caseous when writing to the factor. new word. thanks for watching us tonight. ms. megyn is next. please remember that the spin stops right here. we're definitely looking out for you. breaking tonight, the wife of the orlando terrorist is reportedly speaking out for the first time since saturday's attack. but instead of apologizing or blaming or husband, she's slamming the need ya for spreading what she calls lies. welcome to the kelly file. i'm megyn kelly. the huffington post published an article tonight, everything you're hearing about me is a lie. in it the author of the piece claims to have a source in direct contact with her, who is denying that she had anything to do with her husband's massacre this past weekend but also suggests that instead of

spreading lies about her, she thinks the need ya should be behaving more responsibly. the source lashing out saying quote, maybe folks should start focusing on the people who sold her husband the guns he used to slaughter dozens of innocent people. and it does not end there. trace gallagher live at the breaking news desk with the rest that's emerging from the wife. trace? >> the author of the article in the huffington post claims the wife is a victim of a smear campaign saying that the governor christie is spreading lies about her to point the fingers at the arab and muslim communities. going on to writing write that virtually everything we hear about her is untrue. all she wanted was a home, family and peace for. for the media to say these lie is not right. it's widely reported that she feared her husband was planning

an attack, pleaded are with him not to do anything violent but failed to warn the police. now the wife claims she didn't have any idea of an attack. and despite the fbi saying they had video of her shopping for ammunition with her husband, the wife denies it. as for reports that she drove her husband to the pulls nightclub on at least one occasion so he could quote scope it out, she says she never drove him to the club and doesn't like to drove at all. the author goes on saying he's not telling all he knows because it might make the killer's family's fren uncomfortable. and finally the friend who was with her says it is not an easy time for her and having a child ask a moth where is daddy can't be easy. and for the new york post to show her son's face is not right. there the no mention in the article of the 49 families f who children and loved ones are also

asking where they are. it should be noted the author of the huffington post article is critical of the u.s. air strikes on isis in iraq and syria. >> thank you. joining me now to react, "the new york times" best selling author of "because they hate." good to see you tonight. so here, if this author is right in this article where he claims he knows the source close to noor and he's ticked off at the media for reporting lies about her, you tell me, i think the general american sentiment is the only thing they want to hear from this lady two words, i'm sorry. >> that's exactly it. i am sorry for my actions for not coming forward. and all of the bologna and lies coming from her end. does he think we're stupid or the american public is going to believe anything she says? it's amazing how fast she

changed her story. federal agents are not going to lie when he confessed to them that she tried to change his mind before he went to the club. and again the fbi agents from multiple sources said the same thing, she was cooperating with them, she was working with them, that he was telling them things, that she accompanied him to buy the ammunition and the rounds. there is no way she does not know what her his was up to. it sounds like she's getting lawyered up and getting advice, getting her ready to talk to the american public with a sob story about the poor mother with her little baby. >> she had no idea. they have a small apartment. we saw the pictures of it. she wasn't to believe that that night he got loaded up with ammo, with the big gun and the smaller gun, walked out the door and she had no idea, was a complete shock to me that he went over to that nightclub. >> that's right. you know, late at night.

you sleep, i'm going to go, i'm going to grab this big weapon and go out with it. total bologna. the family members know exactly what's happening with the family. islamic families are very tight, very close. there are no secrets in the family. they talk with their friends about the plan. it's a source of pride to brag about how they associate with something or support something. she not only knew how she felt but i have no doubt that other family members knew exactly how he felt about america, about isis. there is more than one person involved and there are more than just the wife. >> we went over this last night. the studies show in 64% of the terror cases with family and friends were aware of the plot because that terrorist told them. so in two thirds of these cases the family and the friends know specifically about the plot, not just about the radicalization or the general desire to hurt

somebody. she wants us to believe that he was making comments so incendiary that the fbi came out to investigate him but she had no idea. she was completely clueless. i'll give you the last word. >> do you know why the fbi stopped investigating him? they thought about the people that talked about him were racists and that's why the fbi dropped the investigation. >> we're going to get into that in a second. great to see you. >> thank you very much. >> we're also hearing that some of omar mateen's relatives are receiving grand jury subpoenas. the grand jury has been convened to look into this case, including the wife. this as we hear disturbing new reports that in the middle of the worst terror attack on u.s. soil, he was not only on facebook but texting with his wife. he asked her if she was watching the news and that she tried to call him during the attack.

