tv   Red Eye  FOX News  June 21, 2016 12:00am-1:01am PDT

12:00 am
right here at 7:00 p.m. eastern. up next "the o'reilly factor." tonight donald trump is on with bill. good night from washington, d.c. see you tomorrow night 7:00 p.m. go to my facebook page. welcome to "red eye." hello, everyone. i'm tom shillue. let's check in with tv's andy levey at the "red eye" tease deck. coming up, the doj retacted information from the orlando shooter's 9-1-1 calls. if only getting the files on chem trails was this easy. and are they going to buy donald trump out of the apartmental race? everyone knows you can't buy a politician. and the latest barbie doll is -- developer is working as a gamer. back to you. >> thanks, andy. let's with welcome our guest.
12:01 am
she argues better than the lockhorns. ebony k williams. this guy fires on all cylinder. don't hate her because she is beautiful. hate her because she is a lawyer. remy spencer. and he is one of the best dog gone guests we have. sitting next to me, comedian and author of bad dad, tom kodder. let's start the show. he was motivated by omity. we are learning less about the orlando gunman. the justice department released a partial transcript of his 9-1-1 calls removing references of who he pledged allegiance to. here is an exerpt. >> i pledge ally inteligence to "omitted." they didn't want to give the terror group
12:02 am
additional publicity. after an uproar over the omission paul ryan call it preposterous and the doj released the transcript and we learned who inspired this monstrous attack. it was isis. here is the unredacted text. i pledge allegiance and may god protect him, arabic, on behalf of the islamic state. they changed that to god and it should be a llah. we allah. we don't change the proper names. >> i think they were trying to remove all references to anything that seemed islamic at all. we know who it is. >> i don't know about that, tom. i know this morning when i saw they put out the redacted form -- when you redact something it is for a protection of safety.
12:03 am
they say the only reason they had to redact it was the propaganda protection. >> what could be the legitimate reason. can you explain their thinking as they went through this? first the redacted version? >> as you were saying the reason you redact anything you release to the public is for the purpose of public safety. whether they had the best of intentions when they have unredacted within hours of paul ryan saying something, to me it ig gnaw ties that this was purely politically motivated. there was no public interest and no policy concerns. it wasn't about justice it. it was about politics. >> was it a dumb mistake? >> it was very dumb. >> you know about dumb mistakes. >> the story of my life.
12:04 am
>> so shady. >> the obama administration, she went out there and now you know how colin powell felt when they said tow this line. clearly it was incompetence, but it was deliberate incompetence. they kept in -- they kept in the god even with the new version. they kept the allahs and they changed them to god. do you think hearing the name will inspire more terrorism or will it remind us who is committing the terrorist acts? >> he wasn't pledging allegiance to the amish. we knew who it was. are you going to protect al bagdaddi. the names had already come out. he had already said he was pledging allegiance to isis. that came out from the orlando police department. everyone knew it was so stupid. >> is it part of the same
12:05 am
thing? obama has been accused in the past and been accused during this campaign season of not wanting to use the words islamic terrorism, et cetera. and they say it is because they don't want to give them publicity. but i think the idea of releasing this retacted -- redacted document. >> give it context. in the normal criminal case you would redact a victim's name. or a victim's identity. that's how you are protecting the public. the defendant's information is public, but not the victim's. it is politically motivated to redact it. >> now it gives a bad name to redactions and they are useful tools in the right usage. i am super disappointed. she should have known better. no valid reason and she had to eat a lot of crow. >> how about this?
12:06 am
no one would talk about the plans whether or not to arrest the wife. can you talk about the legality of that? >> i still don't understand why she is isn't in jail now. she should be in guantanamo. >> most people agree with you, tom. that's a valid point. there are legal theories that would hold her responsible for her husband's crimes had he lived. under the uh poll police -- accomplice liability theory if there is any evidence what so ever she participated in the act of this crime she is just as responsible as a matter of law as he is for committing these acts. they convened a grand jury and they are investigating. i think they are trying to dot their i's and cross their t's. they are dieding if they have the proof. and then they will make an example out of her.
