security information. that was clear. she lied to us and we've known this all along and now the fbi director is just making it very clear. >> he made it very clear yesterday in his 15-minute presentation that she was there -- she and her assistants were very careless with our nation's secrets. there have been some who suggested, you know what, anybody else would lose their security clearance, which when you think about it, can you imagine having a president of the united states who lost their security clearance because they didn't know how to keep secrets? >> they wouldn't be able to look at the information and lead us in the right way because they wouldn't have access to the latest intelligence, and that's a huge problem, but if you look at comey's statement, he was very clear under normal circumstances there are administrative and security procedures that will come into play and those are penalties. >> sure, but when he said under normal -- >> that means security clearance. >> when he says under normal circumstances what that means,

saying hillary clinton got some welcome news. >> hillary clinton got some really bad news. essentially the director of the fbi laid out an attack ad that the republicans can use against her that she was careless in handling our nation's secrets and yet that's how the mainstream media spun it. >> yes. this is a perfect example of what we at the media research center call bias by omission. they don't necessarily lie, skew the facts but sometimes they leave the most important part of the story out. that's how they help their preferred candidate. like you said, the director of the fbi spent 14 minutes absolutely destroying hillary clinton's credibility but the media spent one -- they spent their focus on the one minute where she was exonerated and where they were not going to press charges. let's face facts, that's not even really a news story. i think we all knew deep down inside that even if hillary clinton had been caught on videotape delivering a folder full of top secret documents to the steps of the chinese embassy

that loretta lynch was never going to prosecute her. the fix was in. >> dan, let's take a listen to another example. this was on msnbc, a political editor for nbc. take a listen. >> sure. >> the notion that the system is rigged, really hard for anybody to agree to that after you see what james comey did and how nonpartisan he took this matter. >> what was your reaction? >> my reaction was that i'm not a lawyer. i'm not going to take issue with comey. that's for lawyers to do. what i am going to say though is that the media is rigged and the media rigging this story is really what makes the difference because they are come police sit. they took a story that should have been all about the fact that the presumptive democratic nominee has been caught in lie after lie. she did not -- she deleted e-mails from her server. she said she did not delete any e-mails from her server. she didn't have just one device, she had more than one device. these were all lies and they are

>> you compare this to trump university? >> hardly. the mayor just demonstrated that this gives the democrats the talking point they've been dieing for which is the fbi doing what they've known they were going to do all along which is to not recommend an indictment because as comey admitted is he knew he couldn't convince the attorney general to go through with a prosecutor. federal prosecutors don't like to go forward with a case they won't win. it's like the o.j. simpson trial. everybody knew he was guilty. everyone knows hillary is guilty, but the supporters wanted that verdict and they got it with james comey and the detractors obviously feel there was some sort of injustice. the burden now is on donald trump to make the case that jim comey made himself, that hillary is reckless, careless and lacks the discretion to protect the state's secrets by housing it on a server that had no protection. >> will it help or hurt the republicans? >> i think it helps the republicans?

attorney/client privilege with cheryl mills. the writing has been on the wall for months there was never going to be a prosecution. so you have to realize the law doesn't matter as much as the politics when it comes to the obama administration. >> so, you're saying there's prosecutorial misconduct with regards to the investigation in hillary clinton? is that what you're saying? someone committed a crime in the justice department? >> no. what i'm saying they would not allow the fbi to ask all of the questions they tried to ask during these interviews because of deals they cooked up with the clintons. and so there has been evidence coming out of this investigation that shows that the justice department has been biased, shocker. they've been biased in a lot of other areas except when it involves people like bob mcdonald, the governor of virginia who they brought a flimsy case against. so flimsy cases are brought against republicans and g cases against democrats are not brought. >> well, how about this, here is the case the federal government

brought against a naval reservist last year, guy by the name of brian nishamira. he was in afghanistan in 2007 through 2008 apparently had some stuff on one of his laptops like hillary clinton, the fbi investigation did not reveal evidence that he intended to distribute to unauthorized personnel and yet that man was sentenced to two years probation. he was fined $7,500 and ordered to surrender any currently held security clearance. jay christian, should hillary clinton have a security clearance given the fact that she's extremely careless with america's secrets? >> should she be the president that she's extremely careless? the democrats are saying things like nobody got this information. comey contradicted that. people who got the e-mails from hillary, third parties, were attacked by adversarial interest. the iranians, chinese, russians, probably all of them. and so to say that this naval