we're going back to trace for the second part of this breaking news tonight. >> at 4:00 a.m. on the morning of the attack after the killer texted his wife asking if she had seen the news, she texted him back saying she loved him. and after reports of the attack were all over the news and she realized he might be responsible, the wife then tried to call her husband. we're now learning that in the days following the attack, noor salman gave conflicting accounts about what she knew about her husband, saying she didn't know what he was planning to do then saying she suspected she might be planning an attack on the pulls night club. we know from security employment reports that he was a skilled marksman. despite that, the killer who december plately wanted to be a police officer could not get into a police academy apparently because of drug use, criminal allegations and behavioral issues in school.

and two weeks before the attack the shooter himself donated blood at a blood drive in ft. pierce. and a supervisor at the blood bank was killed in the attack. you mentioned the wife of the boston bomber walking away a free woman despite evidence she googled quote, if your husband becomes a sha heed, what are the rewards for you. and then on the day of the boston bombing, she replied, quoting, a lot more people with killed every day in syria and other places, innocent people. we just spoke with if lawyer for katherine tsarnaev who goes by katherine russell. he does not know if russell is still under active investigation but that could change. >> she was never charged, katie russell from rhode island talking about how innocent people are killed, unlike those

in the boston marathon bombing. that's the implication. she's free as a bird. is that what's going to happen here to this woman? joining me with more, a criminal defense lawyer who practices law in florida. so there are real questions now because yesterday the attorneys came out, the federal prosecutors came out saying this woman, noor salman may not be changed at all. there's a grand jury looking into it. what in your view is the best possible charge against her? >> this is so fascinating. the battle lines are drawn. let's just say for a moment what she's saying is truthful. that means first of all the media and their sources aren't worth anything because they were not in the room where it happened, to borrow a hamilton phrase. if she is full of it and coming out now saying because her life has been turned upside down and she's about to be indicted, i didn't do all of that and that

wasn't accurate and she's doing it and really lying, then she's looking at 49 counts of murder because she's an accomplice because she arguably aid ud and abetted her husband. >> how? >> assuming what we're hearing is true, she says it didn't happen that way but let's say sum the abc and nbc sources are solid. if she drove him to scope out the pulls nightclub, knowing he was going to commit a terrorist attack or drove him to the ammunition shop, all these things -- >> knowing. that's the key. knowing. just driving him to get bullets is not enough. >> it all presupposes that she knows. she doesn't know, we're done here. she drives him innocently enough, no charges. >> i don't. i don't know if they've got it. it's hard to get at the spouse. in that case of katie russell,

also know mrs. tsarnaev, she was in the apartment where the bombs were being made. she is free as a bird. they couldn't get her. >> you gave a stat early. that means that 46% of the time they don't. that's number one. i've got to correct something i said earlier in the week. knowing of the crime is not enough unless there's one additional element, which is concealment. if she lied as so some are reporting, she lied in any way or minimized or tried to cover up or got rid of evidence, knowing about the plot, knowing about it, the crime being committed and doing anything yards, that lands her in hot water. >> the discussion has we had if she knows i'm married to a would be terrorist, hep's bought guns and ammunition. he hasn't committed a crime yet

but i know what i think is in his head and she doesn't report it, that's not enough to charge her? >> you just changed the facts a little bit. i think i know what he's going to do. that might not be enough. it's knowing. him saying to her i'm going to do this act and i'm going to be in heaven and it's going to be wonderful. it presupposes that she knows. to think in general he's a little nutty, that's not going to do it legally. morally, court of public opinion, it's enough. >> that fact about him donating blood a month before he did this. >> crazy. what is that about? >> think about this. so his blood could possibly have been used to save the lives of some of the people he shot. i mean that's possible. they're supposed to using blood within 45 days. why would he do that? none of it makes sense and none of it ever will. thank you.

it? >> well, i think it does, megyn. this guy in orlando, there were more red flags than a chinese military parade. and somehow, even one of the people you talked to, one of his coworkers four times tried to tell people this guy is trouble. and the employers and supervisors said don't rock the boat. the president will rock the boat when i comes to telling states that they have to have transgender rest rooms. they'll invade people's privacy like james rosen when they wire tapped him and his parents. but this is an administration that doesn't want to offend muslims. they will offend everybody in america but the muslim population. the question is why? they don't want to prosecute this woman. they prosecuted whitety bulger's girlfriend. he went down for 21 months in prison. it's stunning. >> he got on our radar. we had him ten months under

mind, the fguns that they have access to. your thoughts. >> if you had his record on foreign policy on combatting terrorism, you too would want to change the subject to what in this particular case, orlando, is a complete irrelevancy. obama is making a category error deliberately. he wants to lump this in with sandy hook, aurora which he mentioned as if it's some kind of crazy person without a motive who goes ahead and shoots. now the problem is that you've got to ask yourself, is orlando more akin to those or is it more akin to the boston marathon, which he did not mention. the reason he didn't is because there was no gun involved. it was done by other means. and yet it is obvious this is akin to the boston marathon. in fact the killer himself in orlando expressed solidarity not

