the u.s. house of representatives is back in recess after republicans acted in an attempt to force an end to the democratic sit in. the sit in continues at this hour. it's now 1:00 in the morning thursday, eastern standard time. which the democrats are holding a vote on gun control. house speaker ryan held several unrelated votes earlier tonight while democrats shouted and sat on the floor in an attempt to disrupt voting. house speaker ryan dismissed the protest as publicity stunt saying there will be no votes on the bill. democrats have pushed for measures to expand background checks this the aftermath of the massacre in orlando that killed 49 people in a gay nightclub.

joining us is our senior capitol hill producer. it is 1:00 there. we were expecting votes. meantime, in the 1:00 hour, they are back in session now. what do you think? >> they just came back in to session. i could hear the bell sounds behind me signaling a role call vote. we will have a series of votes that are mostly procedural. what we will deal with first of all is a vote to change the adjournment time for tomorrow. there's going to be a vote to adjourn and the house democrats say they will keep the house floor throughout the course of the night here and then there's going to be another vote later on, maybe 3:00 in the morning, 3:30 in the morning that deals with something unrelated, zika funding, a conference report in agreement on how to fund zika and they have to set up the rules for that. that is something they will probably do on friday or so. that's what comes first in the

house of representatives. there's going to be a lot of bleary eyed people here. that is one reason why they want to change the end time to 2:00 or 2:15 in the afternoon. they have been at this for 13 1/2 hours and we could be at it for days and days here. i was told they ordered chinese food to bring in at the late hour. >> no doubt that democrats are not giving up and republicans are not giving in. can you talk more about the vote. they voted on two bills and now they are doing one at 1:00, and another at 3:00, what's the strategy behind that? >> the strategy is to get democrats off the floor. if they adjourn they can't be in the chamber and they may lock the doors and turn off the lights. that's an issue when you get in to these situations.

they will way we are have a right to be on the house floor. the reason the chamber was open, when you recess versus adjourn the house floor is open and sometimes people go and come. it is different when you adjourn. that could, i don't want to say cause a confrontation but if you are getting to the point where you might be kicking people out of the house chamber that will get some people pretty upset and embolden them more. we have been told by house republican leaders and the leadership team they don't want to stir the spot. they don't want to goad folks. that's where they think democrats get point and they don't want to give in to that on the republican side of the aisle. at the ebd end of the day, republicans are not willing to have a vote on guns. democrats are pushing the vote on guns and we're no closer than when we started this 13, 14 hours ago. >> what's the mood amongst democrats. >> they seem pretty optimistic.

they are cranky. they have pointed out they have tried different efforts to get votes on guns. they think they can turn it around on republicans in the fall in the elections and say you either voted for this or you didn't. it is an cup hill battle for republicans to lose control and the senate was in play and as you know there were four proposals, none which these test votes which you can seeded on monday night in the senate. democrats were watching closely. which senators from competitive swing states. kelly ayott, rob portman from ohio. marco rubio indicated that he is going to run for re-election and as a result we have congressman

here. what's the mood of republicans as we go to this vote series at this hour. >> frustration. comment was made that the republicans took control of the floor a few years back. we had people signed up to give five-minute speeches under the rule. the last day of the session before the artist recessed in 2008. speaker pelosi saw this she did a quick adjourn and we spoke during the month of august. we never broke a single rule. this is unprecedented. i have had democrats coming up to me on the floor going you guys need to stop this. this is scary. this is out of control. democrats saying that. >> let me play devil's advocate. we talked about this earlier

that house rule four is clear that you can't use the house floor for anything other than legislative business. i understand the circumstances on the first day of august 2008, but later in the month could you not argue that was not an abuse of house rules. >> no it was not because we were not in session. the house is commonly used for teaching and there are groups that come in the morning before we go this to session, some students and interns come in and they will have teaching sessions. there was no abuse. no rules broken by going on and speaking on the floor. most nights after we adjourned there will be somebody that takes the house floor and tells them about the house floor, speaks and answers any questions. it happens every day. we were adjourned when that was going on and we didn't violate any rules. >> if democrats continue this for a couple of days and say it

gets them to a similar state as the republicans use the floor and chamber even though you may disagree, would you be okay with them coming in and conducting these sessions even though you disagree with the approach on firearm and terrorism. >> if we are adjourned when they do that, then that's fine. they are also violating the rules. we didn't take cameras in or take pictures that violated the house rules. the sergeant at arms said you can not record or film this because we had people that would do that if we had been allowed but the rules didn't allow it so we didn't do that. they are filming, they are broadcasting. they are violating all kinds of rules which raises the issue of breaching their agreement. they are not supposed to broadcast anything from the house floor. i'd like to see their agreement. it maybe in jeopardy.

