floor in an effort to disrupt the proceedings. a crowd of protestors gathering on the lawn of the house steps now, demonstrating in fave of the effort. democrats have pushed for measures to expand background checks in the aftermath of last week's massacre in orlando where 49 people are now dead. are you on capitol hill? >> right. i'm outside of the house chamber here, looking at the democrats from michigan and tom larson, they're down on the floor now, the house is not in session but what they're doing, members are live streaming this video on either facebook page or periscope. the house of representatives, the cameras are controlled by the institution.

you can usually see this on c-span or fox to take heat. when out of session, which is what they're in now, they kill the feed. that is why there is a rough session. you have members down on the house floor, holding up pictures of those killed by guns, the one member now talking steven lynch from massachusetts. you can see that is so they'd encourage people to call their member of congress. if they can argue with them, implore them to get a vote on the gun legislation, pieces of legislation. we don't know how long this is going to go on. this started at about 11:25 this morning and it started very organically. hillary clinton was here on capitol hill this morning, to meet with the democratic caucus. and the democrats have been very

frustrated about no action on firearms. there were a series of votes in the senate on monday that were procedural votes, various pro visions that needed a 60 vote threshold super majority. that killed everything. well, there was no activity whatsoever in the house of representatives. and so in that hour or so, a democratic congressman from atlanta got their heads together and said let's do a good, old fashioned sit in. so literally, i was surprised i saw this scene they were sitting

on the carpet and so republican congressman from texas gavelled them down and told them they're out of order. he recessed the house back and the house stayed out during almost 10 hours in between, at one point, i saw in the neighborhood of 168, almost 170. who came to talk about guns and it wasn't just house democrats. we had a number of senators from massachusetts, elizabeth warren, this is her second trip over. she was bringing doughnuts for everyone. >> and there are people with

sleeping bags. >> we have seen people curled up on couches. last week senator murphy made news because he was standing up. when you filibuster you're not allowed to sit down. 14 hours and 50 minutes he kept his feet. and there has been a development. we're expecting a number of what they term substitute overnight. we get a 15 minute warning. if you hear a bell you know that is what we call the 15-minute bell. signalling the house coming back into session in 15 minutes and

in so doing, a lot are just listening to democrats. and among them was kevin mccarthy. >> we'll go back to you in a little bit. joining us now is former ohio congressman dennis kusinich. what can you tell us right now? >> we have to understand the context. it wasn't too much days ago that 49 persons were executed by someone who committed an act of

terror. and i think it's not unreasonable for the american people to expect congress to do something in recognition in recognition of that event in orlando. and so so i'm glad congress is showing in gumption here and standing up. i remember during a time when i served, republicans took to the floor to try to keep the house open with regard to a specific issue i can't recall at this moment. i can tell you this is important. this isn't political high

jinxes. is a highly visible matter about conditions in this country where congress must respond to the series of mass shootings and take action. that is what they're trying to do. and it's a reasonable thing to try to stop individuals from being able to get access to weapons. >> what happens tomorrow morn something. >> this is unprecedented. i believe a few years ago there was a republican protest. i think you're looking at an

emboldening. there is either going to be a compromise with a commitment for a vote during chris murphy's long filibuster or this is going to continue. and i think that i think should back down. i'm not a partisan. by nature, or by politics. i don't support someone because they're democrats or oppose because they're republicans but in this case with stakes so high, with national tragedy the greatest massacre in the history of the united states, the american people have a right that their congress is going to stand up for their safety.

we spend hundreds of thousands of dollars a year to protect us as a nation. when it comes to protecting ourselves from those who may put us at risk, people are on a no-fly list is not a big -- it's quite reasonable. in this case, i'm siding with those exercising leadership by being not just on the floor, of standing up, but in this case, sitting down. >> do you think they'll come into some kind of an agreement before friday? >> they ought to. look. what is wrong with having a vote on this? speaker ryan is a friend of mine. i think that he has unbalanced, been very good for this country.

there has to be a vote on this. >> congressman we appreciate you being with us tonight. we have to take a break and we'll be right back in just a couple minutes.

>> this is a fox news alert. you're looking capital building in washington, d.c. the house of representatives is back in recess. the sit in continues, at this hour, it's now 12:15 here on the east coast. the democrats are holding to demand a vote on gun control. house speaker paul ryan held several unrelated votes while democrats shouted and sat on the floor in an attempt to disrupt the voting. house speaker paul ryan dismissed a protest as a quote, publicity stunt saying interest will be no votes on the gun bill. a crowd gathering on the lawn of the house steps, demonstrating in favor of the democrats' firearm efforts.

