meeting. you have will recall this one. took place with bill clinton, days before the fbi's decision in his wife's email case. it was one on the tarmac of phoenix, arizona. jon: a lot of people have questions what went on in 30 minutes or so two of them were onboard the private government jet. both sides trying to score political points in this hearing. republicans as well as democrats. let's listen in for just a bit. >> apparently not in his mind. you accepted it. apparently not in your mind dizzydid not constitute gross negligence. i'm an attorney. practiced 16 years before coming here. i'm on this committee 20 years. not actively practicing law. been doing this a long time. i don't for the life of me knows what the difference between extreme carelessness and gross negligence is. he found one apparently not others. could you shed light for me and perhaps anybody else in this room, that may ultimately watch this? what is the difference between

the two? >> congressman, again i'm not going to further explain the director's comments as he has explained them. what i will say when have asked, and i believe i understand your question to be the meaning of grows negligence, one always as you know referred to the statute itself, relevant cases and then it is the very fact specific okay. >> we always start with the statute. history were relevant case law. >> also as senator berman mentioned i've got limited time so if you're not going to answer that question let me give you one final question. go back to this double standard i mentioned before. i couldn't help being reminded when this whole thing especially over the last week of something i was involved in and this very committee 18 years ago and at

the time it was hillary clinton's husband bill clinton who was in trouble. he was accused of sexually harassing a number of women and then lied under oath about it, committed perjury. he then asked if there was other women. he would say there was a civil lawsuit brought and often times when you have a lawsuit like that you go to other people. did you sexually , were you aggressive with people who were under your jurisdiction or that you had some power over, did you ever do that? he never did. then a young intern came forward that was working under him at the white house and she had physical proof, he denied it but there was physical proof, i will go into exactly what that was but there was proof about that he was pretty much caught up in this, he lied, committed perjury. that's why articles of impeachment were voted affirmatively out of this committee and then in the full house and then he went for trial in the senate, i know a lot about that because they pick 13 members to be the prosecutors of that case, house managers and i was on

under henry knight who of course is now gone. my principal focus at that trial was the topic of perjury, the elements of it. it's history, what you had to prove and in my argument with the senate my argument about that was we had hundreds of people over the country who were in jail behind bars for perjury. and the president of the united states should be above the law. the ultimate votewas 52 removing 50 to stay so he remained president . but i would conclude by saying that every american including the president of the united states, including a candidate for the highest office in our land want to be treated equally under the law and i think in this case it's a travesty because i don't think hillary clinton has been treated like any other american would have been treated under the same circumstances. high-yield back. >> congressman steve shadow of ohio making a statement to

the attorney general of the united states as he she answers questions from the house judiciary committee about her decision in hillary clinton email scandal and as you can see other issues are bubbling up as well. archie intelligence correspondent catherine herridge joins us live from capitol hill. >> we are about 80 minutes into the hearing now and what we are seeing develop is really a tale of two hearings, democrats firmly focused on the issue of gun violence and the assassination of five police officers in dallas left me while the republicans are focused on mrs. clinton and whether there has been an application of the law which creates a perception of a double standard, that there was one set of laws for the privileged and connected like mrs. clinton and another set of laws for the rank-and-file, in this case specifically members of the military. here's a senior democrat just a short time ago. >> today, apparently secretary hillary clinton's email takes precedence over

gun violence and civil rights. let us be clear: the criminal investigation is closed. there was no intentional wrongdoing . >> republican lawmakers have been asking the attorney general now on multiple occasions whether she can explain the difference between gross negligence which is the language used in the statute for the mishandling of classified information and what the fbi director describes as extreme carelessness. it's important to note that one of the federal statute which is essentially seeking classified information and storing it in an improper manner does not require any threshold for intent. here's a senior republican on the committee. >> this defies logic and the

law. contrary to director comey's assertion, the law does not require evidence that a person intended to harm the united states in order to be criminally liable for the mishandling of classified information. >> we tried to get a question to the attorney general on the way into the hearing. she did not take questions for a second time from reporters. what we after was essentially the question of mrs. clinton's declaration to the federal court court here in washington dc that she had handed over all her emails which we now know was not the case. she is now accused of doing the same thing before congress in terms of statements about her handling of classified information and her emails. i asked the attorney general whether the justice department would pursue charges, whether they would investigate and whether the rule of law still matters in this country. the attorney general did not answer those questions and went into the hearing room behind me, john.jon:

