about when she talked about rambo style shooting and assault weapons and these baby terms and we get so far off base and the more we talk about things like gun control, the less we talk about the real problem and one of my big problems is, maybe you are right. maybe the fbi is overtaxed. maybe our government can't keep us safe and maybe we have to be more vigilant and get rid of these gun free zones. >> if we are going to do that and we have to get rid of the safety zone for how we talk about each other to because it seems like if you see something say something you have to be careful abouti'm say it . >> we also, there are these zones where the fbi isn't going including any of the radical mosques or the networks funded by radicals where radicalism is created, radical islamic terrorism is created. we do a couple weeks before the attack there wasn't any

mom that went to the orlando mosque and preached killing homosexuals anywhere you can find them so there are radical ideologies weakening the minds of muslims who can get on the internet or in a mosque and we're not surveilling them the way that we should. it goes back to, the fbi, mediated all he could inside the confines of what they are being allowed to do and the reality is, they drop the criminal investigation because it was a criminal investigation but ideology doesn't end once you are done investigating. fbi had shown propensity for radicalization we better keep an eye on him because these guys go to ground. >> let's continue on this. the gun debate is intensifying across the country in the aftermath of the orlando terror attacks. donald trump says he's going to be meeting with the nra about not allowing people on the terrorist watchlist on the no-fly list to buy guns fellow republicans may be open to changing the nation's gun laws. the nra saying it supports delaying the sale of the gun to anyone on a terror watch list. the group in a statement also saying that has always been its position adding quote,
9:08 am
the nra believes that terrorists should not be allowed to purchase or possess firearms.. . at the same time, due process protection should be put in place that allows law-abiding americans who are wrongly put on a watchlist to be removed. meantime, senate democrats led by chris murphy of connecticut and a nearly 15 hour filibuster just passed this morning. after republican leaders reportedly agreed to allow votes on some proposed gun-controlmeasures. kennedy, i want to go to you first. because this meeting with the nra, donald trump. you think donald trump is looking at possibly changing gun laws in this country . >> i think it's actually frightening that you have the two presumptive nominees, one of whom is more than likely going to be president both say that they are for forms of gun control because when you talk about due process versus a constitutional
9:09 am
right, you get on a very simple slope. how do you get on these lists? how do you get off these lists? not everyone of the people in these lists is a terrorist. when you become a terrorist? there are so many discussion to be had but i think otis gun works, that gun store in florida absolutely did something right and that's when for the private sector because when they see something, it's not like they're handing out high-powered rifles in junior high schools. they saw something, someone was suspicious and they said something. >> and they did something. >> what happened at that point is the big question? why three weeks before the attack was not what fell through? we're not anywherenear talking gun-control. the store owner did what he was supposed to do. what failed to mark do we simply not have bodies to go out and follow up with these people ?>> let's get back to this meeting because donald trump is meeting with the nra. what do you expect to take place? i hope the nra reinforces what you said which is what
9:10 am
they been dedicated to for a long time. we got a second and then it was central to who we are as a people. due process is important but we are at work.a delay could be a sensible way to look at the burden of proof needs to be on the government as to why you are able to have your second amendment right as opposed to putting you on a list. >> arbitrarily. >> where does that end? i hope that, i don't think he should have treated that. why is from bringing the conversation to gun control we should keep it on isis. he's meeting with the nra , that's never a bad thing. >> but you were on the no-fly list, people on the no-fly list. they are the ones who should also be precluded from buying guns. how many people have erroneously been on a combat list, innocent americans and they don't even know theywant . >> first of all, this comes as a shock to you both on this issue in the sense that i think due process funds anything else and as we know, a lot of people have erroneously been put on this list. i'm not a huge fan of the second amendment but it is in
9:11 am
our constitution and as a result, you are absolutely right. so many needs to be put on that list and it is up to the government to tell us why there on that list because anyone of us could be put on that list and your denied your constitutional right but i am not a fan of having everybody have guns but nevertheless, the constitution trumps my personal opinion so i agree with you on that and i've never seen anybody on my side of the i'll be able to read that needle and explain to me also but you has the right suspended. >> secondly, there are sensible gun-control measures we can speak that don't infringe on our second amendment rights the same way that i can't walk into a movie theater and start yelling fire despite the fact that i have first amendment rights so the government prevent me from doing that so the problem for me is at which point when you say you have a right to bear arms, what is ours to you? if you take it to its logical conclusion, at which point do you stop and say listen, let's be rational and reasonable about this.

don't really get it. i don't know where is going but i can tell you this, reports about the nra, they don't know where he stands ongoing control. they don't know where he really stands. he tweeted again he wantsto have a second meeting so there are a lot of questions there. we have to wait and let the cake bake there but the bigger issue is that guns were bought legally in orlando . are they not bought legally in san bernardino? are we seeing this over and over again? right? the root problem all of all this have to do with the terrorists who want to kill us. i don't understand how having this conversation now outside the political opportunity that the left gets to take advantage of now. >> he'sbeen on a terror watch list and prevented from buying those guns, you believe you would have required those guns elsewhere . >> it would not have happened, in general it may not have, i don't know. in the same way that listen, consistently, consistently,