joining us now on the phone is chad pergram. what can you tell us about the protests? >> the democrats go out outside of the capitol typically on the lawn and these folks kind of gathered spontaneously. they heard what is going on inside, some had come to see the house in session when they were and they sit outside with signs and members of congress, emmanuel cleaver and others talked to members and gave speeches. it's typical here in the house or senate floor for people to spontaneously show up. we had that a week ago when

senator murphy took the floor for 15 hours in the filibuster. people saw the hash tag and that is the beauty of it. when the shows in session, there is a big light on top of the capitol dome that signals if they're in session. the house is in recess, they're still in session, so if you look at the dome tonight in washington you can see the light above. >> there has been a declining attendance. it's 12:15 in the east. there is a group of people in the hall coming into the chamber. the house will probably come back into session i'm told to conduct votes on what, we're not sure. that is an open session, they can come and watch. >> do we expect we're going to

see a member of the votes going on throughout the night? >> you know that is unclear and there is an agreement on the plan to deal with the crisis, which, at the end of the day, the final version will be a conference report. the democrats hate this. the white house sent out a statement, they don't like this agreement and have to do things to get this done by friday. the house of representatives is not scheduled to be in next week. the senate is. they're going to deal with the zika crisis, they need to get this done by the end of the week. that is one thing we're going to be thinking it's about. the other thing is how they'd handled protestors, house democrats on the house floor. again, what they're go going to vote on is unclear at this point. i should point out something. i have in my hands the house

rule book. and rule four pertains to the whole of the house. use and admittance. the whole of the house shall be used for legislative business and caucus meetings of members. what you have here is the rules being broken but republicans are periscoping and facebooking these feeds. that is not allowed either. this is not the first time we have had this. this is a little bit different than in 2008. and the house voted to adjourn for august recess and so that is a vote they took because they're going to have the political conventions here for the democrats and republicans and republicans said no. no. no. much like democrats have done in 12, 13 hours it was republicans who took the floor.

they came in day after day and they'd have these sessions on the house floor. and the democrats lock the doors which would have been in their right. the chamber was not being used for legislative business. it's being used for something else. this is and after these mass shootings there have been questions about whether democrats did have control of the house and senate should they have done something then but they didn't. there was an issue in 2009 when they focused on economic stimulus packages. health care reform and i assume most of that is the house of

representatives. and and guns are aums a tough issue. and in 1994, it showed, opposed assault weapons ban. this is auj yeared by joe biden. when in the senate. they put in gun control issues earlier in 1994 they'd passed a first bill and the first time you have had gun measures move. and harry reid said we haven't had a victory since 1993. that is what he's referring to.

this hasn't moved much. >> i think you're right. we can all agree 49 innocent victims lost there in orlando and 49 is too many. one is too many. we'll continue conversation right after a quick break.

>> yes. i'm here. >> do you do you think republicans are coming across with the way we're hearing they might come in and do more votes at 12:30 to 1:30? >> i think republicans are a little confused and now it's just a matter of figuring out whether or not they want to get tough on enforcing rules of the house in the wake of a shooting like this. many people have high emotions. republicans don't want to do anything that makes them look evil but if you're speaker ryan you want it resolved. >> we had congressman, speaker ryan come on. what were your thoughts watching him do that?

he is a no nonsense kind of guy. what is your take on that? >> this is just a toe in the water to see what they're able to accomplish and if they're going to be able to disrupt the democrats. this is just an attempt to say okay. what can we do? it's important that speaker ryan, last thing he wants to do is lose control. and democrats would be looking for an opportunity to prove and in part, they use civil hib taryns who do disagree with

suspending due process for people. so they have trouble balancing the country at large but some people within their party. >> some have said it reminds them of protests from 1960. people on the floor and you can see sleeping bags, doughnuts and food. they don't have plans to leave. when is the last time you remember seeing this on the floor of the house? >> right. the comparison is this idea that a sit in, you know, i think does come across as some remarkable imagery being met, owe okay. we think of the civil rights movement.

they're saying look. they shouldn't have their second amount revoked. it's going against what we, as americ americans believe as civil rights. so it does. >> people at home watching this, how do you think this is perceived for the average american? is this a good thing? that americans are seeing lawmakers divided like this? or a good thing for the country? and everyone seeing what's happening tonight? >> people have a well regard for congress and you like the person who represents your community.

and in this case, people have become very divided in the wake of the orlando shooting. if you look at polling, just 7% of the country viewed guns at number one issue. when it came to terrorism, this st an opportunity with something they've tried to do many years z they do have to go into it with realization the american public isn't unified behind them on this. >> right now joining us is former new york congress woman, good evening. we appreciate having you here.