catherine herridge, keeping a ion that hearing for us, thank you. for more on the attorney general's testimony let's bring in a.b. stoddard, associate editor and columnist at real clear politics and charlie hurst, columnist at the washington times. charlie, what is the point of this hearing? >> i think obviously you have both parties trying their best toplay to their base but republicans feel like it's important to push , to ask all these questions and get to the bottom of how the investigation was carried out and how the decision was ultimately made.i think it's interesting this isn't particularly new about the idea that loretta lynch said she had decided weeks in advance that she was going to take the director comey a decision whatever it was. it's sort of a strange admission. i get where she's going with that, she's trying to say she was not affected by the meeting with , that very strange meeting with president clinton but at the same time it also suggests

she relinquished her responsibility. she relinquished her responsibility to pass judgment on the information given her but that aside, obviously democrats are working hard to sort of dismiss all that and say that none of it is important in trying to play up or talk about an issue they would rather talk about witches gun violence but not gun violence in terms of terrorism or anything like like that violence in terms of how do we do something to pass more gun laws which i don't think obviously the electorate has never been in much of a mood for their ideas about that. jon: a lot of people thought the issue was over after james comey is kind of strange testimony last week when you heard him talking. i certainly thought he was going to recommend charges against the former secretary of state, but then he said no prosecutor would ever prosecute so does this testimony, does this hearing say carry the ball further? >> no. loretta lynch has done the best she can today to deflect

and shut it down and say he took his recommendation and you heard the members try to pressure about why it's ultimately her responsibility and her job as attorney general to come up with the final finding on the recommendation from the fbi and she said she simply accepted it, there was no reason to move on. she repeated that several times .when asked about the statute because we expected the hearing would go on for hours talking about this idea of intent versus gross negligence, someone asked her about the statute does not have a threshold for intent and she said the statute speaks for itself though she was trying to keep it moving and didn't want to get into the weeds of why comey said there was no intent from hillary clinton and get into it back and forth like you saw last week where congressman trey gowdy said the server was her intent to hide plastic classified

information or handle it in a way that wasn't secure so i think we expected some fireworks today. she said the same thing about her visit with bill clinton, that she said in press conferences and an interview and basically did not want to talk about her job in being the final arbiter of a decision after comey delivered his findings. she said this is the end of the essentiallyand it's hard for the members to keep moving the debate in a conversation because she's doing a good job of shutting down . jon: seems like the law is pretty clear but clear as mud to some of these people. 80, charlie, stick around. we're going to get another couple interviews in and let's hear from you a little later down the road. heather: politics now, hillary clinton hitting the campaign trail despite the backlash from that email investigation. she kicked off an event a couple minutes ago in new hampshire and for the first time, bernie sanders is by

her side. jennifer griffin is life there, she's in portsmouth new hampshire at this hour where it is loud. jennifer, hello. the democrats show new hampshire for this historical backdrop, why? reporter: it's really interesting header. this is not how the revolution was supposed to end. we are waiting to hear from bernie sanders, this will be his first time appearing with hillary clinton. we expect him to endorse her today. back in 2008 when secretary clinton lost to president obama, they appeared for the first time in unity new hampshire. that may be too much to ask today from bernie supporters but they're going to give it a try. they have chosen this but as the heart of progressive democrats in new hampshire and it's a day so many have been waiting for and many thought it would never calm. it's been almost 5 weeks since hillary clinton became the presumptive nominee. bernie said he would campaign all the way through the convention. it looked like it might be a

contentious convention at one point. today that ends. bernie sanders will claim victory for his movement and endorsed hillary clinton in portsmouth new hampshire. what makes new hampshire so interesting is that has a large portion of independent voters, nearly 38 percent of the voters here are independent. there are more republicans than democrats but new hampshire voted for president obama in the past two elections. what's also interesting is clinton on new hampshire in the 2008 primary, she president obama here. sanders b clinton however by winning 61 percent of the vote. new hampshire is where his revolution was launched . this is sanders country and this is where his campaign will come to an end just a few minutes from now. we are hearing from senator james shaheen of new hampshire now, we expect to hear from bernie sanders next. back to you. heather: the question is can bernie sanders get his supporters on board?