right now they are in the middle of one of those votes. the chief congressional correspondent for the washington examiner. thank you for joining us this hour. >> you are welcome. great to be on. >> i understand you were on the floor not long ago, is that right? >> i think many reporters are watching the action, which has been pretty amazing to see. democrats have basically taken over the house floor and shouting and chanting and singing while republicans have been trying to just move along legislative business. that's is what is happening now. they are trying to move a couple of votes while democrats are on the floor continuing their sit in and protest over the gun control legislation. what's the mood from democrats?

>> i think they really they feel like given the action of gun control and preventing terrorists from getting guns and the effort on the house floor motivated them to keep going. they are pretty lively on the house floor right now. they are not showing signs of tiring out or fatigue. democrats are being quite persist ten with this protest. although the democrats are not backing down on their position that they are not ready to negotiate with democrats on any kind of gun control legislation. they feel they have got a lot of

attention on social media and tv and media coverage and newspapers that they feel they have momentum for what they are doing. that's why you see the effort to adjourn early. they were supposed to be in until friday. i think they could like to conclude within the next few hour and take away the focus of what the democrats are doing right now on the floor. >> what's the feeling among republicans as you pass by them and hear them chatter? >> they are frustrated but also -- this is going to pass, the adjournment vote. i don't think that the democrats quite thought this was going to turn out the way it did today.

i think they were unsure what they were doing when they got on the floor. democrats told me that they weren't sure what the next steps would be. they were taking it an hour at a time. turned in to this and it surprised everybody on both sides of the aisle. republicans are trying to take a balanced approach and don't want to send in plain clothes police officers on the floor to remove the democrats. that's not something anyone wants to experience or see. suddenly the floor is taken over by democrats. the republicans need to do something to establish control. they are not sure what their best options are. the adjournment won't end the protest. because democrats can walk on

the floor anytime they want and talk and get media attention. although it might be difficult if the lights are out. they can keep going. it won't be legislative business spend pending. the day will be a recess day. it will be a different kind of protest once that happens. i think republicans are eager to get the work done and leave. this set a new precedent in terms of how the house operates. nothing like this happened before in a legislative day. to see this happen and that a republican majority really is stuck basically, has no idea how to regain control of the floor, is pretty unusual. >> they voted to adjourn. now what happens. where do they go from here? democrats say they are not going. what do we expect to see in the next couple of hours? >> what they will do now, they

are adjourn because they want to start a legislative day at 2:00 in the morning. it is a parliamentary move to allow them to pick up a bill earlier than they thought. they will come back in after 2:00 a.m. >> so everyone leaves. >> well, no. what will happen right now, the democrats will stay on the noor and keep doing what they are doing. the republicans will gavel out and they will gavel back in an hour and a half, or an hour, and they will take up funding legislation for the zika virus. it is a $1.1 billion piece of legislation. they are going to take that up. in the 2:00 hour. and debate it and vote on it and then after that, it will be the middle of the night, the house will adjourn and they will be done with it until july 5th, which is when the house is

scheduled to be back in session. that's the tentative plan. that's what they are talking about doing. they would adjourn permanently until july 5th beginning sometime in the middle of the night. not right now. but there will be an adjournment for a much longer period of time in a couple of hours or so. that's when, you know, you want to watch, what are the democrats going to do? now he house is out of session. i suspect they will stay here. it is possible, i was told by the senate majority leader they could stay beyond the house being in recess and keep going and going. they haven't made up their mind about what they are planning to do yet. they have made no decisions. democrats are not stepping down and republicans are standing