how are you? >> i'm well, thank you. watching these proceedings with consternation and more. this is of a, i guess nearly seamless effort to distract attention of the failure of this issue from protecting the american people from the threat of terror. >> what do you think will happen next? tomorrow morning, let's take it one step. what do you see happening? >> well, i think speaker ryan will continue to perform with

dignity and concentration on what is important. and they're pursuing -- if they did stay here all night. this is an emotional response to an event and we have to have a discussion about the causes and the cause is that home grown domestic terrorist has been

constrained from or because this administration does not wish to acknowledge the threat of islamic terrorism. they're wasting their time. >> could you do you think they're handling it in the right way? >> no. no. i don't. i like to see a discussion as we know. there are senators on both sides of the aisle. and more attention be the due

process. and terror watch list. that this kind of protest on the house side is an administration. this is to redakt to try somehow to diminish the intent of the knowledge that we're not being protected. there has been a failure to protect by this administration and. >> we only have a minute and a half left. i'd love to get your thoughts on how do you, or do you think this will have impact on the

presidential race this year? >> it's good insurance because there are questions every american should be wave watching these and these folks are friends and colleagues and as they watch this happen, failure to recognize the root cause of the problem and failure to protect americans from issues of our urgent impressive for the national response.

in 13 minutes we heard the 15-minute bill. the house of representatives is going to meet at 12:55 eastern time. there will be a series of votes. i asked what they're going to be voting on and they said we'll know, soon. when members don't know what they're going to vote on. i mentioned that there is an outstanding issue that deals with zika funding and the house leaders have been trying to figure out a pathway to deal with this protest on the house floor. democrats are insis stant and prepared to stay all night. we've seen pizza and coffee and doughnuts by the cart load for hours here. and democrats have been coming to the house floor in shifts. they said they're prepared to be here for days.

we had a situation where republicans commandeered the house floor day in and out. this is not impressive ask this is about firearms. these votes, that is the hot topic. >> so wednesday afternoon, around 11:30 before noon. are we seeing more people? less people? what does it look like? >> there is a surge the people. first there was a smattering of people that came to the house floor and then, it dwindled and we saw more members realizing what is going on and wanted to

give their voice to this effort. and of course getting deeper into the night it's clear the house of representatives is going income in at 10:00. and there is 170 house democrats and there is so that is almost full attendance. the number dwindled a little bit. we've seen a number of republicans who hung out on the house chamber observing and knowing we're going to have votes and we're going to have votes here in 10 or 11 minutes. you'll see members of both parties trickling to the floor. you'll probably hear that

echoing through the marble hallways. democrats got pretty darn loud at 10:00. >> they were saying shame, shame, shame, speaker ryan. he say you had a quick conver tags with him. what does it mean? >> i didn't speak with the speaker directly. i spoke with leadership staff tonight. yes. they say what are you going to do? if you instruct the sergeant at arms to remove these folks. he has a custom of not responding to questions and that is about 6 or 7 hours ago now. >> you're saying number four on house rules has been broken. is that right? >> yes. house rules indicate you can

only use the chamber for legislative business. this is not legislative business right now, it will be come 12:55 here. and republicans could make a point of order and ask the sergeant at arms to remove the members there is a record and finding and that could be from bribery to something like this. and some is because they've gone there. they were on the floor and it was clear that that was a violation of house rules.

and the republicans told me this evening they wanted to take the high road. i had one senior aid say this is what democrats are doing. like wto protestors in seattle. we haven't had any violence here, but they get the point. maybe this is a legislative version but they weren't engaging in any way, shape, or form of what the democrats did. you may remember a week ago, the assistant democratic leader from south carolina trying to get recognition and tried to engage the house on when are we going

to have gun votes? that got to be a heated scene. you had some democrats from northern virginia saying he doesn't think he'd ever seen a member of congress treated so poorly. >> so we have just about a minute. you said it's 12:55. is that when we're expecting the next vote? >> yes. i'm going to look to see if there is an update. it says substantive vote series coming up very soon. we don't know specifically on what. there is a one thing i can tell you is that it's not going to be anything about guns. democrats have the republicans over a barrel. they think they can take this issue to the court of public

welcome back, we have been following the democratic sit in on capitol hill all night long. with the republican from indiana and chair of the house of congress. good evening. thank you for being with us. >> great to be on at this late hour. >> it is late. what's your take on what's going on there? >> i think most americans see it for what it is, a giant publicity stunt. the democrats are saying they want to see a vote on has already been defeated in the senate. even if it were to pass the bill wouldn't become law. it is a big distraction from the real challenge we are facing as a nation, which is the threat from islamic terrorists, the fact the administration's response to that has been weak i think it is not the answer. >> you can see some passionate

lawmake lawmakers i believe these are shooting victims. listen in and you can hear. >> you have given us. we need to do this. we will do it. it is a great institution. we have the will of the public. let us do the right thing. >> lawmaker from connecticut very heated as they talk about gun legislation. what impact do you believe this will have on the presidential campaign that is now in full force? >> again, you can't help but be heart broken by any death in america. you know the folks listed there, are the result of someone who might have obtained a gun while they were on a terror watch list or no fly list.