12:07 am
>> while they are crossing the t's put her in the jail cell. >> the feds are very par particular. they do not like to bring cases that they cannot close. they have a 98 percentile conviction for a reason. the main thing they have to focus on is criminal intention. the aiding and abetting abetting and conspiracy things it is not enough she is there. it is not enough she even acted in a way that furredded his crime. that furthered his crime. they have to interview people and look at digital footprints and prove that. i think they will find that, but they have to have all of that evidence and get a slam dunk. >> let's move on. the gop convention is less than a month away and some of them are brimming with ideas to dumb donald trump. they are considering letting them out of voting for trump
12:08 am
for a conscientious status. let's look at how first ballot voting took place at the last gop convention in 2012. >> there i am. >> >> have you seen this video before? >> you think you have seen that? we might have used that before. >> i'm pretty sure. >> people falling down in dominoes is a metaphor for so many things. >> house speaker paul ryan said the first thing he would do is advise republicans to ignore their confidence. >> i would do nothing to betray confidence. this is a unique nominee. >> i was wrong.
12:09 am
that's why people like trump. can ryan come down on the side of anything? he is waffling a lot. >> he is wishy-washy. get behind your guy. he is the defacto guy. latch your wagon to him and ride it. i don't get why he is the waffle boy. it is unbelievable. i think they may be drinking buddies of his and they are put part of the never trump crowd. >> yoo, mitt romney. i wouldn't vote for him now. i couldn't believe that. he can afford it. i just want them all to go away. if they do this hillary will waltz into the white house. c are they sabotaging the right. >> seems they don't care. it will be a fun convention.
12:10 am
>> i am glad i will be watching from a distance. that's going to be -- contactually. the two scarest words are done nawld trump. donald trump. anytime a reporter goes up to anybody from the staff or any congressmen they went into the chamber. who would think a senator would want to go to the senate chamber and do their job. the reason trump won the primary is because of people like myself . now you are not going to support him because you think you will win re-election? no. people will be angry with you because you are not listening to people. >> they are trying to do the impossible. they want to detach the republican brand that they care so much about and move
12:11 am
forward and fly in the wind. it is an impossibility. they need to wrap their mind around that first. i understand he is in a curious position. wrap your mind around it. the time for all of this posturing is last summer. if you have a problem get your ducks in a row and you get a different nominee. if you are serious about the white house this is the time. >> if people voted their conscience, who would they go to? >> i have no idea what th alternative is. >> nobody is voting for romney and that's what you get when you put a jeb bush and lyndsay graham up there. >> i think it was too many choices. it was a set up for failure if they wanted a particular candidate. >> too many option.
12:12 am
i think trump may sue. >> i think so too. he files thousands of lawsuits a year. somebody apparently said for $150 million donald trump would bow out of the race. for anti-trump -- >> maybe another option they could pay trump to drop out. that's not a fabricated story. >> i bet if somebody offered him 150 million to drop out he would. he texted, yeah, probably. >> he tweeted in response, done. reservation under the name at rice.
12:13 am
i think this is silly and i think somebody made an offhand remark and they turned it into a story. >> you mean they weren't fact checking? donald trump has said this is wholly false and completely fabricated and that may be true. what is interesting is that the story has gained traction and people are considering that it might be true. i can't consider something in the past they would contemplate doing this. his campaign manager is out. >> see ya, wouldn't wanna be ya. >> i feel like i remember every time someone does this, usually the -- if hillary were to do this she would say she
12:14 am
is getting her campaign in order. >> he did the trump campaign a solid. he praised the trump campaign and will do everything he can to make sure he was elected. there was no scandal to be had. some people would like to see some implosion. this was a good day for the trump campaign. he cut ties in a clean way. cory seemed okay about it. he put on a good face and a good shoulder. >> he missed the opportunity. we like to see people fire him on air. >> make him a spectacle. the staffer who texted yeah, probably if trump can get bought out, i know when i ask them to hang out and i ask them to hang out and they say yeah probably that's a no. that means i am never answering your text again. >> major league baseball and bashing socialism.