suggested there could be no prosecution reasonably brought by a prosecutor. i didn't buy it. it wasn't puersuasive to most. let's hope the justice department, you know, i guess we can hope against experience here brings a more politically neutral approach here. but on the other hand, mr. comey saw the writing on the wall. you could argue he saw the justice department was leaking there would be no indictment and the attorney general meeting with bill clinton last week and he was willing to put his job on the line by recommending a prosecution he knew would go nowhere with this compromise justice department. >> yeah. we just had lanny davis on for a lively chat. he said there was no evidence that she broke the law or any of that. do you agree? >> well, mr. comey said there's

evidence of potential violations of law repeatedly and then highlighted the destruction of records, the knowing, mishandling of classified information, some of which was marked and the potential leaking of that or breaching of that information by foreign powers, all of which would be sort of a nice gift for any prosecutor willing to do -- make the case. >> what does this say to america -- what does it say to the world where we are at this point? the judicial watch has been at the forefront of the truth seeking on these e-mails. >> well, you know, there are a lot of records out there that we still want to get, now, thanks to the fbi there are thousands of e-mails that may be available to the american people that previously hadn't been and they should be under the freedom of information act. we have a pending request with the federal court judge, peter, for mrs. clinton's testimony, her deposition testimony. we may ask another third court judge for additional testimony

from leaders on capitol hill. kristin fisher has the very latest. >> reporter: even though the director of the fbi james comey did not recommend any criminal charges, he did offer a blistering critique of how clinton handled classified information while she was secretary of state. first, comey said that clinton did send and receive classified information over her private server. some e-mails were marked classified at the time they were sent. that directly contradicts what clinton claimed from day one. there wasn't just one server, there was multiple servers. comey says it's totally possible they were hacked putting national security secrets at risk. several top republicans are saying they simply does not understand how they can come out and acknowledge all of this violation but not recommend any criminal charges. >> i'm confused by it. i did have the opportunity to speak with director comey just the last couple hours.

if you look at the fact pattern, did she or did she not have classified information in a nonsecure the answer is yes. that's a violation of the law. >> he says he believes the fbi's recommendation was politically motivated. house speaker paul ryan wouldn't go quite that far, at least publicly, but he is giving the oversight committee the green light to ask comey to come to capitol hill and testify and that could happen as early as tomorrow. there's a lot of moving parts and lot of unanswered questions, but house republicans are hoping to get some answers from comey under oath as soon as possible. >> thank you very much. so that's interesting, jason cha fes is demanding an emergency meet with james comey. that's big. >> and the house judiciary committee. they're moving forward on all fronts and you'll probably see

inconsistent, he contradicts himself at least three times. he never answers the key question is why didn't he indict her? which makes gross negligence a crime, i've counted so far already eight prosecutions under that statute. he is dead wrong there's no prosecutions for non-intent. i can remember i was in the justice department and some sad ones where guys just made a mistake. >> why didn't he do it? >> he is a straight shooter. and a decent man. >> you say you're disappointed. >> i've been disappointed with other honorable and decent people. >> where did he contradict himself? >> he contradicted himself by first saying any reasonable person would know you shouldn't set up a -- that's the beginning of conscious and guilty. >> no reasonable prosecutor would indict. >> totally insane. >> that's wrong. >> read the article today in

"the wall street journal," quite a reasonable prosecutor, federal judge, chief judge of the southern district of new york and attorney general of the united states, he would indict. i would indict. lot of people didn't think i was a reasonable prosecutor, i indicted the teamsters in 1998 when i knew it would cost the republican party their endorsement. and i recommended a special prosecutor for ed nearby, who was my boss and didn't want to do it because i knew he was innocent. you had to prove innocence and i couldn't do it in 90 days. >> before you were america's mayor, you were america's prosecutor and you were known as such. what is the cover up here? >> it's overwhelming. >> came up with thousands of e-mails that were not turned other. even this morning, we have lanny davis saying that 110 e-mails were not classified, even though the fbi director says they were.