jon: as bernie sanders gets ready to endorsed hillary clinton, her competitor donald trump is trying to drum up more campaign cash with a fundraiser in chicago as regulation heats up over who he may choose as a vice presidential running mate. senior national correspondent john roberts live now outside trump tower in chicago with that. reporter: morning, donald trump should be here in about an hour and 45 minutes, a contingent of chicago police

and a protest as expected although no one has materialized as yet to talk about donald trump in any kind of negative fashion. trump meantime expected later this week to announce who is running mate is going to be. six people on that shortlist, here's a look at who we believe it's narrowed down to three and either near or at the top of that list is indiana governor mike pence, appearing with donald trump tonight at a rally in westfield . first-term governor up for reelection this year so 12 years as a member of congress so he's got the government experience that trump is looking for. he was also a favorite of conservatives across the nation so that you get trump coverage on an issue that he still have problems with so we will find out before the end of the week who that's going to be. back to you. jon: more on that in just a moment. right now in this fox news alert we want to take you back to portsmouth new hampshire, bernie sanders appears to be throwing in the towel and throwing his support behind hillary

clinton. they are appearing together at this rally in portsmouth and we expect he will give mrs. clinton his endorsement. we understood that he was going to go all the way to the convention with his bernie movement but it appears that's not going to happen. a.b. stoddard from real clear politics back with us once again. 80, is this a site you thought you would be seen? >> no. i think it took a lot to get bernie to retreat and come in the fold before the convention. he promised it so many times to his supporters that they needed to take the fight all the way. this is going to be hard for them to take. you seem a polling that shows a lot of bernie supporters are not interested in hillary or trump. some of them will go to trump, some will go to hillary but she risks not being able to unite the party

and the really diehard bernie supporters say she will need in a race that could be one on the margin so this is a good day for hillary, extremely awkward but it will be helpful to her because without it she would be in considerable trouble. jon: charlie hurt his back with us from the washington times. does he risk looking like a hypocrite here? >> well, except that he's a politician and politicians do that stuff all the time but i think that 80 is right . in a lot of ways, the damage is already done. he has pushed her to the left on a lot of issues throughout the campaign which is ending in norma's success for him and for his supporters. whatever you think of them what socialism but that is a tremendous success for them. clinton is now married to that platform and those left leaning sentiments she expressed during the campaign but i think one of the big things that's going to come up and we saw this earlier on about the black lives matter issue is where she got in trouble. she got in trouble talking about black lives matter. that's going to be a bigissue

going forward . jon: here they come, the last two democratic competitors standing for the democratic nomination of 2016. bernie sanders, the socialist democrat senator from vermont and hillary clinton, former newyork senator, former secretary of state, former first lady. they are side-by-side behind that wall of iphones and elbows . he is about to endorse the former secretary of state against to be bitterly campaigned . has he done enough, 80? charlie mentioned the fact that he has pushed the democratic platform to the left. has he done enough in that regard that he can say look, we fought the good fight and i was successful and is going to be free college for all as a result of what i've done? >> i think he's going to be able to take some victory

laps with his supporters and say we pushed the platform further to the left but i don't think going to the left is really going to endanger hillary clinton in a race against donald trump. he can't she can't run to the center because he's going to run to the left of her on some issues. she needs bernie sanders to tell people how important it is to get behind her and to vote against donald trump, to get out of the house and vote for her and in in an affirmative way in the fall and help volunteer. if this is a endorsement and he expresses sour breaks and continues on on interviews and it's not enthusiastic, that will be a signal to his supporters that he doesn't really care and that's going to be the difference, how enthusiastic is it? how much is he campaigning in college tell her and pushing it all away because it's a race that can be won or lost in the margins and those young voters will help her or her her. jon: in the coalition she's trying to put together, largely revolves around the coalition that elected barack obama twice. can bernie sanders help bring

into the fold some of those people? >> if we've learned anything from this primary it's that the obama coalition has splintered. it does not transfer neatly from one candidate to another and what we are going to see from anyone going along with what age he was saying for bernie sanders is a very hotly negative campaign against donald trump and with the effort being, if they can't get bernie supporters to line up behind hillary, at least you can poison trump to the point they don't go to him. jon: they are in new hampshire, this is the neighboring state obviously for the vermont senator, a state that voted for him in the primary, let's listen in. >> ... senator charlene, thank you very much for your kind remarks and let me begin by thanking the 13 million americans who voted for me during the democratic primaries.