12:15 am
topics reserved for george will's dinner party. you can hear them during dodgers games. he took the opportunity to opine the dangerous affects of socialism. take it away, skullly. >> socialism failing to work as it always does. you talk about gifg somebody free -- giving somebody something free and who do you think is the richest person in venezuela? the daughter of hugo what chavez. oh well. >> some people found the comments out of place, but others love their country. tom, what do you think? do you think this is a place for political commentary? >> i think he has freedom of speech. he also said because he does president like communism he
12:16 am
won't cover reds teams. they should give bernie sanders a chance to call the game. it is millionaires and the cheating and the steroids. >> it it seemed -- look, people do this all the time on the left you have -- and on the right. i think people are talking about issues that are not there to speak about on both sides. we hear actors and actresses talking about politics and their opinion is their opinion. it is not important or persuasive. >> they cab, but they shouldn't be. i don't think this is an intended speech. i don't think he planned to say these things. it is how
12:17 am
he felt. it was sincere. it wasn't an attack. it was stating i thought it made the game more interesting. >> i didn't like it. i want my sports to be my sports and maybe because i am saturate with politics. sports time, chillout time. >> there is a venezuela an guy is at the top. >> in that moment i am only interested in the throw, the hit and the homerun. >> what do you think? >> i like when people -- go off like that? normally i don't like old people. he is 91. >> he is 91? >> yes. >> oh my gosh, that's amazing.
12:18 am
>> he is 91 and like the crazy uncle at thanks giving. we have an old man bernie sanders who can't think and he will win a nomination. >> if he is 91 he can say what he wants. >> you are so boring you need anything to fill time. >> i agree. >> i don't care what you say. throw something out there. >> that's why i love watching them. i love what the commentators come up with. >> has a tattoo, but -- >> i love watching the color. coming up, which puppy won the cutest puppy in the world contest? my monologue is on a completely different topic.

for whatever you're trying to master. this is a fox news alert and i'm kelly wright. police in belgium have detained a man on suspicions he was carrying explosives near a central brussels shopping center. the area around the shopping center has been sealed off. and a bomb disposal team has been called in to verify if he indeed was carrying an egg mows city device. an explosive device. he was following attacks on the brussels subway that killed 32 people. just last saturday dozens of people were arrested suspected of planning an attack on the euro2016 soccer match. police were alerted to the scene following reports of a man acting suspiciously. he was holding an emergency meeting at the time.
12:23 am
one person explained, it's not over. you can expect more threat. stay with fox news for more on this developing story as it progresses. in other news, a major shake up in the donald trump campaign. the presumptive republican presidential nominee firing his campaign manager on monday. trump told "the o'reilly factor" the time had come for a change in direction. that's something many in the party were demanding for weeks. he understood the move and that he still supports trump. authorities say a british man arrested at a donald trump rally in las vegas said he wanted to kill the pre presumptive republican presidential nominee. he was arrested after trying to grab an officer's gun. >> flames near los angeles have consumed some 4500 acres in the san gabriel mountains. so far there are no reports of serious injuries. the fires could merge into one
12:24 am
large fire. now back to "red eye." >> working your butt off is a sign of of your privilege. they are at the center of equitable growth. they found the ones where people worked the longest hours, law, business manage meant, engineering and finance are the ones that pay the most. now that is unfair. they found across all field men work more hours than women. and white workers worked longer hours than nonwhite workers. so to these researchers, upper class white men are privileged to work the most hours. what to do about it? surprise. they say more regulation, of course. the researchers even note that the gender gap in pay would be considerably reduced and may vanish altogether if they did not have an incentive to disproportionately lay error long -- labor long hours.