what's going on? >> evidence of guilty knowledge, the evidence of intent, that's the way you prove intent in a criminal case. you don't prove intent by the person saying i'm going to cover up -- i'm going to just give out these e-mails or rob a bank or engage in insider trading. the way you prove it is obstruction of records, lives, all the false statements, "wall street journal" front page, three false statements. that would be part of the trial. >> even though they weren't sworn, correct? >> right. false statement. rules of evidence allows me to put any false statement in. if it's a false statement i can argue evidence of guilty knowledge. >> can i hand you your political hat. >> if i were donald trump and donald trump's campaign, i would advise him to stay away from jim comey. take the first part of the statement. how can we have a president that was in the words of jim comey

was extremely careless in the handling of thousands and thousands and thousands of some of our most sensitive documents? how can we have a president like that? first of all, none of her aides could pass an fbi background check at this point. >> she couldn't -- she couldn't pass an fbi background check. president doesn't need one. right? however, i must have read 2,000 fbi background checks, 3,000 for top secret clearance when i was associate attorney general. i don't remember anyone who had a record like this. how would you give top security clearance to someone who has been seriously negligent. >> she become an assistant u.s. attorney general based upon that? >> no. she would be turned on. she can't be trusted with top secret information.

she is too extremely careless which as you know equals gross negligence. >> same thing. you said that donald trump -- you gave him advice, stay away from james comey. last night, watch him take on the rest. >> well, here he is taking on hillary, hammering her. watch this. >> today is the best evidence ever that we've seen that our system absolutely, totally rigged. and we've got hillary clinton who is weak, who is ineffective, she'll never be able to do the job, her judgment is horrible, look at her judgment on e-mails. who would do it? this alone means that she should not be allowed to serve as president of the united states. >> well, that's the argument. that's the argument that should be hammered home, the false statements, all of the things that she did that indicate that in addition to the fact that she was highly unsuccessful as secretary of state in a substantive way, she

accomplished nothing. >> that's not what the president said yesterday. >> explain to me how the president of the united states knew -- >> because the fix was in. >> how do you explain that? >> what do you mean? >> i worked very closely with the reagan white house for two and a half years. there's no way you put that president together with hillary if you didn't know she was going to get cleared. >> someone have to call the president and say, oh, the coast is clear. you can get with hillary on the plane. >> there has to be pigeons, little message. >> because if she weren't cleared, he would never be on stage with her a few hours -- >> unless we have a white house that's totally incompetent. also explain to me how after saturday's interview, three days later you got the whole thing ready. i mean, that has to be a setup, too. i mean, i would take at least a week or two to analyze what the alleged defendant said before i would make a decision.

bin laden. tell us about these guys who we put into gitmo? >> now it's almost like the people they release now there's a higher rate of them going back to the battlefield. these are the worst of the worst. but the problem i saw when we wouldn't kill someone on the battlefield, arrest them, send them to the interrogators and go up the chain the cia or department of defense, they had to be so much proof on the battlefield, pictures what we found what we knew to certain kinds of intelligence. there's no mistaking sending a guy to guantanamo bay. they get there -- >> it's their job. >> how do they get out? uruguay is taking him and they release him after a while? >> there's not a lot of governments on our team with keeping them rolled up, locked up. there's a lot of sympathetic government. it's like a promotion. it's not hard to get to places

like yemen and syria. >> the obama administration says we're trying to close gitmo slowly. it's a rallying cry. how many people have you put in gitmo who said the reason i'm fighting jihad is because you have gitmo. >> the only people who still bring it up are us, people that want to close it. they're still off the battlefield. it's not like we're doing what we shoub should do, find them guilty and that's the only thing to do with these people or they'll try to martyr themselves any way. >> in the meantime, he is in south america and the olympics starts in a couple weeks. >> right. he said he was going to be on the border of uruguay and be near brazil where there are muslim communities and mosques. it's no coincidence that's where the olympics are. zika and now this. >> appreciate it.