[applause] it is very easy to forget and republicans want us to forget where we were 7 and a half years ago when president obama came into office. as a result of the greed, recklessness and illegal behavior on wall street, our economy was in the worst economic downturn since the great depression. from 800,000 people a month were losing their jobs. we were running up a record-breaking deficit and the world's financial system was on the verge of collapse. we have, along way in the

[applause] i thank president obama and vice president biden for their leadership in pulling us out of that terrible recession. but i think we can all agree that much, much more needs to be done.too many americans are still being left out, left behind and ignored. in the richest country in the history of the world, there is too much poverty, there is too much despair.

their selection is about the single mother i saw in nevada who with tears in her eyes told me that she was cared to death of the future because she and her daughter were not making it on the $10.45 an hour she was earning. this election is about that woman and the millions of other workers in this country who are falling further and further behind. as they try to survive on totally inadequate wages. hillary clinton understands that we must fix an economy in america that is rated and that sends almost all of the new wealth and income to the top one percent.

hillary clinton understands that if someone in america works 40 hours a week, that person should not be living in poverty. she believes we all believe that we must raise the minimum wage to a living wage . further, she wants to create millions of new jobs by rebuilding our struggling infrastructure. our roads, our bridges, our water systems, our wastewater plants . but her opponent, donald trump, well, he has a very different view.he believes that states should have the

right to lower the minimum wage or even abolish the conceptof the minimum wage . if donald trump is elected, we will see no increase in the federal minimum wage of $7.25 an hour, a starvation wage. this election is about which candidate will nominate supreme court justices who are principled. who will nominate supreme court justices who are prepared to overturn the disastrous citizens united decision. a decision which is allowing

billionaires to buy elections and is undermining our democracy. this election is about who will appoint new justices on the supreme court who will defend a woman's right to choose. who will defend the rights of the lgbt community. [applause] who will defend workers rights, the needs of minorities and immigrants and the governments ability to protect our environment. if anyone out there thinks

that this election is not important, take a moment to think about the supreme court justices that donald trump will nominate and what that means to civil liberties, equal rights and the future of our country. this campaign is about moving the united states toward universal healthcare. and reducing the number of people in our country who are uninsured or underinsured. hillary clinton wants to see that all americans have the right to choose a public option in their help care exchange.

which will lower the cost of health care for millions area she also believes that anyone 55 years or older should be able to opt in to medicare. and she wants to see millions more americans gain access to primary health care, mental care, mental health counseling and low-cost prescription drugs . [applause] through a major and dramatic expansion of community health sectors throughout this country.

hillary is committed to seeing thousands of young doctors, nurses, psychologists, dentists and other medical professionals practice in underserved areas as we follow through. on president obama's idea of tripling funding for the national health service law. in new hampshire, in vermont and across this country we have a major epidemic of opiates and heroin addiction. people are dying every day from overdoses. hillary clinton understands that if we are serious about addressing this crisis, we need major changes in the way we deliver mental health treatment throughout this country. [applause] and that is what

expanding community health centers will do and that is what getting medical personnel into the areas we need them most will do. and what is donald trump's position on health care? no surprise there. same old same old republican contempt for working families. he wants to abolish the affordable care act, throw 20 million people off of the health insurance they currently have and cut medicaid for low income americans. the last thing we need today in america is a president who doesn't care about whether millions of americans will lose access to the healthcare

coverage they desperately need. we need more people with access to quality healthcare, not fewer. hillary clinton also understands that millions of our seniors, disabled veterans and others are struggling with the outrageously high costs of prescription drugs. she and i are in agreement that medicare must negotiate drug prices with the pharmaceuticalindustry . [applause] and that we must expand the use of generic medicine area drug companies should not be making billions in profits while one out of

five americans are unable to afford the medicine they need. the greed of the drug companies must end area this election is about the grotesque level of income and wealth equality that currently exists area the worst it has been in our country since 1928. hillary clinton knows that something is fundamentally wrong when the very rich become richer while many others are working longer hours for lower wages. she knows that it is absurd that middle-class americans are paying an effective tax rate higher than hedge fund millionaires.