12:25 am
each is according to his needs. >> okay, remi. lawyer get paid a lot. they don't deserve it. there is something to be said about caring about what you do and being passionate and motivated. i think a professional whether it is law or medicine or whatever it is, if it is something you care deeply about, you are more willing and able to put in the longer hours working weekends and holidays. if you go and just punch in and punch out and you really don't care about your job and it is really just about the paycheck, it is a lot harder to work those long hours. >> interesting. i also take issue with the whole men work longer hours than women. >> see, i thought you were
12:26 am
saying men love their jobs more than women. i thought you were congratulating white men. >> i have a small staff and i advise the lawyers that work for me. it is about working smarter. you are not going to impress me being in the office until 11. if that's the case, then there is a problem. you need to be smarter. >> you are still a young lawyer. >> do you agree that white men work longer hours? that's what she just said. >> i didn't say that. >> she said work smarter like all of the minority. >> first of all i want to congratulate white men. you know what, this is all inflated. it is malarkey and a bunch of nonence sense. nonsense. people get on facebook and instagram and say it is 10:30 at night and i am burning the
12:27 am
fuel. it is a bunch of nonsense. most of them are reading on-line articles or at the keurig. they are doing money sense and it is hog wash. >> do you think they are reading on-line articles ? >> not just them. all of them. >> we are in the whoa is me. i want everyone to feel so bad for me. i can get your sympathy. the drug ge is real. -- the struggle is real. i know. >> these successful white men, i don't think they are updating their -- >> why are they white men? did i miss that? >> i can't argue with science. it says white gails work their tail d.a. -- white guys work their tails off. >> you and i are comics and work an hour a night. we are on food stamps. we don't put forth a lot of effort. the corner stone of capitalism is work hard and get rewarded. >> i traded in working an hour
12:28 am
a night to working an hour a night. >> i think the marketplace has become so competitive at these more highly educated position. >> you have to be better and stay relevant than the next person. >> and the incentive is bigger too. when you are making $200 to $250 you have more incentive to work more of a work day. >> they indicate there may be a problem. i don't see if it is a problem. >> we are all doing great. >> we are all doing fantastic. >> and we work so hard, right? >> it goes great with our lives. >> she is a woman and we are not so savy. >> two female attorneyses at the table. coming up, a little
12:29 am
segment we like to call half time with tv's andy levey. and don't forget, the "red eye" pod cast is back.
12:30 am
12:31 am
12:32 am
welcome back. time to find out what we got wrong and what we missed. >> hi, how are you? >> good. >> they redact terrorist 9-1-1 calls. they asked if they should have translated allah to god. the way you do it is you don't
12:33 am
translate proper nouns. i think i mostly agree with you here. there are arabic versions of western names or whatever you want to call them. we don't translate those, right? >> on the other hand aren't there times -- is it if there is an arabic name of a city they may translate something like that so that everyone knows what they are talking about. >> possibly. what you are saying it is ambiguous. i think we know what is what. >> i think i agree with you on this. >> you said you know he wasn't pledging allegiance to the amish. we know this because he used a car. >> there can be confusion because there are beard involved. >> he gave it even more publicity. this is the streisand effect.
12:34 am
>> because she -- i don't remember it. >> she wanted a picture of something taken down the internet. now it is called the streisand effect. you said you are super disappointed. do you think she did this without the support of her boss? >> no, and i feel she was kind of set up. i think they hung around to dry. she was the face of this and then she looked completely ridiculous today. >> these transcript rtz historical record of what happened. the doj literally sensorred the historical record to obscure the killer's motives. >> with no reason. >> regarding the wife of the terrorist, if there is evidence she knowingly participated in the crimes she is as responsible as he is. i agree with you. the whole thing is about proving criminal intention.
12:35 am
the attorney general is right and they don't want to act prematurely. if they charge her with a crime that's when certain legal protections would kick in, right? >> that's right. when the feds in indict someone they have to move. if they don't have their ducks in a row they don't have the evidence and it extreme advantage that is not something the feds do. snrs are -- that's what they are doing. when they indict her they will be able to convict her. >> i think that's right. >> conscientious objector delegates. they would allow a way out by granting them conscientious status. it is one paragraph.
