floor in an effort to disrupt the proceedings. a crowd of protestors gathering on the lawn of the house steps now, demonstrating in fave of the effort. democrats have pushed for measures to expand background checks in the aftermath of last week's massacre in orlando where 49 people are now dead. are you on capitol hill? >> right. i'm outside of the house chamber here, looking at the democrats from michigan and tom larson, they're down on the floor now, the house is not in session but what they're doing, members are live streaming this video on either facebook page or periscope. the house of representatives, the cameras are controlled by the institution.

you can usually see this on c-span or fox to take heat. when out of session, which is what they're in now, they kill the feed. that is why there is a rough session. you have members down on the house floor, holding up pictures of those killed by guns, the one member now talking steven lynch from massachusetts. you can see that is so they'd encourage people to call their member of congress. if they can argue with them, implore them to get a vote on the gun legislation, pieces of legislation. we don't know how long this is going to go on. this started at about 11:25 this morning and it started very organically. hillary clinton was here on capitol hill this morning, to meet with the democratic caucus. and the democrats have been very

frustrated about no action on firearms. there were a series of votes in the senate on monday that were procedural votes, various pro visions that needed a 60 vote threshold super majority. that killed everything. well, there was no activity whatsoever in the house of representatives. and so in that hour or so, a democratic congressman from atlanta got their heads together and said let's do a good, old fashioned sit in. so literally, i was surprised i saw this scene they were sitting

on the carpet and so republican congressman from texas gavelled them down and told them they're out of order. he recessed the house back and the house stayed out during almost 10 hours in between, at one point, i saw in the neighborhood of 168, almost 170. who came to talk about guns and it wasn't just house democrats. we had a number of senators from massachusetts, elizabeth warren, this is her second trip over. she was bringing doughnuts for everyone. >> and there are people with

emboldening. there is either going to be a compromise with a commitment for a vote during chris murphy's long filibuster or this is going to continue. and i think that i think should back down. i'm not a partisan. by nature, or by politics. i don't support someone because they're democrats or oppose because they're republicans but in this case with stakes so high, with national tragedy the greatest massacre in the history of the united states, the american people have a right that their congress is going to stand up for their safety.

joining us now on the phone is chad pergram. what can you tell us about the protests? >> the democrats go out outside of the capitol typically on the lawn and these folks kind of gathered spontaneously. they heard what is going on inside, some had come to see the house in session when they were and they sit outside with signs and members of congress, emmanuel cleaver and others talked to members and gave speeches. it's typical here in the house or senate floor for people to spontaneously show up. we had that a week ago when

senator murphy took the floor for 15 hours in the filibuster. people saw the hash tag and that is the beauty of it. when the shows in session, there is a big light on top of the capitol dome that signals if they're in session. the house is in recess, they're still in session, so if you look at the dome tonight in washington you can see the light above. >> there has been a declining attendance. it's 12:15 in the east. there is a group of people in the hall coming into the chamber. the house will probably come back into session i'm told to conduct votes on what, we're not sure. that is an open session, they can come and watch. >> do we expect we're going to

see a member of the votes going on throughout the night? >> you know that is unclear and there is an agreement on the plan to deal with the crisis, which, at the end of the day, the final version will be a conference report. the democrats hate this. the white house sent out a statement, they don't like this agreement and have to do things to get this done by friday. the house of representatives is not scheduled to be in next week. the senate is. they're going to deal with the zika crisis, they need to get this done by the end of the week. that is one thing we're going to be thinking it's about. the other thing is how they'd handled protestors, house democrats on the house floor. again, what they're go going to vote on is unclear at this point. i should point out something. i have in my hands the house

rule book. and rule four pertains to the whole of the house. use and admittance. the whole of the house shall be used for legislative business and caucus meetings of members. what you have here is the rules being broken but republicans are periscoping and facebooking these feeds. that is not allowed either. this is not the first time we have had this. this is a little bit different than in 2008. and the house voted to adjourn for august recess and so that is a vote they took because they're going to have the political conventions here for the democrats and republicans and republicans said no. no. no. much like democrats have done in 12, 13 hours it was republicans who took the floor.

they came in day after day and they'd have these sessions on the house floor. and the democrats lock the doors which would have been in their right. the chamber was not being used for legislative business. it's being used for something else. this is and after these mass shootings there have been questions about whether democrats did have control of the house and senate should they have done something then but they didn't. there was an issue in 2009 when they focused on economic stimulus packages. health care reform and i assume most of that is the house of

representatives. and and guns are aums a tough issue. and in 1994, it showed, opposed assault weapons ban. this is auj yeared by joe biden. when in the senate. they put in gun control issues earlier in 1994 they'd passed a first bill and the first time you have had gun measures move. and harry reid said we haven't had a victory since 1993. that is what he's referring to.

suspending due process for people. so they have trouble balancing the country at large but some people within their party. >> some have said it reminds them of protests from 1960. people on the floor and you can see sleeping bags, doughnuts and food. they don't have plans to leave. when is the last time you remember seeing this on the floor of the house? >> right. the comparison is this idea that a sit in, you know, i think does come across as some remarkable imagery being met, owe okay. we think of the civil rights movement.

in 13 minutes we heard the 15-minute bill. the house of representatives is going to meet at 12:55 eastern time. there will be a series of votes. i asked what they're going to be voting on and they said we'll know, soon. when members don't know what they're going to vote on. i mentioned that there is an outstanding issue that deals with zika funding and the house leaders have been trying to figure out a pathway to deal with this protest on the house floor. democrats are insis stant and prepared to stay all night. we've seen pizza and coffee and doughnuts by the cart load for hours here. and democrats have been coming to the house floor in shifts. they said they're prepared to be here for days.