and that there are corporations in this country that make billions of dollars a year in profits yet because of the loophole that their lobbyists created in a given year, they do not pay a nickel in federal taxes. that is wrong. while hillary clinton supports making our tax code error and more progressive, donald trump wants to give hundreds of billions of dollars in tax breaks to the very wealthiest people in this country. his reckless economic policies will not only exacerbate income and wealth inequality, they will increase our national debt by trillions of dollars. this election is about the thousands of young people i have met throughout this

country who have left college deeply in debt. the many others who cannot afford to go to college and the need in this country to have the best educated workforce in a highly competitive global economy. hillary clinton believes that we must substantially lower student debt and that we must make public colleges and universities tuition free for the middle class and working families of this country. this is a major initiative that will revolutionize higher education in this country and improve the lives

of so many of our people. think of what it will mean, think of it. when every child in this country regardless of the income of his or her family knows that if they study hard, if they take school seriously, yes, they will be able to get a college education and leave school without debt. [applause] this election is about climate change, the greatest environmental crisis facing our planet. and the need to leave this world in a way that is healthy and habitable for our children and future generations. hillary clinton is listening

to the scientists who tell us that if we do not act boldly in the very near future, there will be more drought, more floods, more acidification of the oceans, more rising sea levels. she understands that we must work with countries around the world in transforming our energy system away from fossil fuel and into energy efficiency and sustainable energy. [applause] and that when we do that, we can create a whole lot of good paying jobs. well, donald trump, like most republicans, sadly and

tragically is choosing to reject science. something no presidential candidate should ever do. he believes that climate change is a hoax. in fact, he wants to expand the use of fossil fuels. that would be a disaster for our country and for the entire planet. this election is about the leadership we need to pass comprehensive immigration reform and repair a broken terminal justice system. [applause] is about making sure that young people in this country are in good schools or in good jobs, not

in jail cells. [applause] secretary clinton understands that we do not need to have more people in jail than any other country on earth at an expense of $80 billion a year. [applause] in these stressful times for our country, this election must be about bringing our people together, not dividing us up. [applause] while donald trump is busy insulting mexicans and muslims and women and african-americans and our veterans, hillary clinton understands that our diverse city is one of our greatest

[applause] yes, we become stronger when black and white, latino, asian-american, native american, all of us stand together. yes, we become stronger when men and women, young and old, gay and straight, nativeborn and immigrants, fight to read this country of all forms of bigotry. that is what this campaign has been about. that is what democracy is about. but i and happy to tell you that at the democratic platform committee which ended sunday night in orlando, there was a significant coming together between the two campaigns and we produced ... [applause] just as bernie said, over the years i've gotten to know him as a colleague and a friend. his reputation for passionate advocacy hasn't always made him the most popular person in washington.but you know what? that generally is a sign you are doing something right. who care deeply about our country and our building of movement that is bigger than one candidate or one campaign. so thank you, thank you bernie, for your endorsement but more than that ... [applause] thank you for your lifetime of fighting injustice. i am proud to be fighting alongside you because my friends, this is a time for all of us to stand together. these have been difficult days for america. yes they do, and taking on the systemically racism that plagues our country and rebuilding the frayed bonds of trust and respect between law enforcement and the community they serve will

require contributions from all of us.and we have to begin by starting to listen to each other. and more than that, we then have to come together to do something that will help us fix these problems and heal these wounds. we have to reform our broken criminal justice system, take back our democracy from the wealthy special interests and make our economy work for everyone, not just those at the top. and you know what? we have to do all these things at the same time. that's why throughout this campaign we've been calling for eliminating racial profiling and sentencing, ending the area of mass incarceration, dismantling

the school to prison pipeline, providing more employment opportunities for formerly incarcerated people. in addition to that, i am proposing to new steps that will give law enforcement the support they need while also stopping the tragedy, the tragedy of black men and women and black children being killed in police incidents. [applause] first, first let's bring law enforcement and the communities they swear to protect and serve together. to develop national guidelines on the use of force by police officers.

and second, let's provide better training on implicit bias. that remains a problem even in our best police departments but it also remains a problem across society. and i'm asking for all of us to really search our hearts and minds to make sure we don't have those implicit biases. let's learn from police departments like dallas that have made some progress everyone in every community benefits when there is respect for the law and when everyone is respected by the law.