just with isis but with the tsarnaev brothers of the boston marathon. that's the category we're dealing with. the reason obama doesn't want to talk about that, he'll segue as quickly as he can to gun control is because hch his record fighting isis. >> but domestically, you're going see a greater presence of law enforcement around the country in the coming weeks because they've threatened they want to kill us during the month of ramadan. nothing. nothing about doubling down. we're going to increase the fbi resources, i'm going to have a meeting with director comey and talk about how many more bodies he needs to track somebody like this guy in orlando who was on the radar but was left alone despite all of the warning signs. >> i agree with you on that. but we can harden this country as much as we want. we're 300 million people.

we're the most open society on earth. and we have a choice. if we want to make it into an army camp, i'm sure we can reduce the number of these incidences quite a lot. the fact is we don't. we can't allow that to happen. this war has to be fought overseas. the only way to defeat them, the only way to prevent the recruitment -- this was not active recruitment. from what we know it looks like somebody inspired by. they're inspired by the ideology and they're inspired by the fact that the jihadists, isis, the islamic warriors are on the march and they're winning. all of the messianic movements that we know of the last century and now jihadism thrived on expans success an the promise ultimately of world victory. the minute you are able to throw them back to make them retreat or to destroy them in their

different emphasis between the president and his cia director. let me unpack that just a little bit. we expect policymakers to be optimistic. we pay intelligence officers to be pessimistic and john delivered that in spades today. when the president -- right. and when the president gave kind of a happy face with regard to the war against isis, he was pretty much confining his remarks to iraq and syria where we've gotten better. john was talking about the global threat which he indicated was actually getting a lot worse. the president is trying to put a ribbon around this in the last seven months in the administration. john is heading an agency that's still going to be working eight months from now and so it's essential for him to be very realistic to use your words. and then -- >> but it's irritating. it's irritate to the american people to hear the president of

the united states, the commander in chief downplay the threat that we all know is there. it's not fooling anybody with this. >> well, no. and i think director brennan -- look. the director works for the president but the director is also paid to be, as you suggested, very realistic. john gave a very honest assessment from the cia point of view. the president wants to project his policy as being successful. but john is leading an agency if the public record is correct, megyn, an agency that suggested that we needed to be doing a lot more against this enemy. >> the cia agents have come out, as you know, and in various reports made clear that they were warning president obama about the rising threat of isis when president obama is telling us it was jv, the intel said something very different. now we know it's expanded over the middle east and beyond and become a major problem.

it's metastasized. if you were still in there advising this mpresident, how would you -- they're everywhere. they're all over the place. they're in libya, 5 to 8,000, egypt, several hundreds, yemen, nigeria, afghanistan, pakistan, what are we supposed to do? >> well, there are several approaches. number one, keep on doing what we're doing in iraq and syria. finally we've put enough effort in there and loosened the rules of engagement that we're seeing significant success. so keep that up, perhaps expand it to these other centers of isis power in libya, perhaps even in nigeria. continue to do what we're doing in regard to intelligence. look, as a measure of our success, we've driven isis, which wanted to be a state and a caliphate, we've made it look more like al qaeda pushing it

into raw terrorism. now we've got to deal with that as a measure of some success against core isis. >> let's talk about what's going on back here. you used to run the nsa and that was the agency listening in when a terrorist was believed to have had a phone call that got so much negative attention and has bing changed since you've been there. what would you do to find, as comey said, the needle in the hay stack or the piece of hay that's about to convert into a needle. >> this is a sad story. what i used to do was designed to catch the attack that was planned and hatched over here, catch it while it's exported into the united states to do damage to our own citizens. what we see now with the self radicalized lone wolf individual, they're not leaving the kind of trail that i used to be able to detect at nsa and even at cia. we've got a new kind of problem

and it's usually somebody who has tremendous background in active shooter shooting. >> if you were in that bathroom that night and that shooter was in there with his guns, you would have preferred to have been armed. >> so generally what happens is it's more often than not that somebody who attacks the shooter, physically with an object being something large, not because of stress, they are more likely to hit somebody else and that's the fbi's own research. >> dana? >> i have a different conclusion based on the superextensive report that barack obama commenced that talked about gun use. in fact, concealed carry firearms, it's a great deterrent to crime. i tell you what, i want to have a fighting chance because criminals don't pay attention to gun-free zones and it's like i just became best friends with howard stern. >> i think he read your book. >> right. >> the studies are great and