their ground, as well. this could be quite the battle. have you seen any of those protesters out in front of the capitol? >> there are protesters in front of the capitol. some are in the viewing galleries over chambers. one of the unusual aspects of this for anyone who's been watch ing is the cheering kp from the gallery which is usually prohibited but the house democrats are trying to encourage the participation of the people in the gallery. it is really unusual. you never see anything like this really. and that's what is happening right now. i think some of the people outside are coming in and filling the floor seating. >> some of the lawmakers are going outside and rallying the protesters, is that correct? >> that's right. they are going out and talking to the people who are on the

east front of the capitol. that's the side that faces the supreme court. several dozen people out there. it's not a massive crowd but it has gotten bigger as the day has gone on. and they have signs and are standing out front and the democratic leaders and other lawmakers going out and meeting with these protesters. you can hear them, too. when you are outside of the chamber and the door is open the outside, you can hear them yelling in to the second floor of the capitol. that's happened before but not often. it is unusual. i think they feel emboldened by the response they are getting from the public on this. that's why they are going and

they have goal is to push a vote on gun control. joining us now live from capitol hill is our senior capitol hill producer chad pergham. we are at 1:30. they just passed a vote. talk about that. >> this was a vote -- there's been a couple of votes, one to change what time they would meet tomorrow in the afternoon. the other vote would be to end today, today's legislative day and then start again here in the next hour or two again. they will have adjourned this particular legislative day. that deals wither that ability to call other pieces of legislation that deal with zika. none of these votes have anything to do with firearms or guns. democrats are expected for as long as they can, as long as they have the energy and will power to stay on the house floor

and call for a vote on firearms. it has become this electric issue here. i want to talk about our political vulnerabilities on the democratic side of the 50i8 and the republican side of the aisle. the republicans are continually pushing this narrative we need to crack down on terrorism and give the fbi tools to fight this. democrats see it through a different prism and they see opportunities. particularly in the senate, maybe in house races that if folks don't vote on firearms, particularly the so-called no fly, no buy provision if you are a perspective terrorist and they ground you, prevent you from flying you shouldn't be able to acquire a firearm we will turn that vote an or lack of a vote an and say, look, this is how you voted and they will run ads against you in your district. if it is a sbing district as the democrats try to regain control of the house of representatives this fall and in the senate where it is hard going in to

this autumn for republicans to keep the senate to challenge democrats the opportunities in illinois, ohio, wisconsin, new hampshire, florida. a couple of other states. they are ready to turn that around on republicans. so those are the vulnerabilities. they don't want to say we can lord it over your heads. they would rather get it done and not have a vote but they are willing to turn it around on their opponents this fall. >> chad, an 10:00 when they had their first late-night vote where they voted on two bills there, we saw the democrats get very heated when paul ryan came in. did we see the same thing around 1:15 when they did that vote. >> it wasn't quite as loud and people are a little tired.

it wasn't quite the same energy as at 10:00. i think that was also kind of like a pressure cooker, a pressure valve because they had been at this for ten-plus hours at that stage and waiting for this moment when the house of representatives would come in to session and they would wait for the speaker, probably a little happy it was paul ryan who was going to preside. he doesn't preside over every session and probably paul ryan made a point of making sure it was him to preside and the house was going to continue with business and he is the speaker of the house and he will be cool, calm and collected in that sense. it was a strange scene. very loud. paul ryan was ignoring the house democrats shouting him down and there was a lot of back and forth. during the roll call vote, democrats started singing request "we shall overcome." >> has to be strange to see and hear that. the next vote is coming at what time?

what happens next? >> the house will go out of session in the next hour or two and come back as though it is a brand new ledge ty day, even thee it is the middle of the night here. the next thing up has nothing to do with firearms but funding for zika. this is a whole other kettle of fish. you have a lot of democrats who are upset about this plan because they don't think it is sufficient funding. they don't like the fact this is not new emergency funding for the zika plan. the white house put out a statement this evening, kind of exscoruating the republicans how they are handling this. republicans want to finish it by the end of the week because the house is supposed to go away next week. the senate will be in session and if the house does one thing and the senate does not they are not aligned and can't handle the zika funding. >> we will follow it throughout the night. a quick break.