12:36 am
>> i didn't want to read the whole thing. it gets complicated. >> you said the two scarest words is donald trump. to a lot of other people too. >> exactly. >> this is the world i am forced to live in. better you than me. >> he said it was in the past and he should embrace them. if it is good in the long-term shouldn't he not embrace them? >> then just say that. just take a position. is ryan trying to play this both way? i am going to support him and he has my vote. i want to see him beat hillary clinton. if it is not your conscience,
12:37 am
don't do it. you asked if the republicans have a problem with their conscience who will they vote for? gary johnson obviously. that was easy. you said he did the trump campaign a solid by how he conducted themselves in the interviews. i totally agree. let's see if it holds. >> that's true. >> i feel like the rant was inspired by free hat day. ebony, you said you didn't like this the way bob costas is talking gun control. he is the greatest baseball announcer in history and a hundred years from now people will still be saying that. there is validity to the thought that if you don't like
12:38 am
someone like costas railing about guns you shouldn't applaud skullly doing it with socialism. >> i agree. now that i know he is 91 he can say whatever he wants. >> he is 88 by the way. >> in that case, never mind. >> he is still old and going to die. besides getting his age wrong you say you don't like normal people. it doesn't matter. he is ageless. >> he is a great guy. remi, you take -- he takes longer hours. >> just because they are in the office for more hours than women. it doesn't mean they are working longer hours. >> i guess i can't argue. the point of the study and the
12:39 am
reason i don't agree with the whole privilege thing, but the reason why the author says it is because the study says white men are more likely to be given the opportunity to work longer hours. >> i think minorities are disadvantaged when it comes to education and higher education and opportunities without a doubt. i don't think you can say we have to turn the system on its head which i think this article is talking about. there are people who are privileged and people less privileged. i don't think you can criticize somebody for working hard and doing well. >> i don't think the article was criticizing them. i think it was saying that they -- again, that white men because of education or whatever are given the quote, unquote, privilege of working longer hours and making more money. >> so is the article saying they should stop complaining
12:40 am
about their hard work? >> no. >> it is not news i don't think. >> oi ron nickly -- ironically the article didn't work. >> i don't think you like the article. >> i am done. >> thank you, andy. coming up, has mattel turned barbie into a computer nerd? this wouldn't happen if trump wasn't. first, here is what's coming up on the next "kennedy." >> hi, "red eye" faithfuls. your own joanne noy uh chin ski. joanne noy saw -- nosachinski. and they turn up with triple distilled knowledge. hope you are there with me.

people don't need this barbie shade. i loved the little dolls growing up. i thought they were important. you need parents. you need society and real things to influence you. barbie doesn't hurt. i have a barbie president doll and a barbie miss america doll i still have and it is helpful and great. they should see as many representations of success as possible. >> saying girls need a doll and they are not going to be attracted to gaming unless they see -- well a lot of people that are females didn't want to play with dolls. as far as diverse games go i grew up with gi joe. gi joe rules and everybody else is bad. it is so easy. i don't think we need these diverse dolls. get a teddy ruxpin and he
12:48 am
never did anything wrong. >> to your knowledge. jay he uh-huh loft things. >> maybe yours didn't. mine had a whole list. >> i don't care if they become gamers or not. >> i don't think this doll stands for the proposition that young girls should aspire to be. >> it is good marketing and creating a diversity. we are not talking about barbie's weight anymore. we are talking about realistic barbie dolls and the chunky one and whatever they call them. it is nice that we are not talking about body size. it is something other than clothes. that's positive. it doesn't mean she has to become a geamer. >> what do you think of
12:49 am

12:56 am
>> i don't like to see my man cry unless there was a reason that is celebratory like if you win or something good happens in your life. like you said, you don't want to see them cry when they lose. that speaks to that point. it okay to cry because you are so happy. but crying because you lost is in poor tai. poor tai. >> what do you think? >> i think if he didn't cry he was maced by steph curry. he was maced or pepper sprayed. the guy is from cleveland, akron. he grew up there and they hadn't won since 64. he had two nights where he had back to back wins and it has never been done in oakland which is a ridiculous hard place to play. i think he deserved it. god bless cleveland. cleveland deserved it. >> they are going crazy in cleveland. a special thanks to ebony k.
